     In the article some applications of the concept of legal narrative are undertaken in the perspective of Bernard Jackson’s legal semiotics. The analysis are developed in the perspective of Polish social and economical changes of recent decades. The leitmotif is constituted by remarks on sociolinguistic aspects of teaching legal narratives in changing reality. In this context a notion of “legal grapholect” is introduced to discuss possible influence of “deep layer” of legal language on evolving Polish lawyers’ language and vernacular. Additionally, issues of semiotic group of lawyers and legal register are discussed on the basis of the sociolinguistic paradigm. Reasoning is enriched by remarks of possible merger of Jackson’s legal semiotics and Ch. Perelman’s theory of legal argumentation.

    The study on the smell preference to for six beer brands in invasive slug Arion vulgaris was carried out under field and laboratory conditions. The effect of beer smell on CO2 emission was also estimated. Additionally, chromatographic determination (GC-MS) of volatile fraction of the tested beer brands was carried out. Chemical compounds responsible for the attractiveness of beer brands for the slugs were determined using statistical methods. The correlation analysis between the results of performed tests was made. It was shown that components of beer volatile fraction, such as: t-muurolol, aristolene epoxide, decanoic acid, 9Z,12Z)-9,12-octadecadienoic acid 2-acetyloxy-1-(acetyloxymethyl)ethyl ester, t-cadinol and oleic acid have a positive effect, and γ-elemene and bicyclo[4,1,0]heptane,3,7,7 trimethyl have a negative effect on the attractiveness of beer smell for slugs. Respirometry tests showed an increase in CO2 emission in slugs exposed to the smell of beer, however, it appeared impossible to indicate unambiguously which chemical compound could be responsible for the observed change in their physiological parameters. The increase in CO2 emission by slugs A. vulgaris exposed to the smell of beer did not correlate with the results of their smell preference in the field and laboratory tests. On the other hand, only the results of the laboratory tests performed on 6 individuals well correlated with the results obtained during the preference field tests, which indicate, that estimation the slugs’ preference may be limited to the laboratory tests.
    Badanie preferencji zapachu sześciu marek piwa przez dorosłe osobniki inwazyjnego ślimaka Arion vulgaris przeprowadzono w warunkach polowych i laboratoryjnych. Oszacowano również wpływ frakcji lotnej badanych piw na emisję CO2 przez ślimaki, jak również, wykorzystując metody chromatograficzne (GC-MS), oznaczono skład tej frakcji. Wpływ konkretnych substancji chemicznych na atrakcyjność zapachu marek piwa dla A. vulgaris określono przy użyciu metod statystycznych. Przeprowadzono również analizę korelacji pomiędzy poszczególnymi typami testów. Uzyskane wyniki wskazują, że takie składniki lotnej frakcji piwa, jak: t-muurolol, epoksyd aristolenu, kwas dekanowy, ester 2-acetyloksy-1-(acetyloksymetylowy) kwasu (9Z, 12Z)-oktadekano-9,12-dienowego, t-cadinol i kwas oleinowy mają pozytywny, a elemen i 3,7,7-trimetylocyklo[4,1,0]heptan negatywny wpływ na atrakcyjność zapachu badanych piw dla A. lusitanicus. Testy respirometryczne wykazały wzrost emisji CO2 przez ślimaki eksponowane na zapach piw. Nie udało się jednakże jednoznacznie wskazać, który ze składników frakcji lotnej napojów był odpowiedzialny za to zjawisko. Wzrost emisja CO2 przez osobniki A. vulgaris eksponowane na zapach piwa nie korelował z wynikami preferencji konkretnych marek piwa w terenie oraz w badaniach laboratoryjnych. Wyniki wykonanych na grupach złożonych z 6 osobników testów preferencji zapachu przeprowadzonych w laboratorium dobrze korelowały z wynikami preferencji w warunkach terenowych, co może wskazywać, że oceniając preferencje węchowe ślimaków można ograniczyć się wyłącznie do testów laboratoryjnych.

    The article investigates the multidimensional phenomenon of legal ethics, whose complexity justifies looking for adequate tools for its systematization in philosophy. An attempt is made to characterize a number of aspects of legal ethics in the perspective of Paul Ricoeur’s “little ethics” (French: la petite éthique). The concept makes it possible to order the reflection on the phenomenon of ethics in, among others, the teleological and deontological dimensions, as well as in the intrapersonal (i.e. within a person), interpersonal, and institutional (corporate) dimensions. The article also refers to the question of the textual dimension of legal ethics, including the co-conditioning of the substance of the codes of ethics and the personal “text of action” of a barrister, legal advisor, etc. This provides context for discussing the question of the dialectic of the prescriptive and descriptive aspects of codes of ethics on the basis of Ricoeur’s narratological considerations against a broader background of the dispute between cognitivism and noncognitivism.
    Przedmiotem analizy podjętej w artykule jest wielowymiarowość zjawiska etyki prawniczej. Stopień złożoności powyższego fenomenu powoduje, iż uzasadnione staje się poszukiwanie adekwatnych narzędzi filozoficznych, umożliwiających jego systematyzację. W tekście próba charakterystyki szeregu aspektów etyki prawniczej podjęta jest w perspektywie „małej etyki” (oryg. la petite éthique) Paula Ricoeura. Koncepcja Ricoeura pozwala uporządkować refleksję nad zjawiskiem etyki prawniczej, inter alia w wymiarze teleologicznym i deontologicznym oraz w wymiarze intrapersonalnym (wewnątrzosobowym), interpersonalnym oraz instytucjonalnym (korporacyjnym). W artykule podnosi się także kwestię wymiaru tekstualnego etyki prawniczej, w tym współwarunkowania treści kodyfikacji etycznej i osobistego „tekstu działania” adwokata, radcy, etc. W tym kontekście na gruncie rozważań narratologicznych Ricouera dyskutowana jest kwestia dialektyki aspektu preskryptywnego i deskryptywnego kodyfikacji etycznej, na szerszym tle sporu kognitywizmu z nonkognitywizmem.

    Teza artykułu jest związana z twierdzeniem, że kazuistyczny, quasi-prawny model etyki prawniczej powinien zostać porzucony. Tym zaś, co należałoby rozwinąć, jest indywidualna i kolektywna, zwana także korporacyjną, świadomość specyfiki doznania prawnego i wartości istotnych z perspektywy etyczno-zawodowej, oparta na solidnych podstawach metodologicznych. Przedstawiona w artykule koncepcja etyki prawniczej rezygnuje z prób jej opisu z perspektywy wymuszonej kategoriami związanymi z pozytywizmem prawniczym. Ta sugestia odnosi się do: 1) fenomenologicznego „myślenia według wartości etyczno-zawodowych”, 2) pojęcia intuicji etyczno-zawodowej oraz 3) koncepcji pól świadomości aksjologicznej prawnika i korporacji prawniczej. Dwudziestowieczna filozofia fenomenologiczna, a także związana z nią ściśle nieformalna etyka wartości przedstawiona głównie przez M. Schelera i N. Hartmanna, stanowi podstawę proponowanej koncepcji etyczno-zawodowej. Etyka fenomenologiczna, polegająca na indywidualnym doświadczaniu wartości etycznych, zbudowana na indywidualnych aktach preferencji wartości dokonywanej w obliczu konfliktu moralnego, daje szansę na zdystansowanie się od quasi-prawnej, kazuistycznej percepcji etyki prawniczej. To zaś stwarza możliwość niezbędnej metodologicznej niezależności etyki prawniczej od prawa.
    The thesis of the paper is connected with the statement that the casuistic, quasi-legal model of legal ethics should be abandoned. What should be broadened instead, is individual and collective, namely corporate one, awareness of the specificity of legal experiencing of the values relevant from ethical-professional perspective and based on firm methodological basis. The conception of legal ethics presented in the paper gives up the attempts of describing it from the perspective which is forced by categories connected with legal positivism. This suggestion refers to the following: (1) phenomenological “thinking according to ethical-professional values”, (2) the notion of ethical-professional intuition and (3) the concept of a lawyer’s and legal corporation’s field of axiological awareness. The 20th century phenomenological philosophy and, closely connected with it, informal ethics of values, as presented mainly by M. Scheler and N. Hartmann, serves as the basis of the suggested ethical-professional concept. Phenomenological ethics, relying on individual experience of ethical values, based on individual acts of value preference in case of moral conflict, gives a chance to distance itself from a quasi-legal, casuistic perception of legal ethics. It, then, creates the possibility of necessary methodological independence of legal ethics from law.

    Artykuł porusza problematykę instytucjonalnych aspektów prawniczej etyki zawodowej. Na płaszczyźnie teoretycznej pojęcie prawniczych instytucji korporacyjnych poddane jest reinterpretacji w perspektywie elementów „małej etyki”, zarysowanej przez Paula Ricoeura w dziele „O sobie samym jako innym”. Przesłanką uzasadniającą zastosowanie tego stanowiska jest założenie Ricoeura, zgodnie z którym dążenie etyczne podmiotu podlega urzeczywistnieniu na trzech płaszczyznach, z których najszerszą stanowią „sprawiedliwe instytucje”. W związku z tym, na gruncie wskazanego paradygmatu, podjęta jest próba charakterystyki instytucjonalnych aspektów uwarunkowanego zawodowo, prawniczego dążenia etycznego. Rozwijane analizy odwołują się bezpośrednio do dorobku etyczno – zawodowego korporacji adwokackiej i radcowskiej. Jednocześnie wywód nawiązuje do osiągnięć rozwijanej w Polsce w ostatnich dekadach metaetyki prawniczej, budowanej na fundamencie korporacyjnych kodyfikacji etyczno-zawodowych oraz orzecznictwa sądów dyscyplinarnych.
    In this article, the problems of institutional aspects of lawyers’ legal ethics are discussed. On the theoretical plane, the concept of lawyers’ self-government institutions is reinterpreted in the perspective of ‘little ethics’ outlined by Paul Ricoeur’s in his work Oneself as Another. This approach is cognitively justified because, in the light of the assumptions adopted by the philosopher, the ethical aspiration of an entity can be fully realised only in ‘just institutions’. In the first place, the text discusses the fundamental importance of the institution, taking into consideration the achievements of legal meta-ethics. The point of reference for the analyses undertaken by the author is the role played by the concept in question in the ethical and professional codifications of the self-governments of attorneys and legal advisors in Poland. In the key part of the discussion, Ricoeur’s concept of ethics is adopted as the basis for systematizing and reinterpreting the issues relating to institutions of self-government of the legal professions of public trust. Ultimately, the theory of professional ethics, referring to the philosopher’s work, enables characterising in a comprehensive way the ethical aspirations of a lawyer at the internal, interpersonal and institutional levels.

    The article provides an insight into the notion of civil disobedience and its constituents. The subject is presented with the significance of civil disobedience as a means of protecting the subjective rights in mind. In the context of opposing theoretical and legal paradigms: legal positivism and the natural law, an analysis of the legality of civil disobedience as a means for protection of rights stemming from these laws is conducted. Subsequently, having accounted for the views of Gustav Radbruch and Ronald Dworkin, a compromise view providing a solution to the paradox of protecting the legal system by its infringement in an act of civil disobedience, is outlined.

    The paradigm of legal positivism, historically the most important attempt at turning law into science, has been subject to thorough criticism in past decades. The criticism has concerned the most important features of legal positivism, and especially the assumption of separation of law and morality, the dogma of statue being the only source of law, and the linguistic methods of interpreting legal texts. With a crisis of the positive paradigms, the demand for new, humanistic grounds for analysing philosophical and legal questions is intensifying. This is the reason for this article’s attempt to point to the application of Paul Ricoeur’s achievements to the key questions of the philosophy of law. It must be emphasised that his works, and especially Soimême comme un autre, may serve as a foundation for a philosophy of law rejecting the problematic claims about the dualism of being and obligation, the distinction of descriptive and prescriptive languages, and also the separation of law and morality. Thanks to this, the legal topos pacta sunt servanda (agreements must be kept) finds a reinforcement in the ontology of the subject applying law and can be understood as an ethically significant pattern of identity of the self. Equally fruitful seems the possibility of combining the questions of the ontology of the subject applying law with the question of a legal text and its interpretation. The assumption of Ricoeur’s perspective leads to a reduction in the distance between the legal text and its addressee, emphasised by the critics of legal positivism. This rapprochement becomes possible thanks to the connection of the question of the narrative that a legal text is with the question of narrativisation of the subject (i.e. the interpreter of a legal text), being itself in the ipse sense, i.e. applying the law.

    The linuron contaminated soil was subjected to remediation using ozone as an oxidant. The experiments were performed both in laboratory and pilot plant installations. Kinetics of linuron degradation was determined for both systems. Moreover, main linuron metabolites were identified, and possible degradation pathway was proposed. The soil remediation was found to be successful, which was verified by chemical and biological tests. The half-life time of linuron in the pilot scale installation was no more than 7.5 h. To verify the efficiency of soil detoxification, a toxicity test was performed, which utilized Eisenia foetida earthworm. The test organisms were exposed for 14 days to the linuron contaminated soil prior and after the remediation procedure. It was observed that in the control group and the group of organisms exposed to the ozonated soil, the survivability was 100%, whereas the earthworms exposed to the linuron contaminated soil that was not ozonated did not survive at all.
    Zanieczyszczoną linuronem glebę poddano remediacji z użyciem ozonu jako utleniacza. Eksperymenty przeprowadzono zarówno w instalacji laboratoryjnej, jak i instalacji pilotażowej. Dla obu systemów wyznaczono kinetykę degradacji linuronu. Ponadto zidentyfikowano główne produkty rozkładu linuronu i zaproponowano możliwy szlak degradacji. Remediacja gleby okazała się skuteczna, co zweryfikowano testami chemicznymi i biologicznymi. Okres półtrwania linuronu w instalacji w skali pilotażowej nie przekraczał 7,5 godziny. W celu sprawdzenia skuteczności detoksykacji gleby przeprowadzono test toksyczności, w którym wykorzystano dżdżownicę Eisenia foetida. Organizmy testowe były wystawione na działanie gleby skażonej linuronem przez 14 dni przed i po procedurze remediacji. Zaobserwowano, że w grupie kontrolnej i grupie organizmów narażonych na kontakt z glebą poddaną remediacji przeżywalność wyniosła 100%, natomiast dżdżownice narażone na kontakt z glebą skażoną linuronem nie przeżyły.

    Codes of legal ethics encounter constant waves of criticism. It is pointed out that their disadvantage is, on the one hand, the excessive casuistry, limiting the possibility of taking independent decisions in cases of ethical and professional conflicts, and, on the other hand, the exaggerated declarative character of perfectionist ethical and professional virtues. The gap between the above mentioned perspectives, easily perceived in such codes, results in a dysfunctionality of professional ethics in the actions undertaken by members of the legal profession. The article, apart from the critical-comparative part, includes a proposal of reading and interpreting the content of the codes in a way that transgresses the above opposition. The theoretical basis of the presented position is provided by the concept of “little ethics” formulated by Paul Ricoeur in his work Oneself as Another. The ethical theory developed by Ricoeur combines the elements of Aristotelian ethics of virtues with Kantian ethics of duty. For this reason, it sets a uniform perspective for opposing elements, namely: subordination to the norm of the code and pursuit of ethical and professional self-improvement by legal professionals. The proposed solution belongs to the “reflexive” paradigm of the lawyer’s professional ethics proposed on the basis of Ricoeur’s onto-ethical theory.

    Eristic methods of the Stalinist courts are a phenomenon, on the one hand, well-documented, yet on the other hand, insufficiently explored from the theoretical perspective. They can be understood as forms of violence occurring in the language of the judicial discourse participants (judges, prosecutors), aimed at the total elimination of political opponents. The article is an attempt to characterise these methods using the conceptual instruments, developed by Chaïm Perelman and presented in the work Logique juridique. Nouvelle rhétorique and L’empire rhétorique. Rhétorique et argumentation. What weighs in favour of using Perelman’s theory are its roots in the abundant achievements of the ancient rhetoric. More importantly, however, one of the main objectives of Perelman was the development of the modern theory of legal argumentation, including judicial one. In this regard, the views of the philosopher are adopted as a counterpoint in the rhetorical analyses of the abuses of the Stalinist courts discussed on the example of the Trial of the Sixteen and the Trial of General A. E. Fieldorf „Nil”.
