Opis:
This paper studies the concept of “hybrid regimes”, not so much in defining and authenticating their functionality but, above all, to exhibit them as so-called “partial” constitutional concepts. Articulating the tensions, divergences, and antagonisms characteristic of these regimes, as well as highlighting the blurring boundaries between democratic systems and authoritarianism “with adjectives”, emphasizes the importance of the examined issues. The author introduces an alternative conceptualization and typology of hybrid regimes and a configurational approach. Instead of placing political regimes on a linear continuum – from authoritarianism to democracy – multidimensional solutions facilitating an alternative typology of the analyzed concepts have been exposed. The configuration approach, however, provides an analytically valuable way to evaluate and integrate hybrid regimes with other classification schemes. Such innovations, therefore, help alleviate conceptual confusion in the literature. Moreover, deepening the understanding of the concept of hybrid regimes, along with emphasizing its conceptual ambiguities and complexity – especially concerning the “politically correct” discourse on the current problems of fragile and politically unstable states – is necessary to better understand the complex and confusing nature of modern regimes of power frequently operating in the most politically unstable regions of the contemporary world.

„Political order” – it is the idea permitting to characterise and explaining processes of organizing the collective life and directing with him in the scale of the state what is the task of the system of public power. The self-government is the tool of the administration in member states of the European Union public. Thereby is posing the same factor of political order of these states. Civil society’s construction and deepening democratization requires the political life to employ broad circles of citizens for direct solving of public affairs in the local, regional and nationwide scale. The self-government is being predisposed to fulfilling the part of the factor stimulating inhabitants of territorial units under this corner from its essence (of communes ,districts, provinces – in Poland). Basic documents of the European Union and European Counsil are giving prominence to local and regional communities’ right to regulating and management strongly – for their exclusive liabilities – fundamental part of public affairs.

Artykuł dotyczy Senatu, który jest drugą izbą parlamentu Rumunii. Pokazuje, w jakim środowisku prawno-ustrojowym został on po niemal 50 latach przywrócony do porządku konstytucjonalnego państwa. Opisuje całą procedurę wyborczą, w tym sposób wyboru kandydatów na deputowanych. Ponadto wskazuje na kompetencje Senatu w zakresie oddziaływania na władzę wykonawczą i sądowniczą, a także pokazuje jego działania na arenie międzynarodowej. Przedstawia przebieg procesu legislacyjnego wraz z rolą drugiej izby parlamentu, a także opisuje jej funkcję kontrolną oraz kreacyjną. Pozwala to pokazać, że w parlamencie Rumunii panuje model dwuizbowości symetrycznej.
The article concerns the Senate, – the upper chamber of the Romanian Parliament. It shows legal and political environment in which it was restored after almost 50 years. The paper describes entire electoral procedure including how candidates for deputies are chosen. In addition, Senate’s competence in influencing the executive and judiciary and its activities on the international arena are being discussed. Role of the upper chamber in legislative process is being analyzed with emphasis on it’s control and creation function. The conclusion is that there is a symmetrical bicameral model in the Romanian parliament.

Główną myśl artykułu odnajdziemy w stwierdzeniu, iż rozważania dotyczące problemów obronności powinny zawierać, jako swój kluczowy element, interpretację pojęcia ładu politycznego. Odwołując się do modeli interpretacji przyjętych w antropologii kulturowej, teorii stosunków międzynarodowych i nauce o polityce, autor podkreśla, iż właściwe rozumienie fundamentalnych zagadnień obronności powinno oznaczać wnikanie do sfery przeświadczeń, które są związane z funkcjonującą w każdej kulturze opozycją ładu i chaosu. W centrum uwagi pojawia się pojęcie „drugiej nowoczesności”, pozwalające postawić fundamentalne pytania dotyczące dyskomfortu związanego z dekompozycją struktur nowoczesności.
The article brings to our notice important questions concerning the relationship between conceptions of defense and security and the notion of political order. In effort to embrace this topic, cultural anthropology, political science and theory of international relations are taken into consideration as important, guide-offering, domains of scientific knowledge. The bottom line, however, is shaped by the notion of understanding, belonging to the tradition of hermeneutics. The notion of “second modernity”, having a lot to do with works of Ulrich Beck, gives the article its edge.

The article examines the “foundings-beyond-origins” framework as proposed by Angélica Bernal in her 2017 book, Beyond Origins: Rethinking Founding in a Time of Constitutional Democracy. While accepting Bernal’s arguments about the prevailing vision of founding a political order, she posits that the realities of power deauthorise political origins. This form of politics proposes a model of engagement between Indigenous Peoples (IPs), nations, tribes and communities and hegemonic political orders based on self-determination, autonomy, self-government and consent. These concepts are the cornerstones of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). At the heart of this politcs is the “axiom of indigeneity”, a proposition that bases political origins on populations, customs, territoriality and time. The fact that societies that existed prior to the founding of contemporary political orders have survived the realities of power gives meaning to the idea of indigeneity.

In recent decades, sociologists have too often ignored the group level-the meso-level of analysis-in their emphasis on either the individual or the institution. This unfortunate absence misses much of what is central to a sociological analysis of community based on “action.” I draw upon Erving Goffman’s (1983) concept of the interaction order as I argue that a rigorous political sociology requires a focus on group cultures and tiny publics. Group dynamics, idiocultures, and interaction routines are central in creating social order. This approach to civic life draws from the pragmatism of John Dewey, as well as the broad tradition of symbolic interactionist theorists. Ultimately, I argue that a commitment to local action constitutes a commitment to a more extended social system.

Głównym celem niniejszego artykułu jest analiza przekształceń hiszpańskiego porządku politycznego w neoinstytucjonalnej perspektywie, uwzględniająca szczególne oddziaływanie elementu kontestacyjnego, ukształtowanego w trakcie formowania i aktywności Ruchu Oburzonych, na funkcjonowanie i zależności zachodzące pomiędzy instytucjami formalnymi oraz nieformalnymi po 2011 r. Przekształcenia reguł tworzących określony ład uznaje się za wiążące dla kierunku przeobrażeń podsystemu, obejmującego relacje zarówno pomiędzy obywatelami (poziom instytucji nieformalnych) a partiami politycznymi (poziom instytucji formalnych), jak i pomiędzy samymi ugrupowaniami. Zaproponowana w ramach tekstu zasada kontestacji pozwala na uchwycenie zmian zachodzących w społeczeństwie oraz ich konsekwencji dla tworzącego się obecnie porządku politycznego, kształtując jednocześnie podstawę dla możliwych wariantów jego konstruowania.
The main objective of this article is to analyse the transformation of the Spanish political order from a neo-institutional perspective, taking into account the particular impact of the contestation element created during 15M Movement on the functioning and the relationships between formal and informal institutions after 2011. The transformation of the rules that form a certain order is considered to be binding for the direction of reshaping of the subsystem covering relations both between citizens and political parties and between the groups themselves. The principle of contestation proposed within the framework of the text allows us to grasp the changes taking place in society and their consequences for the political order that is currently being formed.
