Naczelny Sąd Administracyjny w wyroku z 10 lipca 2019 r., II OSK 2195/17, «Lex» nr 2753259, stwierdził, że nie ma podstawy prawnej do żądania przez organ nadzoru budowlanego złożenia przez inwestora oświadczenia o posiadanym prawie do terenu na cele budowlane. Nie oznacza to jednak, że w postępowaniu prowadzonym w trybie przepisów art. 50-51 pr.bud. organ nie może tego badać w toku prowadzonych przez siebie czynności dowodowych. Przedstawiony przez NSA pogląd prawny jest zgodny z aksjologią konstytucyjnego systemu ochrony prawa własności, gdyż w przeciwnym razie, kwestia tytułu inwestora do nieruchomości przeznaczonej na cele budowlane pozostałaby poza kontrolą właściwych organów administracji.
In its verdict of 10 July 2019 (II OSK 2195/17, Lex No. 2753259), the Polish Supreme Administrative Court ruled that there are no legal grounds for the authority supervising construction to demand that the investor submit a declaration confirming his right to the land on which the construction project is to be carried out. However, this does not mean that in proceedings under Arts. 50-51 of Polish construction law the supervising authority may not consider and look into the issue in the course of its evidentiary activities. The legal view presented by the Supreme Administrative Court is consistent with the axiology of the Polish constitutional system for the protection of property rights, otherwise the investor’s title to real estate intended for construction purposes would remain beyond the control of the applicable administrative bodies.

Szpitalne komisje etyczne (SKE) funkcjonują w systemach opieki zdrowotnej od wielu lat. Ich głównym zadaniem jest pomoc zarówno pacjentom i ich bliskim, jak i personelowi medycznemu w rozwiązywaniu problemów natury etycznej pojawiających się w związku z realizowaniem opieki medycznej. Celem pracy była ocena zakresu informacji dotyczących funkcjonowania szpitalnych komisji etycznych w Polsce, udostępnianych na stronach internetowych szpitali. Analizie poddano strony internetowe szpitali akredytowanych oraz placówek ujętych w wykazie prowadzonym przez Ośrodek Bioetyki Naczelnej Izby Lekarskiej. W wyniku przeprowadzonej analizy stwierdzono, że niemal połowa badanych placówek (50,7%) nie przedstawia składu osobowego powołanych komisji. Tylko w przypadku jednej komisji wskazano, że jej członkowie mają wykształcenie w zakresie bioetyki. Zadaniem większości SKE (72,5%) jest ochrona praw pacjenta, rozwiązywanie problemów natury etycznej (66,7%), nadzór nad przestrzeganiem przez personel medyczny zasad etyki zawodowej (46,4%).
Hospital ethics committees (HECs) have functioned in healthcare systems for many years. Their main task is to help patients and their relatives as well as medical staff in solving ethical problems that arise in connection with the implementation of medical care. The aim of the study was to find out what information on the functioning of hospital ethics committees in Poland is made available to interested persons on hospital websites. The websites of accredited hospitals and the establishments included in the list kept by the Center of Bioethics of the Supreme Medical Chamber were analyzed. Almost half of the surveyed institutions (50,7%) do not disclose the composition of the appointed committees. Only one committee indicated that its members had education in the field of bioethics. The task of most HECs (72,5%) is to protect a patient’s rights, solve ethical problems (66,7%), andto supervise the observance of professional ethics by medical personnel (46,4%).

This paper presents the method of evaluation of a technical object as immersed in a logistic system with regard to its durability, the operational availability/readiness and the utilisation factor. These factors decide upon the object's effectiveness. For this evaluation probabilistic models from the theory of reliability and of the semi-Markov process were used. For the purpose of this paper as a technical object serves an aircraft. The process of operating an aircraft consists in using its resources to function accumulated during the process of its manufacture and resulting from a periodic regeneration of these resources in order to maintain its capability of being further operated. For the sake of better understanding our discussion we will refer to the sald 'flying craft' as an aircraft (including also other 'means of transport' into this notion). The paper in principle concerns on analysis of safe durability and aircraft availability/readiness analysis. The availability factor of an object in a logistic system expresses the prospective possibility of an effective action. The degree of utilisation of this „potential" for apassenger plane is represented by the occupancy factor. A product ctors of availability and occupancy can describe the overall effectiveness indicator, which characterises the availability and the market demand.

Obecny poziom technik komputerowych pozwala na ich skuteczne wykorzystanie w procesie monitorowania działania systemów wodociągowych oraz do analizy ich krytycznych elementów, w aspekcie jakości dostarczanej wody. W pracy przedstawiono analizę niezawodnościową funkcjonowania monitoringu jakości wody, na przykładzie systemu zaopatrzenia Wrocławia w wodę. Przeprowadzona analiza obejmowała wyznaczenie intensywności występowania jakości wody niezgodnej ze standardami, średniego czasu trwania nieodpowiedniej i odpowiedniej jakości wody w sieci wodociągowej, prawdopodobieństwa dostarczenia wody o wymaganej jakości, a także wartości wskaźników gotowości i niezawodności dostawy wody o wymaganej jakości. Ponadto omówiono algorytm i program komputerowy Jakość Wody, stanowiący podstawowe narzędzie analityczne w badaniu niezawodności funkcjonowania monitoringu jakości wody w systemach wodociągowych. Wykazano, że informacje uzyskane w procesie monitoringu dają możliwość przeprowadzenia kompleksowej oceny poziomu świadczonych usług wodociągowych w funkcji ryzyka przekroczenia wartości dopuszczalnych stężeń wskaźników jakości wody.
The available state-of-the-art computer techniques offer the possibility of monitoring how the water supply system functions, as well as analyzing the critical elements of the system, such as the quality of the water being supplied. This paper contains a reliability analysis of the functioning of the water quality monitoring process in a large water supply system (using the municipal water supply system of the city of Wroclaw as an example). Assessments were carried out for the following parameters: rate of occurrence of water quality below standard; average duration of the occurrence of up-to-standard and below-standard water quality in the water-pipe network; probability of supplying water of required quality; availability index and efficiency index of supplying water of required quality. The paper also includes the relevant algorithm and computer program ('Jakosc Wody' - Water Quality), the basic analytical tools for examining the reliability of the functioning of water quality monitoring in the water distribution system. It has been demonstrated that the information obtained from monitoring enables a complex assessment of the quality of the services provided by the waterworks, as it incorporates the risk that the admissible values of the water quality parameters can be exceeded. słowa kluczowe polskie: Jakość wody, monitoring, system dystrybucji wody, niezawodność, ryzyko, wskaźnik gotowości, wskaźnik intensywności.

This paper firstly analyzes the concept of availability of satellite constellation. Then the method of constellation availability analysis is proposed based on Markov chain model, outage analysis, as well as MTBF and MTTR of satellite constellations. Finally, an illustrative example is presented to demonstrate the method.
Artykuł w pierwszej kolejności analizuje pojęcie dostępności konstelacji satelitów. Następnie proponuje metodę analizy dostępności konstelacji opartą na modelu łańcuchów Markowa, analizie przestojów, oraz MTBF i MTTR konstelacji satelitów. Metodę zilustrowano przykładem.

Celem artykułu jest przeprowadzenie analizy metod oceny dostępności stron internetowych. Na potrzeby tej analizy przedstawiono metody oceny stron internetowych, wyodrębniono cechy stron, wpływające na dostępność oraz powołano się na obowiązujące i przyszłe przepisy w zakresie oceny dostępności stron internetowych jednostek administracji publicznej. Przeprowadzona analiza pozwoliła na przestawienie problemów wiążących się z wiarygodną i rzetelną oceną dostępności stron internetowych w świetle przyszłych przepisów w Polsce, obowiązujących od 2015 roku.
The aim of the present paper is to analyse the website accessibility methods. For the purpose of the analysis one presents the methods of website accessibility assessment, distinguishes the website features affecting their accessibility and refers to the current and future law concerning the accessibility of public administration websites. The conducted analysis allows describing the problems resulting from the reliable and trustworthy website accessibility assessment in the light of the provisions of the aforementioned Regulation which will enter into force in 2015 in Poland.

W rozdziale przedstawiono wyniki badań dotyczących awaryjności kluczowych maszyn w wybranym przedsiębiorstwie produkującym rury preizolowane na potrzeby przemysłu ciepłowniczego. Analizy awaryjności dokonano przy pomocy wskaźników dostępności, efektywności i skuteczności w oparciu o miary niezawodności, takie jak MTTR, MTBF, MDT. Analizie poddano dwie maszyny oraz ich układy: mechaniczny i elektryczny na przestrzeni ostatnich trzech lat. Badania pozwoliły określić, które maszyny najczęściej ulegają awarii, jakie układy są najbardziej awaryjne i jaki jest czas usuwania uszkodzeń. Wyniki badań pozwoliły zidentyfikować słabe strony w procesie utrzymania ruchu oraz sformułować zalecenia działań doskonalących ten proces
In this chapter, the results of investigations into the failure rate of crucial machines in a selected enterprise manufacturing pre-insulated pipes for the needs of the heat generating industry have been presented. The failure rate analysis has been conducted using the indices of availability, effectiveness and efficacy, on the basis of reliability measures, such as MTTR, MTBF, MDT. The functioning of two machines and their systems: mechanical and electrical over a period of three last years was subjected to analysis. The investigations allowed determining in which machines failures occur the most frequently, which systems are the most likely to break down and what the time of failure removal is. The research results enabled identifying weak points in the maintenance process and made it possible to formulate some recommendations for this process improvement.

The evaluation of the patients economic availability to some groups of medicines. One year follow up of a new reimbursement systemChanges in the organization and financing of the public health care are always a reason of the social restlessness. The same situation was observed in Poland where at the beginning of 2012 a new reimbursement system was introduced. Therefore the main aim of this paper is to verify economic availability of patients to medicines after implementation of the changes. The annual research perspective ensures the reliability of analysis. The study concerns 11 medicines and was conducted using official announcements of the Polish Minister of Health. Due to changes introduced by the Polish government, prices of some drugs have been permanently reduced. But in some analyzed cases (olanzapine) reduction is not sufficient. Some medicines, like gosereline were significantly more expensive in 2012 than in 2011. Although the new reimbursement system has a lot of advantages, further studies and amendments are necessary to provide a real economic availability to many important medicines.

W artykule przedstawiono problem zaspokajania potrzeb finansowania kredytem hipotecznym zakupów mieszkaniowych w kontekście zaspokajania potrzeb mieszkaniowych w latach 2005–2009. Do oceny badanego zjawiska wykorzystano wskaźniki statystyczne oceny dostępności mieszkań, zaspokojenia potrzeb mieszkaniowych oraz dostępności finansowej mieszkań. Do oceny zaspokojenia potrzeb kredytowania zakupów mieszkaniowych posłużono się wielowymiarową analizą porównawczą. Wyniki badań wykazały, iż poziom zaspokojenia potrzeb kredytowania zakupów mieszkaniowych w celu zaspokojenia potrzeb mieszkaniowych, w badanym okresie, był na dobrym poziomie. Zakup nieruchomości mieszkaniowych realizowany był głównie przy wykorzystaniu mieszkaniowego kredytu hipotecznego, niestety potrzeby mieszkaniowe w Polsce są ciągle niezaspokojone.
The article presents problem of covering financial needs by mortgage credit in context of appeasement housing needs during 2005–2009. The statistic ratios such as the housing availability assessment, assessment of satisfaction of housing needs and financial flats availability was used for this purpose. WAP was used to assess necessity of crediting housing purchase. The results showed that satisfying a need of financing housing purchase by mortgage credit at considered period, was on a good level. The purchase of housing properties was financed mainly by the mortgage credit, unfortunately the problem of residential needs in Poland is still unsatisfying.

This article aims to analyse the influence of Spanish on the lexicon available in Catalan. For this purpose, we examine to what extent the Catalan lexicon contains elements of Spanish and what value these units have within the data available. We have also classified language contact phenomena and we have specifically analysed the instances of loans in our corpus. In order to carry out this research, we have mainly focused on the data from the province of Lleida, obtained from 240 pre-college informants who filled out an associative survey regarding 17 centers of interest.

W artykule przedstawiono zasady dostepnosci i standardy oraz różnice i podobienstwa miedzy rónymi rodzajami zasobów wspieranych z budetu gmin lub panstwa, służących zaspokajaniu potrzeb mieszkaniowych ubogich i srednio zarabiajacych grup społecznych w Polsce. Przedstawiono także formy pomocy panstwa lub władz lokalnych w uzyskiwaniu i utrzymaniu mieszkan przez słabsze ekonomicznie grupy społeczne w wybranych krajach Europy Zachodniej. Z uwagi na różnie rozumiany tam termin: lokal socjalny podano stosowane w tych krajach terminy odnoszace sie do mieszkan socjalnych.
The paper presents rules of availability and standards, as well as differences and similarities between various types of housing stock, supported by commune or state budgets, used to satisfy the housing needs of poor and medium-income social groups in Poland. Forms of assistance provided by the state or local governments in the acquisition and maintenance of dwellings by economically weaker social groups in the selected West European countries were also presented. Due to various interpretations of the notion of a social dwelling, also terms that relate to such dwellings in those countries were provided.

The main aim of this article is the presentation of the way of making calculation with the application of the semi-Markov processes, with the continuous time t, where non-exponential distribution function is going to be applied. These type of calculations were published but the time there was approaching infinity. Engineering practice proves that the lack of solutions of this issue leads to obtainment of solutions that are encumbered with errors. This article is the first attempt of the error analysis.

This paper deals with modelling and evaluating the availability and profit of a linear consecutive 2-out-of-4 system exposed to three consecutive stages of deterioration before failure. The system will pass through three consecutive stages of deterioration: slow, medium and fast before failure. The failure and repair times are assumed to be exponentially distributed. Explicit expressions for the system avail-ability, the probability of a repairman being busy due to the failure of a unit, or due to the replacement of failed units, and the profit function have been derived using a probabilistic approach. The impacts of the failure and repair rate on system availability and profit have been investigated. The results of this paper will enhance system performance and ensure the timely execution of appropriate maintenance and improvement, and thus is a major tool for decision making, planning and optimisation.

Potential water resources in the upstream part of the Komering sub-watershed, in March each year ranges from 645.49 m3/sec. With a debit of that size, it should be able to increase national agricultural production in South Sumatra, Indonesia. However, in August – September, the discharge of water availability in the upstream part of the Komering sub-watershed decreased to only 43.08 m3/sec. To analyze the reduced mainstay discharge of the Upstream Komering sub-watershed, due to poor land use practices in the upstream area and the effects of climate variability, it can be analyzed by analyzing land cover conditions, the value of rain variability, and the magnitude of evapotranspiration and validation of direct measurement of river discharge in the field. Changes in land use for the upstream part of the Komering sub-watershed, which are used mostly by residents as community plantation areas, have increased the critical condition of the upstream Komering sub-watershed area of 2,517,560 Km2, or about 65.66% of the total upstream Komering sub-watershed. From the measurement of debit data at the Perjaya Dam in the last fifteen years (2005–2019), the largest main discharge value in 2 weeks to two months in April was 241.67 m3/sec, while the smallest mainstay discharge occurred in the first 2 weeks of October at 54.69 m3/sec. A large difference between the largest and smallest mainstay discharge, it is necessary to think of a way so that the availability of water is always maintained throughout the year (the difference between the mainstay discharge between the rainy season and the dry season so that it is not so extreme). Some ways that can be done to maintain the availability of water include making a reservoir that can be used during the dry season, or increasing storage in the soil by reforestation and harvesting rain.
