Pursuant to Article 316, para. 1 of the Bankruptcy and Recovery Law, in the course of bankruptcy proceedings bankrupt company should be sold first as a whole, unless this is not possible. In the event that participants in the bankruptcy proceedings applied to the court of first instance hearing the case to make request to the ECJ for a preliminary ruling, the court taking into account the state of affairs will consider whether the Court’s position is necessary for the resolution of the case and may decide that Court’s interpretation of EU law is not indispensable. The national court will be obliged to apply to the ECJ, upon the request of the participant in the proceedings, with a reference for preliminary ruling if it considers that the interpretation of Community law is indispensable for the case resolution and that it finds itself be the court from whose judgments there is no appeal.

Opis:
Spółdzielcze kasy oszczędnościowo-kredytowe przez ponad dwadziescia lat działalności, z racji odmiennej sieci bezpieczeństwa oraz specyficznych zasad funkcjonowania, były zaliczane do parabanków. Celem artykułu jest diagnoza zmian regulacyjnych pozwalających na włączenie polskich unii kredytowych do sektora bankowego, a także ocena konkurencyjności oferty depozytowej kas w porównaniu do banków oraz ocena stopnia współzależności stóp procentowych kas i rynkowych stóp procentowych. Konsekwencją przeprowadzanej reformy polskich unii kredytowych jest ich zaliczenie do sektora bankowego. Warunki finansowe depozytów spółdzielczych kas oszczędnościowo-kredytowych w badanym okresie są nieznacznie korzystniejsze dla klientów od bankowych, ale przewaga ta ulega zmniejszeniu w czasie. Ponadto, stopy procentowe depozytów tych instytucji są silnie skorelowane dodatnio ze stopami sektora bankowego.
For over 20 years Co-operative savings and credit unions because of the different safety net and the specific rules were regarded as quasi-banks. The purpose of the article became a diagnosis of regulatory changes for the inclusion of Polish credit unions to the banking sector, as well as the evaluation of the competitiveness of deposits interest rates in credit unions compared to banks and to assess the degree of interdependence of credit unions interest rates and market interest rates. The consequences of the reform of Polish credit union is their integration into the banking sector. Financial conditions of the credit unions deposits are slightly more profitable for the customers than in banks, but this advantage has been reduced at the time of research. In addition, interest rates on deposits of these institutions are highly correlated positively with interest rates of the banking sector.

Orthodox Christians in Poland have faced numerous attempts to be forced into union with the Roman Catholic Church, ranging from the thirteenth to the twentieth century. The first attempt at a union between the Roman Catholic Church and the Orthodox Church took place as early as the mid-thirteenth century. Another attempt at forcing the Orthodox Church into union with Rome took place during the reign of Ladislaŭ II Yagiello. The problem of church union returned in the reign of Alexander the Yagiellonian. When Ivan III rejected all projects for bringing the Florence such a union into practice, discussion on church union disappeared until the end of the sixteenth century. The mission of the papal legate, Father Antonio Possevino, to Ivan IV, had been intended to draw Moscow into the union, and its failure caused the papacy to concentrate its efforts on the Orthodox Church in Poland. The Ruthenian bishops’ obedience to the Pope was officially announced on the 8 October 1596. The decisions of the Uniate-Catholic synod were met with numerous protests from the Orthodox clergy and nobility. The larger part of the clergy and the faithful, together with bishops remained in the Orthodox camp. Despite the failure of the Brest Synod in fully uniting Orthodox and Roman churches, new union projects concerning the Orthodox Church in Poland continued to arise prior to the end of 18th century. The Vatican’s interest in the Orthodox Church in Central Europe was renewed at the end of the First World War. On April 1st, 1917, the Pope created the Congregation for the Oriental Churches which was responsibile for all issues relating to the activities of all the Eastern denominations. Despite aims at unification, attempts at church union have had a negative influence on the relations between the Roman Catholic and Polish Orthodox Church in contemporary Poland. The result of centuries of attempts at unification under the Pope has been fragmentation and division.
Wyznawców Kościoła prawosławnego w Polsce wielokrotnie próbowano zmusić do przyjęcia unii kościelnej i podporządkowania się władzy papieży. Po raz pierwszy próbę taka podjęto w połowie XIII wieku, kiedy to czyniono starania pozyskania do unii księcia halicko-wołyńskiego Daniela. Ponownie unię kościelną próbowano narzucić Cerkwi prawosławnej za panowania Władysława Jagiełły. Sprawa unii kościelnej na ziemiach polskich wróciła za panowania Aleksandra Jagiellończyka. Ostatecznie, w wyników zabiegów Iwana III, odrzucającego wszelkie projekty urzeczywistnienia unii florenckiej, problem unii kościelnej nie był rozpatrywany aż do końca XVI w. Niepowodzenie misji legata papieskiego o. Antonio Possevina mającej na celu pozyskanie Moskwy do unii kościelnej, skłoniło papiestwo do skoncentrowania swych wysiłków na Kościele prawosławnym w Rzeczypospolitej. Narzucona prawosławnym w 1596 r. unia brzeska przyniosła negatywne skutki dla Cerkwi i Rzeczypospolitej. Przy prawosławiu pozostała większa część duchowieństwa i wiernych z dwoma biskupami. Nowe projekty unijne wobec Kościoła prawosławnego w Rzeczypospolitej były podejmowane aż do końca XVIII wieku. Zainteresowanie Watykanu Kościołem prawosławnym w Europie Środkowo-Wschodniej było pod koniec I wojny światowej. W 1917 r. papież powołał Kongregację do spraw Kościoła Wschodniego, która przejęła wszystkie sprawy związane z działalnością obrządków wschodnich. Problem unii kościelnej negatywnie zaczął wpływać na wzajemne relacje między Kościołem rzymskokatolickim i prawosławnym w Polsce. Uniatyzm nie tylko nie przywróciły jedności między Kościołem wschodnim a zachodnim a nawet ową jedność oddalił.

The aim of this paper is to identify the role of the European Union’s funds in combating unemployment in the Radom district. An active policy on the labour market includes different actions that aim to ameliorate the situation on the labour market. It concerns, amongst others, the programmes that contribute to diminishing the unemployment. In the paper the efficiency of the programmes that focus on combating unemployment in the Radom district between 2005 and 2009 was evaluated. The programmes taken into consideration were financed from both domestic and European Union’s resources. The reemployment rate was utilised. Out of the data analysis it can be derived that the efficiency of these programmes varies to a large extent. This is caused by the legal and administrative conditions as well as from the situation on the local labour market.

The paper is interested in how the repositioning of organized labour in Europe in the last 20 years has affected its capacity to answer the current fiscal crisis of the state. While there is reason to expect a growing discontent among unions' core constituencies with the unequal way that the costs of the crisis are being distributed, unions don't seem to be able to organize this discontent, and turn it into a source of countervailing power against 'markets' and the state. In order to understand this outcome, the paper makes three arguments. First, it shows that European integration since the 1980s has at its core been a neoliberal project which has aimed at restoring capitalist power and institutionalizing permanent austerity. It then argues that trade unions have become integrated into this project in a paradoxical way: while their institutional representation has been enhanced, they have simultaneously experienced a significant loss of autonomy and capacity to achieve substantial gains for their constituencies. As a result, trade unions approach the current fiscal crisis of the state from a peculiar state-dependent position, which limits their capacity to organize the growing discontent in a sustainable way.

Opis:
The objective of this paper is to define the role and position of works councils in the countries of Central and Eastern Europe as well as to identify the scope of their functions. The establishing of such employee participation institutions in these countries was the result of the implementation of the European Union directive of 2002, which established a general framework for informing and consulting employees. Initially, trade unions were reluctant or even had a hostile view of works councils. They saw them as rivals and feared that they would lose their monopoly in representing employees. With time, in most cases, trade unions mitigated their averse attitude and began to use works councils as a field for their own activity and as a possibility for extending the range of information. However, works councils are relatively scarce in Central and Eastern Europe and most do not exercise their statutory rights in full.

Paleta rozwiązań w zakresie nadzoru nad uniami kredytowymi jest dość zróżnicowana, co znajduje również uzasadnienie w literaturze. W Polsce po okresie nadzo-ru sprawowanego przez instytucję zrzeszającą, spółdzielcze kasy oszczędnościowo-kredytowe objęto publicznym nadzorem Komisji Nadzoru Finansowego. Reforma sektora kas wprowadzająca nowe rozwiązania organizacyjne i regulacyjne nie uwzględniła proporcjonalności regulacji prawnych w odniesieniu do najmniejszych kas. W 2017 r. wprowadzono nowelizację ustawy o kasach wyodrębniającą małe kasy spośród pozostałych instytucji sektora. Celem artykułu jest zidentyfikowanie i analiza grupy instytucji będących małymi spółdzielczymi kasami w Polsce oraz zdiagnozowanie zakresu wprowadzonych zmian w nadzorze finansowym w rozpatrywanej grupie instytucji. Główną przesłanką wprowadzenia zmian regulacyjnych było wypełnienie obowiązku wynikającego z wyroku TK. W 2017 r. małymi kasami było dziewięć instytucji. Grupa małych kas, choć bezpieczniejsza z punktu widzenia współczynnika wypłacalności, stanowi marginalną część sektora (poniżej 1% aktywów) kas w Polsce.
The range of solutions for the supervision of credit unions is quite diverse. In Poland, after the period of supervision lead by affiliating institution, cooperative savings and credit unions were subject to public supervision by the Polish Financial Supervision Authority. The reform of the credit unions sector introducing new organizational and regulatory solutions did not take into account the proportionality of legal regulations with regard to the smallest credit unions. In 2017, the amendment was introduced to the Credit Unions Act, identifying small cooperatives. The aim of the article is to identify and analyze a group of institutions that are small credit unions in Poland and to diagnose the scope of introduced changes in financial supervision over the group of institutions under consideration. The main reason for their introduction of regulatory changes was the fulfillment of the obligation arising from the judgment of the Constitutional Tribunal. In 2017, there were nine institutions with small credit unions. The group of small credit unions, although safer in terms of the capital adequacy ratio, constitutes a marginal part of the sector (less than 1% of assets) of credit unions in Poland.

Methods: An analysis of press articles and source materials concerning the activities of Galician teachers’ trade unions. Results: Selected forms of organizing extracurricular education by teachers’ organizations were discussed. Conclusions: Teachers’ unions actively participated in the organization of extracurricular education for students, putting great emphasis on developing patriotic and national feelings.

Co-operative Credit Unions in Poland have existed since 1992 and are constantly extending their economic potential and their share in the financial services market. The CCUs have a status of a legal person. These banks are non-profit institutions which are created to implement the idea of mutual financial assistance. In order to use their services a potential client has to be a member of one of the CCUs. The members of the CCU can only be people living in the same area or having the same occupation or belonging to the same organization. CCUs offer their own members basic financial services: running a standard bank account, reception of deposits, provision of loans, clearing and settlement of accounts, sale of participation units in investment funds, handling of individual pension accounts, and sale of insurance policies and emission of payment cards. They can also run the accounts of civic associations and people involved in business activity. At the end of 2006 there were 70 credit unions in Poland which together possessed 1584 agencies providing services to their members. The CCUs enlarge their share in the national market of deposits and loans for households, but this share is still of a modest size. At the end of 2005 the assets of CCUs in relation to assets of the banking sector amounted to a mere 0.9%, while in relation to assets of cooperative banks which are their direct competitors, it amounted to 16.3%.

Opis:
Which institutions may be important in terms of trade union density and how significant they are? Although the status of trade unions may be very different among states, unions are still a very meaningful component of labour markets. In this paper, we contribute to the debate about the institutions that may affect the outcome of trade unions in different legal systems. Firstly, we draw on the theoretical underpinnings of trade union activity and density. Then, we conduct an empirical analysis of the relationships between trade union density in a particular country, country’s legal origins and government’s ideology. In this way, the paper enriches an underexploited niche in institutional research devoted to labour market issues.

The paper focuses on discourse and discourse analysis as a tool for shedding light on the phenomena of trade union recruitment and organization. The author employs discursive data from interviews with numerous trade union officials in Slovenia as a means of shedding light on the process of organizational sense-making, identifying the specific terms officials employ to describe the world of Slovenian trade unionism and trade union organizing. In her analysis, the author argues that age seems to be the most significant factor distinguishing the perspectives among the interviewed officials, pointing thus to the significance of generational changes for understanding the challenges to trade union organizing in Slovenia today.

The paper deals with an organised labour response to recent migration to Northern Ireland from the New Member States (NMS) following EU enlargement in 2004. A trade union's approach to the problems confronting migrant workers is analyzed in the context of neo-liberal reforms of the labour market and shrinking of the welfare state. These changes have taken place in the context of a specific region still struggling to overcome the legacy of a long-lasting conflict from the 1960s until 1998 Good Friday Agreement. Furthermore, an innovative approach to migrant workers organising combining elements of solidarity and membership mobilisation and aiming at promoting a political and class solidaristic cross-sectarian agenda developed by the Independent Workers' Union (IWU) is examined. The results are based on a research programme undertaken by the IWU to uncover the nature of the relationship between migrants, labour market changes and the trajectory of sectarianism in the north.

The paper analyses steel restructuring at one of the major steel companies in Poland. It traces the restructuring history from the 1990s up to recent times, arguing that restructuring was heavily influenced by EU-accession conditionality and by the sector-oriented policy of Polish trade unions. While steel restructuring is often considered a major success story in Poland, this article, basing its argument on the life trajectories of the redundant workers, highlights the downside of a sectoral approach which operates at the expense of regional restructuring.

This article examines how the United Kingdom (UK) trade unions organise Polish migrant workers in the aftermath of post EU enlargement migration, and what forms of inclusion strategies they implement. The benefits and limitations of various inclusionary approaches are scrutinised through the analysis of semi-structured interviews conducted with officers of three different large trade unions. These unions have at times, applied similar and at other times very different strategies, which depend on the unions' structures and decision-making. These approaches vary from equal treatment and the 'level playing field' approach to special treatment. While the first combined approach has resulted in some positive experiences in locating and recruiting Polish members, further inclusion through activism, however, calls for a special treatment approach.

This paper presents different models of capitalism and trade unionism that have emerged in CEE over the last 25 years. It then traces challenges and unions' strategic responses in five policy areas: membership recruitment; mergers and organisational restructuring; collective bargaining; political engagement and social partnership; and international trade union cooperation. The paper argues that trade unions in the new EU member states do have the potential for strategic innovation and, conceivably, organisational renewal. In order to revitalise, however, they need to take on board the concerns of an increasingly diverse workforce and invest more resources in organising.
