Opis:: The article is devoted to the issue of protection of the witness’s personal liberty in the context of conditionings, that influence the shape and the scope of its protection in criminal proceedings. The author takes into consideration procedural status of witness and fact that personal liberty, as the fundamental human right of the contemporary man, should not be the subject of unjustified and excessive infringement, to solve this complex problem. The article concerns both social and legal conditionings that determine the way of defining the personal liberty concept and the scope of observance personal liberty in criminal proceedings. A part of the article focuses on the presentation of conditionings that arise from constitutional and conventional standard and from characteristics, goal and structure of criminal proceedings. The author also verifies standards mentioned above in the context of legal regulations related to the infringements of personal liberty such as detention and enforced appearance and arrest. As a result, author notes practical shortcomings of the regulations in question and outlines also recommended solutions.

Opis:: Umberto Eco clearly states the concept of semantic universals in a short essay. He presents a kind of ethics that starts with cognitive semantic universals rooted in our body. These universal concepts, according to Eco are such because they are independent of any particular culture. Such concepts as for instance “top and bottom”, “left and right”, or “a sense of personal liberty” are rooted in the basic fact that we are bodies. The “sense of personal liberty” is especially important here. This claim is similar to cognitive semantics, especially as presented by Mark Johnson. This article presents an application of those claims to the analysis of Polish translations of Psalm 139. My main claim is that the ancient Hebrew concept of a person is not at odds with such secular semantic approaches as provided by Eco and Johnson. Psalm 139 might be a perfect representation of the cultural polarization of the concept in the process of linguistic and cultural translation and transition. Besides it is this polarization of the concept of this sense of personal liberty which is the focus of this article. My main focus is on Polish translations with circumstantial references to English and Swedish translations. In this article I focus my study of the two minor parts of Psalm 139: one referring to psalmist running from God to heavens, and second, about hating the evil.
Umberto Eco wyraźnie ujmuje koncepcję semantycznych uniwersaliów w krótkim eseju. Przedstawia rodzaj etyki, która zaczyna się od poznawczych semantycznych uniwersaliów zakorzenionych w naszym organizmie. Te uniwersalne koncepcje, według Eco są takimi, ponieważ wolne są od wpływów kultury. Takie pojęcia jak na przykład "góra i dół", "lewo i prawo", lub "poczucie wolności osobistej" są zakorzenione w podstawowym fakcie, że jesteśmy cieleśni. "Odczucie wolności osobistej" jest tu szczególnie ważne. Twierdzenie to jest podobne do semantyki poznawczej, zwłaszcza tej przedstawionej przez Marka Johnsona. W artykule tym przedstawiono zastosowanie tych twierdzeń do analizy polskich przekładów Psalmu 139. Główne założenie autora jest takie, że starożytna hebrajska koncepcja osoby nie stoi w sprzeczności ze świeckim podejściem semantycznym Eco czy Johnsona. Psalm 139 może być idealnym przedstawieniem polaryzacji kulturowej koncepcji w procesie translacji językowej i kulturowej. Dodatkowo jest to polaryzacja koncepcji odczucia wolności osobistej, która jest tematem tego artykułu. Główny nacisk położony jest tutaj na polskich przekładach z okolicznościowymi odniesieniami do tłumaczenia angielskiego i szwedzkiego. W tym artykule autor skupia się na zbadaniu dwóch mniejszych części Psalmu 139: jednej odnoszącej się do psalmisty, Boga i niebios, i drugiej, o nienawiści do zła.
