    In the face of constant pandemic-related and military threats to citizens’ right to work, collective bargaining has become almost the only real instrument to reconcile the interests of social partners and consolidate their efforts. The authors proposed a methodology for assessing the development of social partnership in the regulation of labour remuneration based on a set of indicators and a comparative analysis of the indicators in several public organisations: the State Audit Service of Ukraine, the State Treasury Service of Ukraine, the State Statistics Service of Ukraine, the State Fiscal Service of Ukraine, the Armed Forces of Ukraine, the State Border Guard Service of Ukraine, the Police of Ukraine, and the Pension Fund of Ukraine. Based on the challenges and general trends revealed by the results of the analysis, the authors identified areas for improving collective wage bargaining and the best practices in social partnership for their dissemination in public organisations.

    Przemiany własnościowe i strukturalne w sektorach infrastrukturalnych polskiej gospodarki ostatniego trzydziestolecia, przy motywowanym interesem publicznym (art. 22 Konstytucji) i zasadą społecznej gospodarki rynkowej (art. 20) oddziaływaniu państwa na te sektory, uzasadniają potrzebę refleksji prawno-konstytucyjnej nad statusem działań organów regulacyjnych w tych sektorach. Akcesja do Unii Europejskiej ulokowała te działania na szlaku przedsięwzięć integracyjnych Unii, nakierowanych na „horyzontalną” integrację sektorów infrastrukturalnych państw członkowskich. Najczęściej stosowanym narzędziem prawnym wdrażania unijnych inicjatyw integracyjnych są sektorowe dyrektywy Parlamentu Europejskiego i Rady Unii. Polskie organy regulacyjne, z atrybutami ich niezależności, profesjonalizmu i merytoryki działania, znalazły się w polu, gdzie krzyżują się dwa nurty oddziaływań: ku unijnej integracji sektorowej oraz wiodącego od Rady Ministrów RP i właściwych ministrów nurtu polityki krajowej wobec sektorów infrastrukturalnych. Autor, identyfikując elementy tego usytuowania, wskazuje na konstytucyjno-prawne niejasności (wręcz: dylematy) w odniesieniu do relacji: Rada Ministrów (i jej Prezes)/ministrowie – organy regulacyjne.
    Ownership and structural changes in the infrastructural sectors of the Polish economy in the last three decades, while maintaining the public interest (art. 22 of the Constitution) and the implementation of the “social” market economy principle (art. 20) of the state’s influence on these sectors, justify the need for a legal and constitutional reflection on the status of activities of regulatory bodies in these sectors. The accession to the European Union has placed said activities on the path of the Union’s integration policies, aimed at “horizontal” integration of the infra-structural sectors of the EU member states. A typical and most commonly used legal tool for implementing EU integration undertakings are sectoral directives of the European Parliament and the Council. The Polish regulatory authorities with their postulated attributes of independence, professionalism and objectivity, have found themselves in the field where two routes of the addressed impacts cross: the EU sectoral integration route and the route of implementation of national policy toward infrastructure sectors (steaming from the Polish Council of Ministers and from relevant ministries). The author, identifying the elements of such use, points out the constitutional and legal uncertainties (even: dilemmas) in regard to the relationship between the Council of Ministers (and the Prime Minister)/relevant ministries and the state sectoral regulatory bodies.

    Ex post regulation as the method of sectoral regulation in electricity sector

    Aim/purpose – The aim of the article is to present the essence of ex post approach to sectoral regulation, to show the advantages and disadvantages of ex post regulation and to answer the question whether it is worth using in the electricity sector. Design/methodology/approach – For this purpose, a critical analysis of expert literature was made and an empirical analysis of countries that have applied ex post regulation in the electricity sector in the European Union. Two research methods were used: a case study and a comparison of changes in price and quality of services. The research period covered the period 2000-2016. Findings – It was found that ex post regulation reduces regulatory costs, does not adversely affect the quality of service and long-term rates, gives businesses the freedom of decision-making and the ability to react quickly to changes in the economy. The main disadvantages of ex post regulation are the tendency for companies to over-estimate bills for consumers, the difficulty of pursuing claims by consumers and the need to shift regulatory risk to consumers. Research implications/limitations – In the paper there was identified a research gap, i.e. the effects of ex post regulation in the electricity sector in European Union countries where such regulation was applied. Identifying the research gap will help us understand what are the advantages and disadvantages of ex post regulation and will create a model for when it is good moment to implement this in the economy. Besides identifying the research gap, further studies will be required over ex post regulation. Originality/value/contribution – The additional value of the paper is the study of ex post regulation, its essence and types. The article analyzed the effects of ex post regulation in the electricity sector and provided valuable insights into the potential risks associated with this approach to economic regulation.

    The article provides an analysis of the most important judgments rendered by Slovak courts at the end of 2010, in the course of 2011 and at the beginning of 2012. The article focuses solely on judicial review of decisions issued by the National Competition Authority of the Slovak Republic. Slovak courts dealt with several key issues concerning public enforcement of competition law such as: the application of the so-called ‘general clause’; competences of the Slovak competition authority in regulated sectors; and the application of the economic continuity test. Some of the conclusions resulting from these judgments may be considered disputable. It may be argued, in particular, that they may jeopardize the effective enforcement of competition law in the Slovak Republic. At the same time, the discussed jurisprudence has managed to clarify a number of key issues which had been subject to debate for a number of years. The article presents a review of these judgments, summarizes their key conclusions and considers their possible impact on the system of public enforcement of competition law in the Slovak Republic. The article is divided into a number of parts, each of which covers an individual case, the titles of which refers to the main topic that was under discussion in the presented judgment.
    Cet article analyse les décisions les plus importantes rendues par les cours slovaques en fin de l´année 2010, au cour de l´année 2011 et au debut de l´anneé 2012. L'article traite exclusivement la révision judiciaire des décisions rendues par Bureau antimonopole de la République slovaque. Les cours slovaques se sont penchées sur quelques questions clés relatif à l'application du droit de la concurrence tel que l´application de la clause générale, l´autorité de Bureau antimonopole de la République slovaque dans les secteurs régulés et l´application du test de la continuité économique. Certains conclusions résultants de ces décisions peuvent être considérées comme litigieuses. En particulier, il peut être soutenu que ces décisions peuvent affecter l'application effective du droit compétitif en République slovaque. Il est à noter que certains de ces décisions ont éclairé les questions qui ont été discutées pendant plusieurs années. Cette contribution donne un aperçu de ces susdites décisions, résume les principales conclusions découlant de ces décisions et analyse l´influence potentiel sur le système de l´application public du droit de la concurrence en République slovaque. La contribution est divisée en plusieurs parties, chacune d'entre elles consacrée à un cas particulier, les titres des articles sur des thèmes clés, qui se consacre à la décision.
