Many occupations in industry such as metal stamping workers, electronics parts assembly operators, automotive industry welders, and lathe operators require working in a standing posture for a long time. Prolonged standing can contribute to discomfort and muscle fatigue particularly in the back and legs. This study developed the prolonged standing strain index (PSSI) to quantify the risk levels caused by standing jobs, and proposed recommendations to minimize the risk levels. Risk factors associated with standing jobs, such as working posture, muscles activity, standing duration, holding time, whole-body vibration, and indoor air quality, were the basis for developing the PSSI. All risk factors were assigned multipliers, and the PSSI was the product of those multipliers. Recommendations for improvement are based on the PSSI; however, extensive studies are required to validate their effectiveness.

Purpose – Without undertaking a comprehensive assessment of the costs and benefits of the urban sprawl, this article attempts to analyse the impact of this phenomenon on the financial standing of municipalities. Research method – We have primarily used difference-in-differences (DiD) regression analysis with refe-rence to the treatment group (suburban municipalities) and the control group (other municipalities excluding cities with county status). The research was undertaken during the years 2004-2018 and used financial data from the Ministry of Finance. Results – Urban sprawl is a beneficial phenomenon, at least in the short and medium term from the perspective of the financial standing of municipalities (which experience an inflow of new residents). It is clearly evidenced in the revenues of the budgets of suburban municipalities, i.e. an increase in both total and per capita revenues in relation to the control group. The effect of suburbanisation is also visible on the spending side, although, due to the economies of scale, current expenditures grow relatively slower than the number of inhabitants. The operating surplus of the budget per capita is increasing more rapidly in suburban municipalities compared to the control group. The same is true for municipal investment expenditures. Originality /value / implications /recommendations – In reviewing the subject literature, the issue of the impact of urban sprawl on the finances of local government units (LGU) is treated marginally and indirectly, e.g. when discussing the costs of providing local public services. This article aims to present a synthetic and quantitative review of the impact of suburbanisation on the financial position of LGU budgets, comparing the situation of suburban municipalities to other municipalities. Attracting “new” residents is a desirable strategy in the development of municipalities, hence with the current system of financing, LGUs are likely to oppose changes aimed at limiting or controlling the suburbanisation process.

Opis:
The distribution of perturbations of pressure and velocity in a rectangular resonator is considered. A resonator contains a gas where thermodynamic processes take place, such as exothermic chemical reaction or excitation of vibrational degrees of a molecule’s freedom. These processes make the gas acoustically active under some conditions. We conclude that the incident and reflected compounds of a sound beam do not interact in the leading order in the case of the periodic sound with zero mean pressure including waveforms with discontinuities. The acoustic field before and after forming of discontinuities is described. The acoustic heating or cooling in a resonator is discussed.

The article proposes an alternative method to determine the sequence of generation of pre-tension forces in standing rigging of a mast. The proposed approach has been verified on both a virtual simulation experiment and laboratory tests. In this method, the desired tension values are obtained using the influence matrix which allows to calculate the effect of tension change in an individual rope on the tension distribution in the remaining ropes in the system. Unlike the presently used method, in which the desired tension distribution is obtained in a long-lasting iterative proces burdened with relatively large errors of final values, the proposed method makes it possible to achieve the final tension distribution in a finite number of steps. In the case of FEM analyses, the new method can be a useful tool for determining an arbitrary distribution of tension forces in ropes via solving a system of linear equations.

The study is devoted to standing acoustic waves in one-dimensional planar resonator which containing an ideal gas. A gas is affected by the constant mass force. Two types of physically justified boundary conditions are considered: zero velocity or zero excess pressure at both boundaries. The variety of nodal and antinodal points is determined. The conclusion is that the nodes of pressure and antinodes of velocity do not longer coincide, as well as antinodes of pressure and nodes of velocity. The entropy mode may contribute to the total field in a resonator. It is no longer isobaric, in contrast to the case when the external force is absent. Examples of perturbations inherent to the entropy mode in the volume of a resonator are discussed.

Standing waves and acoustic heating in a one-dimensional resonator filled with chemically reacting gas, is the subject of investigation. The chemical reaction of A → B type, which takes place in a gas, may be reversible or not. Governing equations for the sound and entropy mode which is generated in the field of sound are derived by use of a special mathematical method. Under some conditions, sound waves propagating in opposite directions do not interact. The character of nonlinear dynamics of the sound and relative acoustic heating or cooling depends on reversibility of a chemical reaction. Some examples of acoustic heating in a resonator are illustrated and discussed.

W opracowaniu przedstawiono możliwość wykorzystania analizy wskaźnikowej do oceny kondycji finansowej spółki notowanej na GPW. Celem przeprowadzonych badań jest omówienie praktycznego zastosowania wspomnianej analizy, której dokonano na podstawie przeglądu literatury przedmiotu, a także pełnej sprawozdawczości (bilansu oraz rachunku zysków i strat). Rezultatem badań jest ocena standingu finansowego na przykładzie spółki akcyjnej działającej w sektorze żywności, produkującej wyroby cukiernicze, przede wszystkim na polski rynek, w porównaniu ze średnimi wynikami osiąganymi w branży. Okres badawczy obejmuje 10 lat. Otrzymane wyniki wskazują, że opisywana spółka prowadziła konserwatywną strategię dotyczącą aktywów i pasywów. Jednak w przeciwieństwie do konkurentów odznaczała się agresywną polityką nakierowaną na zwiększenie odbiorców produktów lub usług. Ponadto badana spółka stosowała surową politykę kredytowania odbiorców i miała niski poziom ogólnego zadłużenia. Z tych względów można wnioskować, że spółka koncentrowała swoje działania przede wszystkim na zapewnieniu bezpieczeństwa finansowego. Jednocześnie przyjęta strategia umożliwiła jej osiągnięcie lepszych wyników w obszarze rentowności niż pozostałe spółki działające w tym samym sektorze.
: The study presents the application possibilities of the ratio analysis in the context of the assess‑ ment of the financial condition of a company listed on the Warsaw Stock Exchange. Thus, the constitutive aim of the research is to present the practical application of the ratio analysis made on the basis of a review of the literature, full reporting - balance sheet and profit and loss account. The result of the research is the assessment of the financial standing based on the example of a joint‑stock company operating in the food sector and producing confectionery products primarily for the Polish market, compared to the average results achieved in the industry. The research period is 10 years. The obtained results indicate that the analysed company pursued a conservative strategy regarding assets and liabilities. However, unlike other competitors related to the food sector, it was characterised by an aggressive policy aimed at increasing recipients of products or services. Moreover, the audited company applied a strict policy of crediting customers and had a low level of overall debt. Therefore, on the basis of the obtained results, it can be concluded that the audited entity was mainly focused on ensuring financial security. At the same time, the adopted strategy made it possible to achieve better results in the area of profitability than other companies operating in the same sector.

Subject and purpose of work: This paper seeks to examine how the COVID-19 pandemic affected the financial standing of companies classified according to the type of their business activity. Materials and methods: This paper is based on aggregate data on businesses operating in Poland in the period 2017–2021, grouped according to the type of business activity. The data was published by the Central Statistical Office GUS in Poland. The company status was investigated using the calculated values of diagnostic indicators (return on assets, current financial liquidity, level of debt, stock rotation, and growth in sales). These indicators were normalized with the zero unitarization method to construct a synthetic indicator. The synthetic indicator was then used to generate business rankings. Results: The vast majority of the examined companies proved to be profitable. In 2020, the profitability and sales revenue of the businesses concerned were found to deteriorate slightly. There has been a downward trend in the rankings for companies operating in the accommodation and catering sector and the manufacturers of petroleum products. Pharmaceutical companies were the businesses that improved and topped the rankings. Conclusions: The pandemic had a strong negative impact on businesses operating in the market sector of accommodation and catering. The producers of refined petroleum products were also affected. The producers of pharmaceuticals benefited most during the pandemic. There are no clear indicators as to the impact of the pandemic on other types of businesses.

The aim of the article is to identify the criteria and methods for the evaluation of medical institutions. The article uses economic analysis, comparative analysis, and methods of descriptive statistics. The analysis of existing regulations, source materials, and the specific business character of health care entities indicates the need to evaluate these units with particular regard to the criteria such as costs, quality of assets (level of consumption, i.e., wear and tear and modernness), employment, financial liquidity or the level of debt. The results of the study are the basis for the evaluation of the healthcare sector. The value of the article is in showing the direction taken by the evaluation of the financial standing of entities. The ability to use specific criteria and methods of evaluation for health care entities in business practice.

This paper presents results of the study devoted to analysis of impact of upper extremities' momentum on the jump length and analysis of selected kinematic data changes during the standing long jump. Four young sportsmen participated in the initial study. They have performed standing long jump in two measuring conditions: with and without arms swinging. Motion was captured using a 3D opto-electronic camera system SMART (BTS) and selected kinematic data were evaluated using software packages and data processing: trajectory of body centre of gravity (COG), velocity of COG, maximal vertical distance of COG, take-off angle together with momentum of upper extremities were analyzed. The data were statistically evaluated using descriptive statistics and analysis of variance. Statistical significance of the kinematic data and jump length were analyzed using the Kruskal-Wallis test and post-hoc test (p<0.05) in Statistics toolbox of Matlab program. Statistically significant differences were assessed within intraindividual and intraclass comparison of data.

The aim of the study was to compare the values of selected stability indices registered in the trials in standing with eyes open and without visual control, and in handstand in athletes practicing artistic gymnastics at the highest level of advancement. Methods: The study included 20 athletes practicing artistic gymnastics. The research tool was posturograph CQ-Stab 2P. The results obtained in individual trials were compared using Friedman repeated measures analysis of variance by ranks and then subjected to Dunn post-hoc test with Bonferroni adjustment. Results: Statistically significant differences in the values of stability indices recorded in individual samples were found. Exceptions are the results obtained in the trials with eyes open and without visual control with regard to the size of the surface area delineated by the COP ( p = 0.173) and the frequency of corrective reactions ( p = 0.464), as well as the length of the statokinesiogram path in the mediolateral direction ( p = 0.342), mean velocity of COP movement in the mediolateral direction ( p = 0.246), maximal amplitude of the COP in the mediolateral direction ( p = 0.342) and number of COP displacements in the mediolateral direction ( p = 0.246). Conclusions: In seniors, disabling visual control during free standing as well as adopting a handstand position result in deterioration of the stability indices, which is a resultant of the COP displacement in both directions as well as in the anteroposterior direction. Lack of differences in the values of stability indices in the mediolateral direction suggest that in a free standing position, seniors practicing artistic gymnastics control the movement of the center of foot pressure in the mediolateral direction and eye control is not important for the stability of the body in the frontal plane.

The purpose of the opinion is to examine the possibility of referring the recommendation for election or appointment by the Sejm of individual persons to particular State offices specified in Articles 26, 27–29 of the Standing Orders of the Sejm, or dismissal therefrom, to more than one Sejm committee for their opinion thereto. In the author’s view, a flexible interpretation of Article 30 (5) is possible, as it is implied by the wording of that article which does not state that the recommendation is to be referred to “one” committee, so it does not preclude referring it to a greater number of committees.

Podstawowym celem niniejszego artykułu jest próba ustalenia granic, w obrębie których porusza się prawodawca tworzący przepisy regulaminów Sejmu, Senatu oraz Zgromadzenia Narodowego. Czyniąc punktem odniesienia treść art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 konstytucji, statuujących zasadę autonomii parlamentu (a więc wyznaczających także normatywną płaszczyznę autonomii regulacyjnej) autor ukazuje, jaki wpływ na ustanawianie norm regulaminu ma otaczające go środowisko prawne. W kolejnych częściach artykułu pojawiają się rozważania poświęcone ingerencji w materie wewnętrzne parlamentu różnych aktów normatywnych, tj. konstytucji, ustaw zwykłych, aktów prawa unijnego, Europejskiej Konwencji o Ochroni Prawa Człowieka i Podstawowych Wolności oraz ingerujących względem siebie regulaminów izb. Główna teza badawcza tego opracowania opiera się na przekonaniu, że wytyczony w ramach przepisów konstytucyjnych zakres autonomii regulacyjnej doznaje poważnych ograniczeń, i że decyzje parlamentu regulującego własną organizację wewnętrzną podyktowane są w określonym wymiarze uwarunkowaniami zewnętrznymi.
The main purpose of this article is an attempt to delineate boundaries, within which the lawmaker has got discretionary power to establish rules of the standing orders of the Sejm, the Senat and the National Assembly. As making reference point to the content of art. art. 61 ust. 4, art. 112, art. 114 ust. 2 i art. 123 ust. 2 of the constitution, the author demonstrates what is the impact of the surrounding legal environment on establishing that rules. Consequently, the following parts of this article present the interference of different normativeacts into internal parliamentary affairs, i.e. the constitution, bills, UE law acts, the European Convention on Human Rights and the standing orders of parliament. The key thesis of the article is based on convenience that the scope of regulative autonomy, laid down by the constitution, is the subject of further limitations and that the decisions of parliament in this area have to meet some external (imposed „from outside”) conditions.

The experiments performed on a especially built test stand, concerning the influence of human body position on the feet-to-head vibration transmission are presented. The investigations have been performed for chosen amplitudes and frequencies of source acceleration excitations coming from a vertical shaker. The big influence of standing positions of a human body on the transmitted accelerations from feet to head has been measured and analyzed. Numerical results of variability of experimental studies have been statistically elaborated and graphically presented.

Opis:
The opinion presents the interpretation of the definition of “parliamentary group representing a separate electoral list on the day of the start of the Sejm’s term”. The conditions that all Deputies’ associations have to meet in order to fall into this category have been indicated. Meeting such conditions is necessary for obtaining the right to participate of a representative of the group in sittings of the Council of Seniors. The need to amend the interpreted provision of the Standing Orders of the Sejm, in order to adapt it to relevant provisions of electoral law, has been also signalled.

Opis:
From a methodological point of view, the need to consider, in the synthetic methods, the assessment of enterprise’s financial standing, the criterion of the industrial specific features of the analyzed company and the changing economic conditions of its operation seems to be important . In this paper, an attempt has been made to present assumptions of few discriminatory, logit and banking methods to assess the financial standing of companies belonging to the building sector, taking into account the specifics of the industry. Critical reference has been made to numerous cases of simplifications and methodological errors that occur in the national literature on the subject.

Purpose: The aim of this study was to compare and analyse of relationships between stability indices registered in two positions: standing and handstand in athletes practicing gymnastics at various levels of advancement. Methods: The study included 46 athletes practicing gymnastics. The research tool was posturograph CQ-Stab 2P. Results: In both standing position and handstand in the seniors there were statistically significantly lower values of such indicators as: sway area delimited by the center of pressure ( p = 0.004, p = 0.014), mean amplitude of COP ( p = 0.021, p = 0.017), mean displacement of the center of feet/hands pressure in medio-lateral direction ( p = 0.011, p = 0.003) and maximal displacement of the center of feet/hands pressure in mediolateral direction ( p = 0.036, p = 0.036). In the standing position, seniors also had statistically significantly lower values of the statokinesiogram path length, both total ( p = 0.000) as well as in anteroposterior ( p = 0.001) and mediolateral ( p = 0.002) directions. In the seniors group there were statistically significant correlations between variables obtained in standing position and handstand. Conclusions: The level of sport advancement significantly differentiates the stability of a body in standing position and handstand. The seniors practicing gymnastics, compared to juniors, are characterized by a better ability to control the position of the body in both positions. The lack of relationships between stability indices registered in standing and handstand in juniors suggests that the analysis of the values of stability indices obtained in a standing position does not provide the possibility of predicting the ability to maintain balance in the handstand during the recruitment of candidates for gymnastics.

The acoustic coagulation process is based mainly on the orthokinetic interaction of aerosol particles vibrating with different amplitudes and phases. The presence of drift forces, gathering particles at loops pr nodes of the standing wave, may play auxiliary role by effecting a local growth of particle concentration. The standing wave produces regions of increased concentration and an orthogonal progressive sawtooth waves causes proper agglomeration by maximizing the orthokinetic process. In the presented paper we consider the continuity equation of aerosol particles in regions between nodes and antinodes and the problem of time variation of particle concentration under the influence of drift forces. We show that the concentration at points of stable equilibrium increases exponentially and we estimate the time constant of the process. The time constant depends strongly on the particle radius and frequency. Aerosols of particles of diameters less than several microns are the most dangerous for the environment and for man from ałmost all standpoints. Considering different types of drift we pay speciał attention to those acting on rełativeły small particles. In the real sound field we have to deal with a non uniform field configuration, which means that the actual sound wave deviates from the perfect one dimensional wave. The present paper deals with main effects of two-dimensional sonic fields on particle-gas interactions. In the case when the nodal and antinodal surfaces of the standing wave are convex, the particles move along some curves and, as we expect, gather in some particular points and not only in some planes. This means that one can obtain much greater concentration of particles in some definite regions than in the case of plane standing wave.

The term “tax act” is used in the Standing Orders of the Sejm in the substantive sense and refers to a public levy having the features of a tax, i.e. a pecuniary, compulsory, non-returnable and nonequivalent payment imposed by law and constituting budgetary revenue of the State Treasury or local government units of general purpose. The author points out that it is irrelevant for the qualification of a bill as a “tax bill” what name the bill uses to denote a public levy, if it bears the features of a tax. The title of a tax bill also refers to the bill that repeals or modifies the scope of a tax obligation or its elements. The author concludes that any tax act amendment bill meets the characteristics of the term “tax act”, and the scope of the term “tax act” does not include public tributes other than taxes.

Opis:
The opinion deals with the exercise of parliamentary oversight functions by Sejm committees. It provides an analysis of whether the representatives of State administration might be held responsible for failure to discharge their duties resulting from Article 157 of the Standing Orders of the Sejm. In the author’s view, Sejm committees have at their disposal the means to enforce only political responsibility. Moreover, as concerns suspension of work on a bill in the event of breach of the obligations specified in Article 157 by the representatives of public administration, the author believes that the legitimacy of such action cannot be assessed in abstracto. The author does not rule out that, depending on circumstances and seriousness of the infringements, suspension of work on a bill may be justified.

The article presents a selection of indexes describing financial standing of local government units based on counties of the Wielkopolskie province. On the basis of their values analysed local government units were classified using Ward‘s method to form classes with a similar financial situation.
W artykule dokonano oceny sytuacji finansowej powiatów województwa wielkopolskiego. W analizie wykorzystano dane Ministerstwa Finansów oraz Głównego Urzędu Statystycznego z lat 2004-2006. Na podstawie przesłanek merytorycznych i statystycznych dokonano wyboru wskaźników sytuacji finansowej jednostek samorządowych. Stosując metodę Warda sklasyfikowano badane jednostki w siedem klas o podobnej sytuacji finansowej. Najlepsza sytuacja finansowa charakteryzowała powiat poznański oraz powiaty: grodziski, kaliski, koniński, leszczyński i nowotomyski, najgorsza zaś samorządy: czarnkowsko-trzcianecki i pleszewski.

Sejm committees are internal, collegiate bodies of the Sejm, the establishment of which is required by the Basic Law. The regulations in force, which set the number of standing parliamentary committees (29), allow to state that we are currently dealing with a complex structure. Standing committees are formed to consider and prepare cases which are the subject of the Sejm’s work, to express opinions in laws delegated to the Sejm, the Marshal of the Sejm or the Presidium of the Sejm, as well as to perform control tasks. The spheres of activity of Sejm committees are analyzed in the broader context of legislative, control or creative functions.
Komisje sejmowe są wewnętrznymi, kolegialnymi organami Sejmu, których powołania wymaga ustawa zasadnicza. Obowiązujące regulacje regulaminowe ustalające liczbę stałych komisji sejmowych pozwalają stwierdzić, że mamy współcześnie do czynienia z rozbudowaną strukturą. Stałe komisje Sejmu powoływane są do rozpatrywania i przygotowywania spraw stanowiących przedmiot prac Sejmu, wyrażania opinii w prawach przekazanych pod obrady przez Sejm, Marszałka Sejmu lub Prezydium Sejmu, a także są organami realizującymi zadania kontrolne.

Opis:
Living benthic foraminifera in a relatively unpolluted site offshore Bahrain in the Arabian Gulf, were studied to determine the seasonal variability of their populations, as well as environmental parameters that may affect their distribution. The maximum foraminiferal density was observed during winter with the assemblages primarily dominated by rotaliids and secondarily by miliolids. The high population is attributed to an increased number of juveniles. A relationship between sediment grain size and the foraminiferal density reveals that juveniles were most abundant on coarse-grained sandy substrate and less abundant on fine-grained substrates. In spring, the foraminiferal density decreased, and the lowest values were observed during summer. The population increased again in autumn with highest juvenile/adult ratios. Moreover, results of relative abundance and species consistency show that Ammonia and Glabratellina are consistent from the shallowest to the deepest station, whereas miliolids occurred only at deeper stations. The numbers of peneroplidae and Elphidium also increased along the depth transect. Environmental characterization reveals that although the site is subject to eutrophication caused by nitrates and sulfates, pollution caused by hydrocarbons and heavy metals is not significant. The assessment of 63 heavy metals showed that none of the metals had concentrations that exceed internationally accepted norms [the devised level of Effect Range-Low], but with high concentration of strontium. The lack of a significant environmental effect of heavy metals is confirmed by the Foraminiferal Abnormality Index of <2%. Likewise, no hydrocarbon contamination was detected in the water or sediment samples. We conclude that the site in Bahrain is not yet adversely affected by human development, and therefore can provide baseline information for future comparison and assessment of foraminiferal assemblages in contaminated zones of the Arabian Gulf.

The article refers to the drafts of the standing order of the Sejm, which were submitted to the marshal of this chamber in the last couple of years. All of the presented proposals are designed to change some rules of parliamentary debate. These include: 1) equipping the candidate for the office of Prime Minister with the right to be given the floor during debate over motion of constructive no confidence vote, which is not provided in the standing order at present, 2) introducing the procedure of so called “question time” to the Polish parliamentary system, 3) equipping the presidents of the parliamentary groups (parliamentary clubs) with a right to take a floor out of turn, without being allowed by the Marshall of the Sejm. The author analyses all the solutions contained in the drafts, indicating its advantages and disadvantages (as a matter of fact some of the are drafted poorly). He supports the general direction of the proposed amendments, sharing the belief of their authors that they should help to improve Polish parliamentary system and Polish democracy as well.
Artykuł dotyczy projektów regulaminu Sejmu, jakie wniesiono do laski marszałkowskiej na przestrzeni kilku ostatnich lat. Projekty te zawierają postanowienia zmierzające w kierunku dokonania zmian w obecnym modelu debaty parlamentarnej. Pojawiły się tu konkretnie trzy propozycje: 1) wyposażenia kandydata na Prezesa Rady Ministrów w prawo do wypowiadania się w trakcie dyskusji poświęconej wnioskowi o konstruktywne wotum nieufności, 2) wprowadzenia do polskiego systemu parlamentarnego procedury tzw. godziny pytań, 3) wyposażenia przewodniczących frakcji parlamentarnych (klubów parlamentarnych) w prawo do zabierania głosu w toku debaty poza kolejnością mówców, bez konieczności uzyskania zezwolenia Marszałka Sejmu. Autor dokonuje analizy uregulowań zawartych w zgłoszonych projektach, wskazując na ich zalety i wady. Z nakreślonego wywodu wynika, że zajmuje on przychylny stosunek do kierunku zarówno proponowanych zmian, jak i do leżącej u ich podstaw idei.

Opis:
Size-dependent dynamic instability of cylindrical nanowires incorporating the effects of Casimir attraction and surface energy is presented in this research work. To develop the attractive intermolecular force between the nanowire and its substrate, the proximity force approximation (PFA) for small separations, and the Dirichlet asymptotic approximation for large separations with a cylinder-plate geometry are employed. A nonlinear governing equation of motion for free-standing nanowires – based on the Gurtin-Murdoch model – and a strain gradient elasticity theory are derived. To overcome the complexity of the nonlinear problem in hand, a Garlerkin-based projection procedure for construction of a reduced-order model is implemented as a way of discretization of the governing differential equation. The effects of length-scale parameter, surface energy and vacuum fluctuations on the dynamic instability threshold and adhesion of nanowires are examined. It is demonstrated that in the absence of any actuation, a nanowire might behave unstably, due to the Casimir induction force.

The requirement to perform a particular act “in writing”, as provided for in the Standing Orders of the Sejm, should be understood as an obligation to fix on paper the content of a particular act, using in this purpose graphic symbols, as required by the so-called written language, and such a paper document should be signed in person. The requirement to perform a particular act “in writing” cannot be satisfied by making it in an electronic form. Electronic form is a form of making certain acts (separate and autonomous from a written one) which the Standing Orders of the Sejm provides for only in special situations. A written response to a Deputy’s interpellation must therefore be filed in paper, hand-signed by the person giving response to the interpellation.

The opinion deals with the interpretation of the provision which states that the Marshal (Speaker) of the Sejm may request the committee to express its attitude to the conclusions and remarks made by the legal services of the Chancellery of the Sejm, which have not been taken into consideration, and whether – in this context – it is possible to change the report adopted by the committee. The author argues that the provisions of the Standing Orders of the Sejm provide no grounds for claim that expressing by the committee of its attitude to the conclusions and remarks could take place by way of modification of the report already adopted by the committee. In this situation, it seems that it could only be admissible that the Deputy Rapporteur takes position at the sitting of the Sejm considering the bill or draft resolution in the second reading.

In accordance with Article 193 of the Standing Orders of the Sejm, the answer to an interpellation is to be given in writing. The term in question is, in the parliamentary practice, understood explicitly. It considers it as a “paper form” of a document, which is also supported by established practice of the Sejm in this respect.. Even if the Standing Orders do not contain a legal definition of the term “in writing”, the classification allowing – in the analyzed case – for the use of an electronic version would be of a “projective” nature and differ from the current understanding of the rules of the Sejm. The proposal for a relevant amendment of the Standing Orders of the Sejm, explicitly guaranteeing accessibility of an electronic document, is justifiable.

An analysis is given of standing water waves of finite amplitude growing in time. In the model considered, a piston-type wave maker generates the waves in a rectangular fluid domain. The frequency of the generation corresponds to water waves of lengths equal to double length of the fluid domain. In this way the case of resonance the obtained and the amplitude of the generated standing wave grew in time. The analysis has been confined to the second order approximation expressed in the material variables. Theoretical results have been compared with experimental data.

Opis:
The paper describes research to improve the wind resistance of free standing device. Analysis of the wind influence on object with specified shape, has been simplified to the analysis of two-dimensional case. This helped to formulate the basic criteria for evaluating the examined cases. The study was conducted using numerical methods for fluid mechanics. Flow field has been obtained using the Fluent package. Several configurations of object has been studied. The results of calculations and analysis of the forces has been presented. Some useful hints and tips used during the mesh generation has been shown.
W pracy opisano badania poprawy odporności na wiatr obiektu wolnostojącego. Analizując obiekt oraz działające na niego pod wpływem wiatru siły, rozważania sprowadzono do analiz dwuwymiarowych. Analiza ta pozwoliła również sformułować podstawowe kryteria oceny badanych przypadków. Badania przeprowadzono z wykorzystaniem metod numerycznej mechaniki płynów. Pole przepływu analizowano używając pakietu Fluent. Przebadano kilka konfiguracji obiektu. Przedstawiono wyniki obliczeń oraz analizy sił. Zaprezentowano również kilka użytecznych procedur i sposobów wykorzystywanych podczas generacji siatek.

The paper presents a selection of indexes describing financial standing of households. Based on their values the analyzed aggregate units (socio-economic groups of different size) were classified into classes of a similar financial position.
W pracy przedstawiono dobór zmiennych opisujących sytuację finansową gospodarstw domowych. Na podstawie wartości tych wskaźników dokonano klasyfikacji badanych jednostek agregatowych (grupy społeczno-ekonomiczne o różnej liczebności) w klasy o podobnej sytuacji finansowej. Podstawą do analizy i określenia sytuacji finansowej polskich gospodarstw domowych w 2006 roku była ocena kształtowania się realnych dochodów rozporządzalnych oraz analiza struktury wydatków, przypadających miesięcznie na jednego członka gospodarstwa domowego.

This study aims to analyze the relations between the institutional investors’ share in the ownership structure and the operation of publicly-traded companies, in particular, their financial standing and value. It presents the most significant reasons and mechanisms how institutional investors affect the chosen aspects of operation of portfolio companies. The findings of the selected international and domestic research pertaining to the impact of institutional investors on the development of the financial standing and value of companies were discussed. Moreover, the creation of value of companies and value for shareholders in the Polish capital market has been assessed. It was found that positive, statistically-significant relations between the institutional ownership and the financial standing and value of companies are usually seen in the developed capital markets. It pertains mainly to the markets featuring a high degree of institutional ownership development. The research in the Polish capital market has not resulted in any implicit outcomes, but there is an increasing amount of empirical evidence demonstrating certain relations.
Celem pracy jest analiza zależności między udziałem inwestorów instytucjonalnych w strukturach własnościowych a funkcjonowaniem spółek giełdowych, zwłaszcza ich kondycją finansową i wartością. W pracy przedstawiono najważniejsze przesłanki i mechanizmy oddziaływania inwestorów instytucjonalnych na wybrane aspekty funkcjonowania spółek portfelowych. Zaprezentowano wyniki wybranych badań zagranicznych i krajowych, dotyczących związków między udziałem inwestorów instytucjonalnych we własności a kondycją finansową i wartością spółek. Ponadto przeprowadzono ocenę kreacji wartości spółek i wartości dla akcjonariuszy na polskim rynku kapitałowym. Ustalono, że pozytywne, statystycznie istotne zależności między własnością instytucjonalną a kondycją finansową i wartością spółek są zazwyczaj obserwowane na rozwiniętych rynkach kapitałowych. Dotyczy to zwłaszcza rynków charakteryzujących się dużym stopniem rozwoju własności instytucjonalnej (Thomsen, Pedersen, 2000; Ferreira, Matos, 2008). Natomiast badania na polskim rynku kapitałowym nie przynoszą jednoznacznych wyników (Aluchna i inni, 2005; Aluchna, 2007; Jeżak, Matyjas, Bohdanowicz, 2010; Adamska, Urbanek, 2014). Ocena kreacji wartości dla akcjonariuszy w spółkach z udziałem inwestorów instytucjonalnych była zróżnicowana (Szewc-Rogalska, 2012). Spółki z dużym udziałem funduszy emerytalnych wyróżniały się pod względem kreacji wartości dla akcjonariuszy, a także pod względem poziomu wypłacanych dywidend. Natomiast w spółkach z dużym udziałem funduszy inwestycyjnych nie występowała kreacja wartości dla akcjonariuszy.

The concept of “non-performance of Deputies duties” covers all kinds of acts that violate legal norms determining the manner of exercising the parliamentary mandate. At the same time, this concept does not include acts leading to non-performance of such Deputies’ duties, the violation of which is threatened by a legal sanction set out in other legal provisions. It is not possible to indicate a full catalog of duties, whose breach casuses a liability under Article 22 of the Standing Orders. “Non-performance of Deputies’ duties” covers, among others, cases of violation of duties related to the participation in the composition of another state authority, related to the function of representing the Sejm in proceedings before other authorities and in interparliamentary relations.

The author provides an analysis of the provisions of Article 10a, para. 4 of the Standing Orders of the Sejm in the context of the time period within which it should consider a motion to recall the Marshal of the Sejm. She points out that the opportunity to recall the Marshal of the Sejm is complicated as compared to the election procedure,. The character of the time limit for consideration of the motion to recall the Marshal of the Sejm is not indicative, but mandatory. From an analysis of the concept of ‘the next sitting of the Sejm, it follows that the consideration of the motion and the putting thereof to a vote at the sitting that is “the first one after 7 days of its submission”.

The opinion provides an assessment of the legal acceptability of limiting the form of submission of interpellation and Deputies’ questions to the format an electronic document. The analysis of Article 193 (2) of the Standing Orders of the Sejm currently precludes such a possibility, as both interpellations and Deputies’ Questions must meet the formal requirements that include, inter alia, the need to be in writing. The Standing Orders of the Sejm do not contain a legal definition of the phrase “in writing”. From literal interpretation it follows that it is a paper document, signed in person by its author. The inability to accept that the meaning of the written form can also include the form of electronic document is proved by an absolute requirement to append two copies to an answer to a Deputies’ question. The imposition of an obligation for interpellations and Deputies’ question to be submitted in the form of an electronic document therefore requires amendment of Article 193 (1) and (2) of the Standing Orders of the Sejm.

The opinion concerns a draft resolution to amend the Standing Orders of the Sejm of the Republic of Poland. The principal purpose of the amendment was to abolish the requirement to seek an opinion of the minister competent for Republic of Poland’s membership in the European Union when considering matters concerning the conformity of provisions of the considered bills to the legislation of the European Union. Sponsors of the resolution justify the amendment on legal grounds, such as the need for implementation of the principle of separation of powers, and on extra‑legal grounds, such as the need for modernisation and restoration of functionality of the provision of opinions on legislative proposals. The author of the opinion challenges the arguments of the sponsors of the draft resolution, pointing out its lack of appropriate justification and possible inconsistency with the provisions of both the Constitution and the Act on the Branches of Government Administration.

The article attempts to synthesize the state of research on the diagnostic credibility of discriminatory models used to assess the financial standing of enterprises. The considerations confirmed the validity of the thesis formulated by E. Mączyńska and M. Zawadzki that “there is no single and only right business model for assessing the bankruptcy risk for a business”.
W artykule podjęto próbę syntetycznego ujęcia stanu badań nad wiarygodnością diagnostyczną modeli dyskryminacyjnych wykorzystywanych do oceny kondycji finansowej przedsiębiorstw. Przeprowadzone rozważania potwierdziły słuszność tezy sformułowanej przez E. Mączyńską i M. Zawadzkiego, że „nie ma jednego, jedynie słusznego i najlepszego modelu oceny zagrożenia przedsiębiorstwa upadłością”.

The discussed Article specifies the acceptable subject matter of points of order. The assumption that they may concern matters being the subject of orders of the day and the course of sittings means that the subject matter of the point of order cannot become a matter to be considered in the future, i.e. during any of subsequent sittings. In the author’s opinion, it is in principle unacceptable to submit pro futuro points of order. Article 184 para. 2 of the Standing Orders of the Sejm refers only to the subject of the point of order and not to the motives of the motion submitted by the applicant. This means that, on justifying the point of order, a Deputy may rely on external circumstances, i.e. not related to a group of matters considered by the Sejm during a given sitting.

Notification to committee members about a committee sitting (date and agenda) should take place at least three days before the sitting, unless the meeting was convened as a result of decisions taken at the sitting of the Sejm. The author emphasizes that with Article 152 para. 5 of the Standing Orders of the Sejm causes a few interpretation concerns, what indicates a need of its amendment.

The opinion concerns the decision of the Marshal of the Sejm to expel a Deputy from a sitting, taken pursuant to Article. 175 para. 5 of the Standing Orders of the Sejm. In the author’s view, such decision is not final, as the Presidium of the Sejm may quash it, having considered an appeal submitted by the Deputy and – on the other hand – is immediately applicable, because the expelled Deputy is obliged to leave the Chamber and abstain from participating in further deliberations until his/her appeal is considered (or until the end of the session of the Sejm, if the Deputy has not submitted an appeal). Therefore, the expelled member does not have the right to participate in voting. Preventing the Deputy expelled from the sitting from “entering the Chamber with the purpose of voting” is necessary in order to respect Article 176 para. 6 of the Standing Orders of the Sejm.

Składając wniosek, a następnie pozew w trybie przepisów art. 61 ust. 1 i art. 64 ust. 2 ustawy o stosunku państwa do Kościoła katolickiego w Rzeczypospolitej Polskiej kościelna osoba prawna musi wykazać swoją legitymację czynną do złożenia wniosku (pozwu), jego popierania oraz nabycia prawa własności. Musi zatem wykazać, że jest tą kościelną osobą prawną, która została pozbawiona własności nieruchomości wskutek jej upaństwowienia (tożsamość podmiotów), lub że jest następcą prawnym tej osoby. Wystąpienie z roszczeniem o przywrócenie własności nieruchomości upaństwowionej nie jest uzależnione od tego, czy nieruchomość ta uprzednio stanowiła własność tej osoby prawnej. Może bowiem zachodzić zarówno następstwo prawne w ścisłym tego słowa znaczeniu, jak i określone przepisami ustawy o stosunku państwa do Kościoła katolickiego w Rzeczypospolitej Polskiej uprawnienie do przywrócenia własności nieruchomości, należącej uprzednio do osoby prawnej tego Kościoła (następstwo sensu largo). Tożsamość lub następstwo prawne kościelnych osób prawnych wymagają wskazania podstawy prawnej nie tylko w prawie kanonicznym, lecz również w prawie polskim. W tym celu należy dokonać zarówno wykładni przepisów prawa materialnego, jak i procesowego. Nie ulega jednak wątpliwości, że w obowiązujących po jednostronnym wypowiedzeniu konkordatu z 1925 roku aż do 23 maja 1989 roku przepisach prawa polskiego takiej normy prawnej nie było, ponieważ ówczesny ustawodawca uchylał się od jej uchwalenia, mimo obowiązywania przepisu Konstytucji PRL w tym zakresie. Kwestie te zostały szczegółowo omówione w artykule na przykładzie nacjonalizacji i rewindykacji nieruchomości domu zakonnego Ojców Augustianów w Krakowie.
While filing a petition and lawsuit pursuant to Article 61 Section 1 and Article 64 Section 2 of a relation between the state and the Catholic Church in the Republic of Poland, the legal church entity must produce its standing to file a petition (lawsuit), to support it and to acquire property rights. It must prove that it is the legal church entity that had been deprived of real estate ownership as a result of its nationalization (identity of entities), or a legal successor of this entity. Filing a claim to regain a nationalized property does not depend on whether this property was owned by the legal entity. There may be a legal succession in the strict sense of the word, or a right to regain the ownership of a property formerly owned by a legal entity of this Church (sensu largo succession), as stipulated by a relation between the state and the Catholic Church in the Republic of Poland. Identity or legal succession of legal church entities require an indication of legal basis in both canon law and Polish law. To meet this requirement, one must provide an interpretation of substantive and procedural law. However, it goes without saying that after unilateral termination of concordat from 1925 until 23 May 1989, there were no such legal norms in Polish law, because the legislator at that time avoided passing such legal norms, in spite of the existence of the binding regulation of the Constitution of the Polish People’s Republic in this respect. These issues have been analysed in detail in the article, using an example of nationalization and revindication of the real estate of a convent of Augustinian Fathers in Krakow.

Opis:
The aim of this paper is to present the technique, complications and the outcome of standing flank laparotomy for uterine torsion in five pure Arabians mares, between 267–300 days of gestation. Each mare was diagnosed with a 180° uterine torsion: 2 cases clockwise and 3 cases counterclockwise. No additional abdominal problems were found on admission; the clinical exam results of the mares and heart rate of fetuses were within normal limits (one mare had tachycardia), and patients were cooperative. Mares were put in the stocks, both paralumbar fossae were prepared for surgery and local infiltrative analgesia was administered subcutaneously and intramuscularly on one side (right for clockwise torsion, left for counterclockwise torsion). Sharp incision of the skin and superficial fascia was followed with muscles layers moderate preparation with fingers, using the grid technique. After initial evaluation of the uterus position and confirmation of the diagnosis, the torsion was corrected with gentle manual manipulation. The abdominal wall closure was a routine process. An intradermal suture was used to improve the cosmetic result. A perforated drain was left between muscles and superficial fascia to prevent seroma formation. The air was removed from the peritoneal cavity with active suction. Correction of the uterine torsion was done successfully in all five cases. No reoccurrence or major complications occurred: only in one mare there was some bleeding from the muscles of the abdominal wall and prolonged wound healing due to seroma. All mares had foaled on term, without complications. The foals remain healthy. The cosmetic results were excellent. In selected cases standing flank laparotomy is a safe, cost effective and relatively straightforward method of correction of uterine torsion in a mare.

Opis:
Venturi flume is a very popular measuring device. A particularly attractive version of such a device is a standing-wave-flume, as this enables determination of liquid discharge by one-point depth measurement only. However, it is necessary to underline, that some essential simplifications must be introduced into the theoretical description of this case. The paper contains the results of the control investigations of six existing Venturi flumes, installed in three functioning sewage-disposal-plants in Poland. It was shown, that some important mistakes can be committed, when somebody plans such a flume. These mistakes worsen the flow measurement accuracy. In conclusion it was stated that the standing-wave-flume must be designed very carefully, with the use of gradually-varied flow equations. An alternative, which is worth using, is a Venturi flume with two-point depth measurement.

Misery literature is frequently perceived as a new genre, which emerged in the United States in the 1990s. It is usually defined as autobiographical non-fiction dealing with a traumatic childhood and life’s adversities yet many of most famous misery memoirs have been discredited as fakes. Nevertheless, many traits of the genre features have long existed in the history of literature. This article seeks to analyse the roots of misery memoirs, present their characteristic plot structure, explain their commercial popularity and warn of the dangers they might entail.

Guy Standing's book The Precariat has had a significant impact in stimulating a debate about the changing nature of work across the broad sweep of the global economy. He advances the notion of precarious workers, originally put forward by Italian autonomist Marxists, to suggest that they constitute a new and separate class. This article reflects on the notion of precarious work and addresses the temporal, historical and analytical weaknesses manifest in many accounts by proposing a political economy synthesis. The discussion takes place through the theoretical lens of embeddedness that takes seriously the structures and institutions of capitalism and the agency of workers individually and collectively. First, it is argued that two key influences on the structural embeddedness of precarity are the spatiality of capitalism and its endemic tendency to crisis. Second, the temporal and institutional embeddedness of precarity is discussed in historical and comparative context. Third, the agential influence on embeddedness is examined with regard to the possibility of the self-organization precarious workers and their potential for forging solidarity with other groups. The article concludes that precarious work is intrinsic to capitalism and therefore the precariat cannot be understood as a class in itself. The implications of this for activists is that solidarity needs to be forged between all groups of workers in order to organise for decent and stable employment.

This article compares the rules governing the legal standing before selected regional international judicial and quasi-judicial bodies in Africa and Latin America from the perspective of environmental litigation. The focus is on active legal standing of private entities in contentious proceedings against states. The article sytematizes the rules governing the legal standing into two broad categories: subjective (rights based) litigation and objective interest litigation. Subsequently, the approach of each court will be analyzed on the basis of its procedural rules and jurisprudence. Several trends can be identified, including a tendency of human rights courts to move towards objective interest litigation, a trend to grant non-governmental organizations a privileged position to initiate environmental litigation, and the development of community rights based approach by courts for regional economic integration that could become relevant in the future.
Artykuł porównuje regulacje sytuacji prawnej w sprawach przed wybranymi regionalnymi międzynarodowymi organami sądowymi lub quasi-sądowymi działającymi w Afryce i Ameryce Łacińskiej, z perspektywy sporów środowiskowych. Autorka skupia się na aktywnej sytuacji prawnej prywatnych jednostek w spornych sprawach wnoszonych przeciwko państwu. Artykuł systematyzuje reguły rządzące stanem prawnym w dwóch szerokich kategoriach: sporu subiektywnego (opartego na prawach) oraz obiektywnego konfliktu interesów. Następnie, podejście każdego z sądów zostaje przeanalizowane na podstawie jego reguł proceduralnych i orzecznictwa. Można wyróżnić kilka trendów, włącznie ze skłanianiem się sądów praw człowieka w stronę traktowania takich spraw jako obiektywnego konfliktu interesów, trendem udzielania organizacjom pozarządowym uprzywilejowanej pozycji wszczynania sporów środowiskowych, oraz wzmacnianiem podejścia opartego na prawach społeczności przez sądy w celu regionalnej integracji ekonomicznej, które mogą stać się istotne w przyszłości.

Solutions based on “equivalence interference” are proposed for various problems involving OE verbs. WG verbs with 1SG /-ͻͻmi/ were modeled on Celtic verbs with /-aami/. Pre-OE eode is from /eiͻͻde/, analogical to 1SG /eiͻͻmi/ from /eimi/. OE dyd- is from reinterpretation of peasant /dïd-/, from low-stressed /ded-/ used as a non-emphatic periphrastic, as noble /düd-/. WG /bii-/ ‘be’ was modeled on Celtic /bii-/ ‘(habitual-future) be’. Habitual-future /bi-/ (lost on the continent) re-developed in OE on the model of habitual-future /bi-/ in Brittonic. The English rule that non-indicative forms of BE are /b/-forms is from Brittonic. 3PL bi(o)đon was modeled on Brittonic /biđont/. Pre-OE /ist/ and /im/ were influenced by Brittonic /is/ and /æm/. Loss of distinct endings before 1PL and 2PL subject pronouns and loss of distinct preterit subjunctive endings were both modeled on their analogues in Brittonic.

On 26 March 2020, by a resolution adopted on 26 March 2020, the Standing Orders of the Sejm of the Republic of Poland were amended to allow the sessions to be conducted using electronic means of remote communication. These amendments raise serious reservations as to their constitutionality. This is due to the fact that the Constitution of 1997 stipulates that the Sejm and Senate shall meet at sessions, while the meeting, being a concept that has been defined, is defined as the assembly of MPs in one place in order to consider the matter under discussion. In addition, as parliamentary practice has demonstrated, the changes introduced have generated a number of problems related to Deputies’ attendance at such remote sessions, participation in debates and casting votes. As a consequence, this may lead to weakening of the legitimacy of the work of the Chamber and a reduction in the capacity to exercise the mandate.
Sejm uchwałą podjętą dnia 26 marca 2020 r. wprowadził do regulaminu Sejmu zmiany umożliwiające prowadzenie obrad z wykorzystaniem środków elektronicznych umożliwiających komunikowanie się na odległość. Wprowadzone zmiany budzą poważne zastrzeżenia co do ich konstytucyjności. Wynika to z faktu, że Konstytucja z 1997 r. stanowi, że Sejm i Senat obradują na posiedzeniach, zaś posiedzenie, będąc pojęciem zastanym, definiowane jest jako zebranie się posłów w jednym miejscu celem rozpatrzenia sprawy będącej przedmiotem obrad. Ponadto wprowadzone zmiany, jak pokazuje praktyka parlamentarna, generują szereg problemów związanych z uczestniczeniem posłów w takich zdalnych posiedzeniach, udziałem w dyskusji i głosowaniach. W konsekwencji może to prowadzić do osłabienia legitymizacji prac izby i ograniczenia możliwości wykonywania mandatu.

This paper details the design and potential implementation of standing seats in a commuter rail vehicle for the purposes of maximising capacity and revenue. The vehicle interior design is suited to the “Commuter Class” – a subset of travellers who travel primarily within the commuter belt and frequently utilise rail networks on a daily basis but require little additional space for luggage or peripherals. The concept delivers capacity increases in excess of 50% whilst still offering passengers a greater degree of personal space when compared with standing in aisles or gangways. The impact on vehicle stability and supporting intelligent systems are also discussed, delivering a unique design tailored specifically to meet the needs of the commuter class passenger.
Artykuł opisuje szczegółowo projekt stojących miejsc siedzących i potencjał ich wprowadzenia, w podmiejskim pojeździe kolejowym, w celu maksymalizacji wydajności i dochodów z przejazdu. Wnętrze takiego pojazdu jest dostosowane do ludzi przemieszczających się głównie w okręgu miejskim, podróżujących codziennie i wymagających odrobinę miejsca dla mniejszych bagaży czy urządzeń peryferyjnych. Koncepcja zapewnia wzrost pojemności o ponad 50%, dodatkowo oferując pasażerom jeszcze większy stopień osobistej przestrzeni w porównaniu ze staniem w korytarzach lub przejściach. Wpływ na stabilność pojazdu i wspieranie inteligentnych systemów są także uwzględnione, dostarczając tym samym unikalną konstrukcję dostosowaną specjalnie do potrzeb pasażera pociągów podmiejskich.

This article attempts to evaluate the state of research, in the national reference literature, on the discriminatory methods for evaluating the financial standing and the risk of business failure. In the reference literature, it is still perceived that discriminatory methods are ascribed, in a manner unauthorized from the methodological point of view, the value of timeless and sector universality. Critical reference has been made to numerous cases of simplifications and methodological errors that occur in the national literature on the subject.
W artykule podjęto próbę oceny stanu badań w krajowej literaturze przedmiotu nad metodami dyskryminacyjnymi w ocenie kondycji finansowej oraz ryzyka upadłości przedsiębiorstw. W literaturze nadal dostrzegane jest przypisywanie metodom dyskryminacyjnym, w sposób nieuprawniony z metodycznego punktu widzenia, waloru ponadczasowej oraz sektorowej uniwersalności. Krytycznie odniesiono się do licznych przypadków uproszczeń i błędów metodycznych występujących w krajowej literaturze przedmiotu.

Opis:
Penalty payments imposed on a Deputy for not participating in or interfering with the proceedings of the Sejm are cumulative, but are limited by the amount of funds, to which the Deputy is entitled to collect for the holding of a mandate. Thus, the imposition of a penalty after exceeding this limit cannot have other repressive effects. The assessment of the legitimacy of imposing penalties remains the responsibility of the Presidium of the Sejm. According to the Standing Orders of the Sejm, the subsequent penalty should be collected from the part of the salary remaining after the execution of the first penalty, in the event of the need to apply both provisions.

Solutions are presented, most involving Celtic influences in West Germanic (WG) dur- ing the ancient period, for some long-standing problems involving nominal forms. The M N-SG forms of /n/-stems in WG may be seen as due to loss of /-n/ (in analogical /-ͻͻn/) having happened after shortening. Apparent replacement of the F G-SG by the D-SG in WG may be seen as due to the D-SG of the F personal pronoun being employed, in “external possession”, as a kind of indirect reflexive, after /siin-/ became limited (for reasons connected with Celtic influence) to M SG meaning. This case has analogues in Romance. Final /-s/ in the A-PL of M /a/-stems may be seen as due to Celtic influence causing /-nz/ to be replaced by /-ns/.

Promoting the rule of the law is a national responsibility. The obligation to ensure legality and advance human rights rests on the national government. This article analyzes how federalism, a system of distributing power among subnational entities, can promote this national goal. The article explores how states in the United States have played an important role in encouraging the federal government to enforce the law and safeguard rights. By means of resistance, cooperation, and redundancy, states have moved the United States closer to rule-of-law ideals. The state action sometimes takes the form of litigation, with states bringing suit against the federal government. Such suits have particular significance in challenging illegal inaction by the national government, as when the federal government fails to enforce environmental laws. Litigation by states may overcome standing barriers that would limit such suits by private individuals. States may also engage in direct action by pursuing their own policies that promote the rule of law. In these areas, the states may oppose the federal government, cooperate with the federal government, or act in an independent, parallel manner. What unites all of these modes and instruments of state-federal interaction is that the goal of states is to influence national policy. The state action may begin within the boundaries of a particular state, but what motivates the state initiative is a vision applicable to the nation as a whole. The ultimate aim of state action is not local divergence, but national uniformity. Federalism serves not as a license for local deviation from national norms, but instead as a means for states to engage actively in creating policy at a national level. In this way, independent state activity can indeed promote the national obligation to promote the rule of law throughout the country.

The application of the X-ray standing wave (XSW) technique in the case of imperfect crystals meets serious theoretical and interpretational problems. However, well-known advantages of the XSW technique make it especially interesting to the study of the ordering of impurities and of various processes leading to changes in this ordering in various likes of imperfect crystals. In this work we try to answer the question how imperfection of a crystal may influence the changes in fluorescence yield during the XSW measurement. Two likes of imperfect crystals are studied: Si(111) implanted with high energetic Bi$\text{}^{+}$ ions, and Zn$\text{}_{1-x}$Co$\text{}_{x}$Se single crystal with natural (111) face. The discussion of obtained results shows that general features of the X-ray standing wave field are conserved despite the considerable imperfections of the crystals. The results seem to support the applicability of the XSW technique to the study of imperfect materials, although some further theoretical effort would be required.

W artykule została przedstawiona kondycja finansowa państwowych szkół wyższych różnych typów na podstawie dokonanej przez autorkę analizy wielkości struktury przychodów oraz kosztów działalności operacyjnej. Celem analizy było sprawdzenie, w jakim stopniu obniżenie przychodów dotacyjnych zostało zrekompensowane wzrostem przychodów pozadotacyjnych w poszczególnych typach szkół oraz jak kształtowały się nakłady na jednego studenta przeliczeniowego (w latach 1992-1995).
The article describes the financial standing of State higher schools of various types on the basis of the author’s analysis of revenues and operating costs. The aim of the article was to determine to what extent the reduction in income from grants has been offset by income from other sources in individual types of schools and the trend in expenditures per so-called conversion student (in 1992-1995).

Article 184 para. 1 of the Standing Orders of the Sejm obligates the Marshal of the Sejm to give the floor regardless of the orders of the day for the sitting or in respect of the debate to claim rectification. Only the Deputies to the Sejm are entitled to make rectifications. Rectifications can only refer to “statements that has been misunderstood or imprecisely quoted,” and notice of intention to use the remedy of rectification under this procedure is a direct response to the statement of another Deputy or any other participant in the sitting of the Sejm. For assessing the admissibility of rectification request it does not matter whether the author of the rectified statements directly mentioned the specific individuals whose statements he/she quotes giving their names. Presented rectification is not subject to debate or vote. A rectification should take the form of indicative sentence. In a situation where the Deputy’s statement does not satisfy the requirements relating to rectification, the Marshal of the Sejm has the right, and even the obligation, to reproach the Deputy, and to discontinue his/her speech.

We calculate the impurity-scattering limited mobility of the one-dimensional electron gas in a rectangular GaAs quantum wire confined in the vertical (growth) direction by n-modulation doped AlGaAs layers and free standing along the transverse direction. The scattering potential of the ionized impurity is obtained by solving the Poisson equation with z-dependent electrostatic permittivity in order to take into account the image charge effect due to the abrupt permittivity change at the GaAs/air interfaces. We show that the "image impurity" scattering tends to drastically reduce the electron mobility for sufficiently small (≈10 nm) transverse wire widths.

Parliamentary custom has been present in modern parliament since its inception. The functioning of the British or German parliament shows that customs can co-create or supplement parliamentary procedure. In the Polish parliament, customs also regulate a number of proceedings. The subject of this article is the custom found in the practice of the lower house of the Polish parliament – the Sejm. Examples of customs that have been transformed into norms of the Sejm’s rules of procedure despite their long practice are indicated and discussed. However, the analysis of these examples does not give a clear answer to the question of the reasons for turning custom into law. It shows the inconsistency and discretionary nature of the changes. It is also in vain to find purposefulness and consistency in the creation of norms on the basis of custom.
Zwyczaj parlamentarny jest obecny w nowożytnym parlamencie od początków jego powstania. Funkcjonowanie parlamentu brytyjskiego czy niemieckiego pokazuje, że zwyczaje mogą współtworzyć czy też uzupełniać procedurę parlamentarną. W polskim parlamencie zwyczaje również regulują szereg postępowań. Przedmiotem artykułu jest zwyczaj występujący w praktyce działania izby niższej polskiego parlamentu – Sejmu. Wskazane i omówione zostały przykłady zwyczajów, które mimo wieloletniej praktyki ich stosowania zostały przekształcone w normy regulaminu Sejmu. Analiza tych przykładów nie daje jednak jednoznacznej odpowiedzi na pytanie o przyczyny zmiany zwyczaju w prawo. Pokazuje brak konsekwencji i uznaniowość zmian. Próżno również doszukiwać się celowości i spójności w kreowaniu norm na podstawie zwyczaju.

We consider impulsive excitation of slow magnetosonic standing waves in a two-dimensional hot solar coronal slab. Results of numerical simulations have revealed that initially launched pulses trigger mainly fundamental slow mode and its first harmonic, depending on the pulses' spatial location. Our parametric study has shown these slow standing waves to exhibit wave periods of about 13min. The slow standing waves are accompanied by fast modes simultaneously present in the system.

The electron-hole interaction in a thin (≈10 nm) GaAs quantum wire free-standing in vacuum is strongly enhanced by the image charge due to the abrupt permittivity drop at the wire surface. As a result, the exciton binding energies are much larger and the exciton wave functions much more localised than those of the GaAs quantum wire surrounded by the AlGaAs. The absorption spectrum of the free-standing wire shows besides the 1s exciton peak also the 3s and 5s exciton peaks, even if the peaks are 15 meV broad. The continuum absorption edge shows a large blue shift due to the renormalization of single-particle energies by the image charge.

W artykule przedstawiono wyniki badań statycznej nośności siatek okładzinowych metodą „testu skrzyniowego". Test skrzyniowy pozwala określać nośność i odksztalcalność torkretu i membran [9] oraz różnego rodzaju okładzin górniczych np. stalowych siatek zgrzewanych, a także obliczać pracę jaką wykonują podczas ich obciążania. Zaproponowany sposób badania jest bardziej zbliżony do rzeczywistej pracy okładzin górniczych i powłok natryskowych w wyrobisku górniczym, niż dotychczas stosowane testy wykonywane w oparciu o normy dotyczące: okładzin siatkowych - PN-G-15050:1996 [6], okładzin żelbetowych - PN-G-06021:1997 [4] oraz betonu natryskowego - PN-G-14100:1997 [5]. Badaniom poddano siatki okładzinowe łańcuchowo-węztowe typu ciężkiego, siatkę zaczepową typu ciężkiego oraz siatkę osłonową zwijaną, lekką, stosowaną w obudowie kotwiowej.
This paper presents the results of the study on static load-capacity of mining grids by use of the "box test". The box test allows to determine the load-capacity and deformability of the gunite and membranes [9] as well as different types of mining grids, such as the welded wire mesh, and to calculate work it performs when loaded. The proposed method of testing is closer to the actual work of mine lining and spray coats in excavations than it was with the test performed on the basis of the standards of mesh linings - PN-G-15050:1996 [6], ferroconcrete linings - PN-G-06021:1997 [4] and shotcrete - PN-G-14100:1997 [5]. This study includes the heavy chain-nodal meshes, a heavy detent mesh and a light shield folding mesh which is applied in the roof bolting.

W artykule podjęto problematykę oceny kondycji finansowej przedsiębiorstw przemysłu spożywczego. Analizie poddano 19 spółek akcyjnych notowanych na GPW w Warszawie. Rosnącej dynamice przychodów ze sprzedaży towarzyszył również (aczkolwiek po początkowym spadku) wzrost wartości zrealizowanego zysku netto. W kolejnych latach coraz więcej spółek wypracowywało dodatnie wyniki finansowe. Wartość aktywów spółek charakteryzowała się relatywnie dużą zmiennością, co było wynikiem zmiennej w czasie koniunktury na rynkach finansowych. Wskaźniki rentowności aktywów i kapitałów własnych po spadku w 2008 r. wykazywały tendencję wzrostową.
The article discusses the assessment of the financial condition of the food industry. The analysis covers 19 joint- stock companies quoted on the Warsaw Stock Exchange. The growing dynamism of sales revenues (however after an initial decrease) performs together with an increase in the value of net realizedgain. In subsequentyears, more and more companies are going to develop positive financial results. The value of the assets of companies characterized by relatively high volatility, which resulted from the variable situation on financial markets. Indicators of return on assets (ROA) and equity (ROE) after the decline in 2008 showed an upward trend.

The language of fire has sometimes been used in illustrative ways to describe how social movements spark, flare, and sometimes sputter out. Building on recent scholarship about protest camps, as well as borrowing language from environmental historians about fire behavior, this article draws from ethnographic research to describe the pyropolitics of the Indigenous-led anti-pipeline movement at Standing Rock-examining how fire was used as analogy and in material ways to support and drive the movement to protect water from industrial capitalism. Describing ceremonial fires, social fires, home fires, cooking fires, and fires lit in protest on the front line, this article details how fire was put to work in myriad ways in order to support the movement against the Dakota Access Pipeline (DAPL), and ensure social order and physical survival at the camps built to house supporters of the movement. This article concludes with descriptions of how these sparks ignited at Standing Rock followed activists home to their own communities, to other struggles that have been taken up to resist pipelines, the contamination of water, and the appropriation of Indigenous land.

This paper leverages the IMF’s Financial Access Survey (FAS) database to construct a new composite index of financial inclusion. The topic of financial inclusion has gathered significant attention in recent years. Various initiatives have been undertaken by central banks both in advanced and developing countries to promote financial inclusion. The issue has also attracted increasing interest from the international community with the G-20, IMF, and World Bank Group assuming an active role in developing and collecting financial inclusion data and promoting best practices to improve financial inclusion. There is general recognition among policy makers that financial inclusion plays a significant role in sustaining employment, economic growth, and financial stability. Nonetheless, the issue of its robust measurement is still outstanding. The new composite index uses factor analysis to derive a weighting methodology whose absence has been the most persistent of the criticisms of previous indices. Countries are then ranked based on the new composite index, providing an additional analytical tool which could be used for surveillance and policy purposes on a regular basis.

The objective of this work is to evaluate the safety of adult and child passengers exposed to a radio frequency (RF) source, i.e., a leaky coaxial cable (LCX) on the subway platform. An adult model, a child model, and an LCX model have been numerically designed in COMSOL Multiphysics software. The distributions of the induced electric field (E-field), specific absorption rate (SAR), magnetic field ( H-field) and the head temperature increase in adult and child passenger models were calculated at 900 MHz. The induced fields in the passengers were compared with that without screen doors. The results show that the E-field, SAR and H-field in the whole body of the child are 2.00 × 10 -2 V/m, 1.07 × 10 -7 W/kg, and 2.94 × 10 -4 A/m, respectively. The E-field, SAR and H-field in the central nervous system of the child are 1.00e × 10 -2 V/m, 2.44 × 10 -8 W/kg, and 2.41 × 10 -4 A/m, respectively. The maximum values of the E-field, SAR and H-field in the adult passenger are 1.49–2.34 times higher than those of the child. The E-field, SAR, and H-field in the passenger models without a screen door are larger than those with a screen door. The screen door has a partial shielding effect on the RF electromagnetic field. The values of the maximum temperature that increases in adult and child head tissue are 0.2114 and 0.2111℃ after waiting 6 minutes exposure, respectively. All calculated results are well below the International Commission on Non-Ionizing Radiation Protection (ICNIRP) limits for general public exposure, indicating that RF electromagnetic exposure caused by the LCX on the subway platform is not a threat to passenger’s health.

It will be argued in this article that the EU Recommendation on common principles for collective redress might have limited impact on the field of competition law due to: several uncertainties regarding the legal standing in class actions; difficulties in their funding; and the risk of forum shopping with cross-border actions. Neverthe-less, Belgium and Great Britain have recently introduced class actions into their national legal systems and addressed some of the difficulties which other Member States were experiencing already. It will also be suggested that the Portuguese model – the ‘Popular Action’ – and recent Portuguese practice may be considered an interesting example to follow in order to overcome some of the identified obsta-cles to private antitrust enforcement.

The subject of the research presented in this paper were financial results of mining industry enterprises (PKD 5 – Polish Classification of Activity – “Mining of coal and lignite”) in 2007–2019. The research was conducted using relative and absolute financial measures, forming an extensive and coherent set of features characterizing their financial condition. The purpose was to measure and evaluate the efficiency of examined enterprises operation, considered as an attribute of development as well as factors describing and determining it. This evaluation was made against the background of ongoing restructuring processes taking into account their potential effects. The article presents the course of the process of adapting Polish hard coal mining to market economy conditions after 1989. The process can be conventionally divided into several periods. The scope and intensity of changes in the mining industry followed the subsequent government programs for mining industry restructuring. The lignite mining has not implemented any specific restructuring programs. The remedy processes were mainly related to organizational and ownership changes. In relation to operation efficiency and value creation three turning points in the development path of enterprises were highlighted – 2011, 2015 and 2017, while the period of strong deterioration of results occurred in 2011–2015. It was proved that restructuring processes did not affect the operating return on sales. However, there was a strong relation between changes in economic conditions on the coal market (prices) and the accumulation rate.
Przedmiotem badań przedstawionych w artykule były wyniki finansowe przedsiębiorstw wydobywczych (PKD 5 „Górnictwo i wydobywanie węgla kamiennego i brunatnego”) za lata 2007–2019. Badania przeprowadzono z zastosowaniem względnych i bezwzględnych miar finansowych, stanowiących rozległy i spójny zbiór cech charakteryzujących ich kondycję finansową. Celem był natomiast pomiar i ocena efektywności funkcjonowania badanych przedsiębiorstw, uznawana za atrybut rozwoju oraz czynniki ją opisujące i kształtujące. O cena ta prowadzona była na tle przebiegających procesów restrukturyzacyjnych z uwzględnieniem ich potencjalnych efektów. W artykule przedstawiono przebieg procesu dostosowywania polskiego górnictwa węgla kamiennego do warunków gospodarki rynkowej od 1989 roku. Wyróżniono kilka okresów restrukturyzacji, a zakres i intensywność zmian w górnictwie postępowała w ślad za kolejnymi rządowymi programami restrukturyzacji górnictwa. W przypadku górnictwa węgla brunatnego nie zostały wdrożone żadne szczególne programy restrukturyzacyjne. Procesy naprawcze dotyczyły przede wszystkim zmian organizacyjnych i własnościowych. W zakresie efektywności działania i kreacji wartości wyróżniono punkty zwrotne ścieżki rozwoju przedsiębiorstw – lata 2011, 2015 i 2017, a okres silnego pogorszenia osiągniętych wyników wystąpił w latach 2011–2015. Wykazano, że procesy restrukturyzacyjne nie miały wpływu na rentowność operacyjną sprzedaży. Natomiast w wyraźny sposób uwidocznił się związek między zmianami koniunktury na rynku.

The segment of young consumers meets a particular interest on the side of both market researchers and business. As it was noticed in the report Bogactwo mądrości – spełnianie potrzeb starszych konsumentów: “The prevailing in recent decades cult of youth has shaped the way in which firms perceive the consumer. Though at present the bigger and bigger and more and more influential group of consumers are individuals aged 50+, the majority of suppliers of products and services have still been designing and adjusting their offer only to the young generation” (Deloitte, 2012).It is this group of consumers which is perceived as one of potential and innovative consumers. Hence the knowledge of the young people’s financial standing, competences, behaviour is of substantial cognitive and applicative importance. An aim of the article is to present the young Poles’ financial standing in the light of findings of the survey for the National Register of Debts1 as well as the selected competences of young consumers based on results of the quantitative (main2) survey carried out among 1000 Poles (recognised as at least minimally competent) in August 2013, for two groups: individuals aged 18-29 accounting for 26% and, for comparison, aged 30-39 accounting for 14% of the population surveyed. The survey was carried out with the use of a questionnaire of the survey by the CATI (computer-assisted telephone interview) method. The surveys carried out by NRD show that more than 1/3 of young Poles receive money from parents or family, or have bills paid thereby. Independently able to subsist is every fourth 25-30-years old individual and as much as 14% 30-years old ones. Young people are more often satisfied than dissatisfied with their financial standing. Almost every second young Pole is satisfied or very satisfied with their financial standing; only 23% are dissatisfied or highly dissatisfied. As much as 30% of the respondents were unable to evaluate their standing. Young Poles’ households’ incomes are highly diversified. On average, young Poles’ families have at their disposal the amount of 2,669 zlotys per month. Living on credit is for many young people the only possibility to start their independent lives. Almost one half of Poles up to the age of 35 years availed themselves with credits and loans whenever. In turn, the authors’ surveys indicate that financial competences of young Poles require educational activities whose need is indicated by the respondents. Many young people do not plan their budget or special purpose spending, do not prepare a purchase list, although many young people display high self-assessment of their competences as regards finance management. Segment młodych konsumentów znajduje szczególne zainteresowanie ze strony zarówno badaczy rynku, jak i biznesu. Jak zauważono w raporcie Bogactwo mądrości – spełnianie potrzeb starszych konsumentów: „Panujący w ostatnich dekadach kult młodości ukształtował sposób, w jaki firmy postrzegają konsumenta. Pomimo, że obecnie coraz większą i bardziej wpływową grupą konsumentów są osoby w wieku 50+, większość dostawców produktów i usług wciąż projektuje i dostosowuje swoją ofertę tylko do młodego pokolenia” (Deloitte, 2012). To w tej grupie konsumentów upatruje się potencjalnych i innowacyjnych konsumentów. Stąd wiedza o sytuacji finansowej, kompetencjach, zachowaniach ludzi młodych ma istotne znaczenie poznawcze i aplikacyjne. Celem artykułu jest przedstawienie sytuacji finansowej młodych Polaków w świetle wyników badania Krajowego Rejestru Długów, a także wybranych kompetencji młodych konsumentów w oparciu o wyniki badania ilościowego (głównego) przeprowadzonego wśród 1000 Polaków (uznanych za przynajmniej minimalnie kompetentnych) w sierpniu 2013 roku, dla dwóch grup: osób w wieku 18-29 lat liczącej 26% i dla porównania w wieku 30-39 lat liczącej 14% badanej populacji. Badanie przeprowadzono przy wykorzystaniu kwestionariusza ankiety techniką CATI (ang.Computer Assisted Telephone Interview, czyli wspomagany komputerowo wywiad telefoniczny). Badania przeprowadzone przez KRD wskazują, że ponad 1/3 młodych Polaków dostaje pieniądze od rodziców lub rodziny lub ma przez nich opłacane rachunki. Samodzielnie jest się w stanie utrzymać co czwarty 25-30 latek i aż 14% trzydziestolatków. Młodzi są częściej zadowoleni niż niezadowoleni ze swojej sytuacji finansowej. Niemal co drugi młody Polak jest zadowolony lub bardzo zadowolony ze swojej sytuacji finansowej, jedynie 23% jest niezadowolonych lub bardzo niezadowolonych. Aż 30% badanych nie potrafiło ocenić swojej sytuacji. Dochody gospodarstw domowych młodych Polaków są bardzo zróżnicowane. Średnio rodziny młodych Polaków dysponują kwotą 2 669 złotych miesięcznie. Życie na kredyt jest dla wielu młodych ludzi jedyną możliwością na rozpoczęcie samodzielnego życia. Niemal połowa Polaków do 35. roku życia korzystała kiedykolwiek z kredytów i pożyczek. Z kolei badania autorek dowodzą, że kompetencje finansowe młodych Polakówwymagają działań edukacyjnych, na potrzebę których wskazują sami respondenci. Wiele młodych osób nie planuje budżetu, ani wydatków celowych, nie sporządzają listy zakupów, aczkolwiek wielu młodych dokonuje wysokiej samooceny kompetencji w zakresie zarządzania finansami. Przedstawione wyniki badań mają charakter poznawczy i aplikacyjny. Artykuł ma charakter badawczy.
Сегмент молодых потребителей особо привлекателен как для исследова телей рынка, так и бизнеса. Как отмечается в отчете Богатство мудрости – осуществление потребностей пожилых потребителей: «Господствующий в последние десятилетия культ молодости сформировал образ, каким фирмы воспринимают потребителя. Несмотря на то, что в настоящее время все большей и все более влиятельной группой потребителей являются лица в возрасте свыше 50 лет, большинство поставщиков продуктов и услуг по-прежнему проектирует и приспособляет свое предложение только к молодому поколению» (Deloitte, 2012).Это в этой группе потребителей усматривают потенциальных и инновационных потребителей. И потому осведомленность в отношении финансового положения, компетентности, поведения молодых людей имеет существенное познавательное и прикладное значение. Цель статьи представить финансовое положение молодых поляков в свете результатов обследования Национального списка должников, а также избранных видов компетентности молодых потребителей на основе результатов количественного (основного) исследования, проведенного среди 1000 поляков (признанных по крайней мере в минимальной степени компетентными) в августе 2013 г., для двух групп: лиц в возрасте 18-29 лет, насчитывающей 26%, и для сравнения в возрасте 30-39 лет, насчитывающей 14% обследуемой популяции. Обследование провели с использованием вопросника анкеты по методу CATI (англ. Computer Assisted Telephone Interview, т.е. компьютерной системы телефонного интервью). Обследования, проведенные по заказу Национального списка должников, указывают на то, что свыше 1/3 молодых поляков получают деньги от родителей или семьи, или же родственники оплачивают их счета. Самостоятельно в состоянии содержаться каждый четвертый обследуемый в возрасте 25-30 лет и даже 14% респондентов в возрасте 30 лет. Молодые люди чаще довольны, нежели недовольны своим финансовым положением. Почти каждый второй молодой поляк доволен или очень доволен своим фи- нансовым положением, лишь 23% недовольны или очень недовольны. Даже 30% обследуемых не умели оценить свое положение. Доходы домохозяйств молодых поляков весьма дифференцированы. В среднем семьи молодых поляков располагают суммой 2.669 злотых в месяц. Жизнь на кредит для многих молодых людей – единственная возможность начать самостоятельную жизнь. Почти половина поляков в возрасте до 35 лет хотя бы один раз пользовалась кредитами и займами. В свою очередь, авторы доказывают, что финансовая компетентность молодых поляков требует просветительной работы, потребность в которой указывают сами респонденты. Многие молодые люди не планируют свой бюджет ни целевых расходов, они не составляют списков покупок, хотя многие молодые люди высоко оценивают свою компетентность в отношении управления финансами.Представленные результаты исследований имеют познавательный и прикладной характер. Статья имеет исследова- тельский характер.

Motions to carry out the control submitted to the National Defence Committee stay within the scope of the subject matter of activities of the committee. The author claims that one of the motions rises some concerns of a legal nature. The subject of the request was defined in a problem way, whereas committee’s control relates to enforcement and executing statutes and Sejm resolutions, what leads to a conclusion that the scope of the control should be related to a given act or resolution.

Purpose: The objective of the study is to evaluate the degree of balance disorders in patients with surgical treatment of ankle fractures with the use of stabilometric examinations.Methods: The subjects in the study were 21 patients with ankle fractures treated surgically, within one year of the procedure. The control group were 20 healthy subjects. The balance was evaluated with the use of force platform in standing posture in both single and double limb stance. The analysed parameters were the transition area of the centre of feet pressure (COP), the length of the COP path and the COP velocity. The range of movement in the ankle joint and the intensification of pain were also measured.Results: In the balance evaluation in double limb stance, there were no statistically significant differences. A significant difference was found in the attempts of single limb-stance An average value of COP transition area in the study group was 261.2 mm2 in single stance (on the right operated limb) and in the control group – 93.2 mm2, so the difference was statistically significant (p=0,0096). The presence of pain, the presence or the removal of anastomosis had no significant influence on the balance of the studied subjects. Also a significant correlation between the balance of the subjects and their age was found.Conclusions: The balance in single limb stance after an instable ankle fracture within one year of the surgical procedure is significantly poorer in comparison with healthy subjects. Elderly persons have significantly poorer balance control.

For the development of an effective cargo-scanning system, an intrapulse energy switching has been tested at the National Centre for Nuclear Research (NCBJ) with the possibility to change the beam energy within a 4 μs pulse of the linear electron accelerator (linac). Modifi cation of the electron energy is achieved through the beam-loading effect in a standing-wave accelerating structure equipped with a triode gun. Construction of the machine and the achieved results are presented in this article.

Artykuł stanowi syntetyczne przedstawienie założeń i wyników badania PISA. Omówione są metodologia badania, sposób jego przeprowadzania, formy zadań. Szczególną uwagę poświęca się dziedzinie głównej z roku 2018, czyli rozumieniu czytanego tekstu. Zostały wyjaśnione podstawowe pojęcia związane z tekstem, sytuacją czytelnika, aktem lektury. W dalszej części omówiono wyniki, z uwzględnieniem pozostałych dziedzin (matematyka, nauki przyrodnicze), zmian w ujęciu historycznym oraz porównań z innymi krajami. Przedstawione zostały również wyniki badań kontekstowych, które dają możliwość przyjrzenia się klimatowi polskiej szkoły, sposobom nauczania, dobrostanowi uczniów. Na koniec została przedstawiona propozycja interpretacji wyników.
The article is a synthetic presentation of the assumptions and results of the PISA study. The article discuses methodology of assessment, ways of doing it and forms of tasks. Particular attention is paid to the main field from the year 2018, i.e. the under standing of the text being read. Basic concepts related to the text, the situation of the reader, and the act of reading were explained. The following sections discuss the results, ta king into account other areas (mathematics, life sciences), historical changes and comparisons with other countries. The results of contextual research were also presented, which give the opportunity to examine the climate of Polish schools, teaching methods, and students’ well-being. Finally, a proposal for the interpretation of the results is presented.

Artykuł dotyczy problemu regulaminu Zgromadzenia Narodowego obowiązującego w Polsce. Jego autor w podjętej analizie wskazuje przyczyny, dla których obecna formuła regulaminu, obejmującego kilka aktów normatywnych, odnoszących się do poszczególnych kompetencji Zgromadzenia Narodowego, zresztą uchwalonych tylko w części, powinna być zastąpiona przez formułę jednego, całościowego regulaminu. Głównym argumentem skłaniającym do takiego postulatu jest przekonanie o niezgodności obecnej konstrukcji regulaminu z obowiązującą konstytucją, a także z zasadami techniki prawodawczej. Wśród innych argumentów jest także to, że nieuchwalenie rozwiązań regulaminowych w całości powoduje lukę proceduralną, która uniemożliwia zastosowanie przepisów ustawy o Trybunale Stanu w zakresie prezydenckiego impeachmentu. Biorąc pod uwagę wszystkie te argumenty, autor formułuje de lege ferenda postulat mający na celu zmianę obecnej formuły regulaminu Zgromadzenia Narodowego.
The article deals with the problem of the standing order of the National Assembly in Poland. The author indicates the reasons why it should be enacted as an unified, including all necessary issues, act, contrary to the present one, which is divided into a few independent, only partly adopted and referring to the significant competences of the National Assembly acts. The main argument is that the legislative method, that has been chosen by the lawmaker, seems to violate the constitutional provisions. It also looks not to be in accordance with the rules of legislative technique. Last but not least is that the present legal status causes a procedural gap, which means that some solutions, involved in the bill of State Tribunal, dealing with the procedure of presidential impeachment, cannot be applied until the entire standing order is adopted. Taking into account these arguments, the author raises a de lege ferenda postulate, aiming to change the current formula of the standing order of the National Assembly.

By now, it is a generally known fact that the majority of ‘new’ Polish migrants to the UK are carrying out simple, low-skilled work. At the same time, however, many of these migrants have considerably high levels of education (Anderson et al. 2006, Drinkwater et al. 2006, Fihel et al. 2008, Pollard et al. 2008). Up till now, this problem has been framed predominantly in terms of issues of brain drain, brain overflow and/or brain waste (Kaczmarczyk and Okolski 2005, Kaczmarczyk 2006). However, little attention has been given to the social world the ‘overqualified’ Polish migrants are living in. For the ‘overeducated’ migrants the world of work is often also one of class divisions. The values and general outlook of these (potentially) middle-class people often clash with those of their co-workers, i.e. working class Poles and Britons, resulting in a particular tension within the social environment of work as well as internal conflict. What is, therefore, the migrants’ perception of this situation? How do they view their class position in relation to their occupational and social standing in the UK? This article will be devoted to an analysis of these issues based on qualitative material gathered on well-educated Polish migrants working considerably below their level of qualifications.

The power of the presidium of the committee to determine the agenda of a committee sitting is limited only in two cases – a minority request to convene a sitting and an initiative of the Presidium of the Sejm. The chairperson of the committee establishes the agenda of the committee meeting only in the case in which he executes the minority’s request. No provision of the Standing Orders of the Sejm l allows the chairman of the committee to set the agenda for a committee meeting without the involvement the presidium of the committee. Producing minutes documenting a sitting of the presidium is not required, nor there are any procedural requirements regarding the rules for convening these sittings.

Suspension of the membership in Deputies’ (parliamentary) club is not the same as loss of membership, hence it does not cause changes in the composition of a club. Due to the fact that the Standing Orders of the Sejm do not include any provisions concerning the status of a Deputy, whose membership in the club has been suspended, effects of such suspension should be perceived solely in the sphere of club’s internal matters. The suspended Deputy, until a information about a loss of his/her club membership is submitted to the Marshal of the Sejm, shall be treated by Sejm authorities as a member of the club.

Research method – The financial situation and independence are multidimensional. They are shaped by, among others, economic, legal and financial factors. The assessment of the financial standing and independence was based on the value of the synthetic measure determined by the TOPSIS method. The study covered the years 2009-2018. The article uses data obtained from the Regional Accounting Chamber of Kielce. Results – The subject of the discussion presented in the article are the issues of the financial situation and independence of the municipalities (102) of Świętokrzyskie voivodship. As part of the research, a set of diagnostic variables was selected, their nature, synthetic measure, and their division into quartile groups were determined. Originality / value – Stability and certainty of income determine the scope and level of tasks performed by the municipalities. The financial situation and independence of municipalities are not a permanent category. The financial situation of the municipalities in Świętokrzyskie voivodship was shaped by the development potential, the level of financing public services and implemented transfers, income and expenses independence and budget solvency. The best municipalities were characterized by a good situation and a high level of financial independence.

Zaprezentowano wykorzystanie modeli predykcji bankructwa do oceny kondycji spółek wchodzących w skład WIG-Spożywczy. Do analizy 18 spółek giełdowych wybrano model logitowy oraz liniową funkcję dyskryminacyjną.
The paper presents the use of bankruptcy prediction models to evaluate the viability of the companies comprising the WIG-Spożywczy stock index. The applied models are the logit model and linear discriminant function. The result obtained (the theorieticial probability of bankruptcy and the value of the discriminant function) allow a general conclusion that in the period under review the condition of food companies was good. Both in 2008 and 2009, the average annual theoretical probability of bankruptcy was small (16 and 18%, respectively). The average values of the discriminant function in the two years remained below zero, which provides yet another evidence for the good condition of companies in this sector.
