    The subject of the article are the names of currently open Polish theatres. Attention is focused on the formal structure of the names, i.e. the number and type of the components of the official name of a theatre. Theatre names are nominal in nature and are saturated with vocabulary from the broad semantic field of theatre. The constitutive element of most names is the lexeme THEATRE. Additional identifying and defining elements are adjectives and common or proper (name of the patron) nouns. The minimal name consists of two elements. Other names vary as for their length, yet the order of elements extending the name can be easily established.

    Opis:
    The subject of interest in the article are the names of trees appearing in Europe, commonly used in Polish elaborations. An analysis was conducted on the adjectives being a part of the binominal names, describing the species name (cedr atlantycki – Cedrus atlantica, jałowiec pospolity – Juniperus communis, sosna pospolita – Pinus sylvestris). The aim of this article is to create their formal and semantic typology.

    This paper is devoted to the formation of adjectives from the names of Polish towns. The object of interest is mainly peripheral phenomena, such as the scope of the use of the suffix -ski as a basic formant (Kraków — krakowski), secondary suffixes (-owski, -ański, -eński, -iński/-yński: Kutno — kutnowski, Pajęczno — pajęczański, Gniezno — gnieźnieński, Chełmno — chełmiński, Opoczno — opoczyński, and rarely: Iłża — iłżecki, Jaworzno – jaworznicki), as well as numerous adaptation phenomena of a morphological base in the process of derivation (consonant and vowel alterations, disintegration and stem simplification), and hence the functioning of doublets, or even triplets in adjective formation. The basis of analysis was the material included in “Słownik nazw miejscowości i mieszkańców z odmianą i poradami językowymi” by Marek Łaziński (2007), compared with the data from “Słownik nazw własnych” by Jan Grzenia (1998, 2002), “Słownik nazw osobowych i miejscowych” by Daniela Podlawska and Magdalena Świątek-Brzezińska (2008), “Słownik etymologiczny miast i gmin PRL ” by Stanisław Rospond (1984) and “Wielki słownik poprawnej polszczyzny PWN” by Andrzej Markowski (2004). Due to nonsubstantive limitations, there are only infrequent references to the data included in “Nazwy miejscowe Polski. Historia. Pochodzenie. Zmiany” (1999–2016). Despite straightforward rules concerning the formation of adjectives from place names, ensuring the distinction of this category, quite broad peripheries can be observed, where the shape of the derivative is determined by a range of nonlinguistic factors, such as: geographical conditions (and thus potential dialect influence), chronological factors, the frequency of names, and even arbitrary decisions of linguists.

    The paper contains some remarks on the titles (ideonyms) of the works by Jan Wiktor (1890–1967, mainly literary ones). The writer, who came from Radomysl (on the San River), was socially-oriented. He spent most of his life far away from his hometown. He was a resident of Cracow by choice. He had special affection for Szczawnica and Pieniny. He is particularly remembered for his loyalty to recognised ideology and friendships. As for important professional activities, he favoured travelling. These circumstances determined his journalistic and literary work. The titles he used for his works are strictly connected not only with the content and the trend they represent, but also their genre. By following the standards of microtext poetics, which the title of the work belongs to, they form more or less equal groups from one up to four words, less frequently – more extended. The most dominant category contains titles which have the form of a nominal phrase. Thanks to their literary shape, they are recognised as the texts belonging to certain periods and they clearly reflect Jan Wiktor’s artistic personality. This link is visible at the level of linguistic realisation of a formal structure, in the formation of its shape and artistic expression, in the field of using lexis from particular semantic fields and its architectonics, which is based on the similarities between rhetorical figures (Błogosławiony chleb ziemi czarnej, Droga przez wieś, Kłosy na ściernisku, Legenda o grajku bożym, Ożywcze krynice, Rozmowy pod kolorowym parasolem, Wyznania heretyka) or forming innovative contradictions (Orka na ugorze, Miłość wśród płonących wzgórz, Podróż po słońce, Papież i buntownik, Skrzydlaty mnich, Strzecha w cieniu drapaczy chmur, Wierzby nad Sekwaną). Also orka na ugorze is an idiomatic expression that has been popularised in the Polish language thanks to Jan Wiktor.

    The following paper is dedicated to the analysis of 41 proper names (including 18 historical names) of structures in Cracow used for crossing water and terrain, identified architecturally as bridges, footbridges, trestle bridges and flyovers. These names have got a rather distinct structure: the anteposition contains a generic name, while the postposition comprises an individualising determinant, such as an adjective or a noun in genitive case, less frequently nominative: most Dębnicki (bridge), most Wandy (bridge), most Lajkonik (bridge); kładka Ojca Bernatka (footbridge), estakada Obrońców Lwowa (trestle bridge). Most of these terms have toponymic or anthroponymic motivation connected with Cracow, others belong to exceptions. There is a tendency for using commemorative names, introduced with the preposition imienia/im. (named after): most im. Kardynała Franciszka Macharskiego. Due to the fact that these structures are located in the city, their names belong to urbanonymy. The physical appearance and function of these facilities make it possible to apply in their names the notion of hodonymy. In the Russian language the term gefironim has been used in reference to these names. In terms of the type of denoted structures, the notion gefironim is narrower than an urbanonym, but it is wider when it comes to the area in which these structures are located.

    The article discusses the latest research regarding the dialect of the Lasowiacy, a subethnic group living at the conflux of the Vistula and the San in southern Poland. These studies are linguistic or ethnographic and verify the current state of the dialect, its stratification and functions in the fluid realities. Some researchers claim the present stage is one of “the emergence of an supraregional interdialect based on the Lasowiacy patois, whose usage encompasses a certain section of Subcarpathia” (Radwański 2013).

    This article examines the scope of the activism of the General Court while exercising its so called unlimited jurisdiction in antitrust matters. It addresses three main questions: what is the exact scope of unlimited jurisdiction; what should the intensity of control in case of unlimited jurisdiction; and how does the functioning of control in case of unlimited jurisdiction looks in practice (how to readapt or recalculate the amount of fine and, if the court is prone to do this, how to replace the reasoning of the European Commission).
    Cet article examine l’étendue des activités du Tribunal de l’Union européenne dans le cadre de sa pleine juridiction en matière de droit de la concurrence. Il s’agit d’aborder trois questions principales: quel est la portée exacte de la pleine juridiction exercée par le Tribunal? Quelle devrait être l’intensité de son contrôle exercé dans le cadre de cette pleine juridiction? Et de quelle manière ce contrôle fonctionne-t-il en pratique (comment réadapter ou recalculer le montant de l’amende et, le cas échéant, remplacer le raisonnement de la Commission européenne)?

    This article discusses the harmonisation of laws within the EU focusing on the specific ways of achieving an approximation of the Polish legal system with European competition law. It identifies and gives an overview of three specific ways of harmonising national laws with EU antitrust provisions: (1) spontaneous (or bottom-up) harmonisation; (2) judicial harmonisation and; (3) legislative harmonisation by means of EU Directives. With respect to the last category, particular attention is drawn to the legislative competences of the EU, allowing it to harmonise antitrust issues either on the basis of Articles 103 and 114 TFUE, or perhaps even on the basis of Article 82 TFEU
    Le présent article explique la notion d'harmonisation du droit dans l'UE et se concentre sur les moyens particuliers de réalisation du rapprochement du droit polonais au droit de la concurrence de l'UE. Il identifie et offre un aperçu des trois façons de l'harmonisation du droit national avec le droit antitrust de l'UE: (1) l'harmonisation spontanée (ou bottom-up); (2) l’harmonisation juridique et (3) l'harmonisation législative par voie de directives. Dans ce dernier cas, une attention particulière est accordée aux compétences législatives de l'UE, ce qui lui permet d'harmoniser les questions du droit de la concurrence de l'UE, soit sur la base des articles 103 et 114 du TFUE, soit même, peut-être, sur la base de l'article 82 TFUE.

    The European Union is an international organization which has a broad scope of competences that have been transferred to it by its Member States in the founding Treaties. The object of this text is to identify arguments raised, or that potentially might be raised, by national Constitutional Courts (and in the future possibly by other actors as well) to exclude in certain instances the application of EU law or EU jurisprudence in the territory of a particular Member State. The three main reasons for such an exclusion might be: 1) that an action of the EU is perceived as being ultra vires; 2) that an action of the EU infringes on national identity; and 3) that an action of the EU infringes on constitutional identity. The ultra vires argument has only recently appeared in the jurisprudence of some constitutional courts, whereas the constitutional identity argument has been present since the 1970s. The national identity argument is based on a notion protected, since 1993, by the Treaty establishing the European Union. All three of these arguments are to a certain extent intermingled and their use by national actors for excluding the application of EU law is fraught with uncertainty.

    The general rule concerning the application of EU law in the Member States is that, unless the procedural issues are directly regulated in EU primary or secondary law, the Member States possess a so-called ‘procedural autonomy’. This rule applies fully to national antitrust proceedings, where the presumed infringement may affect trade between EU Member States (decentralised EU antitrust proceedings). However, the procedural guarantees offered to undertakings in EU antitrust proceedings before the European Commission, often referred to the undertakings’ ‘rights of defence’, also form a part of the procedural acquis of EU law. This article examines the question whether that procedural acquis, stemming mainly from EU courts’s jurisprudence and formulated with regard to the proceedings before the European Commission, should be applied as a standard in national (i.e. Polish) antitrust proceedings where EU law applies.
    L’application du droit de l’Union européenne requiert la mise en oeuvre du principe de l’autonomie procédurale. Celui-ci signifie qu’à supposer qu’un problème procédural n’ait pas été réglé par le droit communautaire originaire ou dérivé, les États membres sont compétents pour le régler. Ce principe s’applique pleinement aux procédures de concurrence dans lesquelles la violation présumée est susceptible de produire des effets sur les échanges commerciaux entre les États membres (« procédure communautaire décentralisée en matière de concurrence »). Cependant, les garanties procédurales dont les entreprises disposent en cours de procédures de concurrence se déroulant devant la Commission européenne et qu’on définit généralement comme « droits à la défense », constituent également une partie de l’acquis procédural communautaire. Le présent texte tâche de répondre à la question de savoir si cet acquis procédural, résultant de la jurisprudence des juges communautaires et concernant les procédures qui se déroulent devant la Commission européenne, doit être un standard pour les procédures de concurrence internes où l’on applique les textes juridiques de l’UE.

    This text presents the application of the Charter of Fundamental Rights by Polish courts since the entry into force of the Charter in December 2009. As the Charter is an element of the ‘external’ constitution for the Republic of Poland, similar to the European Convention on Human Rights, the practice of the Polish Constitutional Tribunal is of particular importance in this analysis. Hence the referral to the Charter by common and administrative courts is rather briefl y described and the main focus of the text is on the broader analysis of the way of and reasons for using the Charter by the Constitutional Tribunal. While the Charter is not treated as a model for the hierarchical analysis of norms in cases of constitutional complaints, it can however be offered as such a model in cases of abstract control and legal questions fi led by the courts. The use of the Charter might be further clarifi ed by an answer of the Court of Justice of the European Union to the fi rst request for preliminary ruling made by the Polish Constitutional Tribunal in case C-390/15 RPO.

    Wstęp. Kompleksowe leczenie zesztywniającego zapalenia stawów kręgosłupa powinno łączyć metody farmakologiczne i niefarmakologiczne. Celem pracy jest ocena wpływu nienadzorowanych ćwiczeń domowych na poziom funkcjonalny pacjentów z zesztywniającym zapaleniem stawów kręgosłupa. Dodatkowo przeprowadzono ocenę wpływu ćwiczeń realizowanych w domu na efektywność prowadzonej rehabilitacji szpitalnej. Materiał i metody. Badaniem zostało objętych 52 pacjentów (12 kobiet i 40 mężczyzn) z zesztywniającym zapaleniem stawów kręgosłupa w wieku średnio 44,1 lat. W oparciu o zebrane dane z ankiet, podzielono pacjentów na dwie grupy: grupa A (34 pacjentów) – pacjenci ćwiczący w domu, grupa B (18 pacjentów) – pacjenci niećwiczący w domu. W obu grupach dokonano dwukrotnie oceny stanu funkcjonalnego za pomocą kwestionariusza BASFI (na początku rehabilitacji oraz po 3 tygodniach). Wyniki. W obu grupach wykazano porównywalne wartości wskaźnika BASFI na początku rehabilitacji (BASFI I). Po 3 tygodniach prowadzonego leczenia szpitalnego odnotowano istotną statystycznie poprawę stanu funkcjonalnego (wskaźnik BASFI II) w całej grupie pacjentów. Stopień poprawy stanu funkcjonalnego był porównywalny w obu grupach. Wnioski. W przeprowadzonych badaniach wykazano brak wpływu nienadzorowanych ćwiczeń domowych na poziom funkcjonalny pacjentów z zesztywniającym zapaleniem stawów kręgosłupa. Stan funkcjonalny pacjentów po 3-tygodniowej rehabilitacji szpitalnej uległ znaczącej poprawie. Nie wykazano, by ćwiczenia realizowane w domu wpływały na zwiększenie efektywności prowadzonej rehabilitacji.
    Background. Complex treatment of ankylosing spondylitis should combine pharmacologic and non-pharmacologic methods. The aim of the research was to estimate the influence of non-supervised home exercises on functional condition of patients with ankylosing spondylitis. Additionally, the assessment of the influence of home exercises on the efficiency of inpatient rehabilitation was performed. Material and methods. The study involved 52 patients (12 women, 40 men) approximately at the age of 44.1 with ankylosing spondylitis. The patients were divided into two groups: group A (34 patients) exercising at home, group B (18 patients) not exercising at home. The assessment of functional condition of patients in both groups was performed twice using the BASFI questionnaire at the beginning of the rehabilitation and 3 weeks after the treatment. Results. A comparative value of the BASFI index was found for both groups at the beginning of the rehabilitation, it was determined as BASFI I. After 3 weeks of rehabilitative treatment a statistically significant improvement was observed (index BASFI II) in all patients, as well as in group A and B separately. Improvement of functional condition was almost the same in both groups. Conclusion. The analysis of the collected research material proved that there was no influence of non-supervised home exercises on the functional condition of patients with ankylosing spondylitis. The functional condition of the patients after 3 weeks of rehabilitation improved significantly. The study did not demonstrate any influence of home exercises on the increase of effectiveness of inpatient rehabilitation.
