The presented paper is a result of a comparative analysis of the legal foundations of the civil services or public services, which is more popular name in the narrowly understood Anglosphere countries – the CANZUK group. The comparative study deals not only with the provisions on the employment and the duties of the civil servants of the respective countries but also discusses the Westminster/Whitehall system, which was developed in United Kingdom, on the reformed systems of the former dominions. What is more, in the case of Australia – sometimes described as a place of birth of the Washminster system – remarks on the American influence were added. The article is one part of a cycle “Remarks on CANZUC”, devoted to the analysis of the law and politics of the narrowly understood Anglosphere.

BREXIT, the withdrawal of the United Kingdom from the EU structures has become a turning point in the process of formation of (as it seemed) permanent upranational blocs of economic cooperation. It was the first time that the European Union as a sui generis first in the world supranational organisation was so explicitly questioned as a value in itself. The redefinition of values that took place in the United Kingdom may be connected with a turn towards the part of the “Anglosphere” known as CANZUK. The research hypothesis for the studies announced in this article is that this ideological turnaround will lead to gradual regional integration. The article presents the theoretical and methodological framework for conducting the planned studies, outlines the currently available sources, and maps out the directions for detailed analyses within the singled out research areas. The planned research fits into the area of political and law studies. As regards the first field, analysed will be efforts aimed at consolidating cooperation, and in the future – postulated integration. The research will be carried out from the perspective of Karl Deutsch’s communication theory. The theory emphasises substantiveness of nation states and the need for social integration before political integration, which is also the fundamental assumption underlying the postulates of both the supporters of Brexit, as well as the persons and entities postulating the construction of the CANZUK bloc. With the use of this theoretical perspective it will be possible to complement the research with analyses in the area of contemporary political thought indicating the axiological foundations for the construction of a community in the Anglosphere. In the latter area, analysed will be certain acts of public international law, such as e.g. Trans-Tasman Travel Arrangement. That act may be treated as a model solution as regards constructing an alternative mechanism for the freedom of movement of persons.

The article aims to analyze changes in public (administrative) law, including the introduction of a new act of law (the so-called “Law 2.0”) on higher education and science in 2018 in Poland. Together with the accompanying introductory law and executive acts, Law 2.0 established not only a new legal regime, but also forced institutional changes, that will be analysed in the second part of this article. In addition to the analysis, the article is also presents author’s conclusions de lege lata and de lege ferenda. Artykuł ma na celu dokonanie analizy zmian prawa publicznego (administracyjnego) polegających na wprowadzeniu nowej ustawy (tzw. Ustawy 2.0) o szkolnictwie wyższym i nauce w 2018 roku w Polsce. Wraz z towarzyszącymi jej: ustawą wprowadzającą oraz aktami wykonawczymi, Ustawa 2.0 ustanowiła nie tylko nowy reżim prawny, ale też wymusiła zmiany instytucjonalne, które zostały poddane analizie w drugiej części niniejszego artykułu. Prócz analizy artykuł jest również prezentacją autorskich wniosków de lege lata oraz de lege ferenda.

The present paper explores how political thinking in Poland changed after the election campaigns (general and presidential) of 2015. Its main goal is to determine what the current developments mean for the future of democracy in Poland. Will Poland face a new wave of autocratization – similar to Pilsudski’s one? The paper is based on empirical research conducted during the last presidential and general elections in Poland. An e-survey covering 10,000 respondents was conducted, out of whom over 4,000 left their data for further analysis. The main aim of the study was to find a connection between patterns of political thinking and electoral behavior, demonstrating a link between one’s set of political values and one’s voting decisions. The ruling party in Poland openly refers to esthetics and rhetoric of an authoritarian regime introduced by Pilsudski. Its election slogan: “A good change” has been treated as reference to the interwar concept of “sanacja” driven from the Latin term “sanatio” which means to cleanse or to heal. The main goal of the Sanacja political group was to amend the then parliamentary democracy, which they believed was corrupt and inefficient. The authors of the paper try to present recent patterns and changes in the electorate. In its summary, the paper includes some predictions for the future of the Polish democracy, based on empirical data and observed actions of the ruling party.

One Belt, One Read project can be seen not only as a geopolitical plan for Chinese business expansion, but also as a way to project the Chinese soft power. The later is also a way to prepare foreign markets for the heavy Chinese presence in the near future. What is more the Chinese soft power, as prima facie nonideological one, can be more appealing for emerging markets, especially in African. In the same time the new race for the Africa has started and American as well as European soft powers will clash with Chinese. Near future will show which one performed better and prepared markets for business expansion. The article investigate problem of connection between OBOR and soft power. The main thesis of the article is that Chinese soft power is ideological one and connected with so called Chinese dream. The later is an alternative for the European and American dreams, which dominated the western hemisphere.

Demeny voting is one of less known ways to modify the classic approach to organizing democratic elections. This paper is an attempt at identifying a proper approach to studies on the possible impact of the demeny voting system on the Polish political system. Moreover, it is devoted to identifying other fields that require further research which should precede proper investigation of possible application of demeny voting in Poland. Secondary interest of the article is to pursue the connection between demeny voting and the ideal of deliberative democracy. The author refers to the results of the 2015 general elections and Polish demographic information published by the Central Statistical Office of Poland. The analysis of the data may serve as of a first step towards determining a hypothetical impact of demeny voting on the Polish political system

Lewica i prawica pozostają najpopularniejszymi określeniami wykorzystywanymi do opisu spektrum politycznego. Dzieje się tak, mimo że wartość analityczna tego typu określeń jest znikoma. To zaś ze względu na brak jednolitego sposobu rozumienia określeń. Niska użyteczność analityczna nie oznacza jednak niskiej użyteczności w bieżącej walce politycznej. W tekście przedstawiona została alternatywna (zobiektywizowana) forma porządkowania spektrum politycznego oraz możliwe warianty budowania narracji wokół osi lewica-prawica. Tekst przeznaczony jest przede wszystkim dla studentów. Jest wprowadzeniem do teorii i modelowania spektrum politycznego. Ma walor metodyczny oraz propedeutyczny. Obrazuje różnice pomiędzy myśleniem doktrynalnym a teorią naukową.

El objeto de la obra es presentar la estructura institucional y legal de los poderes legislativo y ejecutivo de los Estados Confederados de América. Como solamente estos poderes se desarrollaron plenamente durante la guerra secesionista, el autor se concentra en la parte del sistema politico de la Confederación referente a ellos. La obra tiene la intención de verificar la tesis que dice que los poderes ejecutivo y legislativo de los Estados Confederados de América eran capaces de dirigir su país. En cambio, el autor no responde a la pregunta de si la Confederación era un país independiente, y no entra en controversias sobre la existencia de la nacionalidad de los americanos del sur. El capítulo I es un fondo histórico referente a la tendencia secesionista presente en el sur de los Estados Confederados. Se encuentran aquí las descripciones de los acuerdos y de los fallos del Tribunal Supremo mas importantes para el concepto constitucional. Los capítulos II I III se dedican al poder legislativo y ejecutivo, respectivamente. Se encuentran aquí las informaciones sobre el funcionamiento bajo el régimen de la Constitución Provisional y de la Constitución de 1861. Las informaciones referentes al poder ejecutivo, podemos leerlas en dos capítulos, así como las que tratan de los departamentos del Gabinete de Estados Confederados de América aparecen en el capítulo IV. En la elaboración, el autor presenta la estructura y la manera de funcionar de las dos ramas del poder, y a la vez, sus mutuas relaciones. Con el objetivo de describir, el autor utiliza ante todo análisis del sistema institucional y legal, apoyados por un análisis comparatista, con el fin de confrontar las resoluciones de la Confederación y de la Unión. La disposición de los poderes legislativo y ejecutivo de encargarse de los asuntos del funcionamiento de un país independiente es la conclusión mas importante de la composición. Una gran influencia de la situación tan variable en el frente y la actitud de las potencias europeas de entonces forman otra conclusión importante. Como anexos se adjuntan: la Constitución de Estados Confederados de América (artículos 1 y 2) junto con un comentario, informaciones de la persona del presidente Jefferson Davis y del vicepresidente Alexander Stephens (referentes a su carrera en el periodo anterior a la secesión). Das Ziel der Arbeit ist die Vorstellung der rechtsinstitutionellen Struktur der Exekutive und der Legislative in den Vereinigten Staaten. Der Autor konzentriert sich nur auf den Teil des politischen System der Konföderation, die die Legislative und die Exekutive betrifft, weil nur sie sich vollauf während des Sezessionskriegs entwikkelten. Die Arbeit darf eine These verifizieren, deren Kern die Bestimmung ist, dass die Legislative und die Exekutive der Konföderierten Staaten von Amerika im Stand waren, über ein Land herrschen. In der Arbeit wird aber nicht die Frage beantwortet, ob die Konföderation einen souveränen Staat war und die Arbeit setzt sich nicht mit der These, dass es die Nationalität der Amerikana vom Süden existierte, auseinander. Das erste Kapitel ist ein historischer Hintergrund, der die Entstehung der sezessionistischen Tendenz im Süden der Vereinigten Staaten betrifft. Hier befinden sich die Beschreibungen der weiteren Kompromisse und der wichtigsten verfassungsrechtlichen Meinungen der höchstrichterlichen Entscheidungen. Das zweite und dritte Kapitel werden der Legislative und der Exekutive gewidmet. Die Beschreibungen enthalten die Informationen sowohl über das Funktionieren unter der Regierung von der Provisorischer Verfassung als auch über Verfassung vom 1861 Jahr. Die Informationen über die Exekutive werden in zwei Kapitel geteilt. Im vierten Kapitel befinden sich die Informationen, die einzelne Ministeriums des Kabinetts der Konföderierten Staaten von Amerika betreffen. Im Gange der Arbeit wurde eine Struktur, eine Weise des Funktionierens der beiden Zweigen der Macht und ihre Wechselbeziehungen vorgestellt. Der Autor bediente der Systemanalyse, rechtsinstitutionelle Analyse und behilflich die komparatistische Analyse, um die Lösungen der Konföderation und der Union zusammenzusetzen. Die wichtigsten Schlussfolgerungen, die aus der Arbeit hervorgehen, sind die Bereitschaft der Legislative und der Exekutive, sich an die mit dem Funktionieren des souveränen Staaten Aufgaben heranzuwagen. Die wichtige Schlussfolgerung ist auch das, dass starker Einfluss auf die Weise des Funktionierens der Legislative und der Exekutive der Konföderation die Wechselsituation an der Front hatte. Als die Anhänge wurden beigelegt: Verfassung der Konföderierten Staaten von Amerika (Artikel 1. und Artikel 2.) mit dem Kommentar, Informationen über Präsident Jefferson Davis und Vizepräsident Alexander Stephens, die Ihre Kariere vor Sezession betreffen . The purpose of hereby paper is to describe institutional and legal structure of the legislative and executive branch in the Confederate States of America. The author focuses only on this part of Confederate political system which relates to legislative and executive, because only those were fully developed in the Civil War conditions. Work in its intention should verify the thesis that the legislative and executive branches of the Confederate States of America were able to fulfill the duty of governing an independent country. But, it does not answer the question about the independent character of the Confederacy and does not step into controversy about the existence of the southern nation. The first chapter is mentioned to be broad historic background of the southern states secessionist movement including the consecutive compromises and main Supreme Court verdicts. The second and third ale fully devoted to the legislative and executive branch respectively. The descriptions enclose information both on powers under the Provisional Constitution and the Constitution of 1861. The information on the executive branch is divided into two chapters of which the second describes the Cabinet of the Confederate States of America. The work describes the structure and the way of fulfilling duties by both branches, their checks and balances. For the purpose of hereby work the author used mainly the systems institutional and legal analysis – but to compare the Union and Confederate solutions – the cooperative one. The most important conclusion of hereby work is that the legislative and executive of the Confederate States of America were able to fulfill its duties in the independent country. Essential is also the conclusion that the current situation on battlefield and the attitude of contemporary European Powers had great impact on it. The annex contains: The Constitution of Confederate States of America (articles I and II) with a comment to essential sections, the information on Jefferson Davis and Alexander Stephens (about their carrier before secession).
