Przedmiotem artykułu jest ogólne spojrzenie na trzy kolejne ustawy o Trybunale Konstytucyjnym, z: 1985, 1997 i 2015 roku. Każda z nich osadzona jest w nieco odmiennych realiach ustrojowych. Pierwsza pochodzi jeszcze sprzed zmian ustrojowych w 1989 r., i po nich podlegała dostosowaniu do tworzonych dopiero zrębów ustroju demokratycznego. Druga jest efektem Konstytucji z 1997 r. i obszerniejszych regulacji w niej zawartych, odnoszących się do Trybunału Konstytucyjnego. Ostatnia, z roku 2015, to wynik analizy dorobku sądu konstytucyjnego, a w jego ramach zauważonej konieczności zmian lub korekt. Czas pokaże, czy zamiar ustawodawcy został osiągnięty.
The article shows a  general overview on three acts dedicated to the Constitutional Tribunal, dating of 1985, 1997 and 2015 year. Each of them is embedded in different reality of legal regime. The first comes from before the political changes in 1989. Later, it was only adapted to a democratic system. But this system was just created that time. The Constitution of 1997 r. is a reason of enact the second act. There are much broader regulations concerning the Constitution Tribunal what was the reason of necessity to passing the bill in the Parliament. The last, from 2015, is the result of analysis of the achievements of the constitutional court, and within it noticed needs for changes or corrections. Time will answer if the intention of the following legislature proceeding has been reached.

Where a system of constitutional judicial review is in place, the concept of democracy is understood as rejecting claims about an unlimited will of the sovereign as the source of state authority, and confining democracy to such manifestations of the majority will which enjoy Constitutional legitimacy – meaning that they are in compliance with the version of a human rights culture that has been inscribed in the Constitution and which is embraced by Constitutional judges when delivering their adjudication. Following the recent parliamentary and presidential elections, the political significance of the Constitutional Tribunal has increased enormously. Only the Constitutional Tribunal is capable of preventing the centre of political power (which governs over the legislative and executive branches) from pursuing its plans. According to parliamentary majority in order to change Poland and fulfil commitments to the electorate, the ruling party had to see to it that the Tribunal’s make-up is pluralistic. Otherwise, all their efforts would be exposed to destruction by the Constitutional Tribunal. This way of thinking, though, implies that the Constitutional Tribunal can be changed in an ordinary law in such a way as to render it incapable of opposing the ruling majority. Regarding the ongoing Constitutional crisis over the Constitutional Tribunal, a scenario involving the observance of the basic law does not appear to be a likely one – unless such scenario leads to the expectation, however mistaken, that political gains can thus be scored and that the operation of the Constitutional Tribunal will no longer pose a threat to plans of the parliamentary majority.

This article examines the process of the judicial Europeanization of the Polish Constitution. In Poland the judicial method of Europeanizing the Constitution is currently the primary way of adjusting constitutional norms to requirements resulting from EU law. The phenomenon of re-interpretation of constitutional provisions in light of the new and changing realities is a characteristic feature of contemporary constitutionalism. It has been a long time since most national constitutions have undergone significant textual changes. In Poland, the scope of judicial Europeanization of the Constitution is connected, to a great extent, with the inflexible procedure required for constitutional amendments. In this situation, these so-called “silent changes” of constitutional norms are the easiest and fastest way of reacting to requirements stemming from Poland’s EU membership. In the Polish case not only have the norms regarding the political system of the state changed, but also constitutional standards relating to the protection of fundamental rights and freedoms have undergone the process of the Europeanization. To some extent, these changes relate to procedural norms as well.

The article discusses interpretative and limited judgments in the jurisprudence of the Constitutional Tribunal in Poland. These judgments are of great significance in the judicial control of law’s conformity to the Constitution. They were distinguished following the departure from the original, dichotomic division of the Constitutional Tribunal’s judgments into those deciding the full and unambiguous consistency or inconsistency of an act with the Constitution. The article defines interpretative and limited judgements, and describes their roles and functions. An interpretative judgement is a decision in which the Constitutional Tribunal decides the conformity or non-conformity of a relevant act to the Constitution in its given interpretation. Its aim is not to eliminate non-uniformity or divergence in the interpretation of legal regulations, but to eliminate from all potential interpretative variants of a relevant act the one that is inconsistent with the Constitution. A limited judgement is a decision in which the Constitutional Tribunal decides the conformity or non-conformity of an act to the Constitution in a specific (subjective, objective or time) scope of its application. A limited judgement aims to decide whether a legal regulation whose interpretation is unambiguous, is consistent with the Constitution in a given scope of its application. The article also describes advantages and disadvantages of interpretative and limited judgements, accounting for the relevant views in the doctrine and jurisprudence in this respect, and examines the number of these judgements against the general number of judgements concerning the constitutionality of law that were passed by the Constitutional Tribunal in recent years.
Artykuł dotyczy problematyki wyroków interpretacyjnych i zakresowych w orzecznictwie Trybunału Konstytucyjnego w Polsce. Wyroki te odgrywają istotną rolę w sądowej kontroli zgodności prawa z konstytucją. W nauce prawa zaczęto je wyróżniać wraz z odejściem od pierwotnego, dychotomicznego podziału wyroków TK na wyroki stwierdzające całkowitą i jednoznaczną zgodność lub niezgodność przepisu z konstytucją. Opracowanie definiuje wyroki interpretacyjne i zakresowe oraz charakteryzuje ich rolę i funkcje. Wyrok interpretacyjny jest orzeczeniem, w sentencji którego TK stwierdza zgodność lub niezgodność z konstytucją przepisu prawnego w określonym jego rozumieniu. Jego zadaniem nie jest usuwanie niejednolitości i rozbieżności wykładni przepisów prawa, lecz eliminacja tego spośród możliwych wariantów interpretacyjnych kontrolowanego przepisu, który jest niezgodny z konstytucją. Wyrok zakresowy jest orzeczeniem, w sentencji którego TK stwierdza zgodność albo niezgodność z konstytucją przepisu prawnego w określonym (podmiotowym, czasowym lub przedmiotowym) zakresie jego zastosowania. Wyrok zakresowy zmierza do rozstrzygnięcia, czy przepis prawny, którego rozumienie nie budzi wątpliwości, jest zgodny z konstytucją w pewnym zakresie jego zastosowania. Opracowanie prezentuje również wady i zalety wyroków interpretacyjnych i zakresowych, biorąc pod uwagę poglądy doktryny i orzecznictwa w tym zakresie, oraz analizuje liczbę tych wyroków na tle ogólnej liczby orzeczeń wydawanych w ostatnich latach przez TK w przedmiocie konstytucyjności prawa.

The paper presents the symbolic dimension of the (re)production of Poland’s Constitutional Tribunal, which is considered to be a model legal-political institution. Paying close attention to meaning, narrative, symbolic codes, and rituals, the authors object to a reductionist explanation, based on instrumental thinking and conscious and material interests, of the legal institutions of power. In accordance with neo-Durkheimian cultural sociology, the Tribunal is presented here as an institution created through binary symbolic codes (sacred/profane), and reproduced, in crisis situations, in performative acts constituting moments of ritual purification. The dominant narrative legitimizing the Tribunal counterpoises ‚sacred’ law with ‚profane’ politics in order to superimpose subsequent homological classifications (rational/irrational, pure/impure, universal/particular). The Tribunal’s symbolic power is thus hidden within a thick web of meanings, which invisibly reinforce its authority.

The analysis herein, while mainly descriptive, presents the main foundations of the Constitutional Tribunal’s jurisprudence in matters of hierarchical control of the constitutionality of laws concerning the EU. It distinguishes some principles, concepts and constitutional theories which, according to the Constitutional Tribunal, set the limits of European integration. The main thesis of the paper is that, in this context, the basic and decisive rule is the supremacy of the Constitution, which does not have exceptions or limitations. A hypothesis was also formulated that the Solange II maxim does not reflect the actual state of European constitutionalism, in which the level of protection of fundamental rights is significantly increased while possible collisions between the level of protection of fundamental rights in the EU and the Member States should be solved by means of the clauses provided in Articles 51–54 of the EU Charter of Fundamental Rights.

The author points out that the issue of costs of proceedings before the Constitutional Tribunal has not been elaborated in the literature so far, whereas it is of practical importance, although not as great as the institution of civil trial costs in particular. However, this issue is an interesting subject of legal interpretation and inference. The paper discusses the functions of costs of proceedings before the Constitutional Tribunal, their scope and the rules for their adjudication. In conclusion, it was found that the regulation of this institution is defective, as it contains significant gaps that need to be filled by way of appropriate or analogous application of several other normative acts. This led the author to postulate de lege ferenda that this state of affairs should be changed.

‘Legitimacy’, ‘reputation’ or ‘institutional trust’ inspired by judicial institutions constitutes an important aspect of the rule of law. Consequently, scholars developed survey-based methods to quantify ‘legitimacy’ as understood in the Weberian sense. Thereby, the survey response quality can meaningfully impact the obtained results. Moreover, one can expect, that sharpening political polarization observed in various countries could amplify such measurement problems. The goal of this paper is to examine the assessments of the Polish Constitutional Tribunal (CT) using two distinct surveys carried out in March 2022 by CBOS (Public Opinion Research Center). Both asked about the overall assessment of the CT performance, as well as electoral preferences (voting intent and preferred political party), frequency of religious practices, self-assessment of economic conditions and included a battery of standard demographic controls. Both overall assessment levels as well as individual-level determinants of the CT assessment (using probit models) had been compared. The findings document that, regardless of the survey data collection mode, controlled for demographic factors, the assessment of CT depends upon variables representing political polarization. This finding can be interpreted as an indication of its political de-legitimization. Moreover, five years after the constitutional crisis, and nearly one and a half years since the abortion verdict, over 40 per cent of respondents of the Allerhand Institute Survey admitted they ‘don’t know precisely’ the task of the CT or even ‘haven’t heard’ about it, indicating a substantial lack of knowledge. The second group of findings documents differences between CAPI and CAWI polls. According to the authors’ knowledge, it is the first attempt to examine respondent-level determinants of CT assessment, and test their sensitivity to the survey data collection mode, thereby contributing to our understanding of the Polish CT legitimacy five years after the constitutional crisis, and methodological aspects of such measurements in general.

One of the fundamental powers of the Constitutional Tribunal – granted by the provisions of the constitution – is to decide on the compliance of particular statutes with the Constitution of the Republic of Poland. The Tribunal’s rulings concern tax statutes as well, which implies specific consequences connected with the verification of the accuracy of tax settlements made under a challenged provision and leads essentially to excess tax being calculated. Such situations have not been uncommon recently, which justifies a more profound reflection on this issue in the context of rationality of verification of procedures regulated under the Tax Ordinance Act, which concern tax obligations arising from a declaration or a decision. It seems reasonable to put forward a thesis that the non-uniform nature of the Constitutional Tribunal’s rulings has not been considered to a sufficient extent in the provisions of this statute. This leads to certain practical problems with tax law, which will be outlined in this study.

It is shown in the paper that the method of appointing judges to the Constitutional Tribunal depends on the character of the Tribunal ascribed to it by a specific legal order. And yet, care is always taken to ensure that the composition of the Constitutional Tribunal is not influenced by any political power. Treating the Constitutional Tribunal as a political organ (or a third chamber of the parliament, a negative legislator) is flawed. The Constitutional Tribunal can by its decisions strike down certain laws. When examining the compliance of a normative act with the constitution the court takes no account of the rationality or fitness for purpose of the solutions adopted. In this paper, a new way of selecting candidates for the office of judge of the Polish Constitutional Tribunal is proposed with a view to ensuring that a judge of the Constitutional Tribunal is distinguished by outstanding legal knowledge and impeccable character as well as being aware of judicial independence.
W artykule zwraca się uwagę na zależność sposobu wyboru sędziów sądów konstytucyjnych w zależności od przypisywanego w danym porządku prawnym charakteru tych sądów. Jednak zawsze zwraca się uwagę, aby skład sądu był ustalany tak, aby jedna, przeważająca w parlamencie, siła polityczna nie miała decydującego wpływu na wybór składu sądu konstytucyjnego. Nieporozumieniem jest traktowanie sądu konstytucyjnego jako organu politycznego (trzeciej izby parlamentu, negatywnego ustawodawcy). Orzeczenia sądu konstytucyjnego mają mieć charakter kasacyjny, badając zgodność aktu normatywnego z konstytucją lub innymi aktami normatywnymi, sąd konstytucyjny nie bierze pod uwagę racjonalności i celowości przyjętych rozwiązań. W artykule proponuje się nowy sposób doboru kandydatów na stanowiska sędziów polskiego Trybunału Konstytucyjnego, który ma zapewnić, że będą się oni charakteryzować określonymi cechami: wyróżniać się wiedzą prawniczą, nieskazitelnością charakteru oraz świadomością niezawisłości.

The use of references to foreign law and jurisprudence by the constitutional courts around the world currently gains more and more attention from scholars. The admis-sibility and usefulness of conducting such a horizontal dialogue between various juris-dictions raises controversies in other countries, but not in Poland, where no significant academic discussion on the legal basis and justification for using comparative arguments in constitutional jurisprudence has been conducted. The reasons for this lack of contro-versy seem to lie in the roots of the 1997 Constitution, and the way in which the Polish legal system is constructed. The Polish Constitutional Tribunal is quite prone to using comparative references in its reasoning. However, it rarely clearly indicated their role or significance for the resolution of the case before it. The analysis of the case-law of the Tribunal indicates that references to foreign law concern constitutional provisions, legislation, and the judgments of other constitutional courts. The purpose of the refer-ences stresses the universality of particular constitutional norms and deciphering their meaning, as well as gathering data significant for the assessment of the proportionality of a national law, as well as at drawing inspiration from the decisions taken by foreign courts. However, the persuasive use of a comparative argument demands that the meth-odological problems which can be noticed in the case-law should be addressed. They in-volve in particular: the need to justify the choice of comparative material that is analysed, the fragmented nature of the analysis, and the lack of a clear indication what role these kind of arguments have in constitutional argumentation.

The paper analyses and interprets the Polish Constitutional Tribunal judicature in order to examine how the concept of human dignity is understood by this court, and what normative contents are included in the concept of human dignity, as it is formed by the Tribunal judicature. According to the Tribunal, the concept of human dignity must be understood in two aspects: on the one hand, dignity is an ontic value, innate and indispensable; on the other hand, it is a value which people acquire in the course of their lives, and may lose it through their own or others' acts. This distinction has an enormous impact on the practice of the Constitutional Tribunal judicature.

Służba cywilna (dalej: s.c.) stanowi kluczowy element każdego państwa prawnego. Jako instytucja odpowiedzialna za wykonywanie władztwa publicznego nie jest wolna od nacisków i prób jej zawłaszczenia do celów partyjnych. Polskie doświadczenia w zakresie tworzenia neutralnej politycznie s.c. nie są okazałe. Pierwsza regulacja w tym zakresie powstała w okresie II Rzeczypospolitej. Po wojnie konstrukcja niezależnej i profesjonalnej s.c. została stopniowo zdemontowana, tak by w 1974 r. całkowicie ją zlikwidować. Po upadku PRL przez kilka lat bezskutecznie starano się reaktywować s.c. Dopiero w lipcu 1996 r. parlament uchwalił podstawy dla systemu s.c. W kolejnych latach dokonano ich rewizji poprzez nowelizacje bądź uchwalenie nowych ustaw (trzy ustawy w ciągu kilkunastu lat). Działania decydentów dotyczące s.c. w tym okresie były przedmiotem orzecznictwa Trybunału Konstytucyjnego. Orzeczenia ukształtowały istotne dla s.c. warunki funkcjonowania i dokonały wykładni aksjomatów tej instytucji. Przedmiotem niniejszego artykułu jest analiza kluczowych wyroków TK.
The civil service (c.s.) is a key element of any nation of law. As an institution responsible for exercising the public authority c.s. is not free from political pressure and takeover attempts for the purposes of the party. Polish experience in the creation of a politically neutral c.s. has not been impressive. The first regulation was created during the interwar period. After the World War II, the idea of an independent and professional c.s. was gradually dismantled to be completely abandoned in 1974. After the collapse of PRL, until 1996, there were several unsuccessful attempts to revive c.s. In that year the parliament adopted a basis for the c.s. system but even that attempt was subsequently revised in upcoming years by further changes (three new acts of law). Moreover, it has to be pointed out that during those years the actions of decision-makers concerning the c.s. have been the subject of jurisprudence by the Constitutional Tribunal. The rulings issued by the Tribunal have shaped the operational conditions which are important for c.s. and have developed an interpretation of the constitutional axioms of that institution. Analysis of key sentences of the Constitutional Court is the subject of this paper.

Provisions of the Act does not infringe the principle of independence of judges of the Constitutional Tribunal and the individual’s right to have his/her case heard without undue delay. Adoption of the solution according to which the Tribunal decides, as a rule, by a full bench is also consistent with the Constitution of the Republic of Poland. However, the finding that there have indeed been grounds for immediate entry into force of the amendment of the Constitutional Tribunal Act of 22 December 2015., is not obvious. Therefore, the arguments justifying the departure from the introduction of the period of vacatio legis should be clarified in the explanatory memorandum of the Act. In the author’s view, a provision requiring a qualified (2/3) majority for the Tribunal to adjudicate can be considered not to comply with Article 190 para. 5 of the Constitution. The legislature should consider, with a view to the future law, clarifying the content of the concept of particularly glaring cases used in Article 31a para. 1 of the Act. Worth considering is also the change in the order in which motions are heard, as referred to in Article 80 of the Act.

The author points out that the bill provides a comprehensive framework for the organization of, and proceedings before, the Constitutional Tribunal without missing any essential elements. He is in favour of the provisions aimed at eliminating loopholes and inconsistencies in the existing Constitutional Tribunal Act and the introduction of new regulations designed to prevent undue delay in proceedings before the Tribunal. However, in his view, some provisions of the bill raise doubts relating to their essence and legislative‑technique requirements and, therefore need to be rework in the course of parliamentary work on the bill. The author propose the wording of provisions complementing and clarifying the text of the bill.

Celem artykułu jest ukazanie procesu legitymizacji Trybunału Konstytucyjnego. Perspektywa relacyjna, którą proponujemy, jest odmienna od prawniczej, dominującej w rozważaniach na ten temat. Traktujemy Trybunał jako rodzaj przestrzeni, usytuowany na przecięciu kilku światów społecznych (prawo, nauka, polityka, administracja), które na niego oddziałują. Badanie przeprowadziliśmy, analizując biografie wszystkich sędziów wybranych w latach 1985–2018. Sędziowie zostali potraktowani jako posiadacze znaczących społecznie zasobów – kapitałów (tytuł naukowy, zawód prawniczy, funkcja w administracji rządowej, mandat poselski itp.). Wykorzystując wieloraką analizę korespondencji, odtworzyliśmy przestrzeń Trybunału. Tym samym uchwyciliśmy nie tylko złożoność i wielowymiarowość legitymizacji polskiego sądu konstytucyjnego, lecz także zmiany tego procesu w czasie.
The aim of this article is to demonstrate the process of the legitimization of the Polish Constitutional Tribunal. In contrast to the dominant legal perspective, we consider the Tribunal relationally, as a kind of social space, located at the intersection of several social worlds that influence it (law, science, politics, and administration). The study concerns the biographies of all the judges elected from 1985 to 2018. Judges are treated as holders of various types of resources-capital (academic title, legal profession, government function, parliamentary mandate, etc.). The study, conducted by means of multiple correspondence analysis, allowed us to reconstruct the Constitutional Tribunal’s space. As a consequence, we have revealed not only the complexity and multidimensionality of the legitimacy of the Polish Constitutional Tribunal, but also captured its dynamic.

Recent years have gone down in the history of the Polish constitutional thought with an unprecedented dispute concerning the underlying principles for the activity and statutory position of the Constitutional Tribunal (‘CT’) . Under the dynamics of political events following the 2015 parliamentary elections the initial doubts whether some of the CT judges were appointed correctly turned into the deepest constitutional crisis in the modern history of Poland which ultimately led to decomposition of the entire state system of constitutional control. Finding all of the underlying causes of that crisis would require multifaceted analyses carried out by experts representing various scientific disciplines. Such an undertaking goes far beyond the boundaries of this study. The aim of this sketch is to reconstruct one of the episodes of the so-called Constitutional Tribunal Crisis which is a direct outcome of the appointment of CT judges by the Sejm (Parliament) to replace judges whose terms did not yet expire . This issue is of key importance for the current discussions on the nature and consequences of CT judgments . The presence of unauthorized persons in CT adjudicating panels became also an important symbolic turning point in the systemic transformation of the Polish constitutional court at the beginning of 2017 .

Article 90 of the Polish Constitution is defined, both in the jurisprudence and in the doctrine, as the legal basis for the accession of Poland to the European Union (‘pillar of European integration’). In the author’s view, Article 90 of the Polish Constitution is applicable not only to the international treaties which confer on an international organization or international institution the competence of the bodies of State authority in relation to certain matters, but also in relation to such agreements which change the scope of the conferred competences or the conditions of exercise of already conferred competences. Article 136 (3) TFEU in an essential way changes the principles of the functioning of the monetary union. Hence, it alternates the conditions of the exercise of the competences conferred by Poland with regard to the monetary policy, which is also covered by the Accession Treaty. In consequence, Article 90 of the Polish Constitution should have been the legal basis for the ratification of the European Council Decision of 25 March 2011 amending Article 136 TFEU with regard to a stability mechanism for Member States whose currency is the euro (2011/199/EU). At the time when the Polish Constitution was approved, the perspective of Article 90 of the Polish Constitution was the EU Accession. This provision did not take into account the application of the ‘Schengen method’ by the EU. The understanding of ‘conferral of competence’, presented in the judgment K 33/12 seems so narrow that its test may not be fulfilled by the majority of accession treaties. Due to this interpretation, a broadly understood European integration, does not fall within the scope of Article 90 of the Polish Constitution. The doctrinal understanding of Article 89 of the Polish Constitution also supports the narrow role of Article 90 of the Polish Constitution with regard to the integration treaties. In the view of the author, it is not excluded that both types of ratification of international treaties may be parallel to each other. Hence, in such a situation the role of Article 90 of the Polish Constitution is diminished.

The author claims that the adoption of a new Constitutional Tribunal Bill, which better defines its position in the system of government, does not solve all the problems. The Constitutional Tribunal started its activity in 1986, when 1952 Stalin constitution was in power. In this constitution the problem of citizen’s rights and civic liberties was regulated in the different way than in present constitutions. The constitution of Polish People’s Republic used general, not precise legal expressions and the catalogue of those rights and freedoms was limited, of a declaratory character. The constitutional provisions were formulated in this way that they were showing the directions of state’s policy, but they didn’t proclaim rights, which you could execute. In fact there was no institutional guaranties of freedoms. This shape of constitution was a result of socialist foundations of this act. The constitution in a socialist state had rather ideological, not legal character. The judgements of the Constitutional Tribunal are very characteristic. Between years 1986–1989 the Tribunal tried to interpret the existing constitutional norms (restrictive interpretation). After constitutional changes in the end of 1989, when Poland was declared to be the “democratic state of law”, the interpretation changed. The role of the Constitutional Tribunal has increased significantly. The Tribunal tried to derive the constitutional liberties from the rule of the “democratic state of law”.

The essence of the article is to present the concept, function and principles of disciplinary liability and the mode of disciplinary proceedings against judges of the Constitutional Tribunal in the context of the ongoing dispute over the independence of each of these constitutional state organs. Disciplinary liability arose from sources of repressive liability and is a special type of criminal liability due to the functions it performs, but also a high degree of ailment. The author argues that despite numerous legal provisions, the model of conduct has not changed, as well as are based on misunderstood axiology, bypassing the principle of nemo iudex in causa sua. I propose, in accordance with the principle of objectivity (impartiality), to submit only disciplinary judges of the Constitutional Tribunal to the Supreme Court for consideration with the simultaneous adoption of an identical mutual principle with respect to judges of the Supreme Court.
Przedmiotem artykułu jest przedstawienie pojęcia, funkcji i zasad odpowiedzialności dyscyplinarnej oraz przebiegu postępowania dyscyplinarnego wobec sędziów Trybunału Konstytucyjnego w kontekście trwającego sporu o niezależność każdego z tych konstytucyjnego organów państwa. Odpowiedzialność dyscyplinarna wyrosła ze źródeł odpowiedzialności represyjnej traktowana jest jako szczególny rodzaj odpowiedzialności karnej z uwagi na funkcje jakie pełni, ale też możliwy duży stopień represyjności. Autor stawia tezę, że mimo licznych nowelizacji model postępowania nie zmienił się, a przepisy naruszają zasadę nemo iudex in causa sua. Tym samym proponuje, aby w trosce o zachowanie zasady obiektywizmu (bezstronności) sprawy dyscyplinarne wyłącznie sędziów TK przekazać do orzekania Sądowi Najwyższemu z równoczesnym przyjęciem analogicznej reguły w odniesieniu do sędziów SN.

Potrzeba zweryfikowania wielu rozwiązań Ustawy o Trybunale Konstytucyjnym i wprowadzenia nowych, spójnych rozwiązań zaowocowała wniesieniem do Sejmu prezydenckiego projektu nowej ustawy całościowo regulującej tę materię. W artykule skupiono się na wybranych zagadnieniach, które zostały unormowane odmiennie od dotychczas obowiązujących. W pierwszej części skomentowano nową propozycję definiowania Trybunału Konstytucyjnego, który ma strzec porządku konstytucyjnego RP. Rozważania w kolejnej części pracy odnoszą się do funkcji sygnalizacyjnej Trybunału, zaniedbywanej zarówno w doktrynie, jak i praktyce. Proponowane zmiany mają w zamierzeniu projektodawcy umożliwić uzyskanie stanowiska od adresatów postanowień sygnalizacyjnych. Następnie została ukazana nowa propozycja wyłaniania sędziów Trybunału Konstytucyjnego, która ma odpolitycznić ten proces. Opisano także sytuację korpusu prawników Trybunału – ciała, które do tej pory nie funkcjonowało na gruncie obowiązującej ustawy, jak również nowe uprawnienie Sądu Okręgowego w Warszawie w ramach procedury rejestrowania i kontrolowania partii politycznych. Całość rozważań wieńczy zakończenie, w którym zwraca się uwagę na inne nowości legislacyjne przewidziane w projekcie.
The need to verify many solutions in the act on the Constitutional Tribunal and implement new, cohesive developments resulted in bringing to the Parliament a presidential bill that would regulate this matter completely. In the article they concentrated on selected issues which were normalized differently than the ones being in force so far. In the first part, a new proposal of defining the Constitutional Tribunal which is supposed to protect constitutional order of the Republic of Poland was discussed. Deliberations in the next section of the work refer to the signal function of the Tribunal, neglected both in doctrine, as well as the practice. The drafter might assume that the proposed changes would make it possible to obtain the opinions from addressees of signal decisions. Next, a new proposal of appointing judges of the Constitutional Tribunal was discussed, which is supposed to depoliticize this process. The situation of the corps of lawyers of the Tribunal was described as well – the body which so far hasn’t been functioning following the act being in force, as well as new rights of the District Court in Warsaw, within the in framework of registering and controlling the political parties. The whole paper finishes with the attention put to legislative novelties suggested in the in the bill.

he author of the position of the Sejm on the application of the President of the Council of Ministers concerning the assessed provision of the Act on the Organisation and Procedure before the Constitutional Tribunal states that the provision in question is inconsistent primarily with the principle of efficiency and reliability of the operation of public institutions expressed in the Preamble to the Constitution. The challenged provision determines the minimum number of Constitutional Tribunal judges whose participation is necessary when the Tribunal takes decisions in full session. This provision has been challenged by the applicant to the extent that it prevents the Constitutional Tribunal from adjudicating when a minority of the constitutional composition refuses to adjudicate. The statutory establishment of a relatively high, rigid quorum may block the exercise of the constitutional powers of the Polish constitutional court. The provision under review may result in the fact that citizens and state bodies – due to the inability of the Tribunal to meet in full composition – will in fact be deprived of the constitutional guarantee of the Tribunal’s rendering of a judgment in cases in which adjudication by such a composition is required.

Opis:
The authors claim that the new Constitutional Tribunal bill, aimed at resolving many essential problems that have appeared in recent years in relation to the jurisprudence of the Tribunal, deserves a positive assessment. However, some of the proposed solutions raise doubts as to their constitutional basis and systemic consistency. The authors point out that some of the issues cannot be solved by the bill due to constitutional limitations. Therefore, they propose to link the adoption of the bill with a prior change of the provisions of the constitution which govern the functioning of the constitutional court. It is the only way to carry out the changes guaranteeing the appropriate level of adjudicative efficiency of the Tribunal. The authors also point out the need for legislative‑techniques changes in some articles of the bill.

In the assessment of the legitimacy of the constitutional complaint, it was stated that the questioned provision of the Financial Instruments Trading Act to the extent that it allows to consider as a prohibited act placing an order or concluding transactions in accordance with the special regulations established for stock exchange trading by a company operating on a regulated market that affect the volume of trading in company shares and may affect the company’s position in indices published by the company, but do not mislead or may not mislead other investors as to the price of shares, is consistent with the Constitution.

In this draft position the author points out the conformity of Article 16 para. 3 subparas (1), (3), (4) and (6) of the Act on the removal, storage and transplantation of human bodies, organs and tissue and Article 16 para. 3 subpara. 2 in part containing the phrase “and place”, with Article 47 and Article 51 para. 2, in conjunction with Article 31 para. 3 of the Constitution. According to the author, the proceedings should be discontinued in relation to other issues, due to inadmissibility of issuing a judgment. In justifications, he claims that the provisions referred to by the Human Rights Defender do meet the criterion of necessity within the meaning of the constitutional provision imposing limitations on obtaining, gathering and disclosure of information o citizens by public authorities and, thereby, meet the constitutional standard concerning the right to privacy and its admissible limitations.

The subject of the assessment contained in the position of the Sejm before the Constitutional Tribunal are provisions of the Civil Code in relation to the doubts of a regional court, whether the application for a court enforcement clause for a bank enforcement title does not interrupt the limitation period for a claim covered by that title against a transferee who is not a bank. In the author’s opinion, the interpretation of the questioned provisions in the process of applying the law, and in particular the limitation of a retroactive effect of interpretation, is vested in courts and it is difficult to conclude that the assessment of the constitutionality of the questioned provisions by the Constitutional Tribunal determined the resolution of the case pending before the court that submitted the question of law. In view of the doubts regarding the admissibility of the question of law, the Sejm should request that the proceedings be discontinued.

The application concerns Article 3a of the Act of 28 March 2003 on Railroad Transport, exempting the application of certain provisions of Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23 October 2007 on rail passengers’ rights and obligations, to urban, suburban and regional rail passenger transport. In the view of the Human Rights Defender, the above said article – insofar as it indefinitely excludes the application of Article 21 para. 1 of the Regulation – is incompatible with Article 2 in conjunction with Article 69 of the Constitution and Article 9 para. 1(c) of the Convention on the Rights of Persons with Disabilities, signed in New York on 13 December 2006. Despite these arguments, the Sejm decided in this case that the contended regulation is consistent with the relevant provisions of the Constitution.

The legislature enjoys a wide discretion as to regulation of the conditions for granting of sickness allowance after termination of the entitlement for sickness insurance. Such allowance is of a unique nature, is not covered by the contribution and is paid in respect of events not covered by insurance risk and to an uninsured person. The author of the draft position points out the principle of equality and reciprocity is observed. The one who bears the greater burden, can expect greater support from the fund, for example an allowance is paid for each entitlement. The application of this principle cannot be extended to the period following the termination of the relation of sickness insurance. The allowance paid in such instance is not backed by the collected contribution and has exceptional nature. Therefore, the examined provision should be recognized as compatible with the principle of equality before the law. In the author view, the article in question is compatible with the Constitution.

Od połowy 2013 roku w Sejmie trwają prace nad projektem nowej ustawy o Trybunale Konstytucyjnym. W ekspertyzach wobec tego projektu zwraca się uwagę, iż korzystniejsza byłaby równoczesna lub uprzednia zmiana niektórych przepisów Konstytucji RP z 1997 r., określających koncepcję, sposób wyboru i kompetencje tego „sądu prawa”. Jednak takiej zmiany nie przewidziano. W tej sytuacji powstaje pytanie, na ile można się spodziewać, że nowa ustawa sprosta wszystkim postulatom reformy Trybunału Konstytucyjnego? Na ile pożądane zmiany będą się mieścić w ramach konstytucji? Artykuł jest próbą krótkiej konfrontacji projektu z propozycjami wysuwanymi pod adresem konstytucyjnej koncepcji Trybunału nie tylko w literaturze prawno-konstytucyjnej i opiniach ekspertów, ale także w środowisku prawników i w opinii publicznej. W tym kontekście porusza istotne nierozwiązane dotychczas problemy, jak zwłaszcza sposób wyboru sędziów (tylko przez Sejm, tylko na wniosek posłów, bezwzględną większością). W artykule wysuwa się tezę, że ten sposób petryfikuje stary system, wywodzący się z lat 80., czyli z okresu, kiedy także poprzez wybór sędziów partia hegemoniczna zapewniała sobie wpływ na Trybunał. I choć inne ograniczenia TK zostały w systemie demokratycznym usunięte, to jedno pozostało bez zmian. Co gorsza – w nowych warunkach demokratycznych sprzyja konkurencyjnej walce partii politycznych w parlamencie o miejsca dla „swoich” sędziów i w efekcie pozwala na zarzut upartyjnienia sądu. Projekt ustawy, inspirowany opinią organizacji pozarządowych, proponuje w tym zakresie pewne zmiany, ale spotyka je zarzut niekonstytucyjności. To kolejny powód, aby nie ograniczać zmian tylko do ustawy
Since mid-2013, the Sejm has been working on the Bill on the Constitutional Tribunal. Expert opinions on that project highlight that, at the same time, it would be better to amend the Constitution of the Republic of Poland of 1997 with respect to the regulations defining the conception, electoral proceeding and the competence of this “court of law”. However, such a solution has not been taken into account. In such a situation a question arises: To what extend can we expect the new Act to meet all the demands to reform the Constitutional Tribunal? How will the desired changes be accommodated within the scope of the Constitution? The article is an attempt to confront the Bill with the demands with regard to the constitutional conception of the Tribunal expressed in the legal-constitutional literature and experts’ opinions as well as by the legal circles and the public. In that context, the article discusses essential problems that have not been solved so far, especially the way of electing judges (only by the Sejm, only after the designation by the MPs, by absolute majority vote). The article presents a thesis that this solution strengthens the old system originating from the 80s, i.e. the period when the dominating party ensured its influence on the Tribunal by appointing its judges. And although other TK limitations were removed in the democratic system, this one remains. What is worse, in the new democratic conditions, it creates favourable circumstances for political parties’ competition in the parliament in order to win seats for “their” judges and, as a result, lets the Tribunal be accused of being involved in politics. The Bill, inspired by non-governmental organizations’ opinions, proposes some changes but they meet with objections that they will be unconstitutional. This is another reason why changes should not be limited to the Act.

The constitutional complaint concerns regulations of the Law on Proceedings Before Administrative Courts. The complainant moves for a statement that Article 173 para 1 of that act does not provide a possibility to lodge a cassation appeal against the Supreme Administrative Court’s order on rejection of the claim on for reopening of the proceedings before the SAC. After analysis, it has been assessed that the contested provision conforms to the Constitution of the Republic of Poland. Moreover, there is no real and direct interest of the complaining company which would be protected by the constitutional complaint directed at stating the unconstitutionality of the indicated provision.

In the opinion of the author of the Sejm’s position limiting the possibility of obtaining the right to compensation only to the heirs of an owner of a real estate left outside the current borders of the Republic of Poland who possess a Polish citizenship is consistent with the Constitution. In the position of the Sejm a statement was proposed that the appealed provision of the Act on the Border Guard, in the area in which it stipulates that an officer entitled to a functional allowance is not entitled to time off from service in exchange for service overtime exceeding service standards, is compliant with the indicated provision of the European Social Charter drawn up in Turin on 18th October 18 1961. The Applicant emphasized that the legislator did not comply with the provisions of the ESC, for he deprived Border Guard officers serving in independent or managerial positions of the right to free time or remuneration for the time of service performed in overtime. In the justification of the position, it was stated that Article 4 of the ESC does not determine the extent of additional remuneration that employees are entitled to for overtime work. Therefore the national legislator has been left with far-reaching freedom to define the rules of remuneration of employees.

Opinion of the Venice Commission about amendments to the Constitutional Tribunal Act of 2016 was prepared upon the request of the Polish Minister for Foreign Affairs, Witold Waszczykowski. In his request, he identified the constitutional issues to be examined by the Commission. As stated by the Commission itself, the opinion referred to the composition of the Constitutional Tribunal. In its Opinion, the Commission makes an assessment, recommendations and suggestions, at the same time declaring its continuing support. In this respect, it did not go beyond the standard procedure, which does not prejudge the issue of whether it is right in its assessments. The Polish authorities are not legally bound by the findings of the Commission’s Opinion which, however, contains some recommendations and suggestions that deserve response.

The author of this draft position points to the conformity of Article 12 para. 1 of the Act of 7 December 2012 amending the Act on Family Benefits and Certain Other Acts (Dziennik Ustaw, item 1548) with the principle of confidence in the state and its laws and the principle of acquired rights, derived from Article 2, Article 32 para. 1 and Article 71 para. 1 of the Constitution There are no sufficient grounds to rebut the presumption of constitutionality of the above‑mentioned provision insofar as the grant of a supplement to the carer’s allowance to persons entitled to that allowance pursuant to the provisions in force until 31 December 2012 is dependent on the fact that disability of the person requiring care occurred no later than he/she has attained 18 years of age or during education in school or college, but no later than by attainment of 25 years of age. The proceedings in relation to the remainder should be discontinued due to the inadmissibility of the judgment.

Aim. This research aims to discuss the importance of the principle of rule of law in protecting the judiciary’s role, especially the independence of constitutional adjudication and its functions. Methods. The study applies the case study approach and comparative method to investigate the constitutional court systems of some countries of the Association of Southeast Asian Nations  (ASEAN) and their independence. Results and conclusion. The resultsreveal a lack of the judiciary’s independence, even among the top branches that are trying to implement democracy in Myanmar. The judiciary is under the control of the executive and legislature branches as their members belong to political parties. Moreover, a constitutional court is established with the members who are elected and nominated by the legislature and executive. Sometimes there can be conflicts when constitutional law does not mention the division of powers among governmental organisations like Myanmar, which results from the impractical functions of the Constitutional Tribunal of Myanmar. Cognitive value. This research highlights possible ways to solve the constitutional issues among the three great branches. This initiative is in the interest of Myanmar citizens and citizens of all nations as these are international issues.

The constitutional complaint refers to the provision of the Act concerning bearing costs of the appeal procedure in certain circumstances borne by the appellant, if the appeal in part of the charges, which the contracting authority did not take into account, had been dismissed by the National Appeals Chamber. In the position of the Sejm, it was proposed to discontinue the proceedings due to an inadmissibility to deliver a judgment. If the dismissal of the proceedings had not been taken into account, the Sejm proposes to state that the challenged provisions conform to the Constitution.

In the presented project of a position, the author claims that indicated provisions of the Civil Code, in part which enabled acquisition of a land servitude of similar nature to a transmission servitude through usucaption, before articles 3051–3054 of the Civil Code entered into force, in situation when an administrative decision restricting rights of the owner of the land is non-compatible with provisions of the Constitution. Constitutional protection of the right of ownership requires every restriction of that right to fulfill certain obligations. From a constitutional standpoint, an institution of land servitude is a restriction of the right of ownership. In analyzed case the basis for the restriction provided in an act is of primary importance. The author does not agree with the Supreme Court that the analyzed provisions regulate land servitude. In her opinion, the provisions cannot serve as a basis for a land servitude as an autonomous right (a transmission servitude), and in consequence cannot serve as a basis for a restriction of constitutional right of ownership. According to the author, the analyzed regulation also does not fulfill the criterion of necessity.

The author, examining firstly the motion of the All Poland Alliance of Trade Unions, is in doubt on whether it is admissible to initiate abstract review of constitutionality of a norms by a trade union in the event that the application does not relate to the interests of its current members. Based on arguments given by the organs of the International Labour Organizations concerning the interpretation of the notion of worker wider than that contained in the Labour Code, the author claims that Article 2 of the Trade Union Act, within the scope specified in the application, is incompatible with Article 2 of Convention No. 87 ILO. Additionally, he points out that since the Convention No. 87 excludes from its scope only the armed forces and the police, then more far‑reaching limitations under the abovementioned Act are inconsistent with Article 59 para. 1 of the Constitution. Consequently, Article 2 of the Trade Union Act is also incompatible with Article 59 para. 1 of the Constitution and Article 12 which is functionally linked to it.

In this draft position the author states that one of the provisions of the Act on combating unfair competition, concerning criminal liability for acts of dishonest competition in the field of advertising, is inconsistent with the Constitution. First, it provides an open catalogue of punishable acts, which violates the standard of specificity of criminal law. Second, the required elements of an offence were not sufficiently defined and they leave a subject of law in doubt as to whether his or her actions might result in criminal liability. Declaring the contested provision to be inconsistent with the Constitution eliminates the necessity of examining its conformity with Article 7 of the European Convention of Human Rights. Since in the examined case the constitutional standard and the international standard are practically the same, the proceedings regarding the latter should be discontinued.

Opis:
The question of the public servants responsibility is a very multifaceted issue. The problem touches not only the area of the constitutional law but also the civil law. Art. 77 paragraph 1 of the Polish Constitution is the base of the public servant responsibility as this article establishes the fundamental postulates of the public authority liability. This constitutional rule creates the right to compensation for any harm which has been done because of the public authority illegal action. The “reflection” of the constitutional norm is included in the art. 417 of the civil code, which states the rules of the State liability in the case of damages made by the public servant. Art. 77 paragraph 1 of the Constitution creates the grounds of the public servants responsibility while art. 417 of the civil code is the concretization of the mentioned constitutional rule. The issue of the public servant liability is composed by the elements which have been the subject of Constitutional Tribunal Jurisprudence interests. That is why the article refers to the questions such as the direct applicability of the art. 77 paragraph 1 of the Constitution, the essence of the compensative responsibility as well as to the entities whose liability is based on the mentioned constitutional rule. The paper concerns also the matter of the damage, including the problem of the compensation range, which can be determined on the base of art. 77 paragraph 1 of the Constitution. It should be stressed that the Constitutional Tribunal jurisprudence do not give the categorical answer to the questions mentioned above. However, the role of the Constitutional Tribunal must be emphasized especially approaching the public servants liability question. Constitutional Tribunal has changed the model of the servant liability because of its judgment passed in 2001. Currently, the illegality of the public servant behavior is the sufficient prerequisite of his liability without the necessity of indicating the public servant guilt.

The author indicates that the provision of the aforementioned law is inconsistent with the provisions of the Constitution and the Convention for the Protection of Human Rights and Fundamental Freedoms. This provision includes the power of a executor who executes mortgage foreclosure, who is obliged to remove an indebted and his household members, where no premises for relocation were indicated to the indebted, or where he is unable to meet his own housing needs. The applicant questioned the constitutionality of legislative omissions, in the result of which there is a possibility of conducting executive proceedings in the administration regarding eviction from residential premises “on the street”.

In view of the constitutional crisis that has been going on since 2015, the issue of locating the Supreme Court and the Constitutional Court within the system of State organs seems to be particularly important. One of the questions that should be answered is to what extent the ideas adopted in the 1990s appear to be helpful for the proper positioning of the Supreme Court and the Constitutional Tribunal within the system. The issue of the origins of the aforementioned ideas should also be examined. Answering these questions enables the identification of essential problems related to the way in which the legislator shaped the relationship between the Constitutional Tribunal and the Supreme Court. The topic of this paper is to present the general assumptions the legislator relied on when setting the position of the Constitutional Tribunal, and the question of whether these assumptions remain fully valid – especially with regard to the possibility of reviewing the interpretation of the Supreme Court.

In the opinion of the Sejm, the provisions of the Act conform to the Constitution. In its position the Sejm states that disclosing to third parties the contents of applications for financing scientific research submitted in proceedings under the Act as public information would pose a significant threat to the material and non-material interests of the authors of the applications. The assumption that the contents of the review and the personal data of experts may be disclosed as public information due to the loss of binding force of these provisions in the result of the judgment of the Constitutional Tribunal means that such persons would be exposed to effects that could not be foreseen at the time of the review.

The constitutional complainant challenged the constitutionality of a part of a Criminal Code provision that states: “anyone who, in order to achieve a material benefit, prevents or obstructs a public tender, or acts in concert with another entity to the detriment of the owner of property or an entity or institution for which the tender is to be held is liable to imprisonment for up to 3 years”, insofar as it provides for criminal liability for entering into an agreement with another person. The author of the opinion concludes that the statutory regulation challenged by the applicant does not violate the principle of specificity of criminal law provisions. Although the regulation raises certain doubts regarding its interpretation, they do not render the addressees of this provision unable to carry out a rational test of the foreseeability of criminal law consequences of their conduct. The challenged provision is in compliance with the Constitution.

The paper is dedicated to describing the way of reception by the Polish Constitutional Tribunal of the “chilling effect”, i.e. an institution related to such activities of public authorities that form an indirect act of deterrence regarding the execution of constitutionally guaranteed rights and freedoms, esp. the freedom of expression. The discussed concept has originated in judicial decisions of the US Supreme Court and has spread into many contemporary legal systems, including jurisprudence of the European Court of Human Rights. Although it is evident that the Tribunal “took over” that concept from the ECHR, it in fact developed its own, unfortunately internally inconsistent, understanding of the chilling effect. Four different ways of application of chilling effect may be noticed in judicial decisions of the Polish CT, while only two of them reflect the perception of this institution by the US Supreme Court and the ECHR.

The need to adopt a new law stems from the judgment of the Constitutional Tribunal finding unconstitutionality of the existing law. The author claims that the provisions of the bill regarding the legal consequences of liquidation of the Polish Association of Allotment Holders and transformation thereof into a garden association, cause doubts of a constitutional nature, since they may lead to a monopoly of one organization of allotment holders. The author is positive about the provisions concerning the legal status of allotment holders, and about the contract of allotment lease. As admissible she assesses the regulations relating to the transfer of the right to allotment and the legal consequences of death of the allotment holder, as well as those protecting his right to bring an action. She questions the provisions making it possible to establish, free of payment, ownership right of the allotment holder or perpetual usufruct with a share in common parts of family allotment gardens. The author argues that such regulation would result in giving the possibility to use an allotment without limitation, e.g. by making residence in its area. Doubtful is also the acquisition by the association, by the operation of law, of usufruct of real property of the local self‑government in the event that it is not legally entitled to the real property.

The article contains a draft position of the Sejm relating to the application submitted by a group of Deputies to the Constitutional Tribunal in which they contested some provisions of the Act – Electoral Law adopted on 5 January 2011, and the act amending it. The purpose of the application is declaration of conformity with the Constitution of several dozen provisions of both the legal acts. An analysis of justification of the position of the Sejm focuses above all on the new instruments of electoral law that were absent or reduced in Polish law. They include inter alia: a two-day vote, a proxy vote, correspondence vote, single-seat constituencies in elections to the Senate, as well as bans on the use of large-format election posters and slogans as well as paid election radio and TV ads. Based on detailed analysis, the authors claim that none of the solutions proposed in the new Electoral Code infringes the constitutional standards.

This article tries to answer three different questions: Did we create a stable and strong constitutional culture in Poland after collapse of the communist system? Has the model of constitutional review enshrined in the Polish Constitution confirmed itself over the 30 years of its application by the Constitutional Tribunal, notably considering the alternative model to the Tribunal’s concentrated review, i.e. the so-called dispersed constitutional review exercised directly by the common courts? As a third topic, the article deals with the perspectives of the constitutional review and necessary changes in that regard. It could serve as an instrument for the future improvement of constitutional culture as well as ensure a more effective influence of the basic constitutional values and principles on the entire legal order in Poland, notably through a stronger presence of the constitutional axiology in the judicial practice. The conclusion of the first part of the article is that Polish constitutional culture is not sufficiently enrooted in the tradition and awareness of the Polish society – this concerns average citizens, as well as members of the political elite. This is one of the essential reasons why the Polish constitutional system, founded on a good institutional framework for the state ruled by law, has become so fragile with regard to the recent political and legal changes, which have an extremely negative impact on the legal order and which undermine the basic democratic principles, starting with the independence of the judiciary. This conclusion draws upon the author’s postulate that the constitutional legal order of the democratic state ruled by law must necessarily be strengthened by a well-organized civil society and by a good constitutional practice shaped in compliance with fundamental rights, basic values and principles. The second part of the article presents arguments in favor of the centralized (concentrated) constitutional review model, which could in principle be maintained in the future. This model is better adapted to the Polish legal traditions and to the structure of the Polish judiciary, whereas the opposite model of decentralized judicial review could seriously weaken the principle of legal certainty. However, it is argued that this approach should not be understood as a categorical refusal of a direct application of constitutional norms, principles and values by common judges. On the contrary - the modern concept of judicial interpretation and application of law requires an openness towards the larger context of the legal order, including the constitutional, supranational and international texts, and presupposes observance of the basic rights and values which are guaranteed by these texts and universally recognized. However, the definitive elimination of legal provisions from the legal order should in principle be a prerogative of the constitutional court in conformity with the logic of the model of centralized constitutional review. At the present time, which sees the model of constitutional review paralyzed by prolonged constitutional crisis, and a clear violation of the independence of the constitutional justice by the parliamentary and governmental majority, the necessity of striving for a specific instrument to effectively apply the constitutional guarantees in the legal order must not be ignored. The author argues that this exceptional situation justifies a temporary replacement of the concentrated model of constitutional review by concrete judicial review, which means that the ordinary judges can refuse the application of statutory legal rules in specific cases if they do not comply with the constitution. In the final part of this publication, focusing on the future perspectives, the author discusses necessary improvements of the constitutional review, in line with a more flexible approach allowing common judges to refuse in some situations the application of non-constitutional rules without referring a question of law to the constitutional court. The author also posits the necessity of introducing some modifications to the model of constitutional complaint and argues for an enlargement of the competences of the constitutional court, covering not only the review of the constitutionality of norms, but also the review of conformity with fundamental rights in their application.

This text presents the application of the Charter of Fundamental Rights by Polish courts since the entry into force of the Charter in December 2009. As the Charter is an element of the ‘external’ constitution for the Republic of Poland, similar to the European Convention on Human Rights, the practice of the Polish Constitutional Tribunal is of particular importance in this analysis. Hence the referral to the Charter by common and administrative courts is rather briefl y described and the main focus of the text is on the broader analysis of the way of and reasons for using the Charter by the Constitutional Tribunal. While the Charter is not treated as a model for the hierarchical analysis of norms in cases of constitutional complaints, it can however be offered as such a model in cases of abstract control and legal questions fi led by the courts. The use of the Charter might be further clarifi ed by an answer of the Court of Justice of the European Union to the fi rst request for preliminary ruling made by the Polish Constitutional Tribunal in case C-390/15 RPO.

The paper does not present an official standpoint of the Constitutional Tribunal, but that of the authors. Writing about human rights they have in mind also the so-called basic freedoms. They point at the general difficulties in applying the jurisprudence of the Constitutional Tribunal the international human rights. These are the following: lack of a uniform understanding of human rights (ideological aspect); difficulties in working out a clear and exhaustive rule of interpreting human rights, which makes it difficult to apply the Pact of the Citizen and Political Human Rights at the international level and the more so at the national level; the Constitution of the Polish Republic says no word about the place of the treaties within the legal order of the State; the Constitution bears a positivistic character, whereas the Pacts of Human Rights take the inborn dignity of the human person as the foundation of rights; lack of a uniform understanding of human dignity. To the particular difficulties belong the following: application of pacts is limited by the art. 33a of the Constitution; the law concerning the Constitutional Tribunal does not provide that the Tribunal should arbitrate in the international contracts which Poland ratified. However, the jurisprudence of the Constitutional Tribunal apparently pertains to the International Pacts of Human Rights. This is performed in two ways: as an aid at the interpretation of the norms of the national law, or - which occurs more rarely - in reference to art. 1 of the Constitution, the article which established the democratic rules of the legal State, imposes at the same time on Poland a daty to respect the Pacts of Human Rights.

The Amendment to the Act on the Constitutional Tribunal passed on 22 December 2015 has raised serious doubts in Polish and foreign academic and political institutions and the media. Of particular concern is the fact that the amendment does not correspond to the limitations of Article 197 of the Constitution of the Republic of Poland. Contrary to appearances the amendment exceeds organisational and procedural questions. The amendment imposing a rule that 13 judges must rule on cases in the  chronological order of their submission and the lack of vacatio legis makes it impossible for the Constitutional Tribunal to continue in practice its normal judicial function. In particular it makes it impossible for the Constitutional Tribunal to decide on the constitutional legality of the Amendment of 22 December 2015 within a reasonable time scale which in itself could result in dangerous and absurd legal situations. This could be tantamount to an interference in the judicial competences of the Constitutional Tribunal guaranteed by Article 188 of the Constitution of the Republic of Poland. It is the Constitutional Tribunal itself that should rule on all dilemmas concerning this amendment.
Nowelizacja ustawy o Trybunale Konstytucyjnym uchwalona 22 grudnia 2015 r. budzi liczne wątpliwości krajowych i zagranicznych ośrodków naukowych, medialnych i politycznych. Obawy wywołuje zwłaszcza to, że nie mieści się ona w granicach określonych w art. 197 Konstytucji RP. Wbrew pozorom wykracza bowiem poza sprawy organizacyjne i proceduralne. Przepisy narzucające zasadę orzekania w 13-osobowym składzie, w kolejności wyznaczanej datami wpływu spraw oraz brak vacatio legis uniemożliwiają w praktyce normalną działalność orzeczniczą Trybunału Konstytucyjnego. W szczególności blokują możliwość zbadania w rozsądnym terminie konstytucyjności ustawy z 22 grudnia 2015 r., co z kolei rodzi niebezpieczeństwo powstania absurdalnych sytuacji prawnych. Może to oznaczać ingerencję w kompetencje orzecznicze Trybunału Konstytucyjnego zagwarantowane w art. 188 Konstytucji RP. Do niego też powinno należeć ostateczne rozstrzygnięcie wszystkich dylematów związanych z wymienioną wyżej ustawą.

In the proposed draft position the author states that the Sejm does not share the belief of the Commissioner for Citizens’ Rights that the provisions of Article 12 § 1 and § 2 of the Family and Guardianship Code violate the Constitution in that they lead to humiliation and a justified sense of grievance of people affected by their operation. It has been shown that in this case the law is not a source of harm to the individual, on the contrary – the adopted regulations are aimed at protecting constitutional values, with maximum respect for the rights and dignity of persons with disabilities. In the opinion of the author of the draft position, it cannot be found that the arguments of the Commissioner for Citizens’ Rights – referring generally to social degradation of people affected by mental disabilities, without taking into account the details of construct of marriage ban – meets the high standards required by the Constitutional Tribunal. According to the author, from the considerations contained in the draft position it follows that the above-mentioned provision of the Code is compatible with Article 30 of the Constitution.

The draft position of the Sejm on the application of the First President of the Supreme Court, submitted to the Constitutional Tribunal, states that the indicated provision of the Act – Law on the System of Common Courts, insofar as it excludes the simultaneous payment of retired judge’s salary and pension from the Social Insurance Institution, is consistent with the Constitution. The constitutionality of the provisions of the Act on the Social Insurance System has also been demonstrated insofar as they make judges in the active status, serving full-time and at the same time taking up additional employment or occupation, subject to pension insurance.

Z art. 190 ust. 1 Konstytucji wynika kompetencja TK do derogacji norm uznanych za niekonstytucyjne, a więc bezpośredniej ingerencji w system prawny. Można jednak wyszczególnić wyjątki od tego podstawowego dla działalności polskiego sądu konstytucyjnego skutku orzeczenia stwierdzającego niezgodność normy ze wzorcem kontroli. Artykuł wskazuje, że Trybunał Konstytucyjny ma instrumenty, które umożliwia-ją wręcz uniknięcie derogacji. Stawiana jest bowiem teza, że zastosowanie wszystkich z uwzględnionych tu środków każdorazowo zależy od decyzji Trybunału; nie wynika ani z petitum pisma procesowego, ani z trybu postępowania. W artykule uwzględniono: odroczenie utraty mocy obowiązującej aktu normatywnego, wyrok stwierdzający pominięcie ustawodawcze, wyrok interpretacyjny afirmatywny oraz funkcję sygnalizacyjną. Ich analizę oparto o kryterium podstawy prawnej, celu oraz skutków ich zastosowania. Opisano wpływ tych instrumentów na system prawa oraz znaczenie dla organów stosujących prawo.
According to Article 190 para. 1 of the Constitution, Constitutional Tribunal has competences to derogate unconstitutional norms, therefore, to interfere in the legal system directly. However, there can be specified some exceptions to this basic result of Constitutional Court’s judgments. The article indicates that Polish constitutional court has instruments which enable to avoid derogating unconstitutional norms. It is worth underlining, that it is always Constitutional Tribunal’s decision to apply any of them. Especially, it doesn’t depend on petitum of pleading or procedures. In the article, it was taken into consideration: an adjournment of the date of the loss of unconstitutional provision’s binding force, a judgment concerning legislative omission, an affirmative interpretative judgment and a signaling. Their analysis is based on criterion of legal basis, aim and result of their application. It is described influence of these instruments on the legal system and, on the other hand, their significances for the authorities applying the law.

The aim of the article was to analyze compulsory legal representation in the proceedings before the Constitutional Tribunal, mainly based on jurisprudence of the Constitutional Tribunal related to this institution. For this purpose, the essence and scope of this institution, as well as subjective and objective exclusions have been presented. Attention was also paid to the participation of foreign lawyers in the proceedings before the Constitutional Tribunal. Finally, the need to reform this institution was raised.

In assessing the constitutionality of the contested Article 215, para. 2 of the Real Estate Management Act, it was stated that it is important to ascertain whether the differentiation of former owners, based on the criterion of deprivation of physical possession of the plot after 5 April 1958, was justified, and therefore whether it has such essential nature that justifies different treatment of similar entities. Pointing to the special status of the right to compensation, as stressed in the jurisprudence of the Constitutional Tribunal, the author claims, however, that claiming the right to compensation cannot be limited by an incidental and historical time criterion, which is the date of entry into force of the Act of 1958, even if the economic reasons argue for that approach. Given the above, it was found that Article 215 para. 2 of the Act, to the extent of the above interpretation, is inconsistent with the provisions of the Constitution.

Niniejsza publikacja stanowi próbę przekrojowego omówienia dotychczasowego orzecznictwa Trybunału Konstytucyjnego na temat wolności gospodarczej uregulowanej przez art. 20 i art. 22 polskiej Konstytucji. W pierwszej części omówiona zostaje podwójna natura wolności działalności gospodarczej, którą Trybunał Konstytucyjny interpretuje jako konstytucyjną zasadę ustrojową, jak również prawo podmiotowe o charakterze negatywnym. Wskazany zostaje również sposób i charakter powiązania tych dwóch różnych ujęć omawianej wolności. Następnie przedstawiona zostaje kwestia dopuszczalności ograniczania wolności działalności gospodarczej. Analiza orzecznictwa Trybunału Konstytucyjnego wskazuje tutaj, iż punktem odniesienia dla określenia granic ingerencji ustawodawcy w wolność gospodarczą można szukać nie tylko w „ważnym interesie publicznym” z art. 22 Konstytucji, ale również - w pewnym zakresie - w art. 31ust.3, proklamującym zasadę proporcjonalności. Publikacja zakończona jest próbą podsumowania orzecznictwa polskiego sądu konstytucyjnego na temat konstytucyjnej wolności działalności gospodarczej, oraz zmierza do udzielenia odpowiedzi na pytanie czy - na gruncie orzecznictwa TK - kategorii wolności działalności gospodarczej można przypisać walor pojęcia w pełni ukształtowanego.
The present publication constitutes an attempt of a sectional overview of the previous jurisdiction of the Polish Constitutional Tribunal on the subject of freedom of economic activity regulated under article 20 and article 22 of the Polish Constitution. Objective analysis begins with the description of double nature of the freedom of economic activity that is interpreted by the Tribunal as a constitutional principle (rule of law) as well as one of the fundamental rights. The presentation concerns itself also with the type of the interrelationship between these two ways of expression of the analysed freedom. Further on, the presentation concentrates on the admissibility of the limitation of the freedom of economic activity. Analysis of the jurisdiction of the Constitutional Tribunal indicates, that the legal limits of the legislator’s interference within the scope of the freedom of economic activity comes out not just as „of important public interest” under article 22 of the Polish Constitution, but also has its basis in article 31 section 3, that formulates the principle of proportionality. The article ends up with an attempt to resume the jurisdiction of the Polish Constitutional Tribunal on the subject of freedom of the economic activity as well as attempts to answer the question if, under jurisdiction of the Constitutional Tribunal, the present freedom has already taken a fully formed shape and meaning.

In the proposed draft position the author points to the incompatibility with Article 45 para. 1 of the Constitution of Article 75 § 4 of the Act – Law on Common Courts System, in so far as it denies the right of appeal to the court against the decision of the Minister of Justice rejecting the request from a judge to be moved to a different place of office. The decision of the Minister, based on his/her own discretion, should be subject to judicial review, as it is taken neither within the scope of administrative supervision over the courts, nor even by means of official superiority, but rather relates to the systemic position of a judge determined by his/her rights and obligations. In the opinion of the author, Article 75 § 1 of the above Act, in so far as it does not specify the conditions for move to another post, is in conformity with Article 47, Article 52 para. 1, Article 65 para. 1 in conjunction with Article 31 para. 3 of the Constitution. This provision contains a mechanism that properly balances the public interest and private interest. On the one hand, it allows the change of place of adjudication established in the appointment document, providing an exception to the principle of stabilization of the office of judge. On the other hand, it guarantees an efficient and fair administration of justice.

The opinion presents Sejm’s draft position in the proceedings before the Constitutional Tribunal concerning constitutionality of the procedure for the creation of common and military courts (Ref. No. K 27/12). A group of Deputies and the National Council of the Judiciary, initiating the proceedings, challenged the transfer to create and dissolve common and military courts to – respectively – the Minister of Justice and Minister of National Defence. In the Sejm’s view, the procedure for creation common courts does not infringe constitutional standards, but the provision authorising the creation of military courts does not comply with the Constitution due to the lack of necessary guidelines.

In the proposed draft position the author points to the incompatibility with the Constitution of Article 51 para. 1 subpara. 3 of the Act on Court Bailiffs and Enforcement insofar as it does not provide for a separate fixed fee rates for emptying the dwelling of the things or people in a situation in which the debtor, after being given notice by a bailiff, has voluntarily performed the obligation within the prescribed time period. The author points out that the definitive reason for finding the unconstitutionality of the provision in question is an internal inconsistency of the mechanism for determining the amount of an enforcement fee, the results of which are contrary to the basic principles of law and the structure of such proceedings as provided for in the Code of Penal Procedure, and at the same time violates the rights of the debtor, discouraging him, in fact, from voluntary performance of the obligation. In the author’s view, proceedings should be discontinued in relation to Article 51 para. 2 of the Act on Court Bailiffs and Enforcement, the remaining scope of the question of law should be left unexamined.

In the judgment of 17 July 2012 (No. P 30/11), the Constitutional Tribunal held that insofar as Tax Ordinance Art. 70 §6(1) resulted in suspension of the limitations period on a tax obligation in connection with initiation of a fiscal penal proceeding of which the taxpayer has not been informed, at the latest, by the end of the limitations period on the obligation indicated in Tax Ordinance 70 §1, Art. 70 §6(1) is inconsistent with the principle of the citizen’s trust in the state and the law established by the state, under Art. 2 of the Polish Constitution. On the merits, the judgment has to be viewed positively, as in practice the challenged regulation led to gross violations of the principle of citizens' trust in the state and law. Many doubts may arise, however, as to the effects of the judgment. In particular, the wording of the ruling and several statements contained in the grounds of the judgment may cause controversy as to whether the judgment causes effect only with regard to the provision as amended from 2002-2005 or also to the provision in the current version. Second, due to the fact that the challenged provision was not fully derogated by the Tribunal but only in the limited scope, the current legal status is not clear. Moreover, it seems that in order to increase the protection of taxpayers, the Tribunal should have pointed out that the unconstitutionality of the provision results not only from the fact that the taxpayer is not notified about the suspension of the limitation period but also from the fact that such suspension occurs after the initiation of the proceedings in the in rem phase. To avoid instrumental using of the institution of suspension of the limitation period by the tax authorities, the suspension effect should take place in the in personam phase.

The subject of this article is the institution of the constitutional complaint, which is analysed in connection with European integration. It should be noted that Poland’s membership of the European Union has had a great influence, not only on the system of national law, but also on the jurisprudence of the Polish Constitutional Tribunal; therefore considerations are carried out here mainly in relation to the Constitutional Tribunal.            In examining the issue of the constitutional complaint, the following assumptions may be stated. First, the constitutional-complaint procedure, is in fact, the examination of the compliance of legal norms with the Constitution, any deviation being related to the entities initiating proceedings before the Constitutional Tribunal, Article 191(1)(6), of the Constitution[1], and to the material scope of the complaint, as determined in Article 79 of the Constitution. Second, there is no doubt that the constitutional complaint can become an important legal instrument shaping the jurisprudence of the Polish Constitutional Tribunal, which has to face constitutional issues related to European integration[2]. Following the example of the practice of other Member States, e.g. Germany, the Tribunal may use the institution of the constitutional complaint as a means of controlling the compliance of the secondary law of the European Union with the Constitution of the Republic of Poland.   [1] The Constitution of the Republic of Poland, Journal of 2 April 1997, Journal of Law 1997, No. 78, item 483, as amended. W stanowisku do Trybunału Konstytucyjnego Sejm wniósł o uznanie przepisów ustawy, które normują zasady udostępniania pytań z Lekarskiego Egzaminu Końcowego, Lekarsko-Dentystycznego Egzaminu Końcowego oraz Państwowego Egzaminu Specjalizacyjnego, za niezgodne z Konstytucją. Będąca autorem wniosku Naczelna Rada Lekarska stwierdziła, że pytania egzaminacyjne z przywołanych egzaminów stanowią informację publiczną, do której dostęp gwarantowany jest konstytucyjnie. W stanowisku podzielono tę konstatację i argumentację NRL, stwierdzając, że zaskarżone przepisy nie spełniają warunków zasadności ograniczenia dla ochrony porządku publicznego czy praw innych osób.

In this position the Polish Sejm declares Article 26, para. 1 of the Act on Fire Protection to be consistent with the constitutional principle of social justice laid down in Article 2 and Article 32 para. 1 of the Constitution. In support of this argument, it was considered that a volunteer firefighter who, in connection with participation in the rescue operations or exercises, has suffered bodily injury and became temporarily unable to work, is entitled to sickness benefit equal to 80% of the base amount, and not – like members of professional firefighting units – up to 100% of the base amount of sickness benefit for an accident at work. Members of VFBs do not practice the profession of firefighter and, therefore, are not entitled to the accident insurance that guarantees 100% reimbursement of lost earnings in the event of an accident at work. In the author’s view, Article 32 para. 3 subpara. 2 of the Act on Fire Protection provides that the municipality is obliged to insure members of the volunteer fire department, therefore on a normative level their insurance is considered as sufficient.

The subject of the assessed constitutional complaint is the problem of the lack of standards specifying the procedure for returning property that has not been finally used for public purposes in the event of deprivation of property rights on the basis of the special road statute. The applicants point out, inter alia, that the diversity of the legal situation of former owners of the expropriated property and owners of property taken over as a result of the decision to authorize road construction works violates the principle of equality before the law and the prohibition of discrimination in political, economic or social life. It was applied that the questioned provision of the Act on Specific Principles for the Preparation and Realisation of Investments Regarding Public Roads, to the extent that it excludes the possibility of an appropriate application of the provisions of the Act on Real Estate Management to real estate taken over under the former of these acts, does not conform to the Constitution.

This draft position of the Sejm concerns the constitutional complaint of 7 July 2015. In the proposed draft position the author claims that the contested Article 136 paras. 3 and 4 of the Act on Real Property Management insofar as it does not provide for the right of the previous owner to demand the return of the property acquired by the State Treasury or a municipality by way of a civil contract, concluded into in the course of the negotiations preceding the initiation of the expropriation, if the property has become unnecessary for a public use, is incompatible with Article 21(2) and Article 64(1) and (2) in conjunction with Article 32 (1) of the Constitution. The procedure for the remainder should be discontinued pursuant to Article 40(1)(1) of the Constitutional Tribunal Act of 2015 due to the inadmissibility of the judgment.

The author of the draft position regarding the constitutional complaint argues that the indicated provision of the Tax Ordinance Act conforms to the Constitution to the extent that it results in the suspension of the limitation period for tax liability as a result of initiating proceedings for a tax crime in a situation where, as a result of court proceedings, an acquittal was issued for the benefit of the accused. The contested provision does not infringe the constitutional principles of equality and property rights and its aim is to bring about the fulfillment of one of the fundamental constitutional duties of an individual, namely the participation in the costs of functioning of the state through payment of due tax liabilities.

In the proposed draft position the author claims that the challenged provisions do not exclude the possibility of participating in the meeting of the appellate court. However, admitting the possibility of limiting the participation of the accused, or his counsel, in such meetings of appellate court, they affect the scope of use of that right. This matter affects both the right of the defense in both the material sense (attending the meeting) and the formal one (limitations on actions of the defender). One should recognize that the provisions at issue, as far as they do not guarantee the accused or his counsel the right to participate in the meeting of the court hearing the interlocutory appeal against the ruling on the application, repeal or change of preventive measures other than pre-trial detention and property collateral, is incompatible with the provisions of the Constitution. According to the author, it is also reasonable to apply for discontinuance of the proceedings in relation to the remaining scope of the application due to the inadmissibility of rendering the judgment.

The paper concerns the concept of overpayment made as a result of a judgment delivered by the Constitutional Tribunal in reference to Article 72 and 74 of the Tax Ordinance Act. Although the doctrine and the judicature of administrative courts view overpayment under Article 74 as stemming from Article 72 of the Tax Ordinance Act, there are certain distinct features of the two. Taking into consideration the potential effects of the judgment of the Polish Constitutional Tribunal, a tax paid when the legal footing of this tax was in existence is considered as being due at the date of payment. A distinction is made between overpayment stemming from article 74 and overpayment stemming from article 72. The latter features a lack of legal footing for tax payment. This distinction also has further implications and consequences.
Artykuł poświęcony jest analizie pojęcia „nadpłata powstała w wyniku orzeczenia Trybunału Konstytucyjnego”, w tym w szczególności różnicy między nadpłatą z art. 72 Ordynacji podatkowej (o.p.) i nadpłatą z art. 74 o.p. Brak rozróżnienia istoty obu nadpłat powoduje poważne trudności w określeniu ich skutków, co widoczne jest obecnie w orzecznictwie sądów administracyjnych. Ponieważ brak definicji „nadpłaty powstałej w wyniku orzeczenia TK”, próba wskazania jej natury prawnej wymaga przede wszystkim uwzględnienia skutków wyroków Trybunału Konstytucyjnego, określonych w art. 190 ust. 1, 3 i 4 Konstytucji RP. Z powołanych przepisów Konstytucji wynika, że w polskim porządku prawnym wyroki Trybunału mają charakter konstytutywny i działają ex nunc, a więc wywołują skutek na przyszłość. Oznacza to, że do chwili ogłoszenia przepis uznany za niekonstytucyjny obowiązywał w systemie prawa i wywierał skutki prawne. W konsekwencji wynika z tego, że podatek uiszczony na podstawie przepisu, którego zgodność z Konstytucją zakwestionował Trybunał, był w momencie zapłaty podatkiem należnym. Nie można zatem uznać, że – tak jak w wypadku nadpłaty z art. 72 o.p. – mamy do czynienia ze świadczeniem nienależnym, uiszczonym bez podstawy prawnej. Wręcz przeciwnie: podstawa taka istniała, korzystała z domniemania konstytucyjności i nie odpadła z mocą wsteczną. Artykuł 74 o.p., który w zakresie pełnionych funkcji stanowi realizację art. 190 ust. 4 Konstytucji RP na gruncie Ordynacji podatkowej, stanowi podstawę odrębnego roszczenia o zwrot uiszczonego podatku.

In his position, the Sejm requested the Constitutional Tribunal to state that to the extent, in which provisions of the Code of Civil Procedure provide for a three-month period for filing complaint concerning the resumption of proceedings in case the judgment was based on a counterfeit or falsified document, and to the extent that the failure to meet this deadline results in the rejection of the complaint, conform to the Constitution. In the opinion of the Sejm, an allegation of a disproportionately short deadline is unjustified, as the deadline of three months to perform a specific procedural activity is one of the longest ones provided for in the Polish civil procedure and does not differ from the ones provided for in the civil procedural laws of other European countries. The practice of application by common courts of the provision in question also justifies the position indicating conformity to the Constitution.

The Sejm’s position is that the examined provision of the Act, which is being challenged by over a dozen communal and city councils, is in compliance with the principles of: non-retroactivity of the law, protection of trust towards the state and statutory law and constancy of tax law during a tax year, which are derived from the Constitution. The applicants demanded an examination of the constitutionality of the provision providing for a retroactive entry into force of the provisions giving new wording to the articles and the appendix to the Construction Law Act and the Act on Investments in Wind Farms. These provisions concern changes in the scope of the real estate tax on wind farms, which is the source of income for local self-government units. In the justification of the position, it was stated that the withdrawal from the cited constitutional principles is motivated by values approved in the Constitution.

In its jurisprudence, the Constitutional Tribunal of the Republic of Poland often uses the comparative law method. For it, comparative material is not only the normative acts in force in other countries, but also foreign jurisprudence. This article presents the results of a quantitative and qualitative study of the judgments of the Polish Constitutional Tribunal in terms of the presence of references to the judgments of other constitutional courts. Reference by the Tribunal to foreign constitutional jurisprudence is a relatively rare practice, but not an occasional one. It was intensified after Poland’s accession to the European Union. Although the main point of reference for the Tribunal in its comparative analysis is still the jurisprudence of the German Federal Constitutional Court and constitutional courts of other Western countries, it also increasingly frequently reaches to the judgments of the constitutional courts of Central European and Baltic countries. The subject issue is part of the progressive process of the so-called transnational judicial discourse or judicial globalization. The reluctance of the Tribunal to reach in its rulings to judgments of foreign constitutional courts, which has been observed since 2017, may be the beginning of its assumption of an exceptionalistic attitude similar to the U.S. Supreme Court.

Opis:
Provisions of the Act on Pensions from the Social Insurance Fund are contested by a citizen in an the extent that they grant the right to working disability pension not earlier than from a month in which the application was submitted, conform to the Constitution. A contradiction with Article 67 para. 1 of the Constitution, is perceived by the complainant in the assumption that the date from which the claim for payment of social security benefits may be requested, is the date of submission of the application instead of the date of an invalidity and the resulting working disability. In the complainant’s case there was a large difference between the time when the terms of acquiring the right to a pension were fulfilled and the moment in which when the application for the benefit was submitted. The legislator, in the case of retirement benefits, including permanent disability pensions, assumed as a rule that the right to retirement and working disability benefits arises from the date of meeting the conditions required to acquire that right

The position of the Sejm of the Republic of Poland concerns Article 207 § 3 second sentence in conjunction with § 7 of the Code of Civil Procedure (CCP), establishing a procedure for consent by order of the president for bringing further writings preparatory to pleading in the course of the case, and Article 207 § 4 CCP which provides the possibility of an oral hearing of the parties in closed session before the first hearing, if the president call upon the parties to submit additional clarification on the issue, in terms of their compliance with Article 45 para. 1 of the Constitution, which establishes the right to a court hearing. In the author’s view, there should be declared compliance of the above provisions of the Act with the Constitution because in the challenged Article 207 § 4 CCP the lawmaker uses the plural to describe the addressee of the norm, so from this provision it follows an obligation to inform about the meeting and the possibility of participation of both parties, as well as entities acting as a party. Moreover, in support of the declaration of compliance of Article 207 § 3 the author presents the fundamental principles of civil process, such as the concentration of the evidence, judicial consideration of the case without undue delay, and the duty of the court and the parties to smoothly and timely completion of the proceedings. Motion has been made for cancellation of the case due to inadmissibility of the judgment on the basis of Art. 39 para. 1 subpara. 1 of the Constitutional Tribunal Act.

In the proposed draft position the author claims that the challenged provisions of the Act of 13 October 1998 on Social Insurance, insofar as it takes no account of the situation in which the day of death of the decedent was considered to be the date when the court decision declaring the person (for whom social security contributions were collected) dead was made, do not conform with the Constitution. In her opinion, in order to achieve compliance of the above-mentioned Act with the Constitution it would be sufficient to take into account – as a precondition – the suspension of the limitation period due to the death of the decedent. The author notes that in would be at risk of irrationality for the Constitutional Tribunal to adjudicate on both examined provisions, as it is difficult to consider the issue of suspension of the limitation period in relation to the claim for undue contributions when the limitation period has not yet started.

The proceedings before the Constitutional Tribunal in this case were initiated by a group of Deputies who questioned the constitutionality of some provisions of the Act of 21 June 2013 amending the Act on the Office of the Minister of National Defence and other acts. The Sejm did not share the arguments of the applicant. The abolishment of the posts of the commanders of the Army, Air Force, Navy and Special Forces (and their corresponding commands) accompanied by the creation of the posts of General Commander of the Branches of the Armed Forces and Operational Commander of the Branches of the Armed Forces is within the regulatory discretion of the legislature. The constitutional position of Chief of General Staff has not weakened, and the changes resulting from the Amending Act do not go beyond the framework set by the relevant constitutional provision. Entrusting to the President of the Republic of the competence to appoint – at the request of the Prime Minister – a person “designated for an appointment as Commander‑in‑Chief of the Armed Forces” has a strong constitutional grounds and ensures efficient procedure for filling the position of Commander‑in‑Chief for a period of war. In addition, the procedure in which the amendment was made did not infringe the principle of proper legislation.

The presented gloss, addressing the judgement of the Constitutional Tribunal, file ref. no. P88/08, issued on November 10, 2009, concerning the decision under art. 28 para. 1 of the act of 28 February 2003 (Bankruptcy and Reorganisation Law) [referred to as BRL] as regards the debtor who is not using an advocate or legal counsel, demonstrates inconsistency of art. 28 para. 1 of the above law with art. 45 and art. 32 para. 1 of the Constitution. The Speaker of the Sejm, Public Prosecutor General and the Research and Analysis Bureau have presented their positions approving the compliance of art. 28 para. 1 BRL with art. 32 para. 1 and art. 45 para. 1 of the Constitution. The Constitutional Tribunal draws attention to numerous formal requirements, especially concerning the bankruptcy petition filed by the debtor. The Tribunal argues that the right to trial may be infringed not only directly, but also indirectly as a result of the procedural requirements being formed by the legislator in the manner which makes the initiation of the proceedings excessively difficult. Subsequently, the Tribunal points out that excessive strictness connected with considerable formalism of petitions for bankruptcy does not fulfil a compensatory function, and does not satisfactorily protect the debtor and his undertaking. In the context of professional representatives, the Tribunal expresses its position on the professional skills that assure professional legal service in court proceedings. The Constitutional Tribunal drew a distinction between debtors having a professional representative and debtors acting on their own, by defining a relevant feature that allows to separate a group, as a consequence the provision in question does not fulfil the constitutional requirements in art. 45 para. 1 of the Constitution. As regards art. 32 of the Constitution, the Constitutional Tribunal presents the view that with considerable complexity and strictness connected with the lack of representation, in a concrete case the constitutionally guaranteed rights may be infringed. As part of the judgement of the Constitutional Tribunal, a separate statement was made in the part concerning the compliance of art. 28 BRL with art. 45 para. 1 of the Constitution. The presented gloss shares the argumentation observed by the Constitutional Tribunal, at the same time considering the public interest, negative results of the late submission of the bankruptcy petition, pointing to the legislator that greater protection of entrepreneurs debtors may be considered.

Artykuł przedstawia opinie Europejskiej Komisji na rzecz demokracji przez prawo (Komisji Weneckiej)  oraz orzecznictwo polskiego Trybunału Konstytucyjnego w czasie kryzysu  konstytucyjnego; następnie przedstawione zostały poglądy doktryny polskiego prawa konstytucyjnego na temat  art. 197 i art. 195 ust. 1 Konstytucji RP z 2 kwietnia 1997r. Zdaniem autora mamy do czynienia z różnicą stanowisk  pomiędzy stanowiskiem TK, w szczególności zajętym w wyrokach w sprawach K 34/15, K 35/15, K 47/15, K 39/16   a poglądami doktryny. W związku z powyższym na tytułowe pytanie można odpowiedzieć: formalnie - tak, praktycznie - niekoniecznie.
Article presents opinions of European Commissions For Democracy Through Law (Venice Commissions) and jurisprudence of the Polish Constitutional Tribunal in time of constitutional crisis; next there are identified position of doctrine polish constitutional law regarding Article 197 and Article 195 ust. 1 of the constitution of the Republic of Poland of 2 April 1997. In author’s opinion, we deal with difference of position among position of TK, particularly in sentences occupy as cases no. K 34/15, K 35/15, K 47/15, K 39/16, K 44/16, but views of doctrines. By reason of above-mentioned it is possible to answer on title question: formally – yes, practically – not necessarily.

When examining the constitutionality of the contested Article 62 para. 1 and Article 63 para. 1 of the Preventing Drug Addiction Act, the author assumed that those provisions do not directly interfere with the freedom of religious practice. Therefore, such provisions to the extent that they relate to cannabis other than fiber hemp, are not incompatible with Article 53 para. 1 and para. 2 of the Constitution. It was also considered that the contested provisions do not apply to the medical use of narcotic drugs and can not be assessed in the context of Article 68 of the Constitution. Moreover, it was noted that the objectives of the prohibitions set forth in the challenged provisions can be considered justified by the guarantee of healthcare derived from the Constitution, indicating the usefulness of the contested regulation because of the general requirements of prevention and the duty of adequate protection of constitutional values. It is also claimed that restriction of access to medicinal products cannot be regarded as inconsistent with the prohibition of degrading treatment, which means that the above mentioned provisions are in conformity with Article 40 of the Constitution.

The recent legal changes pertaining to the institution of the Constitutional Tribunal arouse many controversies. This paper presents a sociological and legal study conducted to collect and examine the opinions regarding the above held by Polish lawyers who because of their profession and experience are in a position to confront directly the legal practice with the changing legal system that is directly responsible for the level of protection of individual rights and the exercise of individual fundamental rights. From the point of view of rationality and functionality of the operations of the Constitutional Tribunal an opinion formulated by jurists who due to their background have greater legal awareness seemed invaluable. After all it will be their opinion which will decide about the future of the judiciary in Poland. The results of the current transformations being implemented in constitutional judiciary as well as at the level of common courts have consequences for all the citizens. The aim of the questions asked in the survey was to fi nd how lawyers in Poland saw the situation with the Constitutional Tribunal today as well as what the though it its regime and functioning could be like in the future. Questions also concerned the current and actual legal status of the Tribunal and the lawyers’ reactions to the changes being implemented or about to me made, and if possible the possible ways of ending the current Constitutional Tribunal crisis.

In this study, which is based on the position of the Sejm regarding a case pending before the Constitutional Tribunal, the analysed provisions are confronted with the principle of the specificity of legal provisions. The content of this principle is indeterminate, and the test of the specificity of legal provisions, which is a tool for assessing compliance with the principle in question, leaves a significant interpretative margin to the Constitutional Tribunal. The Tribunal’s ruling on the incompatibility of legislation with the principle of the specificity of legal provisions should be a measure of last resort, applied when other interpretative methods are insufficient. This is not the case in the case in question.

The position of the Sejm regarding the motion of the First President of the Supreme Court stresses that the provisions of the Act on Vehicle Drivers and the Penal Code which are referred to the Constitutional Tribunal’s review are inconsistent with provisions of the Constitution. The challenged provisions concern the powers of the poviat (district) starost to issue an administrative decision to withhold a driving licence or a permit to drive a tram in specific cases. In its position, the Sejm shared the opinion of the proponent that the assessed norms deprive vehicle drivers accused of violating traffic regulations of the possibility to challenge the correctness of the actions of the control body. Such legal conditions violate the principle of loyalty of the state towards an individual, who, in such a case, is in practice dependent on the arbitrary judgement of the controlling body.

This study is devoted to the analysis of the provision of Article 193 of the Constitution of the Republic of Poland, which authorizes each court to submit a legal question to the Polish constitutional court about the compliance of a normative act with the Constitution, ratified international treaties or the act, if the answer to a legal question depends on the resolution of a case pending before the court. It is worth considering the expectations and directions of changes of the analyzed institution against the background of the applicable legal provisions. The practice of applying a legal question to the Constitutional Tribunal needs to be examined. During these more than thirty-five years, the constitutional measure has undergone some transformations. The main goal of this work is to assess the title legal question through the prism of over three decades of its operation.
Niniejsze opracowanie poświęcone jest analizie przepisu artykułu 193 Konstytucji RP, który upoważnia każdy sąd do skierowania do polskiego sądu konstytucyjnego pytania prawnego o zgodność aktu normatywnego z Konstytucją, ratyfikowanymi umowami międzynarodowymi lub ustawą, jeżeli od odpowiedzi na pytanie prawne zależy rozstrzygnięcie sprawy toczącej się przed sądem. Warto zastanowić się na tle obowiązujących przepisów prawnych, jakie są oczekiwania i kierunki zmian analizowanej instytucji. Zbadania wymaga praktyka stosowania pytania prawnego do Trybunału Konstytucyjnego. Przez te ponad trzydzieści pięć lat konstytucyjny środek prawny uległ pewnym przeobrażeniom. Trzeba zauważyć, że obecnie omawiana instytucja jest uregulowana ustawą zasadniczą, a nie ustawą. Zasadniczym celem niniejszej pracy jest ocena tytułowego pytania prawnego przez pryzmat ponad trzech dekad jego funkcjonowania.

The request of a group of Deputies concerned the assessment of the constitutionality of the provisions of the act, according to which the termination of pregnancy may be performed by a doctor in the event when prenatal tests or other medical conditions indicate a high probability of severe and irreversible fetal impairment or an incurable life-threatening disease; in this case, termination of pregnancy is permissible until the moment of fetus becoming able to live independently outside of the pregnant woman’s body. In the position of the Sejm, it was requested that this provision be declared inconsistent with Article 38 of the Constitution in connection with the principle of specificity of legal provisions, derived from Article 2, Article 30, Article 31 para 3 and Article 32 para 1 of the Constitution.
