As part of his public interest-oriented function of administering justice, a lawyer in Germany must grant advisory assistance (Beratungshilfe) to needy litigants with low incomes on the basis of the legal obligation under § 49a para. 1 of the Federal Code of Lawyers (Bundesrechtsanwaltsordnung – BRAO) in accordance with the Advisory Assistance Act (Beratungshilfegesetz – BerHG). In return, he receives a lower, statutory remuneration claim. The obligation to take over a case with a limited claim to remuneration imposed by law infringes on the lawyer’s freedom to exercise his profession (Berufsausübungsfreiheit) pursuant to Article 12 para. 1 of the Basic Law (Grundgesetz – GG). Such an infringement is only reasonable (angemessen) if the lawyer receives reasonable compensation and it thus becomes constitutional. Legal studies and representative empirical data are required to determine the reasonableness (Angemessenheit).

Opis:
Freedom of contract and corrective justice are considered to be the basic principles governing contract law. However, many contemporary legal orders implement various policy goals into private law. The regulatory private law of the European Union is the most striking example of such a trend. This article aims at reconciling the corrective justice theory of private law and the principle of freedom of contract with the regulatory dimension of the EU law. The main argument is that the meaning of the concept of harm, one that is crucial to the principle of corrective justice, should be understood broadly so that it can transform the corrective justice theory from a monistic one into a pluralistic one.

Odpowiedzialność w działalności gospodarczej – zdaniem Jana Pawła II – może się urzeczywistniać jako prawda w ustroju gospodarczym, w którym podmiotowość i wolność pracy człowieka dominuje nad kapitałem oraz własnością narzędzi produkcji i ziemi. Jest to możliwe tylko w społeczeństwie, w którym istnieją wolność pracy, przedsiębiorczość i uczestnictwo. Celem artykułu jest poznanie przedsiębiorczości w świetle kryterium wolności i odpowiedzialności. Tezą opracowania jest uznanie odpowiedzialności jednostki, podmiotu, rządu, polityki za warunek konieczny do wykorzystania wolności. Koncepcja artykułu obejmuje spojrzenie na przedsiębiorczość jako czynnik wychodzenia z zacofania krajów, przy czym wskazano na rzadko podnoszoną kwestię naturalnych (geograficznych) barier bogactwa i zacofania, jakim jest położenie krajów na mapie świata. Paradygmat odpowiedzialności w gospodarce rozszerzono na naukę, w tym zwłaszcza na filozofię, która jest świadectwem myślenia i objaśnia możliwość wychodzenia człowieka z kryzysu nadziei, o wiele poważniejszego niż kryzys finansowy. Paradygmat wolności sprowadzono do zasady sprawiedliwości, uznając niesprawiedliwość za przyczynę nędzy narodów, a sprawiedliwość za warunek wykorzystania przedsiębiorczości w podnoszeniu bogactwa. Artykuł ma charakter koncepcyjny i teoretyczny, stanowi rozwinięcie problematyki przedsiębiorczości, podejmowanej już w innych publikacjach. Wartością dodaną artykułu jest wykorzystanie teorii zacofania Gerschenkrona, teorii bogactwa i nędzy Landesa, dorobku filozofii odpowiedzialności Tischnera oraz teorii sprawiedliwości de Soto oraz konstytucji wolności Hayeka, w zakresie, na jaki pozwoliła objętość artykułu.
According to John Paul II, responsibility in the economic activity can be realized as truth within the economic structure, in which subjectivity and freedom of labor prevails over capital and the ownership of production and land. This situation is possible in a society characterized by the existence of freedom of labor, entrepreneurship and participation. The goal of this article is to define and recognize entrepreneurship in the light of freedom and responsibility criteria. The thesis devised in this article acknowledges responsibility of a subject, government and policy as an essential condition for applying freedom. The concept of this article is based on the following viewpoint: entrepreneurship is a decisive factor in helping to overcome underdevelopment in many countries. It is worth mentioning that this article deals with issues that are often omitted in many elaborations, namely the geographic location of individual countries which is a natural barrier to development and wealth. The paradigm of economic responsibility has been extended into science, especially philosophy, which serves as the testimony of thinking and elucidates the possibility of a man’s fate crisis, which is subsequently more serious than a financial crisis. The freedom paradigm is defined on the basis of the justice principle, which means that injustice is the main cause of nations’ poverty, while justice is an essential condition for utilizing entrepreneurship as a factor that helps to attain wealth. This article is theoretical and conceptual, and constitutes development of entrepreneurship issues that have been already undertaken in numerous publications. The added value of this article is the application of Gerschenkron Underdevelopment Theory, Landes Wealth and Poverty Theory, the philosophical contribution of responsibility (Tischner) as well as de Soto Justice Theory and Hayek Freedom Constitution. The aforementioned issues are discussed in general, due to the volume restrictions of this article.

The article presents the most important aspects of the new foreign policy of Egypt after the fall of President Hosni Mubarak and the impact of the Arab Spring on the attitude of Egypt in the region after coming to power Freedom and Justice Party (associated with the Muslim Brotherhood). The author stresses the importance of several factors, primarily the permanent impact of the army on the current policies and problems associated with social transformation, which also affected the creation of new foreign policy of the Egyptian state. A short period of rule of the Freedom and Justice Party was characterized in foreign policy area by a profound dissonance between the officially declared objectives and reality. A striking example of this policy was Egyptian approach to the Palestinian issue. Lack of strong leadership and domestic policy mistakes quickly began to adversely affect the activity of Egypt in the international arena. For the United States, the current most important ally of Egypt, key issue was the fulfillment by the new authorities provisions of Camp David Accords and maintain alliance, especially in matters of military cooperation. Therefore, the Egyptian-Iranian rapprochement soon after coming to power President Morsy was regarded as a dangerous precedent, and to some extent a threat to the existing status quo in the Middle East. Egypt also changed alliances with Arab Gulf states – the choice of new partners was dictated by ideological closeness and willingness to break with Mubarak allies. The paper shows also the greatest failures in the international arena of “new Egypt,” among them: 1) the severance of diplomatic relations with Syria and the self-exclusion as a mediator in the Syrian conflict; 2) an unsuccessful attempt to join the BRICS group; 3) failure in Ethiopian-Egyptian dispute overaccessto the Nile resources. The author states that within two years period of Freedom and Justice Party rule the international position of Egypt has been further eroded, which was mainly caused by fatal economic situation of the state and the need to seek new sources of funding in the world.

Cardinal Wyszyński was a defender of every individual, family, nation and Church during the time of communist enslavement of Poland. He was an ardent defender of the truth with regard to human being and its dignity, he constantly emphasized the significance of respecting basic rights and obligations of men, and strongly demanded the observance of these rights when the state violated them. Furthermore, he was radical defender of the freedom of human persons, families, nation and the Church, indicating that only in freedom can they truly develop and fulfill their vocation and goals. He constantly reminded us of the need for justice made in the spirit of love with regard to every individual, family and nation. He clearly defined the tasks and duties of the state and the Church in relation to every human person that should be regarded as the highest value in the world, as well as towards families that are to be considered the cradle of the nation, and towards the nation that he regarded as a family of families sui generis. Additionaly he emphasized that the Church has a unique role to perform in relation to these communities, bringing into their existence not only the supernatural dimension, sanctifying God’s grace, salvation, but also the natural dimension consisting in the care of the Church for the national raison d’etat. Last but not least, in his view, the Church must be free and independent in its activities to be able to perform its religious and social role properly. The Primate indicated the need for cooperation between the state and the Church for the benefit of man, family and nation. When the communist state did not fulfill its role and acted against the rights of citizens, especially believers, against families and nation, he radically opposed these actions, demanding respect for dignity, rights, truth, freedom and justice with regard to every human person, family and family of families – that is the nation.

Artykuł przedstawia analizę werbalizacji dwóch konceptów, ważnych dla różnych gatunków dyskursu politycznego: „wolność” i „sprawiedliwość”. Badanie zostało przeprowadzone na podstawie stosunkowo nowego dla rosyjskiego dyskursu prezydenckiego gatunku, jakim jest orędzie prezydenta do Zgromadzenia Federalnego. Materiał stanowiły wszystkie orędzia wygłoszone przez prezydenta W.W. Putina (2000–2007, 2012–2016, 2018–2020). Do przeprowadzenia badania wykorzystano metodę opisową i kontekstualną. Analiza pokazała, że werbalizacje omawianych konceptów nie są liczne, są także dość ogólnikowe. Główny akcent w przypadku konceptu „wolność” położony został na obszar gospodarki, a w przypadku konceptu „sprawiedliwość” na sferę społeczną.
The article presents an analysis of the verbalization of two concepts important for different genres of political discourse: the concepts of “freedom” and “justice”. The study was prepared on the basis of a relatively new genre for Russian presidential discourse, which is the Presidential address to the Federal Assembly. The lexical material was taken from all the addresses delivered by President W.W. Putin (2000–2007, 2012–2016, 2018–2020). The descriptive method and the contextual method were used during the analysis. The analysis showed that the verbalizations of these concepts are not numerous; they are also quite general. The main emphasis in the case of the concept of “freedom” was placed on the economy, and in the case of the concept of “justice” on the social sphere.

War is the most barbaric and the least effective means of conflict solution. That is why in recent years various international organizations have intensified their efforts to determine the status of a right of peace and the ways of implementing it. Peace is one of the basic values of solidarity, freedom, and justice that determines human behaviour. It guarantees all rights and freedom. However, it is debatable whether the mere ratification of the right of peace is enough to exercise it. It is necessary to undertake a number of actions aimed at eliminating threats to protect this value. These issues are complex but very important for every person, state, and for the whole human community. The idea of peace also had a significant place in the social teaching of the Church, which is evidenced in Pius XII’s and Jan XXIII’s teaching. Since the beginning of his papacy John Paul II put forth a lot of effort in defending the world peace. This is particularly reflected in his annual messages for World Peace Day. The construction of the peace concept in the teaching of John Paul II covers four pillars, which can be found in the concept of John XXIII and which are laid out by him in the encyclical Pacem in terris. These are: truth, freedom, justice, solidarity. Both in the legal doctrine and the statements of the Fathers of the Church, peace is a guarantee of human dignity. Therefore, it is the duty of everyone, the entire international community to take action in order to prevent conflicts and create life based on truth, freedom, and justice.

Cardinal Wyszynski was a defender of basic values, such as human being, family, nation and church during communistic enslavement. He defended the truth concerning their being and dignity, he reminded others of their basic rights and duties, he stood up for these rights when the state government violated them. He defended the freedom of human beings, families, nation and the Church pointing out that only through true freedom can they really develop and realise their vocation and mission. He pointed out the need for justice done out of love, towards every human being, family and nation. He spoke clearly about duties and responsibilities of the state and the Church towards every human being, families, who are the cradle of of the nation, and the nation itself, which is family of families. He portrayed the Church as playing a special role for those societies bringing into their life not only the extramundane dimension, God’s grace and salvation, but also caring about national interest when it comes to natural dimension. The Church must be free in its activity in order to fulfill well its religious and social role. The Primate recalls the need for state and the Church to cooperate out of concern for the man, the family and the nation. When the communistic state didn’t fulfill its role and acted against families and nation, he opposed those actions calling for dignity, rights, truth, freedom and justice towards every human being, family and family of families- the nation.
