L’auteur du présent article se pose pour but d’apporer la résponse à une question qui continue d’être l’objet de controverse: des mots tels que ʽădat-ʼel, ělōhîm ou benê eliōn doivent-ils être interprétés littéralement, dans lequel cas ils signifieraient les dieux des paiens, ou parlent-ils, de façon métaphorique, des juges injustes? Ayant examiné, de façon critique, l’interprétation littérale et se basant sur des textes tels que Ex. 21, 6 et 22, 7, Ex. 18, 13-27, Deut. 1, 9-18 et sur le Psaume 45, 7, l’auteur penche pour Interprétation métaphorique. L’analyse du contenu du Psaume 82 semble confirmer une telle opinion. Cependant, dans la représentation du jugement de Jahw e sur les juges injustes, l’auteur du Psaume 82 se servit de quantité d’images de mythologie autre qu’israélienne pour évoquer l’apparition future de Jahwe jugeant l’lsraël.

The paper contains the results of a questionnaire study carried out on national representative samples of family courts judges (277 persons) and voluntary probation officers (247 persons). The main aim of the study was to obtain the practicians opinion as to the model of probation service existing in Poland and its ideal vision, as well as the conception of the work of a voluntary probation officer with a juvenile delinquent and his milieu and the: effectiveness of such work. comparing the statements of judges and voluntary probation officers, the author intended to find out what opinion the persons who play various parts in the process of resocialization of juveniles have on the educational work of voluntary probation officers: what this work should be and what it actually is. The picture that emerges from the statements of both groups of respondents is not favourable, the appraisals made by family courts judges being more, critical as a rule than those of voluntary probation officers. Some of the respondents statements are declarations and wishes. Over a half of the family courts judges (58 per cent) and about 80 per cent of voluntary probation officers consider the voluntary-cum-professional model of probation service for juvenile delinquents found in our country to be a good one (although only a part of them approve of it fully, with the remaining ones accepting it conditionally and submitting various proposals for its improvement). On the other hand, as many as 42 per cent of judges and about 20 per cent of voluntary probation officers opt for the performance of supervision -by professional probation officers only. To substantiate their standpoint, these persons argue that voluntary probation officers lack qualifications, are insufficiently engaged in educational work with juveniles, and that in their case difficulties arise in executing the proper performance of supervision. Also the enrollment of voluntary probation officers is disapproved of, the examined persons stating that in the face of a small number of applicants for this work, no requirements can be imposed upon them, and many of them are chance persons with no training whatever. As few as 7.6 per cent of family courts judges and as many as 48.6 per cent of voluntary probation officers are of the opinion that probation officers are well prepared to perform their function of resocialization. In the opinion of most respondents, the number of voluntary probation officers is greatly insufficient.                        The author was also interested in the respondents vision of the voluntary probation officer's work with a juvenile and his milieu, the elements that should prevail in this work: education, care or supervision, and the actual situation in this respect, as well as the real course of this work. Most respondents (78 per cent of judges and 52.2 per cent of probation officers) stresed the educational elements of a voluntary -probation officer's activity. :What is alarming, however, is the fact a considerable group both of family courts' judges (21.3 per cent) and of voluntary probation officers (30 per cent) believe formal supervision to be the most important aspect.             Yet as shown by the findings of the study, the actual work of .a voluntary probation. officers departs greatly from the declared ideal model. Voluntary probation officers are burdened with an excessive number of supervised juveniles, with about 30 per .cent of them supervising over 10 persons which is the number set as the maximum. The majority of respondents demand a reduction of the number of juveniles under supervision, which is however difficult to be fulfilled because of the lack of candidates willing to become probation officers. As appears also from the respondents statements, there is no elaborate conception of the voluntary probation officer's work. Too much weight is attached when appraising this work to its formal criteria (e.g. the number of probation officer's contacts with the juvenile). Instead, the quality of his work is inadequately analyzed. Admittedly, both professional probation officers and most of all family courts judges lack sufficient data to carry out such an analysis: namely, the information about a voluntary probation officer's work come from his reports that are frequently faulty as regards quality, contents and promptness; this appears not only from the judge's but also from the voluntary probation officers' own statements.             Co-operation between voluntary probation officers on the one hand, and profesional probation officers and family courts' judges on the other hand, is also faulitly organized. The respondents perceive this co-operation as the opportunity to settle definite legal, educational and organizational matters rather, than as a regular influence of the family court towards an improvement of the voluntary probation officers' qualifications and an increase of their educational impact on the juveniles.             In resocializing activities, great weight is attached to the educational methods applied by the voluntary probation officer. His basic method is considered to be that of individual therapy which should be accompanied by group and environmental therapy. As appears from the statements of most voluntary probation officers, the forms of their work, and of influencing the juvenile in particular, were rather modest and poorly differentiated, the probation officers revealing litt1e initiative and being either relucant or unable to make the contacts with juvniles supervised by them more diversified. As few as about 20 per cent of the examined voluntary probation officers were in good contact with some of their probationers at any rate, the contact being of a therapeutical character (which was important in so- far as over 40 per cent of probation officers stated that they supervised- juveniles with personality disorders). In resocializing work, the posibilities of influence in a group of young persons are insufficiently used. Moreover, voluntary probation officers  meet with many difficulties in co-operating with their probationers families, their contacts with the institutions engaged in crime prevention, education or social assistance being also unsatisfactory. Voluntary probation officers co-operate rather regularly with schools, the police, the Polish Committee for Social Aid and occupational guidance centres only (though naturally the degree of a voluntary probation officer's co-operation with the abovementioned institutions differs).             The respondents of both groups expressed their opinions about the effectiveness of the supervision, its conditions and criteria. In general, views of family courts judges and of volunatry probation officers converged to a high degree, the majority of respondents being of the opinion that nothing but the juvenile's complete and positive participation in the social life and proper performance of due social roles testifies to a successful ending of a supervision.             Convergences could also be found. between the judges and the probation officers opinions about the conditions of success vs. failure of supervision. Discussing successful supervisions respondents of both groups stressed the importance of good relations between the probation officer and his probationer, co-operation with the juvenile’s parents, their emotional commitment and readiness to act jointly with the probation officer, the probation officer's competence in getting into emotional contact with the juvenile and his family and to win their confidence. According to the respondents, the most important factors that determine a failure of supervision are: the juvenile's considerable demoralization, influence of the negative peer group, a negative family milieu and a lack of co-operation. with the probation officer on the part of the parents. Therefore, respondents of both groups lay a great emphasis on the importance of emotional relations which should link the three parties involved: the juvenile, his parents, and the voluntary probation officer. The necessity of mutual approval, understanding and respect for each other’s rights, was particularly stressed. Mutual good emotional relations linking the above-mentioned persons seams to be the key issue as far as success or failure of super- vision is concerned. If both the juvenile and his parents have a favourable attitude towards the probation officer and trust him, it will be much easier for him to persuade the juvenile of the necessity of regular learning or changing his conduct, and his parents-of the need for co-operation. Therefore the findings point to the fact that the declared shape of the work of a voluntary probation officer is much better than the actual one.             The final part of the questionnaire was devoted to the use of educational measures and obligations of juvenile delinquents and their parents resulting from provisions of the Act of Nov. 26, 1982 on the proceedings in cases concerning minors. The Act introduced new educational measures and obligations of juveniles, as well as the possibility of punishing the juvenile's parents with a fine and notifying their workplaces or social organizations they are members of about their failure in parental obligations whenever this failure is caused by the parents fault. About 60-70 per cent of the judges never applied the newly introduced educational measures nor imposed obligations upon juveniles, although over a half of the judges and 60-70 per cent of the voluntary probation officers are convinced that it was right to introduce these new measures. A part of the respondents however (one-fourth of the judges and one-fifth of the probation officers) express their doubts as to the possibilities of the family court's supervision of performance of the obligation imposed upon juveniles. Very few judges applied disciplinary measures towards the juveniles parents in practice, although about 25 per cent of them express an opinion as to the effectiveness of a fine, and about 18 per cent believe that notifying the parents workplace may bring about satisfactory results. As compared with judges, voluntary probation officers expressed their favourable opinion as to the effectiveness of these measures more frequently (44 and 62 per cent respectively).             Because of a relatively short period of binding force of the new provisions (which was about one and a half years at the moment of the study), the problem of application of some of the educational measures and obligations in particular, as well as the judges and probation officers opinion as to their pertinence and the possibilities of supervising their execution should be investigated further.

The paper consists of condensed analysis of four God’s utterances (Judg 2, 1-5; 2, 20-22; 6, 8-10; 10, 11-16) and lines which are their proximate context. In the final part of the paper one finds a juxtaposition of the author’s findings which can be put in the following way: the texts foregoing the pericopes in question and those which immediately follow them are markedly different; their similarity a purely superficial; the lines 2,1-5; 2, 20-22; 6, 8-10; 10,11-16 are characterized by a literary different approach; in view of their content and vocabulary, they are only partially kindred. Probably they were written by different authors and not at the same time. What they have in common is their deuteronomistic composition.

Over the recent dozen years, there have been attempts in the criminal procedure doctrine at considerably re-formulating the airns of proceedings. It has been noticed, among other things, that the criminal process should not only tulfil substantive law. It has other aims as well that are just as important, including first and foremost liquidation of the specific “conflict” resulting from perpetration of an offence. This led to formulation of “post-classical” theories of the criminal process, stressing the consensual forms of conflict resolution that have been known since the birth of societies. Criticized was the assumption that the process seen as an instrument for fulfilling substantive law is in all cases the best form of conflict resolution and the best manner of legitimizing decisions of the agencies that apply the law (N. Luhmann, L. Morawski, T. Weigend, S. Waltoś). Consensual phenomena naturally arouse interest; they have become the topic of discussions. The real reason of such discussions is, among other things, a growing awareness of the poor efficiency of criminal justice: the disproportion of the means that can be used to fight crime to the actual needs in this respect. Already early in the nineties, the findings of a survey carried out within the Adam Mickiewicz University (A.J. Szwarc, J. Sobczak) demonstrated that agreements are alien to the Polish practice. The practice's opinion on that phenomenon varied in the survey: parallel to criticism, serious arguments were voiced for a broader use of agreements. This demonstrated the need for continued scientific discussion of the issue. The initial stage of that discussion was recapitulated at a conference held in June 1992 in Poznań. The conference provided the opportunity for the first direct confrontation of doctrine’s views. Several years later, a survey into formal and informal agreements was carried out within the Criminal Procedure Department of Jagellonian University (A. Światłowski). That survey also confirmed the existence in ptactice of a great variety of agreements, and the practice’s views proved just as diversified. The survey inquired about: 1) the actual extent of agreements, or at least that declared by the circles involved; 2) the appraisal of agreements by some of the legal professions; 3) the possible postulates de lege ferenda voiced on the eve of introduction of new codification, especially with respect to the future formalization of some forms of adjustments made in the criminal process, and to suggested new regulations. The survey was divided into three parts: a pilot survey, interviews, and a mail questionnaire. Upon completion of the pilot survey, the stage of interviews started. Interviewed were judges of common courts and prosecutors public prosecutor’s offices, three from each unit selected for the sample. To secure a possibly even distribution of units, the country was conventionally divided into four areas. Within each area, one court of appeal, one provincial court, and two district courts were selected: one of them operating in a big city in an urbanized area, and the other one – in a smaller locality in a rural neighborhood. A similar procedure was applied to select l2 prosecutor’s offices (one provincial and two district ones in each area). Thus the planned sample to be included in the interview survey was to include 28 units, that is up to 84 persons. Foreseeable difficulties considered, such as refusals to be interviewed or a probable situation where as many as three judges deciding in criminal cases would not be present at the same time in one court, it was assumed that about 50 persons would be interviewed (the actual number was to prove bigger: 62). Besides, selected for the mail questionnaire were 4 courts of appeal as well as 48 each of provincial and district courts and prosecutor’s offices, that is the total of 100 units. Of the 300 mailed questionnaires, 141 (47%) were sent back. The questionnaire was anonymous. The findings have been discussed in the present paper. It has to be stressed that about a half of respondents considered informal and para-formal agreements possible. As regards the incidents of such phenomena, 63 respondents of the mail questionnaire never encountered the informal and para-formal agreements; instead, 75 (53.2%) had to do with them at least once. Characteristically, none of them chose the answer, “very often”. Among the interviewed persons, 29 (46.8%) had to do with agreements, while 33 (53.2%) never encountered that phenomenon. A great variety of answers were given to the question about the stage of proceedings at which agreements are made. Mentioned here were agreemets in preparatory proceedings (and even before the institution or that proceedings),  in proceedings before the 1st  instance cort, and also in the appellate proceedings. Almost all respondents who declared knowledge of the practice of agreements mentioned the sentence as the basic and standard subject of agreement. Of course, also adjustments in purely technical matters were mentioned here. What seems to have been the most typical phenomenon under the former code of criminal procedure was an agreement under which, most generally speaking, the defendant admitted his guilt and did not “obstruct” his conviction in return for a more lenient treatment. Mentioned most often (by 34, that is 44.7% of respondents) as the typical initiator of criminal procedure agreement was the counsel for the defense. As regards the categories of cases in which agreements were made, mentioned were socalled “family cases”, that is abuse and failure to pay maintenance, as well as petty thefts, sometimes combined with compelling a specific conduct or with destruction of property. The fact considered that the number of respondents declaring frequent contacts with agreements was not big, more attention has been devoted in the paper to the statements of those persons, and an attempt has been made at formulating conclusions as to the features of agreements made at the time of the survey. To end with, respondents were offered the opportunity to make suggestions as to formalization of agreements in the new codification that was about to be introduced at the time of the survey. The most frequent postulates no doubt concurred with the subsequently introduced new institutions, especially with the new institution provided for in Article 387 of the code of criminal procedure.

Opis:
The paper concerns personal and environmental factors influencing the effectiveness of the juvenile justice system. The survey was based on the Polish juvenile justice system, but it concerns the European standards of the treatment of juvenile delinquency. The author also presents the problem in terms of community service which is very closely related to the juvenile justice system in Poland. The causal factor was presented in a graph, which is called the Ishikawa and Pareto graph, a graph of reasons and effects. The survey included 148 Polish juvenile court judges. The results of the research could be useful for improving the Polish juvenile justice system and probably some of the issues could be extrapolated to other country juvenile justice systems.

The paper deals with different forms of political impact on the constitutional justice. The main subject of presentation is the analysis of recent Polish experiences which can help to identify better the threats to the independence of the constitutional justice in democratic space. The first part takes the effort to describe the specific phenomenon of political pressure exerted on the constitutional justice through indirect influence (so called “political mobbing”). The argumentation developed in the paper proves that even such indirect and sometimes subtle interferences from the political elite create the very danger for accountability of constitutional justice and have a negative impact on constitutional awareness of the society. The second part deals with typical reasons (ongoing in all constitutional courts) of inevitable “politization” of the constitutional review, first of all the political procedure of appointments of the judges and the political nature of constitutional cases. The thesis is defended through the analysis of Polish experiences which indicate that the presence of politics, inherent element of the constitutional justice, cannot be automatically identified with lack of the objective and independent judgments issued by the judges. Internal independence and formal external guarantees of it allow us to avoid the pathological impact of politics. Two factors have a particularly great impact on the attitudes of judges and support them in fulfilling their responsibility: the continuity of jurisprudential lines, accumulation of constitutional experience (acquis constitutionnel) and the permanent dialogue between the constitutional courts and the international courts or among the constitutional courts in the European space.

Przedmiotem artykułu jest analiza kompetencji nominacyjnej Prezydenta wobec sędziów. W części wstępnej wskazuję na historyczne tradycje związane z posiadaną kompetencją oraz wymieniam inne uprawnienia głowy państwa o charakterze nominacyjnym. Kluczową część rozważań stanowi odpowiedź na pytanie, czy Prezydent może dowolnie powoływać sędziów, czy jest w tym zakresie związany wnioskiem Krajowej Rady Sądownictwa. Przytaczam w związku z tym różne argumenty opowiadające się zarówno za pierwszym, jak i drugim stanowiskiem, przedstawiając własne zdanie w tym temacie. Dopełnieniem rozważań jest tabela zawierająca liczbę powołań sędziowskich i awansów w danym roku.
The main issue of the following article is the analysis of appointment competence of the President in relation to judges. The introduction focuses on historical aspects of a given competence as well as the other appointment competences are listed. The key part of the analysis is the answer to the question whether the President can nominate a judge to a post without being bound by National Council of the Judiciary of Poland. Consequently, various arguments are presented, both for and against this standpoint, emphasising my own point of view on this issue. Eventually, the article closes with a table illustrating the figures of judge nominations and promotions in a given year.

The presented opinion illustrates the Sejm’s position on the application lodged to the Constitutional Tribunal by the First President of the Supreme Court for an adjudication upon the conformity of the Act of 22nd December 2011 on Amendment of Certain Acts Related to the Implementation of the Budget Act (reference symbol of files K 1/12) to the Constitution. Sponsor deems the regulations retaining in 2012 the levels of judicial remunerations from previous year inconsistent with article 2, article 31(3), article 64(1–2), article 88(1–2), article 216(5), article 219(1–2), article 220(1) and article 221 of the Constitution. Sejm has rejected the sponsor’s claims, concluding that the contested regulations shall be deemed consistent with the Constitution.

Opis:
Relation between the truth and the sentence has the significant meaning in canonical processes. Process in fact is an instrument for finding the truth in assumed controversy. Final sentence is the result of the litigation proceedings, which is normal way finishing dispute. In the Code of Canon Law of 1983, the legislator introduces in this context a new legal instrument, votum separatum. Judge in a collegiate tribunal has the right and obligation to pronounce of a sentence in compliance with his conscience, that is achieved with moral certitude. In the situation when the other judges made a different decision by an absolute majority of votes, judge who is convinced in his conscience about wrong decision can give a separate vote.

Opis:
The Supreme Administrative Court in the ruling of the 12th of May 2011 resolved the problem related to the status of the homeowner in the administrative procedure concerning the act of registration or deregistration. The Court ruled that the homeowner is entitled to act as a party in such proceeding and his legal interest derives from that provisions of the Civil Code and the Constitution Act, which set forth the ownership rights and their protection. The author of the gloss agrees with the thesis, however subjects to doubt the justification in such part in which it refers to the protection of ownership stipulated in the Civil Code. Ephasizes that the claims brought on the basis of the Civil Code seem to be inadequate in such situation. Moreover, the author presents further arguments regarding the constitutional principle of property ownership protection.
