    Artykuł dotyczy ewolucji pieczy zastępczej, w tym zwłaszcza prawnego jej aspektu. Autor wskazuje na ideę ochrony praw człowieka i zasadę pomocniczości jako filozoficzny fundament jej funkcjonowania. Piecza zastępcza może mieć formę rodzinną (rodziny zastępcze i rodzinne domy dziecka) oraz instytucjonalną (różnego typu placówki instytucjonalne). Prawo preferuje formy rodzinne, jednak autor podkreśla, że najlepszą formą jest ta, która w konkretnej sytuacji daje największe szanse powrotu dziecka do rodziny. Uchwalona 9 czerwca 2011 r. Ustawa o wspieraniu rodziny i systemie pieczy zastępczej jest dowodem na kontynuację funkcjonowania pieczy zastępczej jako przede wszystkim formy wspierania rodziny.
    The article deals with the evolution of foster care, especially its legal aspect. The author refers to the idea of protection of human rights and the principle of subsidiarity as philosophical grounds for the functioning of this institution. Foster care can assume either the form of kinship placement (foster families, family-type children’s home) or an institutional form (various types of institutional establishments). The law prefers kinship placement, but the author emphasizes that in fact the best form of foster care is the one which in a specific situation offers the greatest chance of the child’s return to its family. The Act on Supporting the Family and the System of Foster Care passed on 9th June 2011 is evidence of the functioning of foster care first and foremost as a form of supporting the family.

    This paper discusses changes in the functioning of foster care since it was reformed in 1999. Its focus is to demonstrate changes in Polish law and evolution in pedagogical views as well as in administrative practice in the context legal standards of foster care set forth in international documents (Convention on the Rights of a Child, European Convention on Human Rights and many others) and in the constitutional principle of subsidiarity. Much attention was also devoted to provisions of the Act of 9 June 2011 on support for Families and Foster Care system as well as to new laws of the Family and Guardianship Code. Of paramount importance is the right of children in care to return to their families (family reintegration), a right that derives from international standards. In this context evolution in pedagogy and the significance of social care were emphasized. The author highlights emotional problems of foster families which hinder efforts aimed at supporting children’s parents.
    Artykuł omawia zmiany, jakie zaszły w funkcjonowaniu pieczy zastępczej, począwszy od rozpoczęcia jej reformowania w 1999 roku. Akcent położono na pokazanie zmian polskiego prawa i ewolucji pedagogicznej oraz administracyjnej praktyki, w kontekście standardów prawnych pieczy zastępczej wyznaczonych w międzynarodowych dokumentach (Konwencja o Prawach Dziecka, Europejska Konwencja Praw Człowieka i wiele innych) oraz w konstytucyjnej zasady pomocniczości. Szczególnie wiele uwagi poświęcono uregulowaniom Ustawy z 9 czerwca 2011 roku o wspieraniu rodziny i systemie pieczy zastępczej oraz nowym przepisom Kodeksu rodzinnego i opiekuńczego. Najistotniejsze znaczenie ma wynikające z międzynarodowych standardów prawo wychowanków rodzin zastępczych i placówek opiekuńczo-wychowawczych do powrotu do rodziny (reintegracja rodziny). Na tym tle pokazano przemiany w pedagogice i znaczenie pracy socjalnej. Autor zwraca uwagę na emocjonalne problemy rodzin zastępczych, które odmawiają działań wspierających rodziców wychowanków.

    The compliance assessment is a relatively new area of activity in the functioning of companies. It can be classified as the mechanism to support the internal control systems. The assessment consists in verifying the compliance of the provisions of internal regulations, adopted and used in companies, with binding law regulations. Compliance, therefore, involves systems and procedures designed to avoid legal risk, including civil and administrative penalties and, above all, criminal but also the risk of financial loss and the loss of reputation. The assessment of compliance, thus, aims at avoiding risk that may affect any economic entity as a result of its activities that do not conform to legal norms and standards in force.

    The study of pathology and dysfunction of the organization involved in the analysis and evaluation of the deviation, then the theoretical generalization, and determination of their remedies. Article presents an analysis and evaluation of pathology in the management of selected, namely corruption and anomie employees. Decision was an attempt to identify the employee as an unmasking remedy human resources management in Poland. The effective way to eliminate various types of pathology in the organization has spread throughout the world.     The author discusses an always relevant problem of the model of the procedure for dissolving marriage. The problem is analyzed from the point of view not only of law, but also social sciences, primarily, psychology. He observes a presence of a dominant tendency nowadays to deemphasize the meaning of marriage and family, and to succumb to crisis and file for a divorce for banal reasons. The so called pro-divorce mentality translates into a tendency observed among judges to favour divorce. On the other hand, the author assesses the legal acts referring to divorce cases as reasonable, i.e. neither favoring nor facilitating divorce. Therefore, a need is emphasized to change the approach to the family in a critical situation. He suggests that in a family court instead of settling family legal problems an attempt should be made to solve them. To this effect, in local communities, special groups comprising psychologists, pedagogues, lawyers, social workers and other specialists should be set up. The ultimate goal for the groups would be to try to reconcile the spouses, to help them solve their family problems, including assistance in dealing with all divorce procedures. People dissatisfied with the proposal suggested by such a group might have a right to file a case in court. In court the proceedings should be held in compliance not with the so far applied adversarial principle but with the conciliatory principle.

    The article concerns the good of the child clause. Once the sense of the clause was specified, the focus of the article was shifted onto the issue that is closely related to the practice of judicial decisions undertaken by courts, namely to the criteria under which the courts apply this clause. To illustrate the issue, it was necessary to make references to the achievements of the theory of law concerning the linguistic interpretation and functional interpretation and, in particular, the relationship between them. The background and inspiration for the considerations is the decision of the Supreme Court issued a few years ago, in which the obvious thesis was propounded that if the linguistic interpretation leads to absurd conclusions, contradicting the assumption of the rationality of the legislator’s actions and contradicting the axiology of the legal system, then the conclusions should be abandoned and the decisions should be made on the basis of the good of the child clause. The author however claims that the Supreme Court has erroneously interpreted Article 42 of the Act of family support and foster care. He supports his claim saying that in the discussed case there were no grounds for rejecting the norm interpreted with the use of linguistic interpretation methods. Moreover, the author asserts that the Supreme Court has improperly applied that functional interpretation since, referring to the constitutional value of the good of the child, it did not in fact protect it, and by its decision the court made the person who did not meet the legal and moral criteria obtain the status of a foster family.
    Artykuł dotyczy klauzuli dobra dziecka. Po omówienia jej sensu uwagę skoncentrowano na zagadnieniu mającym ścisły związek z praktyką orzeczniczą sądów, a mianowicie na kryteriach stosowania przez nie tej zasady. Wymagało to nawiązania do dorobku teorii prawa dotyczącego wykładni językowej i wykładni funkcjonalnej, a zwłaszcza relacji między nimi. Tłem i inspiracją dla rozważań jest wydane kilka lat temu postanowienie Sądu Najwyższego, w którym wypowiedziano oczywistą tezę, że jeżeli wykładnia językowa prowadzi do wniosków absurdalnych, sprzecznych z założeniem o racjonalności działań prawodawcy i przeczących aksjologii systemu prawa, wówczas należy od nich odstąpić, formułując orzeczenie na podstawie klauzuli dobra dziecka. Autor zarzuca Sądowi Najwyższemu błędy w interpretacji kluczowego art. 42 ustawy o wspieraniu rodziny i systemie pieczy zastępczej oraz twierdzi, że w omawianej sprawie brak było podstaw do odrzucenia normy wyinterpretowanej metodami wykładni językowej. Ponadto zarzuca Sądowi Najwyższemu niewłaściwe zastosowanie wykładni funkcjonalnej, skoro powołując się na wartość konstytucyjną, jaką jest dobro dziecka, w istocie dobra tego nie chronił, a wyrokiem spowodował uzyskanie statusu rodziny zastępczej przez osobę, która nie spełniała prawnych i moralnych po temu kryteriów.

    The aim of the present study was the analysis of match activities of full-backs from selected European national soccer leagues. The study sample comprised 30 full-backs playing in the autumn round of the 2014/15 season from five European national top-tier leagues: English Premier League, Spanish Primera Division, German Bundesliga, Russian Priemjer Liga and Italian Serie A. The performance of full-backs (left-back and right-back) from each selected team was analyzed using a professional match analysis system OptaPro which tracks every possible type of ball touch and on the ball action in match covered by a rigid set of definitions. The data for analysis included the total number of passes, total number of crosses, and total number of ball touches performed by the fullbacks in three zones of the pitch: attack, midfield and defense. The study results showed that the full-backs from the Spanish Primera Division executed the highest number of passes and crosses as well as ball touches in the attack zone. They also performed the lowest number of passes in the midfield and defense zones, in which the highest percentage of passes was achieved by the full-backs from the German league teams. The study indicates that in modern soccer defenders must possess a high level of offensive skills that can be necessary in the last stage of a team’s attack.

    The study aimed to assess the total covered distance during a match, performance volume below and above the anaerobic threshold, as well as characterize physical activities of professional Bundesliga goalkeepers during soccer matches. 34 goalkeepers (606 observations) from all eighteen Bundesliga teams, who played in the 2014/2015 season were considered for the study. The performance of goalkeepers was analyzed with the use of the VIS.TRACK system. The variables measured included: total covered distance [km] in the whole match, the first half, and the second half; distance covered below and above the anaerobic threshold (4 m • s–1) [km]; and distance covered in six intensity ranges [km]. The total distance covered by the goalkeepers was 5.48 ±0.56 km. The distance covered by goalkeepers below the anaerobic threshold was 5.28 ±0.52 km, whereas the distance covered above the anaerobic threshold amounted to 0.21 ±0.09 km. The ratio between the goalkeepers’ volumes of aerobic and anaerobic performance was 25:1. The total distance covered by goalkeepers in match play and the distances covered by goalkeepers below and above the anaerobic threshold (96.17% and 3.83%, respectively) indicate that during a match the goalkeepers undertake predominantly aerobic exercises.

    In modern endurance training information about an athlete’s performance below and above the anaerobic threshold is crucial. The aim of the present study was a comparative analysis of the total distance covered by football players in two rounds of the 2013/1014 playing season. Furthermore, the study also assessed the performance of elite Bundesliga players during competitive matches, above and below the running speed of 4 m·s –1, corresponding to the level of anaerobic threshold (AT). The players’ mean body height was 183.00 ±6.44 cm, body mass 78.19 ±7.42 kg, and mean age was 27.99 ±3.47 years. The analysis was carried using the Impire AG motion analysis system on the basis of official match reports from the Deutscher Fußball-Bund (DFB). The study revealed that the total distance covered by the players in match-play was significantly shorter in the second round of the playing season. The distance covered by the players below the AT is significantly shorter in the spring round than in the autumn round, while the distance covered above the AT shows a reverse, although non-significant tendency. In the spring round the volume of players’ work performed above the anaerobic threshold is greater than the volume of exercise performed below the AT.

    Opis:
    The novel polyurea-based (PUA) composites modified with milled basalt fibers (BMF), formed with spray coating technology were produced. The addition of 5–30 wt % of BMF into commercial two-component PUA was used as a low-cost modification which allowed to significantly improve the mechanical performance, as well as thermomechanical and thermal stability of the final products. It was found that the incorporation of 30 wt % of BMF resulted in over 30% stiffness improvement and extension using temperature of the coating above 80 °C. Moreover, an increase by 25 °C in thermal stability evaluated by thermogravimetric analysis (TGA) was achieved, without significant changes in the rheological behavior of the compositions, resulting in the presence of structural defects. Finally, an evaluation of crosslink density was conducted in order to ascertain that the applied modification of the thermoset reactive fast-curing system allows to obtain fully cured products which may be used as a spray coating for hydrotechnical objects protection.
    Metodą powlekania natryskowego wytworzono nowe kompozyty na bazie polimocznika (PUA) modyfikowanego mielonymi włóknami bazaltowymi (BMF). Komercyjny dwuskładnikowy PUA modyfikowano niskokosztowo za pomocą dodatku 5–30% mas. BMF, co pozwoliło na wyraźną poprawę właściwości mechanicznych, a także stabilności termomechanicznej i termicznej PUA. Stwierdzono, że wprowadzenie do polimocznika 30% mas. BMF zwiększyło o ponad 30% jego sztywność i umożliwiło rozszerzenie zakresu temperatury stosowania powłoki powyżej 80 °C. Metodą analizy termograwimetrycznej (TGA) stwierdzono wzrost stabilności termicznej o 25 °C, bez istotnych zmian w reologicznym zachowaniu kompozycji, mogących prowadzić do tworzenia się wad strukturalnych w gotowych wyrobach. Na podstawie oceny gęstości usieciowania potwierdzono, że przeprowadzona modyfikacja termoutwardzalnego reaktywnego systemu szybkiego utwardzania pozwala na uzyskanie w pełni utwardzonych produktów, które można zastosować jako powłokę natryskową do ochrony obiektów hydrotechnicznych.

    Opis:
    Background. In general practice, dysfunctions within the locomotor system are a recurring health issue. Most frequently, diagnoses and treatments relate to pain syndromes of the backbone, the shoulder girdle or the pelvic girdle. The authors believe that physiotherapy, along with other clinical disciplines, should be regarded as an important factor which influences the effectiveness of the therapeutic process in this area. In primary care, treatment of musculoskeletal disorders – especially at the stage of early clinical symptoms – should incorporate basic physiotherapy methods, e.g., massage, physical procedures, kinesiotherapy and the underrated education of the patient. Restoring appropriate spatial arrangement of tissues provides the right conditions for the regeneration and repair of muscles, ligaments and tendons, although it is a process that requires a long time. Therefore, it can be very important to introduce self-therapy in the form of systematically repeated, easy-to-replicate procedures in the scope of self-massage and self-kinesiotherapy. Objectives. This paper presents the impact of physiotherapy in treating selected disorders and pain syndromes of the locomotor system with particular attention to the role of massage. Emphasis is placed on the meaning of self-massage in the process of restoring structural balance of tissues. The model of active inclusion of the patient in the treatment process as preparation for self-therapy is presented. This paper aims to justify the need to reorganize health services provided through general practicioners within the National Health Fund network by incorporating physiotherapy in primary care.
