The purpose of this paper is to discuss the impact of the electoral system on turnout, moderated by political knowledge. Following the introduction of the FPTP system to some city councils in the 2014 elections, we used a quasi-experimental design to compare two sets of economically, socially and culturally similar cities, chosen using the Propensity Score Matching method. Data from two waves of a survey with residents, city councillors and local social leaders after the 2014 local elections showed that, despite widespread public debates, knowledge about the electoral system was very low. The results proved that, although the level of political knowledge was higher in the FPTP system than in the PR system, the turnout in the former was lower, even when controlled by political knowledge. However, the joint impact of the electoral system and political knowledge on turnout was mixed, and depended on the method of measuring political knowledge.

Elections are a tool for the competing entities to achieve political goals. Therefore, electoral procedures are a significant element affecting their political perspectives. A change in the electoral system depends on balance of power in the parliament. In practice, two models of electoral reforms are possible. In the first of them, political parties collaborate to reform the system. Thus, they protect the interests of as many parties as possible. In the second one, the majority can force others to accept the solutions that are beneficial for them. The majority promote the institutional patterns and procedures that give them a chance to consolidate or increase the relative power of influence of elections. The presented paper includes the analysis of social preferences concerning a reform of the electoral system in Poland. The study revealed the preference for the cooperative model of changing the electoral system. Only the respondents who identified themselves as having right-wing inclinations approved of the competitive model.

Pathologies and abuses accompany elections and are connected with the electoral system both in its narrow and broad sense. Moreover, they stem from a human nature and a degree of democratic principles consolidation. Cohabitation is conditioned by the electoral system and, in the case of the proportional allocation of seats, it arises more often than in the majority system with single member constituencies. The phenomenon itself is not always pathological. However, such an adverse situation develops when it comes to clashes, neither substantive nor creative, between the municipal bodies and, in consequence, the interests of the local community are jeopardised. Elections at the municipal level are also accompanied by other pathologies and abuses including: coercing votes when voting by proxy, adding voters to an electoral roll, bringing residents to a polling place, paying for one’s votes, preying on the naïvety of voters which can take grotesque forms or brutalising an election campaign caused by the mediatisation of local policy. The above-mentioned phenomena were examined and presented in the paper based on the analysis of statistical data, articles from the local press and, most essentially for the discussed subject, a rich material collected thanks to the in-depth interviews conducted by the authors.

The article presents a review of possible procedures of changing the electoral system in a comparative perspective with special regard to the Polish legislation. The author claims that changes in electoral system are often manipulated by the political parties. To prevent such tinkering two solutions can be applied: first, is to fix the electoral system in the constitution and, second, to protect the electoral system from amendment within one year before the election. He also provides an analysis of the legal basis of the Polish referendum on electoral system held on 6th September 2015.

This paper aims to present a case study analysis of the condition of the electoral system in the Republic of Belarus after more than a quarter of a century of independence. The main purpose of the paper is to explain the discrepancies between legislation and practice. The author intended to note a real situation that dominates the country’s political scene in comparison to theoretical establishments. A Constitution of the Republic (created in 1994, with minor changes in 1996 and 2004) is the legal ground of the electoral system, however, procedural details were drawn up in the Electoral Code. The principles of Belarusian electoral code consist of some statements known from democratic models, such as universal suffrage, direct suffrage, secret ballot and equality. There are different types of elections in Belarus but the most important ones are presidential and parliamentary elections. Despite the detailed legal rules for conducting these elections, in fact, the principles of democracy, as well as the internal rules in Belarus, are not respected. Both presidential and parliamentary elections have shown this in recent years. Independent observers for a long time have been alarming about worrying electoral practices in Belarus. It is also worth emphasizing that since 1994, one man has been in power uninterruptedly, and Parliament has in fact a symbolic function. In the source materials, the author used Belarusian legal acts, analyses and reports, press notes as well as scientific papers.

The electoral system of Suriname has been analyzed. Suriname has a unicameral parliament, the National Assembly. The 51 seats of the National Assembly are distributed among 10 districts. There are large discrepancies between the numbers of voters represented by a seat in the various districts. Apportionment methods leading to different seat distributions are explored and compared with each other and with the current one. The comparison is done with respect to the number of voters represented by a seat, the mean majority deficit and the probability that a majority deficit will occur, the influence of a voter in a particular district using the Banzhaf power index, and the influence of a political party relative to the percentage of the popular vote that the party obtained. The method of equal proportions turns out to yield the best results in general.

Artykuł przedstawia możliwe konsekwencje polityczne zastosowania mieszanego systemu wyborczego w wyborach do Sejmu RP. Zmiennymi zależnymi są: podział mandatów pomiędzy partie przy tej samej liczbie zdobywanych głosów, odchylenie wyników wyborczych od proporcjonalności oraz stopień koncentracji systemu partyjnego. Zmienną niezależną konkretne – występujące na świecie i opisane w literaturze przedmiotu – typy systemów mieszanych. Testowi poddane zostały cztery warianty mieszanej ordynacji wyborczej, reprezentujące cztery podstawowe typy takich ordynacji. Symulacje przeprowadzono w oparciu o wyniki wyborów 2011 i 2015 roku oraz hipotetyczne wyniki dla wyborów 2019 roku. Poziom dysproporcjonalności systemu wyborczego oraz koncentracji systemu partyjnego został skonfrontowany z pomiarami tych parametrów wśród państw wykorzystujących tego systemy mieszane. Przedstawione wyniki pokazują, że ordynacje mieszane mogą dać całe spektrum ewentualnych zmian, w zależności od ich konkretnego typu.
The present paper deals with the possible political consequences of employing a mixed electoral system in the elections to Polish Sejm. The dependent variables are: distribution of seats amongst political parties which win the equal votes, deviation of election results from the proportionality and the degree of concentration of the party system. The independent variable are specific, described in the literature and actually existing types of mixed electoral systems. Four variants of electoral systems representing four basic types of such systems have been tested. Simulations have been conducted on the basis of 2011, 2015, and hypothetical 2019 elections results. The degrees of an electoral system’s disproportionality and of party system’s concentration were juxtaposed with the measurements of these parameters in the countries which employ such mixed electoral systems. Presented results demonstrate that mixed electoral systems can lead to the whole spectrum of possible changes, depending on the employed type of the electoral system.

Republika Austrii, 1 lutego 1994 r. podpisała traktat akcesyjny i z dniem 1 stycznia 1995 r. stała się pełnoprawnym członkiem Unii Europejskiej. Członkostwo zobowiązało Austriaków do “dostarczenia” Wspólnocie odpowiednich osób do objęcia różnych stanowisk w różnych unijnych organach. Nie inaczej było także w przypadku Parlamentu Europejskiego. Ważnym aspektem stało się dostosowanie poszczególnych norm ustawowych i własnej konstytucji do nowych rozwiązań. Celem niniejszego opracowania jest właśnie przedstawianie austriackich rozwiązań w tym temacie na tle rozwiązań europejskich, ze szczególnym uwzględnieniem unormowań rzadko spotykanych lub wręcz odrębności sytemu Republiki Austrii. Rzecz wydaje się być interesująca zarówno z punktu widzenia praktyki ustrojowej państw członkowskich Unii Europejskiej, jak i z punktu widzenia czytelnika. To drugie podejście pozwoli na ocenę austriackich rozwiązań na tle niedawno wprowadzonej ordynacji wyborczej do PE zawartej w Kodeksie Wyborczym, ale również może podsunąć pewne pomysły, co do przyszłych nowelizacji. Autorzy zwrócili szczególną uwagę na dwa rozwiązania: obniżenie cenzusu wieku czynnego prawa wyborczego oraz jednookręgowy system wyborczy. Austriackie doświadczenia mogą być również pomocne państwom, które wprowadzają możliwość głosowania korespondencyjnego. Są to propozycje szczególnie interesujące z punktu widzenia przyszłych, możliwych nowelizacji systemów wyborczych państw członkowskich.
On 1 February, 1994 the Republic of Austria concluded the Accession Treaty and on 1 January, 1995 became a full member of the European Union. Membership obliged Austrians to ‘provide’ the Community with appropriate personnel to take up different posts in various EU authorities, as well as in the European Parliament. The most important issue was to alter particular statutory regulations and the Austrian Constitution to adjust to the new situation. The paper aims at presenting the Austrian solutions in this matter in the context of European Union law, with particular emphasis on regulations which are uncommon or specific to the Republic of Austria. The matter of interest is the constitutional practice of EU member states and the reader’s perspective is taken into account. The latter approach not only evaluates the Austrian solutions in the context of the electoral law to the European Parliament contained in the Election Code, but could also suggest some ideas in regard to prospective amendments. The authors would, in particular, like to pay attention to two issues: the lowering of the voting age, and the single constituency electoral system. The Austrian solutions might be valuable to refer to in the countries where a system of correspondence voting is just being introduced. These resolutions are particularly interesting taking into consideration prospective, possible amendments to the electoral laws of the EU member states.

The paper presents the mixed electoral system and its models, and analyses their applicability in the elections to the Sejm of the Republic of Poland. The authors focus on the German personalised proportional system and the proposal for an electoral system based on this system constructed by Jarosław Flis. The analysis concerns not only the legal aspect but also the political and social consequences. The presented experiences of various countries show that the reaction of political parties and voters to a new electoral system can be surprising and the political consequences unpredictable.

The ongoing process of democratisation lead to the growing importance of the electoral systems that regulate the procedures of gaining and legitimizing power in democracy. Taking it into account it is worth asking about the relationship between these particular ‘game rules’ contained into electoral law and the respect of the rule of law, being one of the basic norms of a democratic system. A question then may be raised about the existence and the character of the relation between electoral systems and the level of political corruption. It is worth noticing that besides the research conducted by political scientists and the representatives of various branches of social sciences the significant analysis of the issue have been presented by the economists. In this article a brief overview of the economic studies on the relationship between level of political corruption and the electoral systems is presented so as to assess to what degree this approach may be treated as fruitful.

The Polish electoral system to the European Parliament has been criticized for as long as it has been in operation; that is, uninterruptedly since 2004. The commonest objections and criticisms concern the lack of the fixed assignment of seats to territorial districts; significant and unjustified differences in population size among districts; risk of not winning a single seat by the smallest districts; unequal territorial representation; overcomplicated and unclear mechanism of translating votes into seats and in consequence creation of an illusion of a territorial representation. However, there are at least four alternative elector - al systems which are able to eliminate all the drawbacks of the current model while war- ranting the proportional seat distribution both among electoral districts in accordance with the principle of material equality of each vote and among election committees pursuant to the requirements set for the electoral systems of the member countries by the European Union law. The aim of the paper is to compare these alternatives with the cur- rent model, pinpoint the drawbacks and advantages of each solution and indicate which criteria are optimized by the respective electoral systems.
Obowiązujący w Polsce nieprzerwanie od 2004 r. system wyborczy jest krytykowany od samego początku jego funkcjonowania. Zastrzeżenia i uwagi najczęściej dotyczą nieprzypisania mandatów na stałe do okręgów terytorialnych, nieuzasadnionych i znaczących różnic populacyjnych w obrębie okręgów, ryzyka nieuzyskania ani jednego mandatu przez najmniejsze okręgi, nierówną reprezentację terytorialną, skomplikowanie i nieprzejrzystość systemu podziału głosów na mandaty, paradoksalne podziały mandatów pomiędzy okręgi wyborcze, a w konsekwencji stwarzanie iluzji reprezentacji terytorialnej. Tymczasem istnieją co najmniej cztery alternatywne systemy wyborcze, które eliminując wszystkie wady obecnego modelu gwarantowałyby proporcjonalny podział mandatów zarówno pomiędzy okręgi wyborcze zgodnie z zasadą równości materialnej głosy, jak również pomiędzy komitety wyborcze zgodnie z wymaganiami stawianymi krajowym systemom wyborczym przez prawo europejskie. Celem tego artykułu jest porównanie tych alternatyw z obecnym modelem, wskazanie wad i zalet każdego rozwiązania oraz kryteriów optymalizowanych przez każdy z nich.

Amending a constitution or replacing it with a new one is never easy. Even if politicians usually have a lot of ideas how it should be done, the real problem is to put these ideas into practice. If the President Duda’s initiative is to succeed, so in other words – if such a referendum is to be held, the consent of the Senate of the Republic of Poland, i.e. the second chamber of the Polish parliament is needed. According to the Article 125 of the current Constitution the consent of the Senate is given “by an absolute majority vote taken in the presence of at least half of the statutory number of Senators”. And while Law and Justice has such an absolute majority of seats in the Senate, it is difficult to say with certainty whether today, in the face of a rather tight relationship between President Duda and the Law and Justice’s leadership, Senators of this party will support the president’s initiative. And even if the referendum is held, it will only be the first step. The change of the constitution itself requires either the so-called ‘constitutional majority’ or a bipartisan consent, that is the agreement between the ruling party and at least part of the opposition. For the moment Law and Justice does not have such a constitutional majority, even if it joins forces with Kukiz ’15 parliamentary faction – the only political group that welcomed President Duda’s initiative with great enthusiasm. Other Polish political parties do not want to hear about any constitutional change accusing both Law and Justice and President Duda of repeatedly violating the constitution that is currently in force. Of course, it may change after the next parliamentary and presidential elections scheduled for 2019 and 2020 respectively, especially if Law and Justice gets even better results, what – at least today – is suggested in the opinion polls. Maybe then, to change the constitution, they will not need agreement with any other political party, just like the Hungarian Fidesz after the 2010 elections. However, there is no doubt that disputes on the competences and powers of the President of the Republic of Poland, especially (but not only) in the context of the way he/she is elected, will return regularly in the discussions on potential constitutional changes. The possible evolution of the Polish parliamentarism into the presidential or semi-presidential regime would force a significant increase in the powers of the head of state, still elected directly by the people. Staying within the framework of the parliamentary regime would require a more precise definition of the constitutional position of the President of the Republic of Poland, leaving open the issue of the way he/she is elected.

After each election Polishmedia publish nationwide rankings of candidates, comparing the number of votes gained individually. Analysis of the individual results of such candidates, however, shows that they are strongly dependent on factors external to a candidate –the size ofparticular district, its territorial structure and the turnout. The results depend not only on the candidates’ previous media visibility, but also on the visibility of their competitors.

After 1975 Spain began the difficult process of transforming its political system. The changes included the electoral system, but rather than only reconstructing the system, the principles of how to elect the representatives of the Spanish nation were stipulated anew. Therefore, the paper attempts to answer the question of whether the solutions adopted fully reflect the principle of national representation, as intended by their authors. It is also necessary to present the proposals to reform the Spanish electorate system suggested by Spanish academia.
