Ochrona praw konsumenta w Unii, pomimo że stypulowana szeroko (zakres praw) i na wysokim poziomie (choć z odesłaniem do jej szerszej i możliwie maksymalnej realizacji przez państwa UE), nie jest jednoznacznie w tym prawie zdefiniowana i zakreślona, a ponadto brakuje efektywnych sankcji przeciw tym państwom członkowskim, które nie chcą jej zapewnić ochrony konsumenta nawet na minimalnym poziomie (Polska należy chyba do tej grupy). Korzystają z tego zwłaszcza nowe państwa, bo pełną gwarancję szerokiej i efektywnej ochrony może stworzyć tylko silny ruch konsumencki i społeczeństwo obywatelskie. Władze polskie wykazują (na tle starej Unii) niską dbałość o prawa konsumenta, co wynika także z interesów ekonomicznych dużych firm. Skargi Komisji przeciw Polsce nie mają większego wpływu na poprawę sytuacji konsumentów.
The protection of customers’ rights in the European Union, although stipulated broadly (the scope of rights) and at a high level (although with a referral to a broader and possibly maximal implementation by the European Union countries), is not unambiguously defined and outlined. Moreover, it lacks effective sanctions against member states that do not want to provide their customers with the minimum level of protection (Poland seems to belong to this group). This is especially advantageous for the new member states because only a strong consumer movement and civil society can create a guarantee of broad and effective protection. Polish authorities show (in comparison with the old Union) little care for the rights of consumers, and it also results from the interests of big companies. The European Union Commission’s complaints against Poland do not have a significant impact on the improvement of the consumers’ situation.

W artykule poddano dyskusji konieczność stosowania dezynfekcji ścieków w aspekcie ochrony zdrowia publicznego i wymagań stawianych jakości ścieków oczyszczonych. Przedstawiono metody stosowane w dezynfekcji ścieków. Omówiono obowiązujące w Polsce i za granicą regulacje prawne i praktykę dotyczącą dezynfekcji ścieków.
In the article the necessity of wastewater disinfection is discussed, in the aspect of public health protection and treated sewage requirements. The methods of wastewater disinfection are presented. The regulations in Poland and abroad are discussed as well as practice in that matter.

This paper describes a three phase shunt active power filter with selective harmonics elimination. The control algorithm is based on a digital filter bank. The moving Discrete Fourier Transformation is used as an analysis filter bank. The correctness of the algorithm has been verified by simulation and experimental research. The paper includes exemplary results of current waveforms and their spectra from a three phase active power filter.

This paper describes the sliding discrete Fourier transform (DFT) algorithm as an alternative for typical DFT used for spectrum analysis and synthesis. As an example a control circuit for a three-phase 75 kVA parallel active power filter (APF) is used. Such filters have been built and tested. Some illustrative, experimental results are also presented in the paper. The control algorithms of the proposed APF are implemented in the fixed-point digital signal processor TMS320C50. The presented control APF algorithm is a good alternative to classical APF control algorithms, because it allows easy selection of control parameters in mains currents: imbalance, reactive power or harmonics contents. In the proposed circuit transient performance of APF is improved using non-causal predictive current compensation.

Introduction. Increasing incidence of disability among elderly people results in a growing need for long-term care. Aim. The aim of the study was to assess the disability and quality of life in people over 60 living in institutional care. Material and methods. The study group included a group of 100 people residing in social welfare homes in south-eastern Poland. The WHODAS 2.0 questionnaire was used to assess disability and the WHOQOL-Bref questionnaire was used to assess the quality of life. Results. The majority of the respondents had difficulties in getting around (47.94), participation in society (34.29) and self-care (32.40). The lowest level of disability was found in the domain of getting along with other people (6.67). The highest level of quality of life was observed in the environmental domain (63.62), and the lowest in the social domain (37.10). A relationship was found between disability and the quality of life in the study group. Difficulties in terms of getting around and self-care, as well as participation in society had a negative impact on the quality of life. Conclusion. The residents of social welfare homes were characterized by moderate disability and a good quality of life. The results obtained indicate the domains of functioning that require the greatest support for the residents of social welfare homes. The implementation of programs to improve the performance of basic and complex activities of daily living (ADL) may improve the functional status and quality of life in these people.

Current approaches to subjectivity do not stress the notion of attributes of international subjectivity. The definitions of subjectivity embrace this category in general terms (concentrating on the implication of rights and obligations directly from international law), granting such status mainly to individual entities. The resultant increase in the number and quality of potential international entities would make international turnover virtually impossible. This would in turn imply granting international subjectivity to concerns and carriers of domestic law, thus obscuring the scope and subjectivity of particular structures. Hence, clear research assumptions are needed as well as efforts to determine what subjectivity is. These are tentatively formulated in this article with the subjective attributes (i.e. the most essential and constituting qualities) emphasised. The range of subject categories is wide (states and their in statu nascendi forms, international organisations, recognised entities other than states and organisations, international bodies and conferences). An analysis of the normative aspect and implementation of international subjectivity makes it possible to exclude entities and persons from having such status.

The project of the European Constitution that is formally entitled Treaty Establishing a Constitution for Europe, according to the Declaration of Leaken, as a juristic act was supposed to secure democracy and transparency, simplify the norms and ensure effectiveness for the Union, bringing it closer to the citizens. The name of the treaty wrongly suggests that it concerns all the citizens and countries in Europe, although it only concerns the European Union. The project is a compound juristic act. It consists of four loosely connected parts: Basic Provisions, Chart of the Fundamental Rights, Policies and Functioning of the Union and General and Final Regulations. However, the regulations contained in them are neither consistent (many regulations are doubled and their contents are contrary), nor complete, and hence they do not form a system, although the Constitution abolishes the communal legal output (acquis) and establishes a new order. It also liquidates the division into three pillars and establishes a new Union and its institutions. No regulations biding till now are included de iure directly in the new system of the Union law. With abolition of the old norms and lack of new detailed solutions (and with the weakness of the jurisprudential construction), the regulations in the Constitution silently assume a (necessary for the system to function) continuation of the old structures, mechanisms, principles, regulations and interpretations of judicial decisions. However, this is acting contra legem, and more precisely – it is anti-constitutional. Despite the disputes that were led, neither the member countries nor institutions of WE/EU paid any attention to it.

This paper presents a new concept of disinfection traditionally applied in water treatment systems. The new definition of this process results from the change in its functionality, aims and methods, which guarantee high quality of water supply. The literature review and technical practice demonstrate a demand for disinfection to act as a functional element of the integrated water distribution system and an active intermediate link between the technology of water treatment and the water distribution network. The presented concept of a disinfection process enables evaluation of water treatment, increases its effectiveness in integrated water treatment systems. Such defined disinfection addresses water conservation and its biological stability within the water supply network. The presented here new concept of disinfection assigns its new role and function in the integrated water distribution system. The controlling and diagnostic function of the disinfection defined in the paper provides a transparent and comprehensive method, with considerable application in experimental design, as well as practical solutions for integrated water distribution systems.

The protection of individual rights within the non-judicial area is no less important that the judicial one, and it is much more often applied. Imprecise as it is, the distinction between the judicial and non-judicial protection does not bear problems in practice. One is entitled to judicial protection in CoJS and CFI and national courts (acting as communal courts) with regard to the violence of rights (protected in acquis communautaire by other units, institutions and legal persons belonging to member states). The protection in national courts deals with the whole range of acquis, including e.g. (after the recent reform in this matter) the right of competition of the EU. Now the judicial protection embraces the following: the right of petition to the European Parliament and the right of complaint to the communal Ombudsman, and numerous complaints to the Commission. With regard to the violence of the communal right (including: cartel plot, public aid, subsidies, antidumping right, and other economic-merchant practices). The non-judicial protection is also enriched by the right to turn to all institutions of the EU in the physical and legal person's mother tongue from the area of the Union, and the duty to answer in this language. Certainty, this type of protection includes also all kinds of means for the protection of the consumer, health protection, and protection of the environment. All authorities and public institutions of the member states are also obliged to provide non-judicial protection in the area of acquis. There are no doubts as to the duties of the EU states that follow from the primary and secondary communal right in the are under consideration. The non-judicial protection in the national systems of entitlements that follow from KPP has no complete juridical justification (it will be introduced by the Constitution for Europe). The mechanisms of protection under discussion exert a positive influence on the enhancement of the international protection of human rights.

The aim of the research was to assess the postural stability indicators of older women and men receiving institutional care. Methods: The study involved 123 people aged 65–85, living in residential care homes in Rzeszów district. The main research tool was the CQ-Stab 2P 2-platform posturograph. Results: There were statistically significant differences between women and men in the total statokinesiogram path length, the statokinesiogram path length in the anteroposterior direction, the mean COP displacement in the anteroposterior direction as well as the mean velocity of the COP point in the anteroposterior direction under eye control ( p = 0.04). In the case of absence of visual control, men were characterized by significantly worse parameters in the area of mean COP displacement in the anteroposterior and lateral directions as well as the maximal COP displacement in the anteroposterior and lateral directions. It indicated that without visual control body balance parameters in men significantly worsened along with increasing age. A statistically significant difference was found between both genders in terms of the statokinesiogram path length, the mean COP displacement and the mean COP velocity ( p < 0.05). Conclusions: Gender differences in postural stability of older people under institutional care were noticed. Men were characterized by a lower level of postural stability compared to women. Elimination of visual control significantly worsened the balance of the body. The results obtained indicate the necessity of introducing therapeutic programs in nursing homes, taking proprioceptive exercises and exercises without visual input into account.

Introduction. Quality of life (QOL) is an important aspect of life, reflecting health and conditioning the well-being of older adults. Maintaining the QOL is essential in times of demographic changes which resulting longer life spans, and consequently an increased proportion of older adults in society. Objective. The aim of the study was to assess the quality of life and its basic determining factors in the elderly living in rural areas of south-eastern Poland. Material and method. The study was conducted on 973 respondents aged 60–80 years living in rural areas of south-eastern Poland (Podkarpackie Region). The research tool used in the study was the WHOQOL-Bref and a questionnaire on personal characteristics and health. Statistical analysis was performed using Statistica version 10. Results. All quality of life domains assessed were above the median values of the scale. The highest values were found in the social domain (67.35 ± 17.31) and the lowest values in the physical domain (58.74 ± 14.80). All the quality of life values decreased with an increase in age and increase in number of chronic diseases in a given person. A higher quality of life was found in subjects who were physically and socially active. Conclusion. The study stresses the impact of modifiable determiners of QOL. Interventions aimed at improving the quality of life of older adults should involve interdisciplinary monitoring of health, early treatment of diagnosed problems, and promotion of physical activity and daily life activities.
