Opis:
General jurisprudence is a type of thinking about law and the social bond developed by British critical legal scholars. Returning to the classical concerns of (legal) philosophy, it examines the legal aspects of social reproduction both inside and outside state law, treating posited law as a part of wider legality. It brings back to the centre the aesthetic, ethical and material aspects of legality, as well as includes the political economy of law, the legal constructions of subjectivity and the ways in which gender, race or sexuality create forms of identity both disciplining bodies and offering sites of resistance. The British Critical Legal Conference (CLC) is a school of thought committed to a plurality of theoretical approaches to law and to radical politics. The first CLC took place in 1985 and has taken place annually without interruption since. The CLC has introduced a number of themes, approaches and strategies unknown or dismissed by mainstream scholarship, including semiotics, rhetoric, literature, aesthetics and psychoanalysis. A variety of critical schools, such as postmodernism, phenomenology, postcolonialism, critical race, feminism, queer theory, art theory and history, the ethics of otherness, the ontology of plural singularity, the critique of biopolitics and post–politics have been pioneered in the CLC.

Critical legal theory emerged in the United States in the 1970s, at a time when Central and Eastern Europe belonged to the Soviet bloc and was subject to the system of actually existing socialism. Therefore, the arrival of critical jurisprudence into the region was delayed. In Poland, the first texts on critical and postmodern legal theory began to appear at the end of the 1990s and the beginning of the 2000s. Lech Morawski’s monograph, characteristically entitled What Legal Scholarship Has to Gain from Postmodernism?, published in 2001, officially inaugurated a broader interest in postmodern legal theory. Adam Sulikowski has been the main representative of critical legal theory in Poland, developing a postmodern theory of constitutionalism. Other sub-fields of postmodern and critical legal theory, gradually developing in Central European jurisprudence, include such areas as law and literature, law and ideology, law and neocolonial theory, as well as feminist jurisprudence. There is a noticeably growing influence of critical sociology and critical discourse analysis which seem to be a promising paradigm for invigorating critical legal theory from an empirical perspective. The concept of “the political”, in the sense used by Chantal Mouffe, has been evoked to propose a “political theory of law” conceived as an analysis of the juridical phenomenon through the lens of the political. Recently, it has found its concrete applications in the political theory of judicial decision-making.

The aim of the present paper is to contribute to the on-going discussion, both in legal theory and in comparative law, concerning the status of Central Europe and its delimitation from other legal regions in Europe, notably Romano-Germanic Western Europe but also Eastern Europe and Eurasia. The paper adopts the methodological perspective of critical legal geography, understood as a strand of critical jurisprudence laying at the interstices of spatial justice studies, critical geography, comparative law, sociology of law and legal history. The paper proceeds by identifying the notion of Central Europe with reference to a specific list of countries, then proposes a number of objective criteria for delimitng Central Europe and applies them in order to highlight the difference between Central Europe and other adjacent legal regions. Following that, the paper enquires as to whether Central Europe should be deemed to be a ‘legal family’, a ‘legal union’ or simply a ‘legal space’ or ‘space of legal culture’.

Contrary to traditional accounts, which treat adjudication as the application of legal norms to the facts of a case, without any creative activity, the present paper assumes, following crtitical legal theory, that adjudication as a social practice belongs to the sphere of the political and involves judicial decision-making. The concept of the political is understood, following Chantal Mouffe, as the dimension of unalienable and inherent antagonism underlying any society. Any judicial decision, and especially one taken in a case where the court enjoyed a broad scope of discretion, influences a given social antagonism. However, as a prerequisite of a critical analysis of case-law it is necessary to identify the social antagonisms in question. To this end, the paper first analyses the very concept of an antagonism, highlighting its collective character, and then makes a tentative application of the concept to the European Court of Justice, attempting to identify the main types of social antagonisms which are subject to the Court’s jurisdiction.
Wbrew tradycyjnym narracjom, wedle których orzekanie polega na stosowaniu norm prawnych do stanu faktycznego danej sprawy i nie obejmuje żadnej działalności twórczej, w niniejszym artykule wychodzi się od założenia, właściwego krytycznej teorii prawa, iż orzekanie jest praktyką społeczną należącą do sfery polityczności i zakłada podejmowanie przez sędziów decyzji. Pojęcie polityczności rozumiane jest tu – za Chantal Mouffe – jako wymiar nieusuwalnego i nieodłącznego antagonizmu, jaki leży u podstaw każdego społeczeństwa. Każde orzeczenie, a w szczególności takie, przy którego wydaniu sąd korzystał z szerokiego zakresu władzy dyskrecjonalnej, wywiera wpływ na określony antagonizm społeczny. W celu prowadzenia krytycznych badań nad orzecznictwem konieczne jest ustalenie, jaki antagonizm społeczny był w danym orzeczeniu istotny. W tym celu artykuł najpierw analizuje samo pojęcie antagonizmu, kładąc nacisk na jego zbiorowych charakter, a następnie podejmuje próbę zastosowania tego pojęcia do Europejskiego Trybunału Sprawiedliwości w celu zidentyfikowania głównych typów antagonizmów społecznych, które podlegają jurysdykcji Trybunału.

AbstractThe distinction between form and substance (content), which is derived from philosophy, plays a significant role in contemporary scientific legal discourse. Therefore, it seems important to confront the phenomena of legal continuity with the various understandings of the form vs. substance distinction, found in scientific legal discourse. The analysis is justified by the fact that in scientific legal discourse the indication that a certain form of reasoning is ‘formalist’ or that a certain phenomenon is ‘simply formal’ but not ‘substantive’ has a strong evaluative aspect. In his earlier works the author of the article has proposed, by referring inter alia to the works of K. Renner and h. Collins, to use the concept of ‘legal survivals’ in order to conceptualise the phenomenon of legal continuity ocurring in the case of continued existence of concrete and determined legal institutions, despite a change of the political and economic system, accompanied often by the change of socio-economic function of those surviving legal institutions. This allows to formulate a research question as to whether legal survivals are of a ‘formal’ or ‘substantive’ nature. Referring to four distinct ways of understanding the form vs. substance dichotomy in contempoary scientific legal discourse, the present paper replies to the research question by indicating in which sense of the distinction can legal continuity be described as ‘formal’, and in which as ‘substantive’.
StreszczenieRozróżnienie na formę i materię (treść, substancję), wywodzące się z filozofii, odgrywa znaczącą rolę we współczesnym naukowym dyskursie prawniczym. Z tego względu istotne wydaje się skonfrontowanie zjawiska ciągłości prawnej z zastanymi w naukowym dyskursie prawniczym rozumieniami rozróżnienia na formę i materię. Celowość podjętej analizy uzasadniona jest faktem, że w naukowym dyskursie prawniczym wskazanie, że pewien sposób rozumowania ma charakter „formalistyczny”, lub też że dane zjawisko jest „czysto formalne”, lecz nie „materialne” ma silny charakter ocenny. We wcześniejszych pracach autor zaproponował, w nawiązaniu do prac m.in. K. Rennera i h. Collinsa, posługiwanie się koncepcją „reliktów prawnych” (legal survivals) w celu konceptualizacji zjawiska ciągłości prawnej poprzez odwołanie się do trwania, pomimo transformacji ustrojowej, konkretnych i określonych instytucji prawnych, które w nowych warunkach częstokroć zmieniają swoją funkcję społeczno-gospodarczą. Daje to asumpt do sformułowania pytania badawczego, czy relikty prawne mają charakter „formalny” czy „materialny”. Odwołując się do czterech różnych sposobów rozumienia dychotomii forma/materia we współczesnym naukowym dyskursie prawniczym, praca odpowiada na tak postawione pytanie badawcze, wskazując, w jakim znaczeniu ciągłość prawna może zostać określona jako „formalna”, a w jakim – jako „materialna”.

The aim of the present article is to reflect upon the ontological presuppositions of critical jurisprudence (critical legal science), understood as a set of assumptions in the domain of social ontology, which determine the identity of this form of general reflection upon law. The article proposes to identify four such assumptions: the assumption concerning the political character of the social world; the assumption on the social construction of the social world; the assumption of paninterpretationism; the assumption of the existence of epistemic communities.

The present methodological paper aims at answering the question whether the notionof ideological interpellation, put forward by L. Althusser, in the form given to it by S. Žižek, can be operationalised in order to be deployed as a tool for the critical reading of legal texts. The paper gives a positive answer to the question, indicating that the application of the said method may contribute to the opening of legal discourse towards the impact of critical theory. The paper consists of three parts. The first part presents Žižek’s theory of ideology, the second part discusses the notion of ideological interpellation, and the third part is devoted to a preliminary attempt at operationalising the said notion.

The scholarly analysis and critique of law always take place under circumstances of scarcity of academic resources. At any given moment, the number of academic jurists mastering a given legal system and being capable of analysing and critiquing it at a professional scientific level is limited. The pandemic of COVID-19 only exacerbated this phenomenon, exposing the importance of making methodological and paradigmatic choices. What critical legal theory teaches us is that the choice of method and approach to the analysis and critique of legal materials is not politically neutral. Asking about the political goals and choices behind solutions adopted by legislators, ministers, civil servants, law enforcement officers, and judges, and about the actual interests impacted by their decisions is much more important and topical in these difficult times. A sociologically oriented critical legal theory can provide the necessary tools for such an analysis of the corpus iuris pandemici.
Akademicka analiza i krytyka prawa zawsze odbywa się w warunkach niedostatku zasobów. W danym momencie liczba prawników-akademików, którzy znają dany system prawny i są w stanie go analizować i poddawać krytyce na profesjonalnym poziomie naukowym jest ograniczona. Pandemia COVID-19 jedynie pogłębiła to zjawisko, uwypuklając znaczenie dokonywanych wyborów dotyczących metody i paradygmatu badań. Krytyczna teoria prawa wskazuje, że wybór metody i podejścia do analizy i krytyki materiałów prawnych nie jest neutralny politycznie. Pytanie o polityczne cele i wybory stojące za rozwiązaniami przyjmowanymi przez ustawodawców, ministrów, urzędników państwowych, funkcjonariuszy organów ścigania i sędziów, a także o rzeczywiste interesy, na które wpływają ich decyzje, jest niezwykle aktualne w tych trudnych czasach. Socjologicznie zorientowana krytyczna teoria prawa może dostarczyć niezbędnych do tego narzędzi do prowadzenia tego rodzaju badań nad corpus iuris pandemici.

Wzrastające zainteresowanie związków zjawisk prawnych z politycznością uzasadnia podjęcie problemu polityczności nauki prawa. Artykuł podejmuje problem związków z politycznością dwóch subdyscyplin prawniczych – analitycznej teorii prawa oraz dogmatyki prawniczej, prowadząc rozważania z perspektywy jurysprudencji krytycznej, będącej prawniczą aplikacją teorii krytycznej. W tym celu najpierw definiuje pojęcie polityczności, rozumianej w duchu Mouffe jako wymiar antagonizmu leżący u podstaw każdego społeczeństwa. Tak rozumianą polityczność (the political) należy odróżnić od polityki (politics) oraz poszczególnych polityk (policies). Co się tyczy analitycznej teorii prawa, artykuł stawia tezę, iż jest ona programowo (choć milcząco) polityczna, a jej nastawienie badawcze sprowadza się do blankietowej afirmacji formy prawnej, przy uchyleniu się do ustosunkowania się konkretnego do jego treści. Z kolei co się tyczy dogmatyki prawniczej, nawiązując do Sawy Frydmana artykuł stawia tezę, iż dogmatyk, pomimo deklarowanej apolityczności, w rzeczywistości dokonując doktrynalnej wykładni prawa podejmuje kolejne decyzje, które są nie tylko decyzjami interpretacyjnymi, ale też politycznymi, bowiem wyznaczają kolejne etapy w antagonistycznych zmaganiach w społeczeństwie.
The growing interest in the connections between legal phenomena and the political (das Politische, le politique) justifies an analysis of the problem of the relationship of legal sciences towards the political. The article focuses on two juridical sub-disciplines: analytical legal theory and legal dogmatics, and the analysis is conducted from the perspective of critical jurisprudence, a juristic application of critical theory. Towards this end, first the concept of ‘the political’ is defined, along the lines of Chantal Mouffe, as a dimension of antagonism, which lies at the foundation of any society. The political, understood in this way, must be differentiated both from ‘politics’ and from ‘policies’. As far as analytical legal theory is concerned, the article claims that it is programmatically (yet tacitly) political, as it affirms the juridical form as such, abstracting from its concrete content. As far as legal dogmatics is concerned, the article claims, following Sawa Frydman, that the dogmatician, despite his declared apoliticality, when performing a doctrinal interpretation of law, makes in fact decisions which are not only interpretive, but also political ones, setting subsequent stages in the antagonistic struggles within society.

The present paper is a reaction to Maciej Pichlak’s article "Law in the Snares of the Political: Addressing Rafał Mańko’s Critical Philosophy of Adjudication" which was published in this journal (“The Critique of Law” 2020, 12(3), pp. 109–125). The present response addresses selected issues raised in Pichlak’s critique, focusing on three aspects: law and the political, the importance of justice in the critical project, and finally the question of adjudication and ideology. On a more general note, the polemic reveals the importance of philosophical, political and ideological commitments and presuppositions of legal theorists and poses the question of the limits of the autonomy of jurisprudential debates vis-à-vis such commitments.

The purpose of this article is to analyse the relationship between adjudication and the concept of the political. By referring to the understanding of the concept of the political developed inter alia by Carl Schmitt and Chantal Mouffe, the article posits that not all judicial decisions (individual instances of adjudication) should be treated as belonging to the sphere of the political, but only those which fulfil jointly two premises: firstly, they are true decisions, involving at least some degree of discretionality (in the sphere of facts, or in the sphere of law, or in the sphere of the legal classification of facts), and secondly, involving a conflict which is structural for the community or society within which this adjudication is performed. Political adjudication should not be perceived as per se wrong, nonetheless it should be subject to a democratic scrutiny and sustained critique to with greater attention than apolitical adjudication, which merely involves the mechanical application of unambiguous legal rules to undisputed facts.
