This study aims to examine how mainland Tanzania pension fund investments are governed and which developments can be foreseen. The literature provides ample leads for a conceptual and practical framework on pension fund investment governance. This framework is filled in along a case research design drawing upon system participant interviews. It is shown that whilst the system is gaining strength, its inherent limitations may call for change measures. The pension fund’s investments work out fine and contributors receive value for money. Also, the oversight is thought to work reasonably well. Quirks include investments limitations set by the markets and the government, and also a still low coverage, the heavy weight of the government, a load of administrative costs, employer compliance, beneficiary withdrawal, insufficient education throughout and ignorance in general. The system is governed by complex but strict controls and is being professionalised. To lower administrative costs and raise investment returns, the role of the Ministries versus the Regulator may be amended, while keeping Central Bank in the loop. The paper demonstrates that the hierarchical system engenders agency conflicts that are curbed by a trust grounded common strive for optimal financial value. In specific the paper argues that the investment governance benefits from strict controls and professionalising, especially if financial markets and government limitations are lessened

Opis:
Decision making in managing the asset and liability structure of a pension fund can be supported by stochastic dynamic optimization. We discuss our model, which is based on data analysis and forecast for the asset-side as well as a simulation model for the liability side. The core of our decision support system consists of the following building blocks : a set of securities, a pricing module based on a multifactor Markov model to derive expected returns of securities, a simulation-based model for liabilities, a carefully chosen objective function suitable for the pension fund and a stochastic optimization problem solver. We consider the use of different objectives in the model and decomposition techniques to solve the stochastic portfolio optimization problem. Our final goal is to design an efficient parallel implementation.

The pension systems in the majority of European states have been reformed because of serious changes in the demographic structure of the populations. Therefore funded pillars have been added to the pension systems. This addi-tional (to pay as you go system) pillar, created by pension funds, is manda-tory in some countries. The investments made by the pension funds influ-ence the development of financial markets and affect the situation in na-tional economies. The aim of the paper is comparative analysis of the pen-sion fund markets in selected European states in the years 2000-2013, using the synthetic measure of development.

Good governance structures have become an issue of public interest, including public pension systems. This study assesses the pension funds governance in Tanzania, with a special focus on board of trustees’ issues. The growing interest referred to, is partly because the quality and performance of the funds trustees determines the income flows to which members are entitled and promised, as well as any shortfalls thereof, that may require interventions. Our findings suggest that board of trustees play an important role for funds governance and hence performance. The pension fund structure and mechanisms in Tanzania uphold high standards. Yet, a major issue is that the board selection seems to be politically motivated and that the government claims most board seats, making conflicts of interest likely to occur repeatedly.

Membership in an open pension fund (“ofe”) is of a fixed nature and, in its assumptions, it is aimed at gathering funds for the purposes of future pension payments from a so-called “second pillar”. Thus, it may be deemed that the cessation of the membership relation in an open pension fund results only in obtaining a right to pension payments out of the funds collected in the second pillar. At the same time, analysis of provision of acts of laws regulating new pension law allows to indicate various events which result in cessation of the membership relation in ofe. Due to the lack of provisions of laws and literature directly enumerating events which result in cessation of the membership relation in ofe, this publication is aimed at filling this gap and determining the catalogue of events which result in cessation of the membership relation in ofe as well as indicating the moment when the result in the form of cessation of the membership relation takes place.

Efektywność Powszechnych Towarzystw Emerytalnych zarządzających portfelami inwestycyjnymi OFE oceniana jest zazwyczaj poprzez porównanie różnego rodzaju wskaźników finansowych i ekonomicznych, porównanie wartości portfela inwestycyjnego czy poprzez zmiany wartości jednostki uczestnictwa. Porównania te są najczęściej cząstkowe i brak jest porównań wielowymiarowych. Artykuł zawiera próbę badania efektywności Powszechnych Towarzystw Emerytalnych przy wykorzystaniu dwóch alternatywnych metod analizy granicznej tj. parametrycznej metody Stochastic Frontier Analysis (SFA) i nieparametrycznej Data Envelopment Analysis (DEA). Dla każdej z metod zostały ponadto zastosowane dwa alternatywne modele. Wykonano również porównania efektywności poszczególnych PTE z perspektywy klienta i perspektywy samego towarzystwa jako podmiotu gospodarczego. Badania wykazały że istnieją różnice w efektywności PTE w zależności od wartości zarządzanego portfela a także w zależności od przyjętej perspektywy pomiaru.
Effectiveness of the Universal Pension Fund Societies which are managers of the Open Pension Funds are usually evaluated by comparing the different types of financial and economic indicators; comparing the value of the investment portfolio or by changing the value of the units. These comparisons are mostly incomplete and also there are no multi-dimensional comparisons. The article attempt to check the effectiveness of the Universal Pension Fund Societies using two alternative methods of frontier analysis: the parametric Stochastic Frontier Analysis (SFA) and nonparametric Data Envelopment Analysis (DEA). Two alternative models were used for each of the methods. Comparison of the effectiveness of Universal Pension Fund Societies from both, the customer's and the company's perspective were also done in the article. The research have shown that there are differences in the effectiveness of the Universal Pension Fund Societies based on value of portfolio as well as the perspective used in the measurement.

In pension sector, many regulations aimed at maximizing the interests of pension plans members and their beneficiaries, were introduced. Despite this, pension institutions are faced with the same governance problems as modern corporations. The basic problems arise from delegation of decision making powers and creation of agency relationships. The primary objective of pension fund governance is to minimize the potential agency problems or conflicts of interest arising between the pension fund stakeholders and its managing body. Problems, that may affect the safety of retirement savings and pension liabilities. This article attempts to identify the problems faced by governance in voluntary pension funds managed by general pension societies in Poland.

The author analyses the position of a candidate for member of a governing body in an entity supervised by the Polish Financial Supervisory Authority (PFSA) and discusses the related problems. The aim of the article is to identify the area of an increased risk level in financial institutions in the process of appointing members of the governing bodies of supervised entities. The PFSA assumes that the selection of the candidates for members of the governing bodies in Pension Fund Companies may be carried out by either the management board or the supervisory board. This leaves a large space for the activity of the boards. The management board can gain influence over the course of these proceedings. When the selection is conducted by the supervisory board, the risk is significantly reduced. The second aspect addressed therein concerns the position of a candidate for member of the governing bodies in supervised entities in legal proceedings. In jurisprudence it has been established that a candidate is to be treated as a party to the proceedings. The administrative courts found that inadmissibility of a candidate as a party would violate Article 77(2) of the Constitution by closing the judicial path for the candidate and preventing them from asserting protection of their rights and freedoms. Despite this, the Act of 21 July 2006 on Financial Market Supervision (Journal of Laws of 2020, item 2059, as amended) was amended in April 2021 to the effect that a candidate was not a party to the proceedings thus enhancing the risks, including conflicts of interest. The effect of these provisions has been instrumentalisation of those to whom a great deal of responsibility is entrusted – if the approval of the PFSA is obtained. The PFSA's decisions may affect the career path of candidates. In certain cases, they may even 'block' it, leaving little room for defence and narrowing the possibilities of adjusting the competence level to the positions held. There is also no timeframe for the PFSA’s decision. The risks associated with such situation have been described in the article.

The structure of the pension system is expressly indicative of the impact of individuals’ financial parameters on the pension rates. The legal guarantees of availability of insurance data and information are embodied in the obligations imposed on the operators active in the mandatory part of the system (National Insurance Authority and open pension funds) to verify and transmit information on the situation of pension policyholders and pension fund members. The information provided by the ZUS primarily concerns the factors that affect the amounts of future pension benefits. The most important information that participants receive from their pension funds, then, concerns the account balance and the financial results achieved by the fund of which they are members. An analysis of the existing regulations shows that the insureds’ right to information from both the ZUS and OPFs needs extending. Transparency of certain information concerning the OPF is conducive to developing a better understanding of the pension plan, ability to make the right decisions in respect of participation in the OPF, and increased activity within the optional private pension insurance schemes. This may be perceived as the State’s deliberate and systemic measures designed to develop the public’s insurance awareness.

Legal limitations in Poland regarding activities of retiring funds exclude their direct investing in immovables, which leads to the decreasing of their diversification options, and consequently – in the authors’ to this paper opinion – to increasing potential investment risks. By means of some quantitative methods the authors analyze the effectiveness of investment portfolios of the retiring funds in Poland. The purpose of the present research is to achieve an answer to the question whether adding immovables to the investment portfolios of the Polish retiring funds would result in their better diversification and effectiveness.
