The article makes a contribution to the research over that subject matter, both paying attention to history and law. Undoubtedly, the discussed subject matter is one of the most emotional issues connected with history of the Polish People’s Republic. In spite of that there is no full monopraph showing the discussed phenomenon, in a form of a syntetic study. I would be worth taking up such an idea. Preliminary research included the collection of New File Archives in Warsaw, where one can find lots of information on the studied topic. It was supplemented with the press sources, which are the mine of knowledge within that subject, althoug the Author had to be careful and interpret the facts presented there properly. It concerns mainly the numerical data which did not correspond the real actual state at that time. The Propaganda done in party press was mainly aimed the artificial emphasizing of the achievements of the judiciary authorities in battle with malpractice and their successes, not really true. The above subject matter will be widely developed in future, by the majority of historians fascinated with the latest Polish times, both in micro and macro dimension.

Throughout the evolution of public political discourse we have repeatedly seen the effects of scandals on the careers of many politicians. Although the cultural and societal norms that have traditionally dictated the results of such scandals have changed dramatically within the last two centuries, I believe that the aftermath of these scandals may be better understood by analyzing and comparing the politician’s previously established public image to the scandal at hand. I will argue that a negative impact only occurs if and when there is a clear contradiction of character that presents the politician as a deceitful or hypocritical person in the media sphere and therefore the eyes of the public.

Współczesna gospodarka światowa jest niestabilna. Świadczą o tym wybuchające cyklicznie kryzysy. Jednym z kluczowym czynników wpływających na niestabilność i kryzysy jest zmiana struktury własnościowej wielu przedsiębiorstw i towarzyszące temu oddzielenie własności od zarządzania. Procesy te doprowadziły m.in. do różnych konfliktów między akcjonariuszami i właścicielami opisywanymi m.in. przez teorie agencji. Nie ma miesiąca, w którym nie dowiadywalibyśmy się o kolejnym skandalu finansowym wywołanym przez wielkie korporacje. Celem artykułu jest wskazanie na korelacje między nadużyciami korporacyjnymi a teorią agencji. W artykule przeprowadzono analizę istoty teorii agencji, jej problemów, a także ewolucji. W celu zachowania obiektywności w tekście uwzględnione zostały stanowiska współczesnych zwolenników, jak i krytyków teorii agencji. Poruszono problem nadużyć korporacyjnych w Stanach Zjednoczonych w świetle teorii agencji począwszy od Enronu w 2001 roku, przez kryzys finansowy 2008 roku oraz dalsze jego konsekwencje. Przeprowadzona w artykule analiza wykazała, że pomimo wielkiego kryzysu finansowego nie wyciągnięto należytych wniosków w dziedzinie nadzoru korporacyjnego. Nowe regulacje, które narzucały odpowiedzialność menadżerów, nie przyniosły oczekiwanego efektu. Organy regulacyjne i kontrolne nie potrafiły postawić menadżerów odpowiedzialnych za kryzys w stan oskarżenia. Biorąc pod uwagę taki rozwój sytuacji i bezkarność menadżerów należy się spodziewać narastającego problemu agencji na rynkach finansowych.
The contemporary global economy is unstable, as evidenced by cyclical crises. Almost every month we find out about the next financial scandal caused by large corporations. One of the key factors affecting volatility and crises is the change of the ownership structure of many enterprises and the accompanying separation of ownership and management. These processes led, among others, to various conflicts between shareholders and owners, described by agency theories. The purpose of this article is to show correlations between corporate/financial scandals and the agency theory. In the article, the author analysed the essence of the agency theory, its problems and evolution. To maintain objectivity this text includes the opinions of supporters as well as critics of the agency theory. In the article, there was discussed the problem of corporate frauds in the United States in the light of the agency theory, starting from Enron in 2001, through the financial crisis of 2008 and its further consequences. The analysis presented in the article shows that despite the great financial crisis no proper conclusions were drawn in the area of corporate governance. New regulations that imposed managers’ responsibility did not bring the predicted effect. Regulatory and control bodies were not able to make the managers responsible for the crisis indicted. Taking into account the development of the situation and lack of managers’ responsibility, we should expect a growing agency problem in financial markets.

Gdy weźmie się pod uwagę szereg głośnych skandali korporacyjnych w  dużych przedsiębiorstwach, takich jak WorldCom, Enron i  Tyco, a  także w  istniejących nadal firmach, takich jak indyjski Satyam czy Countrywide Financial Corporation, Healthsouth Coporation i  Diebold Incorporated w  USA, odpowiedzialność za nieetyczne postępowanie musi nieuchronnie spaść na liderów tych korporacji. Nic dziwnego, że w  ankiecie, jaką przeprowadził „The Economist” (październik 2003), zaledwie 23% pytanych odpowiedziało, że dyrektorowi korporacji można zaufać – wynik ten był tylko nieco wyższy od oceny, jaką uzyskali sprzedawcy używanych samochodów [„Ankieta”]. Niniejszy artykuł omówi: (1) szczegóły dotyczące widocznego braku przywództwa etycznego w  czterech spółkach wymienionych powyżej; (2) kilka powodów natury psychologicznej i  filozoficznej, dla których takie zachowanie mogło przeniknąć całą organizację; (3) kilka kroków, jakie należało podjąć, aby zniechęcić liderów do takiego nieprawidłowego zachowania, i  wreszcie (4) zalecenia dla przyszłych badań.
With the number of high profile corporate scandals by major companies such as WorldCom, Enron, and Tyco, as well as current firms such as India's Satyam and the United States' Countrywide Financial Corporation, Healthsouth Corporation, and Diebold Incorporated, inevitably the responsibility for such unethical conduct must revert back to the leaders of these corporations. It is no wonder that in a survey conducted by The Economist (October 2003) only 23 percent of those questioned believed that a corporate executive could be trusted, which was slightly higher than that of a used automobile salesperson. This article will examine: (1) Details of the lack of ethical leadership exhibited in the latter four companies mentioned above, (2) Several psychological and philosophical reasons why this behavior was able to transcend throughout the organization, (3) Some steps which should have been in place to deter this poor behavior by corporate leaders, and (4) Recommendations for future research.

This article focuses on the influence of investigative journalism on the system of government, and, in particular, on the functioning and break-up of cabinet coalitions in Poland after 1989. It focuses on the parliamentary-cabinet form of government. The source of conflicts which led to the loss of the necessary trust or accelerated the fall of the government were often crises caused by the work of investigative journalists, in which they disclosed facts uncomfortable for members of the Council of Ministers, related to them either directly, through their own reprehensible activities, or indirectly, through the activities of their closest associates. The aim of this article is to show that the unmasking of scandals involving members of the government, their associates or politicians and officials from their political base is a catalyst that can generate cabinet crises, including the collapse of the government. Analyses show the impact of scandals revealed during the term of office of four governments, that of Waldemar Pawlak, Leszek Miller, Jarosław Kaczyński and Donald Tusk.

The study focuses on two Slovak corruption cases, both well-documented and of similar social relevance, of which one did not receive any cross-media coverage. Moreover, the case of large-scale bribery was rather under-hyped in comparison to other major corruption scandals occurring in the country. The case of cronyism formed a typical example of extremely poor inter-media coverage of highly unfair and politicised cronyism. Through these cases, especially in the one in which the media failed to stimulate the creation of a full-blown scandal, the study further analyses the criteria and circumstances that determine the worthiness of a case for wide media coverage. The study on Slovakia is framed within theories of scandalous reporting and the theory of agenda setting and inter-media agenda setting role of the media, and supported by quantitative analysis of actual media coverage of the bribery case.

W Requiem dla Mediów Jean Baudrillard opisał wojnę domową w rumuńskiej Timisoarze, która odbyła się w 1989 roku. Odkrył on, iż wojna ta została w znacznej mierze zainicjowana przez media masowe. Obecnie media mają możliwość dekontekstualizacji wydarzeń oraz ich obiektywizacji przez umieszczenie w innym kontekście obok innych zdekontekstualizowanych wydarzeń. Stanowi to istotne zagrożenie i może prowadzić do istotnych problemów z punktu widzenia bezpieczeństwa narodowego. Media mogą prowokować turbulencje społeczne i „prawdziwe” przestępstwa. Moim celem w tym artykule jest opisanie tego problemu i ukazanie możliwych rozwiązań. Stosując przyjętą metodologię, badam studia przypadków i analizuję wydarzenia historyczne.
In a Requiem for Media Jean Baudrillard described the civil war in Timisoara, Romania, in 1989. He discovered that the war was to a large extent instigated by the mass media. Nowadays, the media have the possibility to decontextualize events and objectify them by placing them in a different context, alongside other decontextualized events. This could be very dangerous and lead to serious national security problems. Media could provoke social turbulence and “real” crimes. My aim in this paper is to describe this problem and show possible solutions. While following the methodology adopted, I examine case studies and analyze specific historical events.

Artykuł przedstawia problematykę przestępstw kanonicznych contra mores, uregulowanych w art. 6 Suprema sanctitatis tutela z 2010 r. Autor komentuje dwa przestępstwa – przeciwko szóstemu przykazaniu Dekalogu popełnionego przez duchownego z małoletnim (art. 6 § 1, 1°) oraz tzw. pedo-pornografię (art. 6 § 1, 2°). Porządek komentarza przebiega według znamion każdego przestępstwa kanonicznego: najpierw znamiona przedmiotowe (sprawca przestępstwa i jego czyn), podmiotowe (dolus) i w końcu legalne (sankcja kanoniczna). Przestępstwa są ukazane w świetle polskiego kodeksu karnego, jeśli to konieczne, oraz wytycznych Konferencji Episkopatu Polski z 2014 r. Ta metoda pozwala na przedstawienie niektórych trudności w obowiązującym prawie kościelnym, które powinny być rozwiązane.
This article deals with questions concerning the delicts contra mores governed by Art. 6 of Suprema Sanctitatis Tutela of 2010. The Author comments on two delicts: that against the Sixth Commandment of the Decalogue committed by a cleric with a minor (Art. 6 § 1, 1°), and the delict of so-called pedo-pornography (Art. 6 § 1, 1°). The order followed in this comment corresponds to that of the elements of every canonical delict: first, the objective ones (the author of the delict and his act); then the subjective ones (the dolus); and finally the legal one (the canonical sanction). The delicts are presented in the light of the Polish criminal Code, when necessary, and the 2014 norms of the Polish Conference of Bishops. This method makes possible the presentation of some difficulties to be resolved in the existing ecclesial law.

In this paper the evolution of specific types of scandals within the field of transitional justice in Romania is shown. Furthermore, the study makes an inquiry into the reactions of different actors, socio-professional categories and organizations to the implementation of the disclosure law in Romania and to the flourishing of several legislative proposals on lustration and decommunization in the years following the 1989 anti-communist revolution. The actors under scrutiny are main political parties and the Romanian Orthodox Church respectively. The cases under review indicate that scandal is a quite versatile institution, and that the outcome of the disclosure scandals might as well be the advancement of disclosure and lustration measures, as well as also the hampering of such initiatives.

Celem artykułu jest wskazanie przyczyn nowego zjawiska w polskiej polityce wewnętrznej, a mianowicie ,,teflonowej” elity władzy. Określenie to oznacza niespotykaną wcześniej na taką skalę odporność ugrupowań tworzących obóz Zjednoczonej Prawicy na stawiane publicznie przez media aferalne zarzuty. Skandale będące efektem dziennikarskich śledztw, inaczej niż działo się to w czasach poprzednich ekip rządzących w Polsce, nie wywołały wyraźnego spadku poparcia obecnej elity władzy ani tym bardziej jej upadku. W artykule przedstawiono definicję skandalu politycznego. Autor omówił przyczyny niesłabnącej popularności obecnej władzy, do których zaliczył: kwestie ekonomiczne, propagandowe, edukacyjne, populizm rządzących, nieudolność komunikacyjną opozycji, zmęczenie społeczeństwa aferami oraz brak wrażliwości obywateli na przejawy patologii instytucji władzy. W badaniach wykorzystano metody analizy mikrosystemowej i podejmowania decyzji.
The aim of the article is to indicate the causes of a new phenomenon in Polish domestic politics, namely the "Teflon" power elite. This term denotes the resistance of the groups making up the United Right camp to scandalous accusations made publicly by the media, that are unprecedented on such a scale. The scandals resulting from journalistic investigations, unlike in the times of previous ruling teams in Poland, did not cause a clear decline in the support of the current ruling elite, let alone its collapse. The article presents the definition of a political scandal. Moreover, the author discusses the reasons for the unflagging popularity of the current government, including: economic, propaganda and educational issues, the ruling populism, the opposition's communication inefficiency, society's fatigue with scandals and citizens' lack of sensitivity to the manifestations of the pathology of the government institutions. In the study of this issue, the microsystem analysis and the decision-making method were used.

W maju 2016 roku ponad 350 ekonomistów z 30 krajów świata podpisało się pod listem do światowych liderów politycznych z grupą G-7 na czele, ostrzegając, że działanie rajów podatkowych jest nie tylko niesprawiedliwe społecznie, ale też nie ma współcześnie jakiegokolwiek uzasadnienia ekonomicznego. Autor bestsellerowej pracy naukowej Kapitał w XXI wieku Thomas Piketty, profesor Columbia University i doradca sekretarza generalnego ONZ Jeffrey Sachs, profesor Princeton University i laureat Nagrody Nobla Angus Denton oraz wielu innych cenionych autorytetów naukowych wezwali do wprowadzenia większej przejrzystości w globalnym systemie podatkowym i wprowadzenia regula cji ograniczających funkcjonowanie tzw. OFC. Także organizacja pozarządowa Oxfam International, która koordynowała stworzenie listu, wezwała światowych liderów do ustalenia wspólnego stanowiska w sprawie ukrócenia tajemnicy związanej z funkcjonowaniem spółek w rajach podatkowych, ujawniając szkody, jakie one przynoszą. Tzw. optymalizacja podatkowa w opinii cytowanych w artykule analityków Oxfam, Credit Suisse i UNCTAD przyczynia się do pogłębiania globalnych nierówności dochodowych, traktowanych jako największy problem globalny XXI wieku. Autor, powołując się na ww. analizy naukowe oraz wyniki śledztwa dziennikarskiego Międzynarodowego Zrzeszenia Dziennikarzy Śledczych (ICIJ), stara się zdiagnozować i przybliżyć te wzajemne zależności, ukazać wielorakie szkody, jakie proceder ten przynosi gospodarkom i społeczeństwom, prezentując własne oceny i prognozy na przyszłość.
In May 2016, over 350 economists from thirty states signed a letter to global political leaders and the G-7 in particular, warning that tax havens are socially unfair and have no economic justification whatsoever. The author of the best selling Capital in the Twenty-First Century, Thomas Piketty, Professor of Columbia University, the adviser to the UN Secretary General Jeffrey Sachs and Professor of Princeton University and Nobel Winner, Angus Deaton, alongside many renowned academics, called to make the global tax system more transparent and to introduce regulations that would curb the activities of Offshore Financial Centers (OFCs). An NGO Oxfam International, which coordinated the writing of the letter, called upon global leaders to develop a joint standpoint to abandon the secrecy of business operations in tax havens and reveal what harms they bring. According to the analysts from Oxfam, Credit Suisse and UNCTAD, what is called tax optimization actually contributes to greater global income disparities, which are treated as the gravest global issue in the 21st century. The author refers to academic analyses and the results of the journalistic investigations of the International Consortium of Investigative Journalists (ICIJ) in an attempt to diagnose and examine those mutual dependencies and to present the various harms the procedure brings to economies and societies, and presents his own assessment and forecasts for the future.

The paper deals with the issue of the supervision of the media that frequently exceed the standards observed by journalistic circles and their social environments. The direct victims of breaches of deontological principles in the profession and work of journalists primarily involve the recipients, journalistic circles and the reputation of a given medium. There are also indirect consequences, such as a loss of confidence that translates into lower sales or reduced advertising. In the cases that are commonly termed media scandals a crisis situation emerges. The analysis of the problem and the recovery of a tarnished reputation and lost confidence of recipients are usually performed by teams of experienced journalists, appointed ad hoc by edi-torial boards or by press ombudsmen working in the media, which is much less frequent. This paper discusses both scenarios. Three famous scandals have been selected from among many examples. One involves the 1980 case of the journalist Janet Cooke from The Washington Post whose Pulitzer Prize was withdrawn after she admitted that her award-winning story was a fabrication. Another case is the equally high-profile case of The Los Angeles Times from 1999, which marked a conflict of interest, following the publication of a special issue devoted to the sports arena that was being erected in the city at that time. The third scandal occurred in The New York Times in 2003, and concerned mass plagiarism and fabrication of press materi- als by that daily’s reporter, Jason Blair. The attempts to regain reader trust involved, among other things, the publication of reports drawn up by specially appointed teams of press ombudsmen.

The aim of the study was to present what impacts and to what extent have the food incidents that involve risks associated with a lack of food safety and further publicized by the media so-called food scares or food scandals. The analysis was conducted on the basis of available national and international scientific and industry literature and reports that cover this topic. In the study economic, health, social and legislative impacts of food scares were presented. Current efforts to ensure the effective protection of consumers in terms of food safety, both including its health and economic aspects, are intended to prevent impacts that accompany with food scares.
