Quantification of harm is regarded as one of the most significant obstacles for the full compensation of harm and development of private enforcement within the European Union, including CEE Member States. Consequently, the Damages Directive establishes general rules and requirements for the quantification of harm, such as a rebuttable presumption of harm in case of cartels, the power of national courts to estimate harm as well as others, which closely interact with the principle of full compensation emphasized by the case-law of the European Union and directly established in the Damages Directive. The main focus of this paper is the effectiveness of the rules on the quantification of harm in general, and how these rules will contribute to the development of private antitrust enforcement in CEE Member States. Therefore, one of the issues to be discussed in the paper is the analysis of how, and to what extent specific rules and requirements for the quantification of harm have been transposed into the national legislation of CEE Member States. As certain CEE national jurisdictions have had certain rules for the quantification of harm already before the implementation of the Damages Directive, the paper analyses how effective these rules have been, and how much they have contributed to the development of private antitrust enforcement of those CEE national jurisdictions. Previous experience of those CEE Member States in applying specific rules for the quantification of harm is important, in order to assess the possible impact of the newly introduced rules on the quantification of harm and on private antitrust enforcement in general in other CEE Member States. The rules for the quantification of harm will not enhance private antitrust enforcement on their own, however, their effective application by national courts together with other rules under the Damages Directive should contribute to a quicker development of private enforcement in CEE Members States.

The paper reviews literature on theories of harm in digital markets, and the specific difficulties in quantifying the damage in private enforcement of competition law. The development of a tentative case-law on private enforcement in digital markets in the European Union is studied next, in comparison to the US antitrust practice, differentiating between businesses or consumers filing damages claims. Finally, the paper raises the specific issues posed by the digital economy for competition law claims for damages, and explores the idea of extending the presumption of harm also to abuse of dominance in digital markets, as well as making private parties aware of cease and desist injunctions or filing for private enforcement remedies.
L’article examine la littérature sur les théories du préjudice dans les marches numériques ainsi que les difficultés spécifiques liées à la quantification du dommage dans le cadre d’une action en dommage concurrentiel. Ensuite, le développement timide d’une jurisprudence des actions privées sur les marches numériques dans l’Union Européenne est étudié en comparaison avec la pratique antitrust américaine, en faisant la distinction entre les plaintes introduites par des entreprises ou des consommateurs. Enfin, le document soulève les problématiques spécifiques à l’introduction d’actions en dommages et intérêts concurrentiels sur les marchés numériques, et explore les propositions suivantes : étendre la présomption du dommage aux abus de positions dominantes sur les marchés numériques, inciter les parties privées à requérir des injonctions et encourager la mise en oeuvre de remèdes dans le cadre d’actions privées.

The European Commission published a White Paper on 2 April 2008 on damages actions for breach of EU antitrust rules. The content of the White Paper is since then being prepared to be converted into EU legislation on private antitrust enforcement. This paper presents the developments in private antitrust enforcement in Poland after 2 April 2008. It commences with an outline of EU actions in this field which act as an introduction to the more detailed analysis of recent jurisprudential and legislative developments in Poland. The latter part of the paper covers, in particular, the 2009 Act on the Pursuit of Claims in Group Proceedings and the 2011 Act Amending the Civil Procedure Code and Some Other Acts which abolishes all specific elements of commercial proceedings, including the statutory ‘non-admission of evidence’ principle. These two legal acts are assessed in order to establish whether their introduction is likely to help facilitate private antitrust enforcement in Poland and to consider to what an extent are these developments responding to the challenges outlined by the European Commission.
Le 2 avril 2008 la Commission européenne a publié le Livre blanc sur les actions en dommages et intérêts pour infraction aux règles communautaires sur les ententes et les abus de position dominante. Le contenu du Livre blanc est dès lors en cours de préparation pour être converti en législation de l'UE sur l’application des règles de la concurrence par des particuliers. Cet article présente le dévelopement de l’application des règles de la concurrence par des particuliers en Pologne après le 2 avril 2008. Il commence par un aperçu des actions de l'UE dans ce domaine qui agit comme une introduction à l'analyse plus détaillée de la jurisprudence récente et les évolutions législatives en Pologne. Cette dernière partie du document porte, en particulier, sur la Loi de 2009 sur la poursuite des revendications dans les procédures collectives et la Loi 2011 modifiant le Code de procédure civile et certaines autres lois qui abolisent tous les éléments spécifiques de la procédure commerciale, y compris le principe de «non-admission de la preuve». Ces deux actes juridiques sont évaluées afin de déterminer si leur mise en place pourrait faciliter l’application des règles de la concurrence par des particuliers en Pologne et d'examiner à quel point ces développements répondent aux défis formulés par la Commission européenne.

The article gives an overview of Ukrainian legislation and experiences concerning antitrust damages actions. The analysis has led to a number of conclusions: private claims are rare in Ukraine due to difficulties in obtaining evidence, high legal costs, and lacking confidence in the Ukrainian court system. The paper gives examples of Ukrainian private antitrust enforcement practice and provides a statistical analysis of the dynamics of ‘compensated’ damages caused by antitrust infringements in Ukraine. The value of ‘compensated’ damages is compared to the value of the economic effect of stopping antitrust infringements, as well as to the value of the overall welfare loss deriving from market power in the national economy. Finally, some new sources of damages caused by market power are discussed considering the development perspectives of this branch of antitrust activity.

Despite the fact that the right to full compensation of harm caused by the breach of Articles 101 and 102 TFEU was confirmed in European Union jurisprudence many years ago, and that actions for damages for competition law infringements were admissible in Poland also before the transposition of Directive 2014/104/EU (hereinafter, the Damages Directive), the number of reported court cases regarding private enforcement of competition law is very low. The commented judgment of the Court of Appeals in Cracow (Sąd Apelacyjny w Krakowie) of 10 January 2014 is one of the very few judgments of Polish courts regarding actions for damages for an infringement of competition law.

This paper will analyze the impact of the modernized approach to Article 102 TFEU on the application of the prohibition of dominant position abuse contained in Polish competition law. For that purpose, several questions will be answered. Has the consumer-welfare standard already become, or will it become (in particular under the influence of the effects-based approach), the decisive criteria for the finding of a violation of Article 9 of the Polish Competition Act as well as its past equivalents? Will EU’s new approach to the abuse of dominance lead to a re-orientation of the goals pursued by Polish competition law on unilateral conduct? Has Polish enforcement practice attached as much emphasis to the protection of market structures as some EU cases that might have justified the accusation of over-enforcement? Has the recent reform introduced any new requirements, standards or tests in the procedural dimension of the application of the ban on the abuse of dominance and if so, to what an extent will they influence the traditional approach employed by Polish antitrust and judiciary institutions? In order to answer these questions, relevant Polish legislation and case-law will be analyzed. The article will try to establish the actual scope of the change relating to substantive as well as procedural rules which will (or should) affect the enforcement of Article 9 of the Polish Competition Act under the impact of the new EU approach.
Cet article a pour but d’analyser l’impact de l’interprétation modernisée de l’article 102 TFUE sur l’application de l’interdiction de l’abus de position dominante dans la loi polonaise. Dans ce but, nombreuses questions seront adressées. Par exemple, le bien être des consommateurs, est-il déjà, ou sera-t-il dans le future (en particulier, sous l’influence de l’approche fondée sur les effets), le critère décisif pour constater une violation de l’article 9 du Droit de la concurrence polonais, aussi que leurs équivalents? La législation polonaise et la jurisprudence seront analysées. Cet article tente d'établir l'étendue actuel des changements relatifs aux règles substantives et procédurales, qui affectent (ou devraient affecter) le renforcement de l’article 9 du Droit de la concurrence polonais sous l’influence de la nouvelle approche de l’UE.

Ever since the Croatian Competition Agency started functioning in 1997, public enforcement of competition law has been the norm. Civil actions for breaches of competition law have been the exception in Croatia. The existing legislation in the area of competition law makes no effort to incentivise private enforcement. There are no specific rules in the Competition Act 2009 dedicated to civil actions, except a single provision that assigns jurisdiction over damages claims to commercial courts. General tort law is applicable in order to prove damages. A number of issues arise here mostly due to the complexity of competition cases. These issues were described in the European Commission’s White Paper on Damages Actions for Breach of EC Antitrust Rules (2008). The level of uncertainty as regards the outcome of the claim is high. It seems that special rules need to be adopted in Croatia in order to improve the position of the injured side. The paper deals with a number of procedural and substantive law issues relevant to the facilitation of civil proceedings for antitrust damages. A domestic law perspective is applied taking into account recent developments in EU competition law and policy.
Depuis 1997 quand l'Agence croate de la concurrence a commencé à fonctionner, l'exécution publique de droit de la concurrence a constitué la norme. Les actions civiles pour violation du droit de la concurrence ont été une exception en Croatie. La législation en vigueur dans le domaine du droit de la concurrence ne succite pas l’exécution par des particuliers. Il n'y a pas de règles spécifiques dans la Loi sur la concurrence de 2009 consacrées aux actions civiles, à l'exception d'une seule disposition qui attribue la compétence à l'égard des demandes d'indemnisation aux tribunaux commerciaux. La responsabilité délictuelle générale est applicable afin de prouver les dommages. Un certain nombre de questions se posent ici principalement en raison de la complexité des affaires de concurrence. Ils ont été décrits dans le Livre blanc sur les actions en dommages et intérêts pour infraction aux règles communautaires sur les ententes et les abus de position dominante (2008). Le niveau d'incertitude quant à l'issue de la demande est élevé. Il semble que des règles spéciales doivent être adoptées en Croatie afin d'améliorer la position de la partie lésée. Le document traite sur un certain nombre de questions de droit procédural et droit de fond relatives à la facilitation des procédures civiles en ce qui concerne les dommages suite à des violations du droit de la concurrence. Le point de vue du droit interne est appliqué en tenant compte des développements récents en droit et politique de la concurrence.
