This contribution deals with the position of the Slovak Republic in relation to safe harbours in transfer pricing from de lege lata perspective and from the perspective of existing application practice of tax authorities in Slovakia. The main aim of the contribution is to confirm or disprove the hypothesis that the existing safe harbour framework in the Slovak Republic is in line with the OECD recommendations in the Transfer Pricing Guidelines for Multinational Enterprises and Tax Administrations. Methods of analysis and synthesis and of comparative legal method were employed. The results indicate that though de lege lata the Slovak law contains certain features which might be described as safe harbours, essentially relieving certain taxpayers from the obligation to have contemporaneous transfer pricing documentation, a safe harbour stricto sensu was not identified. However, in the practice of Slovak tax authorities there seem to be routinely accepted safe harbours with respect to low value-adding intra group services. Moreover, there seems to be an excessive reliance on transactional net margin method which in practice may lead to establishment of a de facto safe harbour. The authors argue that such practice seems to be in direct contradiction to OECD recommendations, poses a significant risk of becoming a target of safe harbour shopping and should be reconsidered.

The emergence of the current forms of functioning of the economy has been conditioned mainly by factors such as technical, technological and informational innovations, but also by a change in the perception of values in society (e.g. attitudes towards the environment). One of the new (current) economic forms already implemented is the sharing/collaborative economy. The paper aims at identifying the meaning of the content of the term sharing/collaborative economy as well as the positives and negatives of the sharing/collaborative economy model in the current hyper-competitive globalisation environment (e.g. risks for standard economic sectors such as transport, accommodation and food services). The paper also includes a partial prediction of the impact of the COVID-19 pandemic on the functioning of the sharing/collaborative economy.

This paper deals with the issue of participatory budgeting as one of the newer tools of political participation. Its aim is to characterise the current situation in the Slovak Republic at two levels of territorial self-administration (self-governing regions and municipalities). To reach defined aims, it monitors the existence of legislative settings at the national level, the existence of individual settings at the observed levels and subsequently the practical application of the participatory budgeting itself. Procedures associated with the study of documents are used in article; the obtained data are summarized, described and compared mutually. In addition to laws and regulations issued by self-government units, the source of data is also the regional and local self-government units’ official websites. In the absence of one universal definition of the participatory budgeting rules at the national level, the findings have shown that there are relatively extensive conditions for implementing participatory budgeting with its specific settings defined by self-administrations. In Slovakia, participatory budgeting is only gradually introduced into the internal rules, which reflects a relatively small number of municipalities or self-governing regions, which ultimately use it effectively.

The fundamental rights and freedoms, as the highest values in a democratic society, need to be adequately protected, thus states create the mechanisms to protect them. This mechanism of protection of fundamental rights and freedoms also includes the police, especially the Police Force, whose primary task is to protect the life, health, fundamental rights and freedoms of citizens and individuals in the Slovak Republic. The role of the Police Force defining the basic aspects forms the content of this study, with a further focus on the tasks performed by the police. Following the above, the study focusses on the activity of police officers, carrying out service actions and interference with fundamental rights and freedoms. The procedure of the police in carrying out service actions tends to be the subject of further examination due to their appropriateness and legality. This issue is considered highly serious in the society, and recently it has been a subject of not only scientific discussions in the Slovak Republic. Currently, the Academy of the Police Force in Bratislava is carrying out a research project which focussing on service actions with the cooperation of the police experts. The core material is presented in the paper, which aims to point out the basic organisation and activities of the Police Force as the authority responsible for the protection of fundamental rights. The emphasis is put on the selected issues of the police while interfering in human rights and freedoms. Chronologically, from general to specific matters, the paper introduces fundamental rights and freedoms and the police interventions into this area. Theoretical research is supplemented by practical cases, conclusions and possible recommendations for the police practice by the use of several methods, in particular analysis, abstraction and deduction.

Research background: SMEs make up an important segment of the economic system, not only in the national economy, but also throughout the EU, and their importance continues to grow. SMEs in Slovakia, according to the latest data of the European Commission, represent 99.9 per cent of all enterprises, constitute 70.7 per cent of jobs, and 61.2 per cent of value added in the economy. However, they are often confronted with market imperfections. SMEs frequently have difficulties in obtaining capital or credit, particularly in the early start-up phase. Their restricted resources may also reduce access to new technologies or innovation. Authors often deal with the impact of SME financing on their development. Madrid-Guijarro et al. (2016), Lee et al. (2015) claim that SMEs have difficulty in funding innovation and the worsening in general credit conditions has been more pronounced for non-innovative firms. Purpose of the article: The main objective of the conducted research was to analyze the conditions for the development of small and medium enterprises (the SMEs sector) in Slovak Republic, whereas the specific objectives were: (1) to determine the terms for gaining external sources of financing for the development of SMEs, (2) to examine the resources for innovation development in the SMEs sector, (3) to find out if SMEs are considered to be a competitive advantage. Methods: The research was conducted in the Slovak Republic in 2016. Participants were 193 Slovak companies that were classified as SMEs by the size class of employment. The research tool used for the study was the own questionnaire consisting of 38 questions and the demographics. The structure of the questionnaire allowed the authors to identify the group of questions concerning the most important conditions for the development of the examined sector referring to the business environment. The results were processed by chi-square method. Findings & Value added: On the basis of the conducted research of the sector of SMEs , it can be concluded that a large group of companies have difficult access to external sources of financing and this refers both to the access to the European Union funds, grants, bank loans and other instruments of the financial market. However, it occurs that: (1) in Slovakia, the smaller the enterprise, i.e. the fewer employees it hires, the easier the access to external sources of financing, (2) innovative projects are realized from company profits or a loan, (3) problems in Slovakia in accessing external funds due to the complexity of the process of approval of applications and documents and strict criteria for the assessment of financial capacity.

This article discusses the internal situation of the Slovak Republic in the years 1994-1998, the period in which the country was governed by the coalition of Movement for Democratic Slovakia, the Slovak National Party and the Slovak Workers’ Association, and the prime minister was Vladimir Meciar. The main objective of the research was to analyse the actions undertaken by the coalition government in the context of violations of civil and political rights and freedoms, which could indicate an authoritarian way of exercising power and the dismantling of a democratic state of law. In the analysed period, the role of the parliamentary and nonparliamentary opposition was marginalised, the role of the media limited, the rights of national and ethnic minorities violated. There was also an ongoing, sharp conflict between Prime Minister Vladimir Meciar and President Michal Kovac. The effect of this governance was the union of almost all political forces and seizure of power after the elections in 1998. In order to answer the research questions, the author used the method of institutional and legal analysis, decision analysis and the statistical method. The research confirmed the hypothesis that, against the background of other Visegrad Group countries, the Czech Republic, Poland and Hungary, in the case of Slovakia there were many instances of human rights violations in the period analysed. This led to the drastic deterioration of bilateral relations with many countries and the slowdown of Slovakia’s accession to the North Atlantic Alliance and the European Union.

In one of the many definitions of public administration it was stated that it is the fulfillment of individual and collective needs of citizens, resulting from the co-existence of people in society, realized by the state and its dependent organs. One of the needs of an individual is the need for safety. Ensuring the safety of citizens is realized by the public administration, due to its service to the society as an executive apparatus possessing a democratic mandate of political power, in service of the law created by said organs. A particular role in the area of defence belongs to authoritative administration, which performs tasks including reversing risks and removing dangers, including the realization of tasks and undertakings aimed at military preparation in case of war. The aim of the following article is to present the tasks and competences in the area of protecting the President, the government, government administration officials on duty and local self-administration of the Slovak Republic. Various methods have been used to reach the pre-determined goal, primarily the method of document investigation, which made it possible to gather, sort, describe and scientifically interpret the legal acts of the Slovak Republic regarding defensive matters.
