The article is based on an analysis of the subject literature, the legal acts and information from the official web sites of European non-governmental organizations (NGO’s), the main purpose of which is to present the idea and the primary role of NGO’s, whose priority is to propagate and popularize consumer protection within the European Union. In addition, an analysis is conducted of the systematics of the Consumer non-governmental sector in the European Union. Also the relation between non-governmental organizations and the European Commission are discussed. The article includes a characterization of the specific role of the European Economic and Social Committee, which consists of representatives of the various economic and social components of organized civil society, such as consumers in the development of consumer protection in the European market. In the next section of the article the chosen European Union non-government organization and its role in consumer protection is analyzed. In particular the specific actions undertaken in this area by the European Community of Consumer Co-operatives (Euro Coop), the European Farmers Organization, the European Association for the co-ordination of Consumer Representation in Standardisation (ANEC) and the Bureau Européen des Unions de Consommateurs ( BEUC ) are analyzed. The final section of the article is the conclusion of the real role of consumer NGO’s both now and in the future in European Union policy. Those considerations are based on real European Union regulations such as Regulation (EU) No 254/2014 of the European Parliament and of the Council of 26th February 2014 on a multiannual consumer programme for the years 2014-2020.

Responsible borrowing means a thorough reflection on the need to become indebted, full transfer of true information affecting creditworthiness, comprehensive analysis of the credit agreement, and refraining from avoiding the repayment of loan obligations. The main purpose of the article is to verify the hypothesis that Polish legislators make only the lenders fully responsible for excessive borrowing on the consumer loan market. The following research methods were used: critical analysis of the subject literature and economic analysis of the respective legal provisions. On the basis of the analyses conducted, areas were identified in which the legislator should use the appropriate legal instruments stimulating responsible borrowing. Among them the following were listed: the consumer’s obligation to prove the absence of overdue payments and the consumer’s notifiation of becoming acquainted with the terms of the loan agreement.

The main purpose is to present how modern technology has shaped the consumers, the decisionmaking process and finally their behaviour along the purchase journey. The ICT revolution has once and for all reshaped the business landscape and one of its most visible changes was the rise of the Information Economy and the Mobile Society. The use of mobile technology in today’s economy has caused many changes and a transformation in contemporary business models. The ubiquitous mobile technology has reshaped irrevocably the relationship between entities on the market and created a new type of consumer – the mobile consumer. The purpose of the article is to present this new type of consumers from the perspective of their journey to obtain more information which they needs to include in their purchase decisions.

Konsument digitalny wyróżnia się na tle innych konsumentów pewnymi szczególnymi cechami. Artykuł ma na celu przedstawienie sylwetki współczesnego konsumenta, którego coraz częściej określa się mianem digitalnego.
Contemporary consumer have quite quickly adapter to a changing market reality and new mobile solutions. They use technology in order to make their lives easier, take reasonable buying decisions, and thus, they redefine the way in which they do shopping. A digital consumer is a person who regularly does e-shopping and uses a lot of applications available on Android, Windows Phone, iOS platforms and others to purchase products and foods. A digital consumer is distinguished among other consumers by certain particular features. The aim of the article is to present of a contemporary consumer, who is more and more often described as a digital consumer.

Consumer behavior in developed economies is the subject of sustained interest, since only the consumer himself decides what kind of services he needs and for which he is willing to pay well. Tourism is considered a major determinant of the development of the national economy and represents a potential of generating a profit from a macroeconomic point of view and also from a microeconomic perspective. The aim of this paper is the analysis and comparison of the views of the individual authors on concepts such as tourism and consumer behaviour. We also want to point out through conducted marketing research on the impact of demographic variables on consumer behavior in tourism.

The paper focuses on the issue of public enforcement of consumer law in Poland. This analysis considers exclusively the stage of administrative proceedings and it does not concern judicial control over the decisions issued. The analysis aims at answering the question whether the phenomenon of legal impossibilism is to be observed in the domain administrative proceedings instituted by the President of the UOKiK with the purpose of implementing consumer policy. The hypotheses to be verified in the foregoing are as follows: (i) there are procedural mechanisms which enable an authority to effectuate protection of consumer rights, operating to the public benefit, and that (ii) it might be reasonable to expect that these mecha nisms are exploited in practice by the President of the UOKiK. The first part con siders the legal framework for enforcing consumer rights with the use of public law mechanisms in Poland. In the second part, the discussion revolves around the practical application of the legal instruments by the President of the UOKiK. The conclusions constitute a starting point to initiate further, in depth empirical studies related to the activities undertaken by the President of the UOKiK with the aim to effectuate protection of consumer rights in Poland.

The ADR Act of 23 September 2016 addressing consumer dispute resolution implements the EP and EC ADR Directive of 21 May 2013 regulating consumer dispute resolution, and EU and EP Regulation 524/2013 of 21 May 2013 on Online Dispute Resolution in Consumer Disputes. The aim is to give consumers who engage in dispute resolution with business entities an option to apply to legal entities that offer independent, impartial, transparent and effective facilities of amicable dispute resolution. The aim is also to equip entrepreneurs with a necessary tool to avoid costly and prolonged court proceedings against consumers. This article discusses how the Act regulates the substance, commencement, conduct and conclusion of the proceedings in out-of-court settlement of consumer disputes.

This study focuses on the recent fall of many large scale department stores (Macy’s, J. C. Penney Company, Sear’s, Kmart) and other retail, pharmacy and grocery stores (Bebe, Whole Foods, CVS, Chico’s, Limited, Radio Shack, Game Stop) across the United States. The researchers set out to discover why stores that have existed for years suddenly had to shut down physical locations. The researchers hypothesized that these retail outlets have failed to properly attract millennial consumers. Marketers are endlessly attempting to find solutions on how to best attract millennials in this digital age. What appears to be evident, though, is that the habits of this demographic prefer the ease provided by online shopping. Secondary sources were reviewed to determine exactly why the stores have fallen. The millennial culture was a key component of the study. The results suggest that the stores failed due to improper targeting and in-store attraction.

The paper discusses the topic of consumer patriotism and is an attempt to connect it with the construct of the old traditional, and the new type of patriotism. Nazwane zostały ponadto instytucjonalne modele ochrony konsumentów w wybranych państwach Unii Europejskiej. Ostatnia część artykułu pełni rolę konkluzji i zawiera rozważania na temat istoty oraz znaczenia instytucjonalnej ochrony konsumentów we Wspólnocie.
The article is based on the analysis of the legal acts, literature concerning the subject and information found in the official website of the institution of protection. The work elaborates the scheme of institutional consumer protection developed in the European Union. Selected aspects of institutional and legal consumer protection matters were discussed. The institutions directly concerned with the creation of the consumer protection standards have been pointed out. Moreover, some of the institutional schemes of consumer protection in the selected States in EU were named. The final part of the article is the conclusion that elaborates the matter of importance of institutional consumer protection in the European Union.

Artykuł ma na celu dokonanie syntezy uwarunkowań funkcjonowania współczesnego społeczeństwa konsumpcyjnego w Unii Europejskiej. Przedstawiono genezę oraz istotę rozwoju społeczeństwa konsumpcyjnego w Europie. Wskazano na definicję społeczeństwa konsumpcyjnego w ujęciu ekonomiczno-politycznym i socjologiczno-filozoficznym. Na uwarunkowania współczesnego społeczeństwa konsumpcyjnego Unii Europejskiej wpływają procesy prawotwórcze w zakresie ochrony bezpieczeństwa ekonomicznego konsumentów, w tym bezpieczeństwa towarów, w zakresie informacyjnym i edukacyjnym oraz w zakresie systemu dochodzenia roszczeń, ze szczególnym uwzględnieniem zakupów transgranicznych. W artykule zdefiniowano pojęcie etyki konsumenckiej oraz określono, że wraz z rozwojem społeczeństwa konsumenckiego w Unii Europejskiej wykształciły się specyficzne normy etyczne związane z procesem nabywczym.

The article presents the position and role of the “Office of Competition and Consumer Protection” in creation consumer protection policy in modern Poland. The “Office of competition and consumer protection” has been showed on background of other consumer protection subjects, through description of its origin, development, organizational structure, legal base and the main infliction in range of consumer policy. It this publication also resolve the governmental Consumer Policy Strategy 2007-2009 which outlines the basis of the activities of the “Offi ce” nowadays and in the future.

In the article we discuss a standard example of an optimization problem. In our problem we are optimizing the objective function, i.e. a consumer utility function with two variables representing quantities of two commodities denoted by x1 and x2. We consider the standard optimization problem in which we maximize the defined utility function subject to a budget constraint. More precisely, the problem is to choose quantities of two commodities 1st and 2nd, in order to maximize u(x1, x2) function subject to the budget constraint. The aim of the article is to present how we can exemplify and solve this kind of problems in a classroom. In the paper we suggest four methods of finding the solution. The first one is based on the graphical interpretation of the problem. Based on this we can get the approximate solution of the defined optimization problem. Then, we present an algebraic approach to find the optimum solution of the given problem. In the first method we use the budget constraint to transform the utility function of two variables into the function of one variable. The second algebraic method of achieving the solution is based on the second Goosen’s law, which is known as the law of marginal utility theory. In the third algebraic method applied to find the maximum of the utility function, we use the Lagrange multipliers. The text emphasizes the educational aspect of the theory of consumer choice.

The article addresses the issue of consumer preferences for brands of coffee in Poland (for ground coffee, instant coffee, coffee beans and instant cappuccino). The main source of the study is the results of primary research conducted using a structured interview (CAPI – Computer Assisted Personal Interview) on a nationwide sample of 800 coffee consumers. The results of the research which have been included in the article indicate, among others, ongoing changes in the preferences of Polish consumers regarding their choice of coffee brands. The results show that brands offered by small, local manufacturers are of little significance on a national level in terms of brand awareness, consumption, and consequently sales. Branded products offered by large corporations such as Jacobs, Nescafe, Lavazza and Tchibo play a major role in the coffee market in Poland.

The article is based on an analysis of Polish and international legal acts, government programs and literature, and aims at presenting the concept and the scope of consumer policy in the period of systemic transformation in Poland. The publication features an analysis of the major factors shaping consumer policy in Poland in the years 1989-2004. Selected international legal acts affecting consumer protection in the years 1989-1997 were also analyzed. Elements of consumer policy present in selected governmental economic programs in the period of transformation were synthesized. It was assumed that consumer policy in the period of systemic transformation indirectly resulted from the economic policy of the government. Its shape was primarily affected by the social and economic transformation occurring since 1989 and the birth of free-market economy. The process of adjusting the Polish legislation to the European Union standards, which began in 1991, and subsequent accession to the European Union in 2004 also played an important role.

Celem artykułu jest przedstawienie propozycji modelu teoretycznego opisującego rolę atrybucji doświadczeń konsumentów w kształtowaniu ich postaw wobec organizacji. Jako wniosek z analizy istniejących w literaturze przedmiotu modeli i wyników empirycznych wskazano, że nawet w przypadku atrybucji poza organizacją (tj. gdy konsument uznaje przyczynę swojego doświadczenia za niezwiązaną z organizacją) istnieją mechanizmy (określone jako: rola emocji, rola skojarzeń oraz sprzężenie interakcji), poprzez które doświadczenie konsumenta może wpływać na jego postawę wobec organizacji. Omówiono możliwości wykorzystania przez organizacje informacji dotyczących atrybucji doświadczeń swoich klientów.
The paper aims to present a proposed framework depicting the role of consumer experience attribution in the origination of consumer attitudes towards the organization. As a conclusion from the analysis of models and empirical findings existing in the literature, it has been suggested, that even in case of the experience attribution outside an organization, there exist mechanisms (based on emotions, associations and interaction feedback) through which the experience can impact the consumer attitudes towards this organization. There were discussed the possibilities of how an organization can utilize the information on customer experience attribution.

This article raises an issue of consumers at the age of 50+. The role of this market segment is constantly growing in Poland, but despite of this, it is still hard to identify this wide consumer group. Therefore, the aim of the paper is to identify the portrayal of older people (50+) in Polish print advertising. Amongst over-fifty consumers, the press media are still the key communication channel for spreading marketing recommendations to this consumer group. Content analysis was employed to define the characteristics of these consumers. The research demonstrates that firstly, the older generation is depicted mostly marginally, secondly, women are over-represented, and thirdly, only a few product categories portray the older models at all. Two schemes 'brand ambassador' or/and 'representative of a consumer target group' were used to reflect the portrayals of this market group. In spite of the common opinion, that the market segment of people of 50+ is uniform, the findings suggest that older consumers are not homogeneous. A new age segmentation for the elderly has been proposed. The older market segment is sharply divided into two groups ('mature' and 'elderly'). The age of 60 is a strong demarcation line here. The portrayal of 'mature' consumers at the age of 50-59 covers 50% of all the engaged older consumers in print adverts. Over 10 different portrayal models have been found in the market communications analyzed. The contemporary 'mature' ones differ substantially from stereotypical models reserved for elderly consumers. Over 7 different models, mostly still 'young bodies and souls', are adapted to express the portrayal of this target group. However, for both the elderly 'young' and 'mature' (60+) sub-group the models are much more predictable and traditional. The segment of 80+ does not exist at all in print adverts. Generally, the portrayal of 50+ is more complicated and diverse than it is commonly believed in practice.

The purpose of this article is to provide a theoretical and empirical explanation of how the consumer socialization works with children of 7/8 years. This paper poses questions about the way brands are discussed in social situations in the environment of school class. It explores children’s socializations into consumer-brand relationships and the influence that marketing texts have on their everyday social experiences. The analysis of children’s talk about brands is critical in order to understand the ways that brands (with parents, siblings and peers) socialize them into consumer culture. The first section presents contemporary discussion of children’s consumption phenomena. The second section emphasis on researching with 14 groups of primary Polish pupils in Lublin. It uses data analysis born of in-depth interviews analysis. This study is based on principles of cultural studies and discourse and functional analysis which approach as a means to enhance richness and uniqueness in the area of children’s consumption. In order to understand children’s brand consumption the paper indicates five main functions emerged from the data: 1. Exploring consumer culture through play and gratification 2. Seeking safety in an overabundance 3. Identification and gender socialization 4. Belonging to a group and rivalry 5. Utilitarian functions. Author argues that consumption ideology and their discourses are not increasingly define children’s everyday social experiences. 7/8-year-olds were not a coherent group significantly interested in brands and consumption, but on the other hand, they were not a group that did not interested in them at all. Counter to the (mainly polish) literature children have not extensive knowledge of brands and brands are not so emerging in their lives.

Aim/purpose – This paper aims at investigating the existence of Consumer Social Responsibility (CSR), legally based on the second-generation EU consumerist legislation, which affects companies deeply in fulfilling socially responsible choices of business. Design/methodology/approach – The method followed-up of CSR is a bottom-up perspective inspired by matching corporate social responsibility with consumer social responsibility. Among consumers a strategic role is entrusted to the ‘state’ that is named in this paper ‘superconsumer’. Findings – It is argued that a juridical consumer responsibility may be affirmed as part of a European strategy to inspire voluntary sustainable choices by corporations, imposing a social responsibility for consumers from the bottom. Pieces of evidence are collected throughout three sectors of EU legislation: financial market, energy environment and public procurement. Research implication/limitation – The implication of this research consists in drawing a path of inference from the well-known rights of consumers to their duties including consumers’ social responsibilities. The most significant limitation of the study is its restriction on investigating only three sample domains among larger sectors within EU consumer law and preferably Italian law. A subsequent development of this research will fill this gap by broadening the investigation field. Originality/value/contribution – There are no previous studies in Italy and in European literature concerning the role of consumer law in affecting CSR and, more generally, in the European juridical literature on CSR about the influence of consumers’ legal responsibility on socially responsible choices of companies. In addition, it leads on to the original idea of the existence of juridical consumers’ duties inferred by consumers’ rights as the inseparable effect of consumers’ empowerment.

This paper analyzes the question how EU and national laws implemented and how courts and regulatory authorities apply two opposing regulatory approaches and the corresponding legally defined images of consumers in market regulation: the active and responsible consumer concept on the one side along with the more protective concept of vulnerable consumers on the other side. The paper examines the normative concept of the consumer from a broad perspective of market regulation by focussing on unfair commercial practices as this is a horizontal instrument involving a broad range of transactions in various markets and because the Unfair Commercial practices Directive 2005/29 specifically lays down the normative concept of the consumer (both ‘average’ and ‘vulnerable’) in its provisions. The analysis proceeds on the basis of the normative standard as developed in the ECJ’s jurisprudence on free movement rules and further provides a case study of two Central and Eastern European Member States – Hungary and Poland. It examines how EU law and national laws implemented, and how the ECJ and national courts and regulatory authorities interpret the normative concepts of the consumer (both ‘average’ and ‘vulnerable’). The specific questions the paper analyzes are: Do the existing normative notions of the ‘average’ consumer and the definition of consumers in EU and national law correspond to public policy discourse on consumers’ active role in regulating markets? How do these laws address the vulnerability of consumers? How do the EU and national law notions conceptually link to each other? And most importantly how do courts and regulatory authorities interpret these notions? The paper finds that while there are clear normative concepts of the consumer in the legislation and EU free movement jurisprudence, their application in other fields of EU consumer law, as well as in national law, demonstrate a more nuanced image of the consumer. The paper argues that the legal rules and the envisaged concepts of the consumer need to be enriched by insights from law enforcement. Moreover, both law and law enforcement must be informed both of how markets evolve and how the role of consumers changes as well as enriched by the results from other social sciences, most notably behavioural economics studying consumer behaviour.
Cet article analyse la question comment le droit de l’Union européenne et le droit national mettent en œuvre, ainsi que comment les tribunaux et les autorités de régulation appliquent, deux approches réglementaires opposées à l’image légal du consommateur dans le domaine de la réglementation des marchés : d’une part le concept de consommateur actif et responsable, et d’autre part le concept plus protectrice de consommateur vulnérable. L’article examine le concept normatif du consommateur dans une large perspective de régulation du marché en mettant l'accent sur des pratiques commerciales déloyales. C’est parce que c’est un instrument horizontal qui implique un vaste éventail de transactions sur les différents marchés et parce que le Directive 2005/29 relative aux pratiques commerciales déloyales des entreprises prévoit le concept normatif du consommateur (« moyen » et « vulnérable ») dans ses dispositions. L’analyse est basée sur le standard normatif développé dans la jurisprudence de la Cour de justice de l’Union européenne concernant les dispositions sur la libre circulation, mais elle fournit aussi une étude de cas de deux États Membres d’Europe centrale et orientale - la Hongrie et la Pologne. Il examine comment le droit de l’Union européenne et les droits nationaux mettent en œuvre, et comment la Cour de justice de l’Union européenne, les cours nationales et les autorités de régulation interprètent, les concepts normatifs du consommateur (« moyen » et « vulnérable »). Les questions spécifiques analysées dans l’article sont suivantes : Est-ce que les notions normatives concernant le consommateur « moyen » et la définition du consommateur dans le droit de l’Union européenne et la législation nationale correspondent aux discours de la politique publique sur le rôle actif des consommateurs dans la régulation des marchés? Comment ces lois traitent la vulnérabilité des consommateurs? Comment les concepts utilisés dans le droit de l’Union européenne et le droit national sont liées ? Et surtout, comment les tribunaux et les autorités réglementaires interprètent ces notions? L’article constate que bien qu'il existe des concepts normatifs clairs du consommateur dans la législation de l’Union européenne et dans la jurisprudence de la Cour de justice de l’Union européenne concernant la libre circulation, leur application dans d’autres domaines du droit européen, notamment dans le droit du consommateur, ainsi que dans le droit national, démontrent une image plus nuancée du consommateur. L’article affirme que les règles juridiques et les concepts du consommateur doivent être enrichis par les expériences de l’application du droit. De plus, le droit et le système de son application doivent prendre en compte comment les marchés évoluent et comment le rôle des consommateurs change. De plus, le droit et le système de son application doivent être enrichi par l’expérience d'autres sciences sociales, notamment l'économie comportementale focalisé sur le comportement des consommateurs.

Although existing models describing consumer behaviour offer a great deal of insight into the patterns and heuristic behind every customer’s buying decisions, they are not without serious limitations and operate as standalone units. Shopping intelligence, a completely new concept in economic psychology, not only attempts to merge the existing concepts into one, but to add value by allowing researchers to objectively assess respondent’s shopping style and capabilities in quantitative manner. Knowledge of these factors will allow the companies to be more competitive, by better tailoring their product, price and marketing strategies to the needs of its customers. It will also help entrepreneurs avoid losses due to inappropriate choice of the aforementioned strategies. Customers will too be beneficiaries, as they will receive a product that meets their demands better.

Conjoint analysis is a statistical method popular in marketing research. It allows to analyze the combined effect of many product attributes in order to look into consumer's willingness to purchase. The article presents the most important types of conjoint analysis, their characteristics and examples of application. It also looks for new development paths for conjoint analysis and consumer sciences.

Opis:
An introduction of a new product to the market usually needs modelling consumer behaviour and consumer reaction to this product as well as developing marketing strategies that would contribute to this introduction. The present article deals with investigating the causes of slow consumer acceptance of innovation; systematization and determining the main features concerning new marketing approaches to overcoming consumer resistance to the use of a new product and its functional applications; discussing marketing strategies for decreasing fears in decisions related to the new product purchase. Such strategies might be helpful when solving the problem of rejecting the innovation and increasing the possibility of its success.
Wprowadzenie nowego produktu na rynek na ogół wymaga modelowania zachowania i reakcji konsumenta na ten produkt, jak również opracowania strategii marketingowych, które by się przyczyniały do tego wprowadzenia. Artykuł poświęcony jest badaniu przyczyn powolnej akceptacji innowacji przez konsumentów; systematyzacji i określaniu głównych cech dotyczących nowych podejść marketingowych do przezwyciężenia oporu konsumentów przed korzystaniem z nowego produktu i z jego zastosowań funkcjonalnych; omówieniu strategii marketingowych dla zmniejszenia obaw w decyzjach odnoszących się do zakupu nowego produktu. Strategie takie mogłyby się okazać pomocne w rozwiązaniu problemu odrzucenia innowacji i zwiększeniu możliwości jego sukcesu.
