Opis:
The reaction of the Polish government to the COVID-19 pandemic was the undertaking of numerous actions, which resulted in restrictions in running a business activity. The made decisions gave rise to controversies due to the scale of restrictions despite failure to implement any of the constitutional states of emergency. The article presents an analysis of the scale of restrictions set during the first wave of the pandemic, and an attempt was made to compare their scope with solutions envisioned for the state of emergency.
Reakcją polskiego rządu na pandemię COVID-19 było podjęcie licznych działań, które spowodowały ograniczenia w prowadzeniu działalności gospodarczej. Podjęte decyzje budziły szereg kontrowersji ze względu na skalę obostrzeń pomimo niewprowadzenia żadnego z konstytucyjnych stanów nadzwyczajnych. W artykule poddano analizie skalę ograniczeń ustanowionych w trakcie pierwszej fali pandemii oraz podjęto próbę porównania ich zakresu z rozwiązaniami przewidzianymi dla stanu klęski żywiołowej.

This article aims to present social work as a practice protecting the rights of people suffering from the processes of marginalisation. It takes as its point of departure two models of advocacy structuring multiple types of activity in this field, ranging from work with particular individuals to political engagement at the macro level. The next part offers a discussion of the results of a quantitative study (CAWI and CATI interviews) conducted among social workers from local social welfare centres in the Wielkopolska region. In the light of analysis of the obtained data, the practice of advocacy in social work emerges as one focused on providing direct assistance in the form of financial and non-financial benefits. The declared level of acceptance to facilitating collective action and macro practice of social work was lower. The results also reveal the attitudes of social workers to social rights and social problems.

Opis:
As an important task of the country's socio-economic development, protecting the rights of female workers in employment and income is concerned and implemented by international organizations and all countries in the world. The COVID-19 pandemic has been affecting the global economy and hurt the incomes and employment of many female workers. In Vietnam nowadays, there is an increase in the unemployment rate of female workers, gender inequality in employment and income, and the ability to secure their jobs and income. The article analyzes the current regulations and their implementation in the employment and income of Vietnamese female workers in the context of the COVID-19 pandemic. The article also proposes some recommendations on legal provisions related to training backup jobs, arranging and employing female employees, providing income support for female employees during leave due to the COVID-19 epidemic; and policies related to female workers and their employers. These recommendations will improve Vietnam's labor law on female workers’ rights in employment and income and enhance the efficiency of human resource use and socio-economic development.

Purpose of the work is to investigate theoretical principles of employees’ rights protection in the context of responsibility for mobbing. The theoretical and methodological basics of the research are general scientific and special methods of certain jurisprudence phenomena and processes’ cognition. The dialectical method was used in the synthesis of theoretical and methodological foundations of employment policy abroad and in Ukraine, as well as formulating conclusions. Thus, we used a common dialectic method which allowed us to reveal the content of employer, employee and mobbing in the context of the domestic and foreign scholars’ experience. We also have used abstract and logical investigation methods of law process in the field of employee’s rights protection. Statistical methods were used for analyzing trends of employee’s rights in different countries. The authors investigated: the main stages of the employment in Ukraine; focused attention on three events that occur during the legal employment of a hired worker; the definition of the mobbing, its concept, the experience of counteracting and establishing responsibility for this offense in the EU. The paper identified the main principles of the mobbing counteracting system’s development in Ukraine. In further investigations it is necessary to make a distinction between actions that Theoretical Principles of Employees’ Rights Protection in the Context of Responsibility for Mobbing take place exclusively at the workplace while performing employee’s duties and extending to more private aspects of a person’s life (correspondence, messengers, telephone calls at a time that is not formally a working).

In Norwegian legal system the model of employees security is typical and occurs on two levels. Accordingly to first, it’s provides the special employment protection, in the meantime the second guarantees the right to remuneration for illness period, as well as to benefit from the social security. The mentioned matters are governed by the following: the Act on Labour Law of 17 June 2005 and the Act on Benefits of Social Security of 28 February 1997. Both of them are analyzed by Authors. Act on Labour Law regulates the scope of the employment protection and conditions that allows the termination of the employment contract, while the Law on Benefits, provides the social security provisions, specifying the mode and the rules for the granting remuneration/allowances, periods of their payment and the workers entitled. An analysis of the provisions of Norwegian statutory regulations (taking into account the protection of employment contract during the illness) shows the restrictive solutions in this field. However, the employment protection against dismissals during the period of 12 months of illness, is not rigid, whereas the termination during the period of incapacity for work is permitted with applying the general conditions of the termination of employment contract. The special attention must be given to the institution of egenmelding, which must be understood as the specific employee’s entitlement for justified absence at work (due to illness) based on the principle of loyalty of the both parts of employment relationship.

The article is devoted to the origin of the concept of the workers’ participation in the management, and then to its implementation in the EU and in Poland. The history of implementing common principles of workers’ self-management in the EU is quite complex; the participation model, the so-called Mitbestimung introduced after World War II in Germany (the act was passed in 1976) was then slowly and in a limited range (informing and consulting) introduced on the basis of the EU Directive of 1977 into the legislation of particular member states. Implementation became quicker when the EU decided to establish, as one of variants, the so-called European Company. In this model the European company committee was provided for. The directive was implemented in Polish legislation by the act of 2002; in companies acting in more than one country there is an obligatory company committee. Similarly, there should be a company committee in the so-called European Company and European Economic Interest Grouping. The European Company is an alternative legal form of company, the same on the territory of the whole EU. The history of workers’ participation in management in Poland, broadly discussed in the article, is much more complex. It started in 1981, under the pressure of the “Solidarity” trade union, with introducing the acts on the state company and the workers’ self-management in the state company. These acts, although they are included in the participation current, broadly outlined the rights of the workers’ committee and of the workers’ (delegates’) general meeting, actually granting them part of the rights to make decisions, that in fact belong to the owner (e.g. dividing the profit, sometimes electing the manager). The intention of these solutions was to introduce a reformed model of an independent company in a still planned economy, and they started a broad current of discussion on efficiency of these solutions and limitations of workers’ participation not only in managing, but also in ownership after 1989. The model of the state company of 1981 (actually, in the practice of the 1980’s significantly reduced by the martial law authorities) turned out to be a temporary one and under the conditions of market economy was substituted by a form that made it possible to introduce direct or indirect privatization. However, it is characteristic that Poland has, independent of the EU, its own ample experience and traditions in solving the problem of workers’ participation in management. The author, who in the 1980’s was a workers’ self-management advisor, synthetically compares arguments for and against introducing solutions that include workers’ participation in company management, and decidedly defends the limited participation model in the EU’s version introduced in Poland by the act of 2006.
