This study examined rural and urban Chinese adolescents’ (aged 13–19 years, N = 395) attitudes toward children’s self-determination and nurturance rights, and how these attitudes relate to various dimensions of socialization in their family and school environments, including perceptions of parental and teacher autonomy support and responsiveness and family and school democratic climate. Relations between these variables and psychological well-being also were examined. Perceived parent and teacher autonomy support and responsiveness and democratic climate differentially predicted attitudes toward each type of right and were positively correlated with adolescents’ psychological well-being. Our findings suggest that environments that are structured more democratically and that are responsive to children’s autonomy needs contribute to their psychological health and well-being in diverse cultural settings.

In this paper, it will be shown that Hegel’s philosophical thematisation of subjective freedom has given a fundamental contribution to the historical innovation of modernity, which regards not only human rights, but also norms and values. Besides, it played an important role concerning the cultural transformation, i.e., the process of the realization of the historical innovation oriented towards the ideals of modern freedom. To show this, the author will focus on some passages from Hegel’s Philosophy of Right of 1820, in which Hegel regarded subjective freedom as universally-normative and, at the same time, as socially and historically contextualized (situated, respectively). Hegel, namely, explicates modern freedom in its ideality and moral normativity, addressing its realization in particular forms of life. Marriage, for instance, as it will be shown towards the end of this contribution, exemplified as the right to particularity, is the normative basis of modern subjective freedom. Tensions and collisions will permanently challenge this type of freedom and also require permanent (and self-defeating) efforts invested in striving for a (too contextualized and situated) „reconciliation“ (in Hegel´s terms Versöhnung).

In 1995, Professor Krzysztof Skubiszewski added a Dissenting Opinion to the East Timor Judgment, wherein the ICJ declined jurisdiction in a proceeding started by Portugal against Australia for its having concluded the East Timor Gap treaty with Indonesia, in blatant violation of the East Timorese’s right to self-determination. Ad-hoc Judge Skubiszewski posited that the Court should have accepted jurisdiction and he presented a series of convincing arguments for this proposition. In 2019 the ICJ rendered an Opinion in the Chagos Islands case. The fact that the ICJ accepted jurisdiction in this case demonstrates that an impressive development has taken place since 1995, one whereby many of Professor Skubiszewski’s requests have been implemented. At the same time however, the Chagos Opinion is not fully satisfying as it neglects, to a considerable extent, the human rights issue. This contribution shows that Skubiszewski’s Dissenting Opinion would have provided guidance also for these questions and that it remains as topical today as it was in 1995.

The paper concentrates on the right to self-determination of indigenous peoples on the basis of the Nisga’a Nation. The author analyzes the most important provisions of the Nisga’a Final Agreement, in particular those envisaging self-determination of the Nisga’a Nation. Then the author briefly examines the Nisga’a Constitution which may be regarded as a means to implement the Nisga’a Final Agreement. It shows how the Nisga’a selfgovernance model fits into the provisions on self-determination of indigenous peoples. The thesis of this paper is that the Nisga’a self-governance is consonant with international legal standards expressed in the UN Declaration on the Rights of Indigenous Peoples. Nisga’a selfgovernment model is much more than just cultural autonomy: it actually amounts to political autonomy. This subject is worth exploring because it may serve as a pattern to be followed with reference to other indigenous peoples, not only in Canada.

In contemporary public international law, it is increasingly common that in many countries of the world and Europe, political representatives of the peoples are calling for an inalienable right to the external self-determination of the peoples involving secession to try to achieve their independence and autonomy, forming their national states to the detriment of already existing countries in which they are currently living. However, this may cause destabilization and wars in many complex multiethnic states and the European Union. Therefore, the Aland Islands and Quebec cases are extremely important for today’s understanding of the exercise of the right to self-determination of the people in contemporary public international law, in particular as the International Court of Justice in The Hague and the domestic courts invoke them as precedents to address all future cases of reference to the right of the people to external self-determination involving secession. Based on those cases, it has developed that the issue of secession is the question of the internal legal order of each sovereign country, which should deal with this issue through its constitutional legal order, and contemporary public international law should deal with its consequences. In connection with this, it is necessary to investigate and offer answers that will highlight possible abuses of the right to self-determination of all peoples as a collective human right in contemporary public international law. Such unlawful conduct may result in adverse legal consequences, in particular, the violation of basic principles of public international law, including the principles of territoriality and sovereignty of the states, the distortion of world peace and order, economic progress, the rule of law and the pursuit of basic human rights and freedoms, as well as other collective human rights, which may ultimately be the cause of provocation and lead to international and civil wars.

The article deals with the issue of limits of the criminalisation of assisted suicide. The reason for addressing this issue is the finding of the Austrian Constitutional Court on 11 December 2020 (ref. G 139/2019-71), in which the Austrian criminal provision penalising assisting another person to commit suicide (Section 78 of the Austrian Criminal Code) was unexpectedly declared unconstitutional. The Court not only confirmed that everyone’s right to autonomous and independent decision-making in matters of personal life includes the decision as to the time and manner of a dignified death, but also decided whether an individual’s right to selfdetermination includes obtaining the assistance of another person to undertake a suicidal act. The resolution of this issue is of universal significance – including for the Polish legal order, in which assisted suicide is currently penalised without exception. The aim of the paper is not only to provide an overview of the grounds for the finding and explain the limits of criminal liability under the revised Section 78 of the Austrian Criminal Code, but in particular to resolve the question of the admissibility and legitimacy of decriminalising assistance to suicide to the extent adopted in Austrian law, which may also provide some inspiration for the Polish legislator. The study uses a formal-dogmatic method of research, which is determined by its subject. In the final conclusions it was indicated that the Austrian legislator cautiously liberalized the prohibition of assisted suicide, which, however, is not without some controversy.

This article adopts the premise “first in time, first in right” to bring Indigenous knowledge about the Colorado River Basin and the natural world more broadly out of the mainstream’s obscurity to reposition these perspectives at the foreground of the region’s water cultures. To initiate what is in essence a decolonization of Colorado River Basin water knowledge, I examine texts representing various tribal affiliations and genres to consider how their particular use of story engages the historic and ongoing environmental injustices they have faced and continue to negotiate in their fight to preserve their sacred lands, identity, and access to reliable, clean water. Such a decolonization occurs through these texts’ use of narrative to work within and against the scientific and instrumental discourses and their respective genres that have traditionally constructed and dictated mainstream Colorado River knowledge and activity. My treatment of narrative within the Ten Tribes Partnership Tribal Water Study (2018) and the Grand Canyon Trust’s “Voices of Grand Canyon” digital project (2020) sheds greater light on the essential relationships the Basin’s nations and tribes have with the Colorado River. Through these counternarratives to the West’s dominant water ideologies and cultures, the Basin’s tribal nations draw attention to past and ongoing struggles to secure equitable water access while amplifying their resilience and determination that defines their calls for environmental justice.

The author, in his paper, pays close attention to a presumed consent and wider a right to self-determination, which is meant as an act of decision in a transplantology context. Polish legislation of transplantation from 2005 in article 4 lists four reasons for transplantation of organs: post-mortem autopsy, therapeutic, academic and didactic. Simultaneously, article 5 states that transplantation of organs for a therapeutic reason is possible when the deceased person distinctly hadn’t disagreed for such an action. If there are no clear objections against transplantation, and the deceased person does not carry a note of which could suggest otherwise, the physician can legally assume that the person had agreed for an organ sampling (from a presumed consent). A phrase “for a therapeutic reason” evidently points out that donor’s disagreement is only valid in a face of organ, tissue and cell harvest for a medicinal cause. However, organs sampling: post-mortem autopsy, which is both academic and didactic as, does not fall under the same regulations, as it will be conducted regardless of presence or lack of permit of family or the will statement of the deceased one. On the other side, every organ sampling for academic and didactic reasons, requires a separate declaration from a donor as lack of their disagreement is not sufficient in this case. To resolve this forensic-legal deadlock, it is suggested to extend a presumed consent of organs sampling.
Autor w swoim artykule zwraca uwagę na problem zgody domniemanej, i szerzej prawo do samostanowienia sięgającego poza granice życia człowieka, w kontekście celów transplantacji. Podstawowy akt prawny zawierający uregulowania dotyczące transplantacji, a mianowicie Ustawa z dnia 01.05.2005 r. o pobieraniu, przechowywaniu i przeszczepianiu komórek, tkanek i narządów (Dz. U. z 2005 r. Nr 169, poz. 1411), wylicza cztery cele, dla których mogą być pobierane komórki, tkanki i narządy ze zwłok ludzkich: diagnostyczny, terapeutyczny, naukowy i dydaktyczny. Zgodnie z art. 5 ust. 1 „pobrania komórek, tkanek lub narządów ze zwłok ludzkich w celu ich przeszczepienia można dokonać, jeżeli osoba zmarła nie wyraziła za życia sprzeciwu”. Zapis ten jest przykładem tzw. zgody domniemanej, na podstawie której przyjmuje się, iż dany człowiek za życia wyraził się aprobująco o możliwości ofiarowania swoich organów, a więc faktycznie nie złożył odpowiedniego sprzeciwu, podważającego domniemanie zgody. Sformułowanie „w celu ich przeszczepienia” wyraźnie wskazuje, że instytucja sprzeciwu ma zastosowanie jedynie w przypadku pobierania tkanek, komórek i narządów w celach leczniczych. Dawca nie ma jednak prawa do wyrażania ewentualnego sprzeciwu wobec pozostałych celów: diagnostycznego, naukowego i dydaktycznego. W celu rozwiązania swoistego impasu prawnego proponuje się rozszerzenie zakresu zgody domniemanej.

W artykule podjęty został problem załogowych misji kosmicznych w kontekście praw człowieka, przysługujących ich uczestnikom. Przedstawiony został skrócony opis prób poznania kosmosu i organizowania coraz śmielszych wypraw załogowych, co stanowiło apogeum zimnowojennej rywalizacji pomiędzy USA a ZSRR. W zakresie badawczym znalazła się w szczególności koncepcja lotu na Marsa, która pozostaje przedmiotem kilku konkurencyjnych programów, angażujących także sektor prywatny. W artykule przedstawiono prawa człowieka, które mogą być zagrożone podczas kosmicznych misji załogowych, w szczególności podczas misji na Marsa. Opisano prawo do życia, do ochrony zdrowia oraz do samostanowienia, w ujęciu aktów prawa międzynarodowego oraz prawa polskiego. W końcowej części artykułu przedstawione zostały rozważania nad dopuszczalnością prowadzenia misji załogowych w kontekście obowiązków państwa do ochrony wymienionych praw.
The article describes the problem of manned space missions in the context of human rights of their participants. A brief description of the space exploration attempts was presented, including organization of increasingly bold manned expeditions, which was the apogee of the Cold War between the US and the USSR. As part of the study, the concept of a flight to Mars was included, which involves several competing programs, with participation of the private sector. The article presents human rights that may be at risk during manned space missions, especially missions to Mars. The right to life, to health protection and to self-determination have been described, according to both international and Polish legal acts. In the final part of the article, an analysis was presented of admissibility of manned space missions in the context of state obligations to protect presented rights.
