Opis:
The aim of the article is to conduct an analysis of polish legal provisions relating the entrance examination for legal specialist courses. Graduating those courses allows in Poland to become a professional lawyer. Recently in Poland the rules of the final exams of legal specialist courses were changed. New amendment of law has abolished the form of tests at the final exams. Knowledge of the candidates will be verified by practical tasks. Author says that this new amendment is not sufficient. There should be a similar change made in relation to the entrance exams.

Opis:
Legal history in Poland is imperiled by a few threats. One of them is a model of the university education, promoted by the heads of faculties, which is devoted to strictly legal subjects. It may happen, that historical subjects will be eliminated or vastly limited in the course of the implementation of this model. Such kind of pressure inclines legal historians to emphasize their utility to contemporary legal science. However, it is worth noticing, that there are different dangers that lie in wait for Roman law and for Polish legal history. Basing instruction upon incomplete sources in showing a distant genesis of contemporary legal institutions causes an excessive simplification, which is a serious threat to the reliability of scientific research. The Polish legal history researcher will be helpful to a specialist of contemporary law only occasionally and in most of those rare cases his research will be used to point out the birth of a certain legal institution in Polish law. Another threat to Polish legal history is an intensive interest in mostly recent history. Although, after years of censorship in the state of real socialism, this situation is intelligible, as it resulted in abandoning the research of old-Polish times, nowadays conducted by only a few scholars. As far as the group of Romanists is concerned, they tend to indicate the Roman roots of almost all past, present and future legal institutions. However, this is cannot be done when applying all rigors of scientific research. A drop of the scientific level of publications may be observed as well. Authors do not investigate sources of the practice of the law, the use of legal history literature is insufficient and the publications of historians of other specializations are used only to a minimal degree. Legal historians in Poland have to deal with these main problems, if they hope for the further development of their discipline.

Opis:
In Romania, the history of legal education dates from ancient times. The historical records show that legal education had appeared on the territory of countries that have later entered into the composition of the Romanian State, after enactment of the first written laws (pravile – or codices), and long before the enactment of legal codes on branches of activity. Thus, the preliminary of legal education in the Romanian countries can be traced back to the practice of writing laws (pravila – or codex) that emerged in the 17th century: in Walachia this was the Govora Code of 1640 and the Matei Basarab’s Code (also known as the reshaping of laws) in 1652: in Moldavia it was the Vasile Lupu Code (also known as the Romanian book of learning) of 1646. However, there are historians who claim that since 1400, an Academy of law or, at least, a course in law, would have been organized at the School of Alexander the Good in Suceava. The first educational institutions were established in monasteries and churches and teachers had a western and Byzantine educational background. In Moldavia in 1648, during the reign of Vasili Lupu, the Great Princely School was founded at Trei Ierarhi Monastry in Iasi. In 1694, under the reign of Constantin Brâncoveanu – in Walachia, the Princely Academy was founded in Bucharest. Thus were laid the bases of Romanian higher legal education. In 1777 in Transylvania, the Romanian territory which for a long time was under Austro-Hungarian domination, by an imperial document called Ratio educationis imperial, an Academy of law was established in Oradea together with another in Bratislava. Over the years, the study of juridical sciences in Romanian countries developed and received systematic organization – especially after the Union of the Romanian principalities in 1859 – being influenced as much by historical realities as by the political, economic and social conditions of the country. This paper aims to provide an overview of the development of legal education in Romania and the contributions to the development of the science of law of the most prestigious Romanian jurists.

Opis:
The question of legal education is recognised as important along various dimensions and thus has been in the focus of attention of numerous distinguished legal scholars and practitioners all over the world. The problem of legal education includes not just methodological issues, but also the issues that are par excellence philosophical in nature. Legal education has a specificity that arises from the nature of law and its complexity, and is related to the personal dimension of this education. The process of education should be organised in such a way that students should be in contact with members of the legal community whose authority, moral and subject matter-related attributes play a vital, formative role in legal education. The author tries to confront the didactics-related reality with ideals and postulates present within this field. Yet, it is revealed that such a reality is hidden below a “thick layer” of myths, which have grown around legal education. These myths blur the real picture of lawyers’ education, creating a kind of legal education mythology. Two types of systemic legal myths are indicated. The first one is built on the paradigm of university legal education. The other type is based on the paradigm of university studies.

Opis:
The paper analyzes the system of legal education in Lithuania. It provides a short historical overview and recent developments in this area. On the one hand, higher education institutions try to implement main goals of the Bologna Process and to provide two-cycle studies in the field of law. On the other hand, there are still very strong ties to the traditional one-stage model of legal studies. Thus, universities try to combine both these models and offer both two-stage and one-stage studies. In such a situation students are given an opportunity to choose the model they prefer. The paper gives an insight into the programs of studies offered by the universities in Lithuania. The last thing discussed in the article is the issue of securing quality of legal studies.

Clinical teaching reflects the need to combine theory in the teaching of the law and practical skills. It creates the possibility of „being a lawyer” still at the stage of university education. Currently, legal clinics program was introduced at all Polish law schools – both public and private. The essence of legal clinics is to enable students to acquire the necessary skills in „safe” conditions under the guidance and supervision of the academic teachers. It should be remembered that the aspect of teaching is the primary purpose of the law clinics. This means that regardless of the social mission, the clinics give free legal assistance to poor people, it is as if only „side effect” of the educational process.

Art. 48 of the Constitution of the Russian Federation guarantees everyone the right to qualified legal assistance. The question of the means and methods it should be provided with has been debated between lawyers for a long time. A number of scientists talk about the need for legislative consolidation of the ‘advocate monopoly’. Others consider it appropriate to license the legal services market. These disputes remain relevant today. However, in 2019, Russia has undergone a reform of procedural law, which lawyers have called a ‘process revolution.’ Many rules of procedural codes have undergone major changes. In particular, as a result of the reform, the requirements for persons who may act as representatives in civil matters have been substantially changed. In the framework of this article, an attempt is made to analyse the reform of the institution of representation. Based on a systematic analysis of procedural legislation and law enforcement practice, the author comes to the conclusion that legislative consolidation of the need for higher legal education for representatives can be called one of the positive aspects of the reform. This article provides an analysis of the development trends of the institution of representation in the historical aspect. The author concludes that it is maintaining logical and consistent movement along the path of becoming an‘advocate monopoly’ in Russia. It seems that subject to its competent and phased introduction, as well as the reform of the corps of the bar itself, not only by increasing its number but above all by increasing the professionalism of its members, it can and should become an effective tool in the civil process.

What is the purpose of a study to present comprehensively the condition and social impact of civil law lawyers in 18th century England? The study provides a broad panorama of a far European province, particularly in relation to its legal and intellectual character. A province is an intellectual, not a geographical term. Yet, the panorama should not be art for art’s sake. A comparative study based on it might be instructive, if a legal researcher following it becomes well acquainted with the foreign jurisdiction and its legal history. There will always be a need for learned diagnoses and for the openness of lawyers’ minds. A study of Roman law, if introduced and exercised as practical legal history, has proven to provide a very useful measure of diagnostic accuracy and to overcome provincial thinking in law.
