Opis:
Germany has notable land management and planning traditions. As part of their formal responsibilities, local governments have powers to regulate and structure their areas and landscapes through land-use planning. They use it to prepare and guide land-uses for development purposes in Municipalities. This study presents the Bavarian experience of land-use planning in relation to public administration. The study emanated from a research conducted at Technische Universität München and funded by the GERMAN ACADEMIC EXCHANGE SERVICE. It uses data from semi-structured interviews with land management experts, Mayors and public administrators at different levels of public administration. The authors used these interviews to discern the scope, nature and role of public administration of land-uses at either the local or regional scale. It led to four findings. The two major ones being that: first, based on good governance principles, there are contradictions in the administration of land-use planning in Germany. Second, there are no harmonised criteria for assessing the efficiency and effectiveness of land-use planning administration. By way of recommendation, it suggests an Efficiency Assessment Criteria and Method of land-use planning through public administration, among others suggestions.

This report is a comprehensive study of Norwegian and Polish spatial planning systems. It focuses on land-use part of planning and shows basic similarities and differences between those two planning policies. The aim of this report was to study and analyze the planning systems in both countries. During the preparation of this report, authors posed the following questions: – What kind of relations are there between all the planning levels stated in the legislation procedure as well as in practice? – Which planning documents concern land-use management? – What are the main trends of spatial management in urban areas? – How in practice does public participation in spatial planning process look? During the research authors attempted to answer those questions by using different methods. Firstly, professional documentation has been investigated. The main data sources were planning legislation and documents (including maps), as well as professional literature. Secondly, informal interviews were conducted. Fifteen interviews with planning researchers and with local and regional planners were carried out in Norway. Interviews were informal, however, they were based on previously prepared key-words list. Besides the analysis of the planning system in both countries, the report also includes two case-studies. In this report Oslo and Kraków were taken into consideration. In the report an emphasis was put also on environmental issues in spatial policy, public participation and privatization process of planning.

Problematika návrhu vysokorychlostních tratí je velmi aktuálním tématem, zejména z důvodu napojení ČR na evropský systém VRT. Problematika návrhu se však netýká jenom přípravy technologických částí stavby. Nejdůležitější je příprava území aby navržená stavba mohla být naplánována, tzn. je nutno uvést do souladu navrženou trasu s dotčenými územními plány, posoudit vliv na životní prostředí a další faktory. Součástí článku je uplatnění těchto hledisek při posouzení návrhu modelové trasy VRT v úseku Praha – Drážďany, což ve výsledku bude znamenat propojení letiště Václava Havla Praha a letiště v Drážďanech.
The issue of the design of high-speed rails becomes very current theme, especially because of the connection of the Czech Republic to the European system of HSR. The issue of the design is not only about the preparation of technological parts of the construction. The most important thing is the preparation of the site to enable planning of the design of the construction. It is necessary to bring the designed route into line with land use plans, to assess the impact on the environment and other factors. The article includes the application of these aspects when assessing the design of the HSR route model between Prague – Dresden. This will mean linking the Vaclav Havel Airport Prague and airport in Dresden.

The purpose of this study was to identify compatibilities of land-use patterns resulting from adjacent functions within the rural commune of Oleśnica. The analysis was made based on the relevant studies of conditions and directions of spatial planning, as well as a field inventory. The results of the studies show that the applicable planning document became a potential source of spatial conflicts. On these grounds, a negative assessment was given to the functioning spatial planning system, which, according to the premises of spatial order and sustainable development, should prevent them. The existing incompatibilities are the result of issues with coordination of the local spatial policies. As a consequence, they cause an urban development chaos, lack of proper space shaping, environmental damage and lower the residents‘ quality of life.

The principle of freedom of construction is considered as a fundamental rule in the Polish Construction Law. In the search for its prescriptive basis, reference should be made primarily to the provisions of the Basic Law. The Polish Constitution does not include such terms as „freedom of construction” and “right to build-up a plot” arising under it. The lack of literal references to the abovementioned terms does not prejudge the intentions of the legislator to ensure the protection of freedom of construction by law. The local spatial development plan, which serves as an act of local legislation, affects primarily the exercise of proprietary rights. Limitation on the right to buildup a plot is evident mainly in the prohibition of land-use by the owners in a manner that conflicts with the agreed spatial development plan. The limits of the planning authority in the context of guaranteeing the safeguarding.

The article highlights some socio-economic aspects of land use planning. Effective space management requires co-ordinated programmes, the limits allowing the social space to self-regulate and the carefully calculated volume of input (not only in the economic terms) into maintaining the desired quality of this space. Disturbed balance between the space self-regulation and the disproportionate input usually results in excessive burden laid on one of these elements. Therefore, adequate proportions between the two of them should be of central importance for land use planners. To this end, it is extremely important to develop a proper land use policy, a part of which are local development plans. They create the space and its functions and, conversely, it is the space and its quality that determine the provisions of land use plans. The latter make entities behave on the market in a specific way, thus shaping, directly or indirectly, the local property prices. A local development plan, or its absence, often hinders the growth of not only the local real estate market, but also the local development in general. Effective planning, especially in terms of economic and social consequences, determines the contents of the information resource that is necessary for making right land use decisions. The deficit of micro-scale analyses leads to a situation when local plans are created on the basis of data aggregated for much larger areas (such as cities or their districts) thus making the predicted effects of land use planning burdened with error. Another equally important issue is an ex post analysis of the land use planning effects. It is also necessary to develop a coherent concept of the spatial order of the area beyond the administrative borders. Unfortunately, the areas covered by land use planning are constantly shrinking in size, which is resulting in the disturbed continuity of the spatial order and in the uncontrolled urban sprawl.Spatial development policies and land use plans should be preceded by the strategic analyses of their impact on the natural environment, of the mutual influence of the plan provisions on the neighbouring administrative units, of the economic effects of using local land and buildings (not limited to the financial consequences of a zoning fee) and, first and foremost, of the social relevance of the functions proposed for the area in question.

The correct arrangement of area use function in built-up and urbanized areas is of a crucial meaning as for the satisfaction of economical and functional needs of a city. The process of creating functional structure is not incidental, it is a consistently implemented concept included in the planning documents. The use of limited resources is conditioned by the needs linked to the proper management, based on optimal adjustment of area to determined functions. Maintaining spatial order is a result of interdependent and correlated actions of many entities. Some of these actions are regulated in law, while other arise from indirect actions of entities operating in a given area, among others, of real estate market professionals. Selected problems of the optimal shaping of built-in and urbanized areas (in particularly of cities) were presented in the study. Those processes of the real estate system and their influence on the optimal use of areas in which a significant role may be played by real estate professionals: real estate appraisers, real estate agents and real estate managers were presented.

Projekt MinLand, realizowany w ramach programu Horyzont 2020, ma na celu zapewnienie dostępu do udokumentowanych nieeksploatowanych złóż kopalin oraz perspektywicznych obszarów ich występowania w obrębie Unii Europejskiej, tak aby teraz lub w przyszłości możliwe było prowadzenie dalszych prac eksploracyjnych i/lub eksploatacyjnych. Drogą do tego jest właściwa integracja polityki przestrzennej i surowcowej w krajach członkowskich wspólnoty. W perspektywie długoterminowej zapewni to stabilne i konkurencyjne dostawy surowców nieenergetycznych ze źródeł pierwotnych przy odpowiedniej promocji dobrych praktyk w działalności górniczej i jej akceptacji społecznej. Projekt realizuje zatem wyzwania stawiane przez Komisję Europejską w zakresie szeroko pojętego bezpieczeństwa surowcowego państw członkowskich dla obecnych i przyszłych pokoleń.
MinLand Project, implemented within Horizon 2020 program, aims to develop tools for ensuring access to documented unexploited mineral deposits and prognostic areas in European Union. This is to ensure the possibility of conducting further exploration and/or exploitation works now and in the future. The way to achieve this goal is the proper integration of land use policy and mineral policy in member countries. In the long-term, this will ensure stable and competitive supply of raw materials from EU primary sources, while promoting good practices in mining activity and its social acceptance. The project meets the challenges posed by the European Commission in the field of the raw materials security of Member States for present and future generations.
