The article analyzes The Philippines v. China arbitration case and its geopolitical implications for further bilateral relations between USA and China. Additionally, it examines the viewpoints of Chinese leaders. Term arbitration refers to a process in which a party submits a “dispute” to an unbiased, independent third party. Its main goal is to settle and conclude the disputes presented. The Permanent Court of Arbitration is an intergovernmental organization established in 1899 that designates arbitral tribunals to resolve disputes between and among nations. It is based in The Hague, Netherlands, and currently presides over the arbitration case. Philippines brought the case before the tribunal to dispute China’s claim of “indisputable sovereignty” over almost the entire South China sea through its “nine-dash line” claim. The five arbitrators were assigned to the Judge Thomas A. Mensah (President), Judge Jean-Pierre Cot, Judge Stanislaw Pawlak, Professor Alfred H. Soons, and Judge Rüdiger Wolfrum. It will be argued that China has had a bad relationship with all neighbors since 1974, when China used force against South Vietnam in the South China Sea in order to recapture the Paracel Islands and against a unified Vietnam in 1988 to seize Johnson Reef and five more features, massacring a party of Vietnamese flag-bearers. In 1994, China seized Mischief Reef unobserved and it took months before the world noticed. Until then, China was the only claimant to have no permanent presence in the area. There are already clear signs that China is using its military power to rebuke the arbitration. Admiral Wu Shengli, the Commander of the Chinese navy, just hosted the US Chief of Naval Operations, Admiral John Richardson, at the Chinese Navy Headquarters on July 18 2016, following the successful participation of Chinese warships in the major US RIMPAC exercise in the Pacific. He made clear that the militarization of China’s artificial islands will continue so that their defense corresponds to the “level of threats”. After a PLA Air Force patrol close to Scarborough Shoal made the headlines of most Chinese newspapers yesterday, a military spokesman announced that air patrols would become a regular occurrence now. The Tribunal issued its Award on July 16 2016 after several months of hearings and submission of documents. China was absent throughout the proceedings, refusing to recognize the case. The Tribunal concluded that there was no legal basis for China to claim historic rights to resources within the sea areas falling within the ‘nine-dash line The Spratly Islands and its many reefs are being claimed by China under its “nine-dash line” claim that covers nearly the entire South China Sea including parts of the Philippines’ Exclusive Economic Zone (hereafter referred to as EEZ). China insisted it has historic rights in asserting its ownership of the region believed to be rich in natural gas resources and also a vital trade route for international cargo ships The 2012 Scarborough Shoal standoff was one of the factors that prompted the Philippines to file a case against China. Tensions between the two countries escalated when Chinese surveillance ships prevented Philippine authorities from apprehending Chinese vessels found poaching endangered Philippine marine species at the shoal. The dispute over maritime features in the South China Sea has been ongoing for decades prior and involved other Southeast Asian countries such as Vietnam, Malaysia, Indonesia. On January 23, 2013, the Philippine government (hereafter referred to as Manila) announced that it had initiated an arbitration case against the People’s Republic of China in accordance with the dispute settlement provisions of the United Nations Convention on the Law of the Sea concerning a range of issues relevant to the ongoing sovereignty dispute in the South China Sea between the two nations.Manila’s case was submitted for arbitration to a five-judge panel formed under the “Settlement of Disputes” process contained in Part XV of UNCLOS and hosted by the Permanent Court of Arbitration (PCA) in The Hague. The United Nations Convention on the Law of the Sea is an international treaty that defines the limits of a nation’s maritime sovereignty claims. This convention was ratified by both the Philippines and China. Under its provisions, areas within 200 nm from the country’s baselines would be part of the EEZ. UNCLOS states three basic maritime features: Islands under the sovereignty of a country are entitled to a 12 nm (approximately 22 kilometers) territorial sea and a 200 nm (approximately 370 km) exclusive economic zone (EEZ). The state may exclude foreign entities within its territorial sea and has the sole right to exploit resources found within the EEZ Since the initiation of the arbitration case, China has conducted several massive reclamation projects to turn submerged reefs into artificial islands capable of hosting military structures and equipment. The conclusion offers general thoughts on the larger implications of the findings for the management of maritime disputes involving China and especially U. S.-China security relations.

This article discusses The Self-governing Republic, a programmatic-ideological conception which was part of the “Solidarity” Program accepted at the union’s First Convention in 1981. This conception was rooted in the ideas of the democratic opposition of the nineteen-seventies but it also reflected the pivotal changes in social consciousness which took place in 1980–81. Its main focus were postulates for the development of democratic institutions in all walks of social, political and economic life, postulates concerning the development of participant institutions, and the postulate to lay the moral foundations for democracy (e.g., responsibility of those guilty of communist crimes). This text confronts the programmatic legacy of The Self-governing Republic with its only partial implementation after 1989. The foundations of procedural democracy had been lain by this time but development of themoral foundations for democratic transformation were conspicuously lacking. The institutions of social self-government were only partly developed in the formof territorial self-government and, not without considerable resistance, development of the NGO sector which became the main programmatic successor of “Solidarity’s” legacy. In the nineties those changes which did take place in this sector were mainly the result of grassroots pressure and foreign aid. Since 2001/2002, however, positive institutional improvements have been observed in the vicinity of this sector. These improvements correspond with the sector’s new conditions of functioning following Poland’s accession to the European Union.

Issues related to national security problems have long been of interest to many research centres. National security, due to its role and importance for the functioning of both the state and society, has become an important research area not only for military specialists, but also civilian experts. However, despite the unquestioned principle of the need to study the problems of national security, dispute issues are increasingly appearing that require new solutions based on scientific foundations or a fuller interpretation of the applicable rules of conduct. Security as a research area is multidimensional, it is analysed primarily in terms of organisation and subject. Therefore, there is no doubt the thesis that ensuring security is a fundamental duty of the state, because it really determines the sense of its existence. The security of the state is of course also the security of its citizens. Since the dawn of human history, the security of the individual has been associated with state-forming processes. Unfortunately, security, like many other common phenomena of everyday life of individuals and societies is intuitively made aware and does not succumb to unambiguous definitions, which is why a number of discussions arise and not only in the scientific community. The national security of the Republic of Poland is a specific range of challenges generated for the state. The article looks at the conditions of external and internal national security of the Republic of Poland, which is the starting point for research on national security. National security was defined and its typology made.

Agroecotourism is becoming the most dynamical branch of the world tourist industry. The Republic of Belarus has inexhaustible potential for the development of agroecotourism. It promotes a steady development of rural regions, raises well-being of its inhabitants by attracting investments, creates modern social infrastructure and new work places, contributes to the achievement of social and cultural purposes. Agroecotourism is considered to be an important component of a successful realization of the ‘State Program for the Revival and Development of the Countryside in the Republic of Belarus for 2005-2010’. The problem is that the agrotouristic enterprises have not enough money to increase the scale of realization of basic concepts and models stipulated by the National Program. Maintaining and developing the natural and human potential of Belarus will require making the agroecotourism a profitable branch of the agrarian sector of economy.

The article “Status of women in the Republic of Turkey” examines the issueof an ambiguous predicament of feminine part of the society in one of the European Union’s candidate countries. The objective of the article is to attempt to answer the following question: what are the reasons of social acceptance for violating women’s rights in Turkey? In order to examine the issue, this paper describes and compares legal status (past and present) concerning Turkish women and the instances of abusing their rights. Big contrast shown between them raises other questions. In the end all reflections lead to conclusion that patriarchal heritage and Kemalism’s inadvertences are the two main reasons responsible for current predicament of Turkish women. The whole article refers to the efforts of Turkey to become an EU member, as it plays a significant role there in the process of law modernisation. Artykuł bada zagadnienie, jakim jest niejednoznaczne położenie kobiet w jednym z krajów kandydujących do członkostwa w Unii Europejskiej – w Turcji. Rozważania będące treścią artykułu oscylują wokół pytania o przyczyny społecznej akceptacji dla łamania praw kobiet w tym państwie. By na nie odpowiedzieć, z jednej strony poruszona zostaje kwestia stanu prawnego (niegdysiejszego oraz obecnego), dotyczącego kwestii równouprawnienia, z drugiej zaś zostają opisane aktualne przypadki naruszeń praw kobiet. Duży kontrast pomiędzy tym, co państwo tureckie gwarantuje w różnego rodzaju aktach prawnych, a rzeczywistą trudną sytuacją, w jakiej znajdują się tamtejsze kobiety, prowokuje do stawiania kolejnych pytań. Ostatecznie, rozważania prowadzą do wniosku, iż to patriarchalne tradycje oraz ideologia kemalistyczna są dwiema głównymi przyczynami, które doprowadziły do obecnej - dość ambiwalentnej – sytuacji, w której tkwią dziś tureckie kobiety. W całym artykule pojawiają się liczne nawiązania do starań Turcji, by zostać członkiem Unii Europejskiej – jest to bowiem istotny powód, który od wielu lat wpływa na modernizację prawa w tym kraju

The purpose of this article is to present the key elements of the unique system of the Yogyakarta Sultanate as the monarchical part of Indonesia’s republican system, against the theoretical background of the concept of ‘monarchy within a republic’ and the trends in the systemic practice of modern monarchies. Indonesia is in many respects a unique example of a mixed system in which republican and monarchical elements coexist. The incorporation of monarchical elements into the republican system has been done in a very original way – by giving one region of the state dual constitutional status, with the traditional ruler of that territory in the dual role of republican governor and hereditary ruler. The Yogyakarta Sultanate, despite its uniqueness, is subject to problems typical of all modern monarchies, arising from the need to adapt to civilizational and cultural changes, such as gender equality, while respecting rich traditions and cultural identity.
Celem niniejszego artykułu jest przedstawienie kluczowych elementów unikalnego ustroju współczesnego Sułtanatu Yogyakarty jako monarchicznej części mieszanego systemu republikańskiego Indonezji, na tle teoretycznych założeń koncepcji “monarchii w republice” oraz tendencji w praktyce ustrojowej współczesnych monarchii mieszanych. Indonezja jest pod wieloma względami wyjątkowym przykładem republiki mieszanej, w której współistnieją elementy republikańskie i monarchiczne. Monarchiczne elementy systemu zostały skumulowane tylko w jednym regionie państwa. Włączenie elementów monarchicznych do systemu republikańskiego zostało dokonane w bardzo oryginalny sposób – poprzez przyznanie jednemu z regionów państwa podwójnego statusu konstytucyjnego, z przyznaniem tradycyjnemu władcy tego terytorium podwójnej roli – republikańskiego gubernatora i dziedzicznego władcy. Sułtanat Yogyakarty, mimo swojej wyjątkowości podlega problemom typowym dla wszystkich współczesnych monarchii wynikającym z konieczności dostosowania się do zmian cywilizacyjnych i kulturowych, takich jak równość płci i dopuszczenie kobiet do dziedziczenia tronu, przy jednoczesnym poszanowaniu bogatych tradycji i tożsamości kulturowej.

In all three Central European countries, long-term residence is defined as residence for a specific purpose of more than 90 days. The requirements for granting this type of residence are generally similar with differences in the individual types of purpose of this residence permit. The Polish Act contains a category that could be defined as ‘above-framework’, expanding the range of options that make it possible to obtain long-term residence. The Slovak legislation contains the purpose of “special activities”. In comparison with the Czech legislation, the range of possibilities for obtaining long-term residence in Slovakia is more extensive and less rigid. Specifically, in the case of long-term residence for the purpose of study, there is a fundamental difference in the legislation in the Czech Republic and Slovak Republic, where Slovak legislators include in the term “study” all university, secondary, and higher vocational education. The Polish Act mentions only university studies and doctoral studies. The administration related to the admission of a foreign student to a specific school in the territory is certainly more extensive and demanding in Poland, with both the minister and the voivode enter the process beyond the framework of standard state administration bodies. The arrangement of the Act reveals a fundamental difference in Poland, where the sequence and logic of the arrangement is different to the Czech or Slovak legislation, which is expressed in which institutions Poland focus greater attention and emphasis or importance. None of the countries completely leaves the issue of visas for aliens from third countries unregulated. Although the legislation is identical in many respects, there are differences between individual institutions and the periods for which a visa can be issued. However, the issue of alien law is, at first sight, very extensive and content-intensive in all the above Central European countries, as evidenced by the length of the legislation itself, the complexity of individual institutions, and specific complexity of the provisions.

The primary purpose of this paper is to ascertain the degree to which the Republic of Serbia is ready for full membership of the European Union. Therefore the criteria set by the European Union for the countries aspiring to membership have been examined, including in particular the Copenhagen criteria of 1993. The assessment expressed in the European Parliament resolution of 18 April 2013 has also been taken into account. In many respects, the Republic of Serbia is not yet fully prepared for membership in the European Union, but on 20 January 2014 negotiations started on Serbia’s accession to the EU. Their results will be conditional on the course and pace of the talks concerning the normalisation of relations between Serbia and Kosovo. The date of Serbia’s eventual accession to the European Union is expected to be 2020.

Financing the theatre system in the Republic of CroatiaThis paper describes ways of financing culture in the Republic of Croatia using the example of theatre art, with an emphasis on the Ministry of Culture in the Republic of Croatia. The organizational model of theatre activity in Croatia is presented and the models of its financing are discussed. A comparative statistical overview of budget resources is also presented at the level of the state and the Ministry of Culture and the theatre activity for the period 2009 to 2018 in order to gain insight into their interdependence. Finansowanie systemu teatralnego w Republice ChorwacjiNiniejszy artykuł opisuje sposoby finansowania kultury w Republice Chorwacji na przykładzie sztuki teatralnej, ze szczególnym uwzględnieniem działalności Ministerstwa Kultury. Przedstawiono model organizacyjny systemu teatralnego w Chorwacji oraz omówiono modele jego finansowania. Zaprezentowano statystyczny i porównawczy przegląd zasobów budżetowych na poziomie państwa, Ministerstwa Kultury i instytucji teatralnych w okresie od 2009 do 2018 roku, dający wgląd w ich wzajemną zależność.

The present paper aims to provide a real view of adjudication of administrative cases in Kosovo. The issue of adjudication of administrative cases in the Republic of Kosovo remains a challenge following justice reforms which began in 2013 and are still on-going. Kosovo as a new country faces difficulties in professionalization of public administration and this is closely related to large number of case that are subject of judicial review which is not a case with other countries which have longer experience in public administration. In this context, more attention has been paid to review of administrative acts and issues with special focus on judicial review, following with legal remedies, administration silence as cause of judicial review. The paper also contains information about administrative justice in Kosovo before and 2013, and its current state. New court structure brought with New Law on Courts which entered into force in 2013 affected administrative justice substantially. In the previous system, Kosovo Supreme Court was the only instance handling administrative disputes. In this regard, the issue of effective legal remedies was not in place as required by international standards. However, new court structure brought significant changes regarding legal remedies in administrative justice by setting up three court instances; Administrative departments within Prishtina Basic Court and Appellate Court as well as Supreme Court extraordinary legal remedies review.

Stockbreeding is a fast growing branch of agriculture. But in modern economic conditions Republic of Belarus has many problems with it. On the contrary the countries of Europe achieved big results in meat production. In most of them branch is export oriented. The authors analyze situation in meat production in the Republic of Belarus and give their opinion thereupon. The present conditions are unfavourable and the volume of meat production is falling. It is necessary for the government to assist meat producers.

Freedom of expression and freedom of the press form guarantee and emphasize the democratic character of a state. The dissemination of information and opinions is a prerequisite of democracy, which essentially requires that citizens be guaranteed the possibility to participate in public affairs. An opportunity to learn some information and opinions is of paramount importance for broadening knowledge, sharpening the critical mind, shaping one’s own views and making rational and informed choices. For full access to information and opinions circulating in the public, it is necessary that it should be made public and media and their journalists will make it in the best way. The aim of this study was to compare constitutional legal solutions concerning freedom of expression and freedom of the press and the way they are effectuated in practice in theRepublicofArmeniaand in theRepublicofPoland.
Swoboda wypowiedzi i wolność prasy stanowią gwarancję i podkreślenie demokratycznego charakteru państwa. Przekazywanie informacji i opinii jest warunkiem demokracji, która z istoty swojej wymaga zagwarantowania obywatelom możliwości uczestnictwa w sprawach publicznych. Możliwość zapoznania się z informacjami i opiniami ma podstawowe znaczenie dla pogłębienia wiedzy, wyostrzenia zmysłu krytycznego, ukształtowania własnych poglądów oraz dokonywania racjonalnych i świadomych wyborów. Aby dostęp do informacji i opinii funkcjonujących w obiegu publicznym był pełny, konieczne jest ich upublicznienie, a najlepiej robią to media i zatrudnieni w nich dziennikarze. Celem opracowania było porównanie konstytucyjnych rozwiązań prawnych w zakresie swobody wypowiedzi i wolności prasy oraz sposobu ich urzeczywistniania w praktyce w Republice Armenii i Rzeczypospolitej Polskiej.

This article examines the dangers posed by the presence of a large Russian minority in the territory of the Republic of Kazakhstan. The detailed analysis of the situation in the period from 1991 to 2021 has made it possible to identify not only the dangers, but also the ways in which the Kremlin takes advantage of this issue to exert major pressure on Kazakhstan’s political decision makers to promote Russia’s vital interests. The paper looks at the measures taken by the authorities in Nur-Sultan, the main purpose of which is to limit Russian influence in the republic, as well as the negative impact of the adopted mechanisms on the growth of participation of ethnic Kazakhs in the socio-political life of the state.

The proposal presented by the United Poland party (Solidarna Polska) and defined as a new constitution cannot be considered as a complete proposal of the new fundamental law. A significant number of solutions, which are a copy of the RP Constitution is decisive in this regard. Special attention should be paid to the replication of the scheme of chapters of the fundamental law of 1997. Besides, a majority of chapters was adopted without meaningful changes and the content of most articles was simply repeated. The proposal is not original, based mostly on the existing construction of the fundamental law. Nevertheless the proposed changes could be defined as significant. The most important is a modification of the executive power, expressed in the abolishment of the office of the Prime Minister and placement of the RP President as the head of the Council of Prime Ministers. A meaningful change refers to the abolishment of the Senate and return to one chamber – the Sejm. A visible and highly original is the proposal of electing the Prosecutor General in general elections. Additionally the following can be considered as original: the establishment of the Court of State Responsibility instead of the State Tribunal, the return to the verdicts of the Constitutional Tribunal which are not final, and making a referendum upon the motion of a group of citizens. These proposals include solutions both replicated but also new and interesting and in some cases also controversial.

The present article is devoted to the formation of small rural enterprises in the Republic of Belarus. An overview of the current state of small business is discussed, as well as its dynamic growth in the country is put forward. Next, this paper singles out the possibilities of state budget aid to the development of small-scale business in agriculture. In addition, the role of infrastructure as reliable support of small businesses in rural areas is highlighted. Finally, some prospective directions for the development of small business sector in agriculture at the national, provincial and local level are proposed.

The migrant crisis is an imposed problem that requires a thorough solution. The complete understanding of the reasons for migration, as well as the situation in the Mediterranean basin and in the Middle East is a precondition for finding appropriate solutions. Eradication of poverty and disparity, the fight against terrorism and the ISIS extremism as well as the fight against other similar groups are just a fraction of the necessary preconditions for a successful dealing with the current challenges. The solution to the drama with the infinite wave of migrants from Syria and the Middle East, to which we are sad observers, seems is not to be seen soon. First of all, if we look at the European political elite and the general lack of a reliable and clear strategy for solving this problem, all we will see is helplessness and mutual accusations. The migrant or the refugee crisis is followed by a large number of incidents or series of events. The massive arrival of refugees in the European Union, usually illegal migrants from Asia, Africa and parts of Southeastern Europe, started in the mid of 2010 and escalated in 2015. The reasons for the mass arrival are traditionally associated with the chronic unemployment and poverty in these countries, but lately, are also result of the war, especially in Syria, where the civil war caused massive exodus of the population. The situation is similar in Libya, where the fall of Moamer Gaddafi’s regime led to anarchy, used by the well-organized networks of human traffickers. By mid-2015, the refugee crisis mainly took place on the Mediterranean coast of Italy, where refugees were arriving by ships and boats. In many cases, such attempts were futile and led to mass deaths. Lately, there has been a massive influx of refugees and migrants in the Balkans, using Greece and Croatia, EU member countries on the periphery of the Union, as entry point. But also, The Republic of Macedonia and the Republic of Serbia, candidate countries for the EU, are not bypassed. Although the European political establishment met the refugees with sympathy and as victims of the horrors of war that EU needs to provide shelter for, in time, the attitude toward the refugees became subject to fierce criticism by part of the European public. Concerns about the additional burdening of the social services, worsening of the security situation or the possible disappearance of the Christian identity of Europe due to the massive influx of Muslims from war areas in the Middle East arose. Recently, the attitude toward the migrants became the subject of a heated debate - dispute between some European countries, especially between Germany, which insists on “open door” policy and Hungary, Slovakia and Poland, which claim that their countries will suffer consequences due to such policy. The refugee-migrant crisis is a threat in several aspects and already has influence on the economic and social stability as well as internal security in the countries through which the migrants transit or remain, including the Republic of Macedonia. The busiest western – Balkan route used for arrival in the Schengen zone, especially in Germany, Sweden and other western and Nordic countries, brings negative influence visible in the social aspect, genuine threat to the national identity (culture, language, religion) and such endangerment inevitably will lead to an increased incidence of xenophobia, nationalism and racism. At the end, conditions for emergence of social disintegration will be created in the countries through which the migrants transit or remain, including the Republic of Macedonia. The economic stability, being crucial for a social stability, but also, for internal security, will be affected due to the use of additional resources and capacities (accommodation, health, communal services, transport and education) that the affected countries, including the Republic of Macedonia, should provide and set in function due to the newly arisen situation.

Insurance supports a healthy and prosperous society, enabling businesses and individuals to protect themselves, property, and their finances against risk. As such, insurance today is not just important for the individual consumer, business client or businesses; it also has consequences for the entire economy, restoring businesses to health after natural disasters, acts of war, riots, strikes, fluctuations or financial crises, and state measures to dictate the import or export of goods. The aim of this paper is to examine the part played by insurance in the economy of the Republic of North Macedonia. This paper introduces and summarises an argument and outlines the nature of the exploration to follow. For this introductory purpose, referencing in the paper is kept deliberately light; aiming to find discussion points of relevant sources in the course of the argument as it unfolds. We argue that insurance operates not at the periphery, but also at the core of development, in both practical and conceptual terms. Research of the space that insurance occupies and the role that insurance has in general welfare is performed by using the legal platform that insurance has in place, including the Law on Obligations, the Law on Insurance Supervision, and the Law on Compulsory Traffic Insurance. Through the method of analysis, synthesis, and statistics, the author processes the official data of the Ministry of Finance presented by the National Bank, in order to provide a clear overview of the trends in the use of insurance in the Republic of North Macedonia. The results from the study show that in the time period analysed, the insurance sector is classified as the third most important segment in the financial system, and that life insurance prevails over other types of insurance.

This article relates to the process of adaptation of Czech citizens to Turkish culture. The article explores the perception of Turkish culture by Czech citizens, problems they encounter in the Turkish society and the ways of their adjustment to the host culture. The empirical research on 10 Czech citizens was conducted using the method of semi-structured interviews. The article addresses the most important issues connected with the process of cultural adaptation.

There is a stereotype that the Republic of Belarus is a country where pluralism does not exist in all spheres of life. However, this statement is not precisely correct, as contemporary Belarus demonstrates political neutrality and pluralism in the foreign policy and multiculturalism inside the country. Multiculturalism is viewed in the paper as mutual tolerance among the population and respect to the Otherness in cultural life. Two major spheres of pluralistic phenomenon are discussed: ethnic composition of Belarus and its religious confessions. Although a major part of the believers belongs to two Christian confessions, Orthodox and Catholic, many other confessions and new religious movements also exist. Religious pluralism is a practical reality in Belarus which has the reputation of the most religiously tolerant post-Soviet country. Contemporary laws provide the legal basis for tolerant relations in the country, and there is a historical tradition of religious tolerance in Belarus.

In this article, the author considers market segmentation as a process of dividing the market into separate parts – segments that differ from each other with different sales opportunities of the manufacture’s products. The author demonstrates such segment of the consumer market as the market of cosmetic services. Principle scheme of segmentation of the cosmetic services market is shown. Criteria and characteristics (principles) of segmentation necessary for forming market segment are singled out. The article also focuses on the sequence of creating a market segment. The author reveals two principal approaches to marketing segmentation used in world practice. The basic principles of segmentation of the consumer market are described. Distribution of income by population groups, % in 2015-2017, is analyzed. (for April month), on the basis of which the possibility of breaking up potential consumers into stable segmental groups was considered, segmentation of the population on the basis of income can serve, when the entire population is divided into five 20% of groups. The author distinguishes and describes the characteristic features of the methodology, segmentation which consists of successive stages. The point of view of modern world marketing is to first see the market segments, and then the country. The issue is not so much about the market potential of Kazakhstan, but about the potential among all consumers of cosmetic services. The main companies now describe the segments of the world market and the niches that cross national borders. They can be achieved physically, using a variety of means of communication and distribution channels, but the psychological target orientation is realized similarly. These segments are identified on the basis of adherence to similar concepts of the ideal product. This allows the company to develop the same product range for such segments, and the product is sold to the same target segments for benefits in numerous countries. Goal: Purpose of this article is to consider the cosmetic services market segmentation as one of the most important marketing tools. Also consider market segmentation as a process of dividing the market into separate parts – segments that differ from each other with different sales opportunities of the manufacturer’s products. Identify such a segment of the consumer market as the market of cosmetic services. Analyze features of the distribution of income by population groups,% in 2015-2017 (for the month of April), also to break down potential consumers into stable segmented groups based on income, when the entire population is broken down into five 20% of the groups, to consider enterprises segmentation by the size of trade turnover and areas of activity. Methods: Methods of document analysis (translation of primary and especially secondary data into targeted information), analysis of methodological and educational literature, observation (the method of collecting primary marketing information about the studied, by monitoring selected groups, customers, employees of the enterprise) are used as methodological tools. Results: In this article, market segmentation as a process of dividing the market into separate parts is considered – segments that differ from each other with different sales opportunities of the manufacturer’s products. Also there considered such segment of the consumer market as the market of cosmetic services. Features of income distribution by population groups,% in 2015-2017, are analyzed (for the month of April), a breakdown of potential consumers into stable segmented groups based on income was also carried out, when the entire population is divided into five 20% of the groups, the segmentation of the enterprise according to the size of trade turnover and spheres of activity was considered.

Purpose: The aim of the study is to show that war games and simulations used in the Armed Forces to improve military personnel bear the hallmarks of edutainment. Design/methodology/approach: The study is of a theoretical and empirical nature. The theoretical methods used, such as: analysis, synthesis, inference, analogy and abstraction based on literature and other available media specialist sources on the discussed topic. The use of empirical methods was in the form of observations and methods of collecting judgments and opinions with the informal interview technique with representatives from the Centre for Simulation and Computer War Games (CSiKGW). Findings: This researches were aimed at explaining the essence of the concept of edutainment, the concepts related to it, explanation of determinants determining the development of new forms of improvement off human resources in organisations and in the Armed Forces of the Republic of Poland. It was shown that edutainment is new, interesting form of educatin in so specific hierarchical organisations, such as Armed Forces. Originality/value: Author has obtained expert's opinions on the perception of war games and simulations as an effective form of improvement combining learning with elements of entertainment, i.e. as edutainment. Additional, in the theoretical research showed that edutainment is a successful form of learning and creating knowledge in innovative way.

Building professional identities of student teachers at the beginning of their vocational education and professional training provides opportunities to explore diversity of practice and provide external support. In the available literature, there is only a small number of studies that explore the professional identity of pre-service and student teachers. The main problem of this research is to examine self-reported attitudes toward student teachers’ professional identity dimensions. The second aim of the presented study was examining the reliability and concurrent validity of the Student Teachers Professional Identity Scale (Fisherman & Abbot, 1998), which was used for the first time in Serbia. The initial sample of respondents consisted of 158 students from the Faculty of Pedagogical Sciences. Results indicate that university students perceive teaching roles more as a specific job and not as a profession. They are goal-directed towards their job as teachers and perceive their practice as a part of their studies and not as a result of their professional identity development as teachers. The mentioned scale (for one-factor solution with the satisfactory criterion of confirmatory factor analysis) obtained very good reliability (α = .935) and concurrent validity indicators and values. Researching professional identity at early career stages can help educators to emphasize the multidimensionality and complexity of the teaching profession.

After so-called Arab Spring increasing number of people seeking international protection in the EU Member States became noticeable. In 2015 over 1 million people and by the June 2016 around 156 thousand refugees, displaced persons and other migrants went to Europe, either escaping from the internal conflict or searching for better social welfare. European Commission has undertaken actions in order to stop influx to Europe, e.g. donated funds equivalent to the 83 million euro to the urgent refugee relief in Greece and also supports refugees staying in Turkey, and this country, from the beginning of conflict in Syria, i.e. from 2011, received the help equivalent to the 455 million euro.The EU did not only confine itself to grant the financial aid, but also revised its primary and secondary law. The basic aim of this changes was to increase refugees’ protection regime, to ensure that co-called Dublin system, which establishes criteria for determining the Member State responsible for consideration of an application for asylum, will be more effective and fair system. It is noteworthy that one of the main factor that caused these changes were, due to their relevance, judgements of European Court of Human Rights and case law of the European Union Court of Justice in so-called Dublin cases.EU asylum and migration policy has a major impact on legislation of its Member States, including Polish legislation. Therefore, in order to adapt Polish law to European Union law, the act of 10th September 2015 on the amendment to the act on granting foreigners the protection in the Republic of Poland and some other acts, which implements to the Polish legal system all of provisions of the directive of the European Parliament and the Council 2013/32/UE, so-called procedural directive, the directive of the European Parliament and the Council 2013/33/UE, so-called reception directive, and for adjustment of Polish law to the regulation of the European Parliament and the Council 604/2013/UE, so-called Dublin III, was passed.This paper highlighted the most important amendments to the act of 13th June 2003 on granting foreigners protection in the Republic of Poland, which concern the international protection, i.e. granting an alien the status of refugee and subsidiary protection status, including obligations arising for Poland from the international law, as well as law of the European Union in this respect.
Po tzw. arabskiej wiośnie ludów zauważalny jest znaczny wzrost liczby osób poszukujących ochrony międzynarodowej w państwach członkowskich UE. W 2015 r. ponad milion, a do czerwca 2016 r. około 156 tys. uchodźców, uchodźców wewnętrznych i innych migrantów udało się do Europy, uciekając przed konfliktem wewnętrznym lub w poszukiwaniu lepszych warunków bytowych. Komisja Europejska podjęła działania mające na celu zahamowanie napływu migrantów do Europy, np. przeznaczyła środki w wysokości 83 mln euro na pilną pomoc dla uchodźców w Grecji, wspiera także uchodźców przebywających w Turcji, której od początku konfliktu w Syrii (tj. od 2011 r.) przekazała pomoc w wysokości 455 mln euro.UE nie ograniczyła się tylko do udzielenia pomocy finansowej, ale też dokonała zmian zarówno w prawie pierwotnym, jak i wtórnym. Ich podstawowym celem było wzmocnienie ochrony uchodźców, zapewnienie większej sprawiedliwości i efektywności tzw. systemowi dublińskiemu, który określa państwo odpowiedzialne za rozpatrzenie wniosku azylowego. Należy także podkreślić, iż istotnym czynnikiem determinującym te zmiany były orzeczenia Europejskiego Trybunału Praw Człowieka oraz TSUE w tzw. sprawach dublińskich.Polityka UE w dziedzinie azylu i imigracji w istotnym stopniu wpływa na ustawodawstwo państw członkowskich, w tym Polski. W związku z tym, w celu dostosowania prawa polskiego do aktów prawa unijnego, uchwalono ustawę z dnia 10 września 2015 r. o zmianie ustawy o udzielaniu cudzoziemcom ochrony na terytorium Rzeczypospolitej Polskiej oraz niektórych innych ustaw, która dokonuje wdrożenia całości postanowień dyrektywy Parlamentu Europejskiego i Rady 2013/32/UE (tzw. dyrektywy proceduralnej), dyrektywy Parlamentu Europejskiego i Rady 2013/33/UE (tzw. dyrektywy recepcyjnej) oraz dostosowuje przepisy krajowe do przepisów rozporządzenia Parlamentu Europejskiego i Rady 604/2013/UE (tzw. Dublin III).W artykule przedstawiono najważniejsze zmiany wprowadzone do ustawy z dnia 13 czerwca 2003 r. o udzielaniu cudzoziemcom ochrony na terytorium Rzeczypospolitej Polskiej, dotyczące ochrony międzynarodowej (tj. nadania statusu uchodźcy i przyznanie ochrony uzupełniającej), z uwzględnieniem zobowiązań wynikających dla Polski z prawa międzynarodowego i aktów prawa unijnego w tym zakresie.

Celem artykułu jest przedstawienie konsumpcji prywatnej w Korei Południowej oraz wykazanie, że jej charakter jest m.in. efektem przyspieszonego rozwoju w drugiej połowie XX wieku. Analizie poddano przyczyny niskiego poziomu konsumpcji prywatnej względem PKB i niskiej dynamiki wzrostu w ostatnich latach. Ponadto porównano strukturę wydatków konsumpcyjnych gospodarstw domowych w Polsce i Korei i wyjaśniono podstawowe różnice. Szczegółowo omówiono wysoki poziom wydatków na restauracje i hotele, edukację, ochronę zdrowia i łączność, wykazując, że wynikają one z szybkiego tempa życia w Korei, powszechnego pędu za karierą i nowoczesnością.
The article describes the dynamics and character of private consumption in South Korea. The author argues that the patterns and low growth rate of Korea’s consumption habits are to some extent influenced by the rapid economic growth the country went through in the second half of the 20th century. She discusses the low volume of imports of consumer goods and the Korean passion for luxury goods. The article includes a comparison between consumer spending in Korean and Polish households, highlighting spending on hotels and restaurants, education, healthcare, communication, etc. The author explains that Korea’s high expenditure in these areas are linked to a fast pace of life, career-orientation and fascination with modernity, typical characteristics of this fast-developing nation.

As human medicine is developing at a galloping pace, continuously offering new medical products, diagnostic methods and preventive programmes, there is almost no time gap between their creation and application in medical practice. All these biomedical achievements are primarily intended to improve public health and the patient’s quality of life and health. Hence, it is important to define potential risks, side effects, and unwanted outcomes when applying a medical product/treatment before integrating it into healthcare. Unlike any other product/treatment intended for human use, medical products/treatments require prior clinical testing on human subjects (sick or sound). The authors of this paper have restricted their scientific interest to the participant (human subject) of a clinical study as one of the core elements of a clinical investigation, representing at the same time its means and its aim. By analyzing relevant international as well as national legal rules and ethical principles of the Republic of Srpska related to the participation of humans in clinical studies, it will be concluded that the participants’ safety and right to self-determination, integrity, and autonomy manifested through their independent right to either consent or refuse to participate in a clinical study supersedes the interests of science or society. However, clinical trial-related statistical data obtained from randomly chosen healthcare institutions in the Republic of Srpska will show certain derogations from prescribed ethical policies. Considering this fact, the authors have paid special attention to thematising the ethicality of recruiting participants for a clinical study based on partial or no information related to the purpose, methods, potential risks and side effects of the investigation in the name of the greater good for humanity. Such practice has accentuated the discretionary powers of ethical review committees on the one side and the uncertainty of the right to informed consent on the other.

The article considers the issues of applying ground penetrating radar (GPR) technologies for engineering purposes concerning subsurface research. It describes the field of application of GPR research during road construction and operation and the advantages and disadvantages of this type of engineering survey. It presents comparative data on the accuracy (inaccuracy) of existing GPR control methods applied to determine the thickness of the monolithic pavement layers in Europe, CIS, and the USA. The main provisions of the GPR survey procedure are described, including four main stages: the analysis of initial materials of surveyed section and equipment preparation; GPR survey; geological verification; processing and interpreting of radargrams; and the preparation of a report. Geophysical works were performed using the geo-radar of the OKO series as part of the road measuring complex DVK-05 on the section of the Astana-Petropavlovsk A-1 highway with cement concrete pavement and on the section of the R-12 "Kokshetau - Atbasar" with asphalt pavement. The example of a radargram and the core sample of a cement concrete pavement taken during geological verification of the thickness of a monolithic layer is presented. Graphs of variation in the thickness of pavement layers by radargrams of longitudinal passages in the indicated road sections with the assumptions about the nature of the heterogeneity of the obtained values are given. The obtained results on the thickness of monolithic layers (cement concrete and asphalt concrete) were assessed on the criteria of quantitative deviation from the required standard value. Recommendations were provided to address positive deviations in the thickness of monolithic pavement layers at various stages of the road survey.

In the period between the two World Wars, Turkey played quite an important role in the security system of the Second Republic of Poland, especially after the May Coup in 1926. Poland promoted the establishment of the Central European Bloc, which in some variants would also include Turkey. Furthermore, the state played an important role in the Polish Promethean politics because it had borders with the Caucasus, and in addition there was the large Caucasian emigration. As early as in the 1920s Poland initiated intelligence cooperation with Turkey against the USSR, as a result of which Polish intelligence missions operated in the Turkish territory and Turkish intelligence officers underwent specialized training in Poland. The more Turkey approached the Western countries before the outbreak of World War II the more this cooperation intensified.

The first constitution of the Ottoman-Turkish Empire was adopted in 1876 – the Kânûn-ı Esâsî (Eng. Fundamental Law). In its history, Turkey has had four constitutions. They were adopted in 1921, 1924, 1961, and 1982, with the latter being presently in force. Nowadays, the creation of a new constitution is the main issue on Turkey’s political agenda. The government of Turkey and Mr. Recep Tayyip Erdogan want to amend the constitution, and envisage creating an executive presidential system (Tur. Başkanlık sistemi), similar to that of the Russian Federation and the United States. Critics are concerned about what Recep Tayyip Erdogan’s motivation may be. This article analyzes the historical roots of the constitution, its amendments, the presidential system in Turkey and the arguments of the Republican People’s Party (CHP) and Peoples’ Democratic Party (HDP) against the adoption of a presidential system. The key issues that the authors address are the changes that could be made under Turkey’s new constitution and whether all political power would be concentrated in president’s hands.

Abstrakt angielski: The article discusses relations between labour (working people) and capital (businessmen, employers) from the perspective of the Constitution of the Republic of Poland. The notion „labour” in the Constitution denotes any gainful employment done by man for another subject, regardless of the legal basis of doing it. By capital we mean the owners as well as subjects of other property rights to the means of production performing business activity using hired labour. This activity requires cooperation between these two factors, but at the same time there occurs a natural conflict of interests between them. According to Art. 20 of the Constitution, the Polish economic system, defined as “social market economy, is based on private property and freedom of business activity as well as on solidarity, dialogue, and cooperation of social partners (i.e. of labour and capital). The principles of cooperation between labour and capital in the form of prognoses and making collective agreements are defined by Art. 59 of the Constitution. The Constitution protects “capital” by special protection of private property (Art. 21 and Art. 64) and by freedom of business activity (Art. 20 in conjunction with Art. 22). It also protects labour, stating in Art. 24 that “Labour is under protection of the Republic of Poland. The State supervises the conditions of performing labour”. Labour protection, i.e. protection of working people is justified mostly by the fact that people earning money for living by working for another subject they are economically dependent on, have weaker economic and social position, which may lead to their exploitation. The duty of the State is to counteract exploitation, which is mostly done by means of semi-imperative rules of labour law and ruling implements of supervision of observance of these rules by the employers. The principle of labour protection from Art. 24 of the Constitution has been developed in its other resolutions concerning labour freedom, minimum remuneration for work (Art. 65), the rights to safe work conditions and to recreation (Art. 66). The Constitution assumes cooperation between labour and capital, trying to preserve balance between the interests of both parties.

According to the Law on elections of the President of the Republic of Uzbekistan the most important guarantees for adhering to and ensuring universally recognized international principles of electoral law are: First, conducting transparent and open, free and genuine, fair elections (art. 5, Law); Second, organization and conduct of elections of the President of the Republic of Uzbekistan by independent electoral commissions (art. 4, Law); Third, state financing the elections of the President of the Republic of Uzbekistan and electoral campaign of candidates (art. 6, Law); Fourth, state informational support to elections of the President of the Republic of Uzbekistan and pre-election agitation (chapter IV, Law); Fifth, participation in elections of the President of the Republic of Uzbekistan by national, international and foreign observes (art. 5, Law); Sixth, appealing and responsibility for violation of legislation on elections of the President of the Republic of Uzbekistan (art. 7, Law); Seventh, taking non-discrimination measures (art. 2, Law).

Making optimal decisions in the context of economic integration with the European Union requires a creation of the harmonized information system within the framework of the Eastern Partnership. Therefore, the official statistics plays a more important role in questions related to improvement of statistical methodology, establishment of information resources, development and implementation of the common standards of statistical data provision and sharing. It is evident that such an information system must be created with consideration for capacities of national statistical systems of the Eastern Partnership member countries. Presently, the cooperation between the National Statistical Committee of the Republic of Belarus and the Statistical Office of the European Communities has become fairly stable. The Belstat regularly provides the statistics on the following topics: foreign trade, demographics and annual data reflecting socio-economic development of the country (Eurostat questionnaire for countries with economies in transition). The global assessment of Belarusian statistics, carried out in 2007 by Eurostat, showed that Belarus has a comprehensive, consistent, and well established statistical information system which includes all statistical domains allowing for provision of comparable data in most areas. One of the possible directions for developing the information sharing and creation of the harmonized information system is the use of SDMX international standards (sharing of statistical data and metadata) which are used in the European Statistical System and define a general information model, technical specifications and formats of structured aggregated statistical data and metadata. Today, within the framework of the State Programme of Creation of the Integrated Information System of State Statistics of the Republic of Belarus, organizational and technical solutions designed to maintain a common metadatabase and a summary information database are under development, with XML format used for data presentation.Based on Eurostat’s experience of development and implementation of standards, the creation of the harmonized information system within the European Partnership must include stages for analysis of national information systems, employed approaches to metadata structure description, definition of techniques for data conversion in order to meet requirements of technical part of the standard, development of appropriate software for conversion. It is evident that the creation of the harmonized information system within the framework of the Eastern Partnership, first of all, requires a detailed coordination between statistical offices of the programme’s member countries.

In the group of Central Asian countries, the Republic of Kazakhstan appears to be scientifically best communicated with Europe. Thus it has raised an increasingly strong interest – also on the part of comparative law researchers. The subject matter of this article is an attempt to reform territorial administration and to establish territorial self-government in Kazakhstan. The reforms have not been implemented without any resistance or mistakes, it is important, however, that the need to change and modernize local government structures is discerned. The debate over the constitutional reform of the local political system favours the construction of social awareness of the fact that a clear distinction between the territorial government administration and territorial self-government as well as the latter’s independence, determines the construction of civil society and democratization of social life.

The aim of the current article is to examine the main peculiarities of public diplomacy of Poland in Eastern Partnership countries. The main fields of Polish public diplomacy realization in those countries, among which are the promotion of democracy values, informational propaganda, cultural and science diplomacy, sustention of Polish diaspora, will be analyzed. The article outlines the level of Poland’s promotion and branding activities in the framework of multilateral cooperation. The most important projects, initiatives and educational programs that represent Polish culture and traditions in Eastern Partnership countries will be examined. The research will show which of the Eastern Partnership countries are highly or less involved in the programs of Polish public diplomacy realization.

The sixtieth anniversary of entering into diplomatic relations between Republic of Poland and Democratic People’s Republic of Korea inclines to draw up a balance sheet. Korea is located far away from Poland, in a very different civilization circle, the neo-Confucian one. It has 5 thousand years of history; the legendary Tangun in a year 2333 B.C. has founded the first Korean state Kodzoson. The history is generally difficult, numerous invasions of grand neighbors (China, Japan). The Korean chronicle compared Korea to a prawn swimming in between of two whales. Such difficult history is also the attribute of Poland. Poland was also a subject of partitions, numerous invasions of the neighbors. Polish and Koreans have common national features: pride, inexorability and independence.
