Opis:
The article concerns the problem of determining the relationship between the Polish Act on Combating Unfair Competition of 1993 and the Polish Act on Combating Unfair Market Practices of 2007. The problem arose when the Unfair Commercial Practices Directive was implemented in the Polish system in 2007. The Directive is based on the division, which was not known in the Polish Act on Combating Unfair Competition, relating to business-to-business (B2B) and businessto-consumer (B2C) relationships. The adoption of such an artificial division has raised numerous problems of interpretation. A better solution would be to adopt in subsequent legislative works the criterion of protected interests, which are the basis of each of the analysed legal acts. Consequently, it will be necessary to introduce legislative changes to the Polish Law on Combating Unfair Competition.

Terrorism is a phenomenon connected with using violence by people, national groups and criminal organizations in order to achieve political, social and economic targets. It has been present in the life of man since the beginning of the civilization. Internationalization of terrorist actions has consistently introduced humanity into the age of terrorism. The 1990s and the beginning of the 21st century have brought an uncontrolled outbreak of world terrorism, whose background has been Islamic radicalism. Terrorist attacks in New York, Bali, Istanbul, Madrid and London continue to be a proof that terrorist groups have great resources, owing to which they can put their plans into effect. Gathering funds designed for terrorist activities in the world of Islam is done in a lot of ways. One of the most effective ones is using the havala system of transferring money without actually moving it and without any traces left on paper. Apart from that financial means are gathered by Islamic banks, charity organizations, and also achieved in the criminal way: smuggling and drug producing. Preventing the practice of financing terrorism is one of the main tasks of the United Nations Organization, however, despite the fact of passing the Convention and numerous resolutions condemning international terrorism there are no determined actions aimed at eradication of the practice. Weakness of the UN was revealed when they did not assume a determined attitude towards the invasion of Iraq by the United States and its allies, which resulted in destabilization of the situation in the Middle East and gave the terrorists a perfect training ground for the struggle against the West. Globalization of Islam leads to internationalization of jihad, and effects of this process were revealed both in Madrid in 2004 and in London in 2005. Hence it seems that the war against terrorism has to be waged on two levels: a short-term one, that is conducting military, political and financial actions in order to prevent terrorist attacks, and a long-term one – effecting democratic changes and preventing internationalization of jihad. This is the only chance to stop terrorist offensive by Islamic groups.

Dzięki wielu zaletom – łatwości komunikacji, szybkości i wygodzie zakupów, dostępowi do administracji publicznej czy bankowości elektronicznej – Internet stał się ważnym elementem naszego życia. Jest on jednak również polem działalności przestępców, których ofiarami są nie tylko instytucje, ale i obywatele. Ze względu na rosnącą skalę tego zjawiska Najwyższa Izba Kontroli sprawdziła, czy w latach 2019–2021 państwo prowadziło skuteczne działania pozwalające zidentyfikować, zapobiegać oraz ograniczać skutki przestępstw internetowych1 . Przedmiotem kontroli były te wymierzone w indywidualnych użytkowników Internetu, niosące dla nich ryzyko strat finansowych. Sprawdzono cztery podmioty: Ministra Cyfryzacji (dalej Minister), Pełnomocnika Rządu ds. Cyberbezpieczeństwa (dalej Pełnomocnik Rządu), Komendę Główną Policji (KGP) oraz Naukową i Akademicką Sieć Komputerową – Państwowy Instytut Badawczy (NASK). Ustalenia NIK wskazują, że skoncentrowały się one na ochronie instytucji i systemów kluczowych dla funkcjonowania kraju. Jednocześnie pomijały obywateli, którzy w okresie wzmożonej działalności cyberprzestępców byli zdani tylko na siebie.
Due to its numerous advantages such as easy communication, speed and comfortable shopping, access to public administration or electronic banking – the internet has become an important element of our lives. It is, however, also an area for criminals, whose victims are both institutions and citizens. Taking into account the growing scale of this phenomenon, the Supreme Audit Office examined whether in the years 2019–2021 the State took effective measures that would allow to identify, prevent or reduce the consequences of internet crime. The audit covered the crimes targeted at individual users of the internet, which may bring financial loss risks. Four entities were audited: the Minister of Digitalisation, the Government Proxy for Cybersecurity, the Police Headquarters and the Scientific and Academic Computer Network – the State Research Institute. The findings of the NIK audit show that these entities focused on protection of the systems of key importance for the State. Simultaneously, they ignored citizens who, at the time of increased activities of cybercriminals, were left alone.

The National Programme for Combating Cancer for the years 2006−2015 (NPZChN) has been implemented by the Minister of Health on the basis of Article 4 of the Act of 1st July 2005 on adopting the multiannual NPZChN programme. The objectives of the programme that have been set in the Act, have not been achieved so far. NIK has for a long time called for considering some new methods that would allow for increasing the number of women participating in cancer screening, and that would provide immediate access to treatment. The indicators for early cancer detection and effectiveness of treatment are still much lower than the European averages. The Minister of Health did not provide conditions for effective achieving of the programme objectives, he did not have sufficient information on the activities of various entities that deal with cancer prevention and treatment, and he did not create an effective system for cooperation and data exchange among these entities. The effectiveness of preventive tests was low due to the low turnout of women for smear tests and mammographic tests.

The subject of this article is combating adult illiteracy in the People’s Republic of Poland. The existing knowledge concerning the topic has been supplemented with the analysis of the archival documents, currently being in possession of the Central Archives of Modern Records in Warsaw. It describes how illiterates were recognised in the society, in what way they were encouraged to train new skills and how attending the courses was made possible for them. The analysed documents include censors’ reviews of manuals, press articles, letters wrote by former illiterates and other valuable records. The communists were combating illiteracy not only in the name of the social progress, but mostly motivated by their quest to broaden the possibilities of ideological indoctrination – during the courses organised for illiterates and later on. This is why the selection of manuals and other publications addressed to former illiterates was propagandist. The strategic importance of the matter was expressed by Vladimir Lenin himself: “Socialism cannot be built by illiterates” (W. Ozga, Education in the six-year-plan and the revolutionary changes of the society and economics in the People’s Republic of Poland, Warsaw 1951, p. 124).

The article deals with an important issue of corruption in Poland. The author defined the phenomenon of corruption and pointed out its characteristics. Then the overview of competence scopes of entities involved in combating corruption in Poland was carried out, i.e. the Police, Central Anticorruption Bureau and Internal Security Agency as well as fiscal control bodies. In the summary the author made some significant generalizations, pointing out to overlapping in the range of competence and the need to amend legislation in this area.

The article includes issues related to counteracting and combating terrorist financing in Poland in the context of existing threats. The regulations in force on the international level, and provisions governing these issues in the Polish legal system are both discussed. Based on data from the General Inspector of Financial Information (Generalny Inspektor Informacji Finansowej), the Ministry of Justice and National Prosecutors’ current efforts to combat the practice of the terrorist financing in Poland are summarised. The article shows the potential hazards for terrorist organisations, who use gaps in the Polish system to make attempts to transfer money for criminal practices. One aim of the publication is to attempt to answer the question whether Poland, to a sufficient degree, is prepared for combatting terrorist financing and whether it is able to do it effectively, taking into consideration the scale and character of existing threats.

Administracyjne podejście do przestępczości zorganizowanej polega na wykorzystywaniu prawnoadministracyjnych instrumentów w celu eliminowania lub ograniczania sfer aktywności przestępczej. Stanowi ono subsydiarne narzędzie względem innych metod walki z tego rodzaju przestępczością i wpisuje się w ideę zintegrowanego podejścia do przestępczości zorganizowanej, zakładającego z jednej strony pogłębianie wzajemnej współpracy między organami ścigania, z drugiej zaś uwzględniającego uzupełniające znaczenie metod alternatywnych, zakładających bezpośrednią współpracę organów ścigania z podmiotami zewnętrznymi. Rozwijanie metod administracyjnych, wskazywanych na forum Unii Europejskiej jako kluczowe dla wzmocnienia zdolności poszczególnych krajów w zakresie przeciwdziałania i zwalczania przestępczości zorganizowanej, wiąże się z istotnymi wyzwaniami, w tym w kontekście zróżnicowanego poziomu rozwoju tego rodzaju instrumentów w poszczególnych państwach oraz rzeczywistego stosunku służb do korzystania z tego rodzaju instrumentów. Mając powyższe na uwadze, w okresie polskiego przewodnictwa w Radzie UE Polska zaangażowała się w popularyzowanie administracyjnych metod przeciwdziałania przestępczości na forum unijnym. Przejawem tych działań był aktywny udział w Nieformalnej Sieci ds. Administracyjnego Podejścia do Przeciwdziałania i Zwalczania Przestępczości Zorganizowanej oraz w pracach nad utworzeniem, w ramach wirtualnej Platformy Ekspertów Europolu, praktycznego narzędzia współpracy w postaci strony dedykowanej temu zagadnieniu.
The administrative approach in preventing and combating organized crime involves the use of administrative legal instruments to eliminate or reduce criminal activity. It is a tool subsidiary to other methods of combating crime. It also corresponds with the concept of an integrated approach to organized crime, which includes, on the one hand, tightening the cooperation between law enforcement and, on the other hand, the use of alternative methods, provided that law enforcement authorities and external entities cooperate directly. The development of administrative methods of preventing and combating organized crime, has been considered by the EU as crucially important in strengthening the capacities of individual countries to prevent and combat organized crime. However, this also entails considerable challenges, especially when it comes to various levels of development of these methods across the EU as well as their actual use by law enforcement authorities in various EU countries. Therefore, Poland, during its EU Presidency, was engaged in promoting the development of administrative methods aimed at preventing and combating organized crime by active participation in the Informal Network of Contact Points for Administrative Approach in Preventing and Combating Organized Crime as well as in the development of a practical tool of cooperation on the Europol Platform For Experts.
