    The article examines the relationship between national parliaments and the EU institutions from the perspective of the concept of policy networks. We verified the hypothesis that the varied and complex forms of cooperation between national parliaments and EU institutions developed through good practices and self-organisation had positive impact on the political processes of the EU. The studied policy networks were analysed for: determining the limits, the level of integration and openness, the nature of existing relationships, the causes of network creation and ultimately the impact of these networks on the political processes taking place in the EU.

    Opis:
    The aim of the research is to explore various forms of participation of the EU Member States Parliaments in the political processes of the European Union. The assessment of the intensity of the analyzed participation will be made by applying the concept of classification of the distinguished participation, which includes passive and active participation. This study has a significant impact in the context of participation of citizens, whose direct representatives are elected members of the national Parliaments (NP). The article verifies the hypothesis that the variety of forms of participation of NP in the political processes in the EU strengthens the democratic legitimacy by increasing transparency and accountability of the EU institutions and by improving cross-level communication lines between the EU institutions and national authorities. Active forms of participation increase influence of NP on the EU political processes. However, a wide range of informal participation increases the effectiveness of supranational decision-making processes, in particular, reducing the technocratic nature of the decisions.

    Opis:
    The article attempts to give a comprehensive analysis of the first application of the so called yellow card mechanism provided for in the Protocol on the application of the principles of subsidiarity and proportionality and introduced by the Lisbon Treaty. The special focus is given to three issues: the quality of the EC explanatory memorandum, the differences in the scope of national parliaments’ reasoned opinions and the legal basis of the proposed regulation, which was the factor that motivates parliaments and determines the EC’s decision. The author suggests that these three aspects in the case of the proposal for Monti II Regulation confirm opinions formulated earlier in the literature, that the procedure for subsidiarity scrutiny can have significant legal and political implications.

    The article aims to analyse the national parliaments’ capability of exerting influence on the European Commission in the framework of the yellow card procedure. The analysis is based on the actions undertaken by national parliaments of selected Member States from Western as well as Central and Eastern Europe within the period between the announcement of the European Commission proposal for a targeted revision of Directive 96/71/EC on the posting of workers and its decision to maintain the proposal. The analysis covers three variables concerning the states selected for analysis, namely the economic interest of those states, the coherence of their parliaments’ respective positions and the actions undertaken by the national parliaments, including those of their members, on the international level.

    Niniejszy artykuł ma na celu analizę możliwości oddziaływania parlamentów narodowych na Komisję Europejską w ramach procedury żółtej kartki. Badania opierają się na aktywności parlamentów narodowych wybranych państw Europy Zachodniej oraz Europy Środkowo-Wschodniej w okresie między ogłoszeniem wniosku Komisji Europejskiej dotyczącego rewizji dyrektywy 96/71/WE dotyczącej delegowania pracowników w ramach świadczenia usług a decyzją Komisji dotyczącą podtrzymania tegoż wniosku. Analizie poddane zostały trzy zmienne dotyczące państw wybranych do analizy, tj. interes gospodarczy, spójność przedstawianych przez parlamenty stanowisk oraz aktywność parlamentów, w tym ich członków, na arenie międzynarodowej.

    Autorka porusza kilka kwestii związanych z adaptacją zasady pomocniczości w prawie traktatowym Unii Europejskiej, analizując kolejno: rolę pomocniczości w kształtowaniu stosunków między Unią a państwami członkowskimi, zwłaszcza w kontekście podziału kompetencji, sposób jej wyrażenia i gwarancji w traktatach, jej relacji z innymi zasadami, zwłaszcza zasadą proporcjonalności, oraz jej skuteczność w praktyce. Doceniając znaczenie i potencjał zasady pomocniczości w strukturze tak szczególnej jak Unia, gdzie zarazem osiągane muszą być interesy wspólnotowe, jak i respektowane interesy narodowe, autorka dostrzega pewną słabość jej rzeczywistego oddziaływania w wewnętrznych relacjach UE i państw członkowskich. Krytycznie zatem ocenia funkcjonowanie tej zasady w trybie ex ante (żółta kartka), jak i ex post (orzecznictwo TS UE), wskazując, iż warte przemyślenia byłoby wprzężenie oddziaływania zasady w toku procesu legislacyjnego, ale wymagałoby to uruchomienia odpowiednich mechanizmów proceduralnych i strukturalnych. Może więc ponownie porozmawiać o drugiej izbie PE lub innej analogicznej strukturze, która pozwoliłaby na pilnowanie zasady pomocniczości przez dedykowaną szczególnie tej kwestii instytucję parlamentarną?
    The article discusses a few issues relating to the adaptation of the principle of subsidiarity in the law of the European Union and analyses the role of subsidiarity in the development of relations between the EU and the Member States, especially in the context of the division of competences, the way of its implementation and guarantees in the treaties, its relation to other principles, especially the principle of proportionality, and its efficiency in practice. Acknowledging the importance and potential of the principle of subsidiarity in such a special structure as the EU, where common interests must be safeguarded and national interests must be respected, the author notices a certain weakness of its real influence on the internal relations between the EU and its Member States. Thus, she critically assesses the functioning of this principle ex ante (a yellow card) as well as ex post (rulings of the Court of Justice of the EU) pointing out that it is worth considering the possibility of including the influence of the principle in the course of the legislative process but this would require launching appropriate procedural and structural mechanisms. So, we should probably talk about another chamber of the European Parliament or another similar structure that would enable a dedicated parliamentary institution to supervise the principle of subsidiarity.
