Im Aufsatz verfolge ich das Ziel, das Schaffen von Marquise de Sade aus dem Gesichtspunkt der Philosophie und Soziologie zu interpretieren. Der Text ist auch eine Polemik gegen die in Polen allgemein anerkannten Interpretationen des Schaffens von de Sade. Indem ich den Marquise als proto-postmodernen Autor darstelle, beabsichtige ich aufzuzeigen, dass es ihm gelungen ist, authentische Tendenzen der modernen westlichen Kultur zum Ausdruck zu bringen. Indem Sade versuchte, endgültige Konsequenzen aus der Abkehr der westlichen Kultur von der christlichen Moraltradition zu ziehen, hegte er die Überzeugung, dass die Abwendung von metaphysischen Ideen die ganze menschliche Existenz auf die sinnliche Dimension des Lebens reduzieren sollte. Analog dazu bildet gegenwärtig die Entwicklung der Pornographie und der auf erotischen Inhalten basierenden Massenkultur eine virtuelle Welt der Begierde und des ununterbrochenen Spiels mit menschlicher Sinnlichkeit. Die philosophische Grundlage dieser Entwicklung bildet ausgerechnet das Schaffen von Marquise. Letztendlich schafft die gegenwärtige postmoderne Kultur eine soziale Wirklichkeit, in der der Mensch auf bewusste Weise die Sinne über die Ideen herrschen lässt – und nicht umgekehrt.
The aim of the present article is an interpretation of the works of Marquise de Sade from a philosophical and sociological point of view. The text also poses a polemic with the interpretations of Sade’s work, which are generally acclaimed in Poland. Introducing the Marquis as a proto-postmodernist, I will try to indicate that the he effectively managed to express the authentic tendencies of the contemporary Western culture. Trying to face the final consequences of the departure from the Christian traditions and principles of social integration, Sade believed that the departure from metaphysical ideas should limit the human life to its sensual dimension. Likewise, the contemporary expansion of pornography and the mass culture based on erotic content builds a virtual world of lust and a persisting game of human sensuality. The philosophical foundation of this development constitutes the work of de Sade. In conclusion, the contemporary postmodern Western culture creates a social reality in which human intentionally allows her/his senses to dominate ideas – and not vice versa.
Celem artykułu jest interpretacja twórczości Markiza de Sade’a z punktu widzenia filozofii i socjologii. Tekst stanowi też polemikę z powszechnie uznanymi w Polsce interpretacjami twórczości Sade’a. Przedstawiając Markiza jako proto-postmodernistę wskazuję, że udało mu się wyrazić autentyczne tendencje współczesnej kultury zachodniej. Usiłując wyciągnąć ostateczne konsekwencje odejścia zachodniej kultury od chrześcijański tradycji moralnej oraz zasad integracji społecznej, Sade żywił przekonanie, że porzucenie metafizycznych idei powinno sprowadzić całą ludzką egzystencję do zmysłowego wymiaru życia. Współczesny rozwój pornografii oraz kultury masowej opartej na treściach erotycznych tworzy – analogicznie – wirtualny świat pożądania oraz nieustającej gry ze zmysłowością ludzką. Filozoficznym fundamentem tego rozwoju jest właśnie twórczość Markiza. Ostatecznie współczesna kultura ponowoczesna tworzy rzeczywistość społeczną, w której człowiek w sposób świadomy pozwala zmysłowości panować nad ideami – a nie odwrotnie.

This article analyses the question of Polish-Hungarian borderland in the Early Modern Age. On the basis of the work Chronografia albo Dziejopis Żywiecki by Andrzej Komoniecki, it discusses various problems related to the political, economic and social history of the Żywiec borderland region. In addition, Komoniecki’s attitude towards members of neighbouring communities across the borders is presented, as the chronicle includes many references to the day-to-day lives of the burghers and peasants from Żywiec and the surrounding area. Komoniecki describes their customs, rituals and mentality, and devotes much space to descriptions of robberies and executions of criminals. It is  suggested, moreover, that Komoniecki was particularly interested in natural disasters and other unusual events.
W artykule zostało omówione pogranicze polsko-węgierskie w epoce nowożytnej. Podstawą do przeprowadzonych badań było dzieło Andrzeja Komonieckiego Chronografi a albo Dziejopis Żywiecki. W oparciu o to źródło Autorka analizuje problemy związane z kwestiami politycznymi, ekonomicznymi oraz dziejami społeczności zamieszkującej Żywiec i otaczające je pograniczne ziemie. W artykule został zaprezentowany także, wyłaniający się z dzieła, stosunekKomonieckiego do Węgrów. W kronice można odnaleźć wiele wzmianek dotyczących przede wszystkim życia codziennego mieszkańców Żywca i okolic. Komoniecki ze szczegółowością opisuje ich zwyczaje, rytuały, mentalność. Dużo miejsca poświęca także opisowi rozbojów dokonywanych przez zbójników działających na obszarze pogranicza. Kronikarz jest także zainteresowany wszelkimi nadprzyrodzonymi zjawiskami i dziwnymi zdarzeniami. Wszystko to czyni omawiane dzieło niezwykle cennym i interesującym świadectwem życia ludzi mieszkających na pograniczu.

In this article, I compare two positions – emergentism and panpsychism, in relation to the problem of the nature of consciousness. I analyze arguments offered in support of both positions and undertake to question them. I focus on panpsychism as the less known and more controversial position. Panpsychism and emergentism are considered “metaphysical hypotheses”. Finally I propose emergentism as a preferable position in view of the fact that it is impossible to defend panpsychism as a coherent position, compatible with science.

La buona figliuola (The Accomplish’d Maid) is an opera buffa in three acts by Niccolò Piccinni and Carlo Goldoni. The librettist based his text on Samuel Richardson’s novel Pamela, or Virtue Rewarded. It was performed for the first time at the Teatro delle Dame, Rome on 6th February 1760 with an all male cast. It was a big success and La buona figliuola took Europe by storm. Every European opera house had this opera in its repertoire. The performances were in: Barcelona, Prague, Vien, Dresden, London, Berlin, Mannheim and Paris. This opera was probably performed even in Beijing by Jesuits in 1778. La buona figliuola was so popular in Europe that Stanisław August Poniatowski, the King of Poland, wished it for his coronation ceremony. The performance took place at the National Theatre on 7th August 1765, just five years after the world premiere. This opera was also very popular in Warsaw. People loved the story of a simple and good maid Cecchina. Seventeen years later, Wojciech Bogusławski, the director of the National Theater, translated and adapted Goldoni’s opera and named it Czekina albo cnotliwa panienka (Czekina or a Virtuous Maid). He performed it in 1782 with big success. First of all, the article describes the historical context of the creation of libretto – the Carlo Goldoni’s biography. Next, it presents the story of maid Cecchina and the phenomenon of the description of the Polish theories of translation from the 18th century, the Polish version of the opera – Czekina or a Virtuous Maid, is presented. Finally, two versions of the libretto – the Goldoni’s and the Bogusławski’s, are compared.

This paper combines on the one hand the educational ideals and didactics in the schools of the Polish–Lithuanian Commonwealth reformed by the Commission of National Education (1773), and on the other hand one of the most representative testimonies of the then intellectual culture, i.e. Encyclopédie ou dictionnaire universel raisonné des sciences, des arts et des métiers, published in the years 1751–1780. It shows continuity with regard to learned culture and the place of philosophy in modern school. In accord with the standards of the Encyclopédie the European school preserved the course of philosophy in the spirit of philosophia recentiorum, at least at the university level. This philosophy took a critical approach in its assimilation of the elements of modern epistemology, especially the accomplishments of modern natural sciences. Such attitude was also typical of the school reformed in the mid-eighteenth century in the Commonwealth, especially by the orders of Piarists and Jesuits. The Commission had introduced independent mathematical and natural subjects, a fact that limited philosophy. In secondary schools philosophy was reduced to logic and practical ethics, and at universities to natural law with social, political, and economic elements. For this reason they even departed from a traditional structure of university, with a propedeuctic faculty of philosophy, when in the spirit of the physiocratic physical and moral orders a two-element structure of universities was established. Despite these changes, philosophical elements can be found even in the didactics of natural sciences in the schools of the Commission. The same tendencies are apparent in the then European school, therefore in the form of interpretations drawing on the category of substance and its properties, or even the conception of the animal soul.

This paper combines on the one hand the educational ideals and didactics in the schools of the Polish–Lithuanian Commonwealth reformed by the Commission of National Education (1773), and on the other hand one of the most representative testimonies of the then intellectual culture, i.e. Encyclopédie ou dictionnaire universel raisonné des sciences, des arts et des métiers, published in the years 1751–1780. The activity of the Commission, likewise its preceding reforms carried out in the Commonwealth in church schooling in the mid-eighteenth century, correspond with analogous changes in Europe, their specific example manifestation Encyclopédie. Their spirit was similar, it sought to reconcile modern utilitarianism – appropriate to the needs of absolutist states, which had taken the concern for education from religious groups – with an integral vision of school. In this vision, the fundamental elements was moral formation combined with religious formation. Despite some manifestations of certain rationalism and naturalism, in line with the spirit of the epoch, rather more typical of Encyclopédie than the Commission’s schooling, religion remained the foundation of morality, and the latter was the ground of the social order.

Jest to glosa aprobująca w stosunku do uchwały Sądu Najwyższego o sygn. III CZP 36/13. Autor aprobuje wypracowaną w tej uchwale tezę, że „Właściciel rzeczy może żądać od posiadacza służebności wynagrodzenia za bezumowne korzystanie z rzeczy”, nawet wówczas gdy właściciel nie realizuje roszczenia negatoryjnego polegającego na żądaniu usunięcia urządzeń przesyłowych. Roszczenie o wynagrodzenie za bezumowne korzystanie z rzeczy ma zdaniem sądu i autora charakter samodzielny. Zagadnienie samego charakteru prawnego roszczeń uzupełniających, a zwłaszcza ich samodzielności, nadal budzi spory w polskiej cywilistyce. Wątpliwości dotyczą również tego, czy do wystąpienia przez właściciela z roszczeniem o wynagrodzenie za bezumowne korzystanie z nieruchomości bez tytułu prawnego niezbędna jest równoczesna legitymacja tego właściciela do wystąpienia z roszczeniem windykacyjnym, co wykluczałoby żądanie wynagrodzenia przy istnieniu podstaw do jedynie roszczenia negatoryjnego. Zatem wyłączone byłoby tego rodzaju roszczenie dla urządzeń przesyłowych. Należy się zgodzić ze stanowiskiem sądu, że roszczenie o wynagrodzenie za korzystanie z rzeczy ma charakter obligacyjny i wówczas, gdy powstanie - uzyskuje samodzielny byt w stosunku do innych roszczeń właściciela i może być przedmiotem obrotu.
This is a commentary approving the ruling of the Supreme Court ref. III CZP 36/13. The author endorses the argument put forward in this ruling that “The owner can demand a fee from the possessor of the easement for non-contractual use of a thing”, even if the owner does not pursue actio negatoria that is based on demanding removal of transmission facilities. In the Court's opinion and the author’s opinion as well, a claim for a fee for non-contractual use of a thing is independent. The issue of the legal nature of the supplementary claims, particularly their independence, remains a matter of dispute in Polish civil law. It is also questionable whether it is necessary for the owner to simultaneously have entitlement to pursue rei vindicatio in order to demand a fee for non-contractual use of a real estate without legal title, which would exclude a claim for a fee in the presence of grounds only for actio negatoria. Therefore, this kind of a claim would be excluded with regard to transmission facilities. One shall accept the standpoint of the Court that the claim for a fee for non-contractual use of a thing has the nature of obligation, and when it arises - it obtains independent existence in relation to other claims of the owner and may be traded.

Artykuł Robinson na scenie czyli dzieje nieudanej adaptacji dotyczy opery komicznej Robinson Crusoe Jacquesa Offenbacha, której libretto powstało w oparciu o fabułę wielkiej powieści Daniela Defoe. Adaptacja, dokonana przez francuskich librecistów w drugiej połowie XIX wieku, daleko odbiegła od epickiego pierwowzoru i z powieści będącej epickim hymnem na cześć ludzkiej zaradności i siły przetrwania uczyniła błahą komedię z banalną akcją i bez głębszego przesłania. Porównanie dwóch różnych gatunkowo tekstów o tym samym bohaterze przynosi wniosek o organicznej nieprzekładalności monumentalnej powieści, szczególnie na komedię, przeznaczoną na scenę muzyczną.
The article discusses Jacques Offenbach’s operetta Robinson Crusoe, whose libretto is based on the great 1719 novel by Daniel Defoe by the same title. The adaptation by French librettists in the late 19th century is a far cry from the original narrative. The novel, an epic hymn to human resourcefulness and resilience, became a light comedy with a trite story line and without a deeper message. The analysis of two formally very different texts with the same protagonist brings about a conclusion of an innate impossibility of translating a grand novel to a comedy stage.

Body mass (size) is a very important biological character, interrelated with key life history traits, such as fertility, age at maturity, reproductive success and mortality. On the physiological level, body mass is also closely associated with key components of energy budgets. Yet, factors moulding within-species variation of body mass and its relations to energy expenditures and life history traits are still not fully understood. The weasel (Mustela nivalis Linneaus, 1776) is an extremely interesting species almost perfectly suited to study these relations. It is characterized by a considerable variation in body mass (range 40-150 g) and extremely high metabolic rates. This highly specialised predator hunts on different species of rodents. In the forest weasel preys on the bank vole (Clethionomys glareolus) and yellow-necked mouse (Apodemus flavicollis), whereas in the open habitats it mainly preys on the voles (Microtus spp.). Due to their small body size and high metabolic rates, weasels encounter numerous constraints. The prey size is one of the main ecological factors determining variation in weasel's body mass. Males heavier than 100 g suffer from increased winter mortality. We therefore hypothesise that in summer bigger males are favoured by sexual selection, whereas in winter energy constrains select for smaller animals. To test this we investigated time budgets, resting (RMR) and field metabolic rate (FMR) in weasel males of various sizes during winter and summer. In contrast to other carnivore species the body-mass corrected RMR of weasels was lower in winter than in summer. Weasels also minimised their winter energetic expenditures by decreasing hunting activity (on average 4 h/day in summer vs. less than 2 h/day in winter). Irrespective of body mass this was usually sufficient to catch just a single prey unit. In accordance with our expectations the winter hunting activity was sufficient to balance the energy budget of small males, but compromised survival prospects of bigger individuals.

In his article the author sketches a portrait of Geralt of Rivia, a title character of Andrzej Sapkowski’s Witcher series aw well as a video game The Witcher 3: Wild Hunt, while at the same time tracing the work of deconstruction inscribed in the figure of the hero. Most significantly, it is Geralt’s gender identity that becomes subject to deconstruction; a model of heroic, fatherly, withdrawn masculinity becomes subverted and unseamed – on the one hand by female corporality; on the other, by female politics – which results in questioning and rejecting the so far dominant model in favour of subjectivity suspended between femininity and masculinity (and their other variants).

W wielu wypadkach wyjaśnia genezę swoich powieści i udział Trebutiena jako źródła rozmaitych informacji. Przedstawia swoje poglądy na temat samych listów. Wyjaśnia, jak uporządkować korespondencję w przypadku ewentualnego jej opublikowania. Z tych właśnie względów listy jako parateksty powinny znaleźć się w dziełach zebranych Barbey d'Aurevilly'ego.

This paper seeks to show the State in its historical and analytical approaches. In view of history, we find two principal solutions. In this text they are called metaphysical and contractual. The metaphysical solution is characteristic of the pre-modern era with its Aristotelian claim that we carry the social principle in our human nature; the principle is the spawning ground for the State. Now, the contractual, i.e. the modern, approach defines the State as a result of human negotiation. Historically speaking, there have been many proposals along the spectrum from an overgrown institution to its, much atrophied, form. The author proposes a modest approach to our understanding of the State: it is needed from the well-being of social community. The condition, however, of this well-being is that the State be limited, allowing much space for its society to grow and form indispensable interrelations.
Artykuł przedstawia państwo z historycznego i analitycznego punktu widzenia. Jeśli chodzi o historię, mamy tu dwa rozwiązania. W tekście zostały określone jako rozwiązanie metafizyczne i kontraktowe. Rozwiązanie metafizyczne cechuje epokę przednowożytną. Tutaj punktem centralnym jest pogląd Arystotelesa, iż zasada społeczna zawarta jest w ludzkiej naturze. Na tej zasadzie zbudowane jest państwo. Podejście kontraktowe charakteryzuje epokę nowożytną – państwo powstaje jako efekt negocjacji. Historycznie rzecz ujmując, powstało wiele propozycji formy państwa: od przerośniętej instytucji do jej bardzo zubożonej formy. Autor proponuje skromne podejście do rozumienia państwa: jest potrzebne dla zdrowia społecznej wspólnoty. Jednakże warunkiem tego zdrowia jest państwo ograniczone, które pozostawia dużo przestrzeni dla rozwoju społeczeństwa i ważnych społecznych relacji.

The text is an intervention in post-secularist and anti-fundamentalist philosophy of affective alterity. It attempts to reconstruct the philosophical tradition of affective alterity and to construct a theory of it. Homosexuality is affective alterity, the other love of Thou and I. We explore dynamic religions in their openness to the Other. Emphasis is on Judaism and the "Love the stranger" postulate in the Hebrew Bible; we go back to biblical and rabbinical literature as well as Erich Fromm's and Julia Kristeva's psychoanalytic interpretations of them. The idea of hospitality, rooted in the Bible and the Koran, was revived by Jacques Derrida, Julia Kristeva, Griselda Pollock, and Geoffrey H. Hartman. It is of urgent importance in Poland where fundamentalist misogyny and homophobia increase. In our paper, queer rights are examined as human rights - and this is again pertinent in Eastern Europe. The methodology of the intersection of cultural analysis and Jewish studies here are inspired by Mieke Bal and Ernst van Alphen. The particular connection between Jewishness and queerness is stressed by Daniel Boyarin, Ann Pellegrini and Alisa Solomon; as we write, it is to be found in today's Poland in the Shterndlech Iton Babel magazine, published by the younger generation. Also, the feminist studies of Maria Janion, Kazimiera Szczuka and Bozena Uminska are of significance here. We end with visual culture productions: the queer or omni-sexual art exhibition against nationalist censorship Love and Democracy, curated by Pawel Leszkowicz in Poznan (2005), and in Gdansk (2006). Throughout the paper we propose our understanding of love. The text whose part is entitled "Faith and Democracy" is a sequel to our Polish-language book Love and Democracy. Reflexions on the Homosexual Question in Poland (2005) with an extensive English summary. Our loves, our subjectivities are despised and disrespected, but created in art, philosophical research, and activism. Let us exercise (in) love.

The aim of this paper is to illustrate the analogy of law and game on the example of selected problems of contemporary theory and philosophy of law. The frames of this text are determined by the metaphor of the game, and in particular by the reference to football, because football has the feature of universality in the modern world. In the context of the relationship between the law and the game, the basic assumptions of the concept of H. L. A. Hart, R. Dworkin, A. Marmor, A. Hutchinson, J. Searle are introduced. Above all, however, the use of the metaphor of the game by H. L. A. Hart in „Concept of Law” is being described. Particular emphasis is placed on discussing the distinction he made between the game according to the rules and the game of „scorer’s discretion”. Considerations regarding this problem are supplemented with examples from the world of football.

This paper presents three texts regarding erotic behaviours: from the 16th, 17th and 18th centuries. Their interpretation in the works by historians of literature and manners is subjected to a critical reflection aiming to show that inattentive or unskilful reading of the language of an old text or perception of old behaviours from the perspective of the contemporary culture leads to distortions and misunderstanding. As a result, evaluations of the same phenomena and behaviours are completely different, which prevents understanding and acceptance of the specificity of the world of the past.

Tematem artykułu są domy narożne w kwartale zabudowy miejskiej i towarzysząca im wyjątkowość formy wynikająca ze specyfiki ich usytuowania w strukturze miasta. Celem badań jest wykazanie, iż znane z przeszłości rozwiązania próbują być współcześnie implementowane i reinterpretowane na nowych warunkach formalnych i estetycznych. Badania zostały przeprowadzone ze względu na wyjątkową specyfikę przestrzenną formy domu narożnego w zabudowie miejskiej, która jest predestynowana do rozwiązań oryginalnych i od zawsze stanowiła twórczą pokusę do wymyślania kształtów mogących aspirować do miana lokalnego znaku miejsca. Przedmiotem badań są budynki narożne o szeroko rozumianym przeznaczeniu mieszkalnym, których formy mają kluczowy wpływ na rozpoznawalność współtworzonych miejsc. Podstawową metodą badawczą jest analiza wybranych realizacji. Wyniki badań wskazują na różnorodne rozstrzygnięcia przestrzenne brył domów narożnych, dając przesłanki do wypracowania pewnych typologii i teoretycznych podstaw projektowania tego rodzaju zabudowy. Na podstawie przeprowadzonych badań wysunięto wnioski dotyczące zasad komponowania atrakcyjnych form domów narożnych. Atrakcyjność ta może być realizowana zarówno w oparciu o rozwiązania zachowawcze i wynikowe, jak i tworzyć czytelny znak miejsca poprzez oryginalne formy, często o ekspresywnym charakterze.
The topic of the paper are corner houses in an urban block and the accompanying uniqueness of form that results from the specific nature of their location in the urban structure. The study aims to demonstrate that there are currently attempts at implementation and reinterpretation of the solutions known from the past under new formal and aesthetic conditions. The study was conducted owing to the unique spatial specificity of the form of a corner house in urban development, which is predestined for original solutions and has always been a creative temptation to invent shapes that can aspire to the status of the local sign of a place. The subject of the study is corner buildings with a broadly understood residential purpose whose forms have a key impact on the recognition of co-created places. The basic research method is the analysis of selected developments. The research results indicate various spatial solutions of the bodies of corner houses, giving premises for the formulation of certain typologies and theoretical bases for the design of this type of buildings. On the basis of the research, conclusions were drawn on the principles of composing attractive forms of corner houses. This attractiveness can be achieved both by means of conservative and resultant solutions, as well as by creating the legible sign of a place through original forms which are frequently expressive in character.

Pozytywizm jest rodziną kierunków filozoficznych wysoko ceniących naukę i poznanie naukowe. Charakterystyczne dla pozytywizmu są tezy, że jedynie nauka dostarcza poznania wartościowego oraz że filozofia nie ma metody innej niż naukowa. Zamiarem pozytywistów było usunięcie metafizyki z obszaru filozofii. Profesor Bogusław Wolniewicz, jeden z bardziej oryginalnych polskich filozofów analitycznych drugiej połowy XX wieku, był stanowczym przeciwnikiem antymetafizycznych tendencji w filozofii. Autor omawia i poddaje dyskusji problem relacji nauki i filozofii oraz stanowisko Wolniewicza i jego argumenty skierowane przeciwko pozytywizmowi i scjentyzmowi.

It is not a coincidence that urban fantasy is being identified with modern, futuristic metropolises. On its streets, two worlds are juxtaposed: the real and the magical. Unlike the first one, the latter is concealed in shadows, hiding elves, vampires, and other magical creatures from the watchful eyes of ordinary citizens. Only a handful of informed humans have the right to step into this world, which is presented only to the select few. The author of the article Guns and Hats, or a Drowner on a Bicycle: On the (Retro)Industrial Adaptation of Urban Fantasy Subgenre distinguishes between three main tropes of the eponymous convention: a presence of the city, a coexistence of magical and empirical world, and an influence of organisations guarding the secret of the otherworld. All three mentioned tropes are exemplified in two contemporary fantasy novels—Adam Przechrzta’s Adept (The Adept) and Charlie Fletcher’s The Oversight, both set in the nineteenth-century fictionalised reality, which bears resemblance to urban fantasy subgenre. In the end, nineteenth-century city turns out to be the best locale to set a fantasy story that addresses the primary sense of urbanization.
