W artykule scharakteryzowano stosunek największych polskich central związkowych do Obozu Zjednoczenia Narodowego. Zróżnicowane opinie na temat OZN, wyrażane w latach 1937–1939 przez przedstawicieli organizacji związkowych, a także podejmowane w związku z tym działania były w dużej mierze uwarunkowane nastawieniem ideowym poszczególnych środowisk. Wynikały też z zaszłości historycznych i powiązań niektórych central z partiami politycznymi. Były również konsekwencją rywalizacji o prymat w ruchu zawodowym.
The article characterises the attitude of the largest Polish trade union centres towards the Camp of National Unity (Polish: Obóz Zjednoczenia Narodowego, OZN). The differing opinions on OZN expressed between 1937 and 1939 by representatives of trade union organisations and the actions taken in their consequences were, to a large extent, conditioned by the ideological stance of individual circles. They also resulted from historical backgrounds and the relations of some headquarters with political parties. They were also a consequence of competition for supremacy in the labour movement.

Finland is a member of the European Higher Education Area. The principles of the Bologna Declaration have become reality in certain respects. The form and structure of Finnish law degrees are uniform with the Bologna model. However, mobility and the free movement of students have only been realised in a limited sense. Finnish law degrees are still closed both in international and national respects. Uniformity of degrees is treated here as a means to carrying out free movement and the right of establishment as the principles of the European Union. Uniformity of degrees is a necessary precondition in recognising degrees earned in another country. Without the recognition of the workmanship and degree earned in a home country, it is very difficult to establish oneself in a host county. Both the basic treaties and the applicable directives of the European Union obligate member states to recognise degrees earned in other member states. There are, however, important exceptions and restrictions. Lawyers often work as judges, prosecutors, bailiffs and other officers. They are subject to exceptions and restrictions. As a rule, advocates have the freedom to provide services and establish themselves in a permanent way, and act as advocates in another member state. Even in this case, there are steps and restrictions. In practice, it is not easy to move to another member state and act as an advocate with the help of a law degree earned in the home state. Basically, the reasons for these difficulties are the differences between national legal systems.

The European Union (EU) and the Eurasian Economic Union (EAEU) are international organizations integrating member states, primarily in the economic field. Both organizations guarantee four economic freedoms: free movement of goods, services, labor, and capital. One of these freedoms: free movement of services is particularly important. It should be noted that within the customs union of the EU and the EAEU the internal customs barriers have been eliminated, and for the exchange of services between these organizations, only the borders between the two unions remain an obstacle. For this reason, legal regulations concerning the free movement of services in the EU and the EAEU determine the opportunities for economic exchange between these organizations.

The text focuses on the migration in the European Union and in Poland at the begging of the 21st century. It aims to prove that even if the reasons and consequences of migration are varied, they have significantly shaped the development of human civilization and have been a part of human socialization. Furthermore, this text points out that the phenomena of globalization and democratization have affected the population movement and caused new patterns of contemporary migration. The European Union is a great example of cooperation between different countries in order to realize the principle of free population movement, which was put to the test over past years. Additionally, this article characterizes the Polish migration, especially the inflow of immigrants to Poland. Poland has become an emigration and an attractive immigration country. This text revels also the consequences of migration in modern Europe.

The results of the referendum regarding the UK leaving the European Union indicated that the majority of British citizens, who are also citizens of the EU, decided to leave the European Union. The citizens’ decision has serious legal consequences arising from Article 50 of the Lisbon Treaty. This is the first case of a state leaving the European Union, which raises many questions. In the presented material, the institution of referendum is being analyzed as a form of direct democracy as well as, in this context, the effects of Brexit affecting directly the citizens of Great Britain – ex-citizens of the European Union.

The aim of the paper is to present ramifi cations in the field of family law, inheritance law and tax law which arise from the lack of recognition of registered partnerships and same-sex marriages in certain European Union Member States, such as Poland. The lack of recognition is commonly perceived as discrimination on grounds of sexual orientation, but the emphasis is usually placed on its consequences concerning human rights. In this article, the author focused on discriminatory aspects in the area of family life and personal taxation. A lack of appropriate provisions in domestic law produces negative effects affecting taxation obligations for cross-border families that concluded their marriages or partnerships abroad but cannot benefit from these institutions in certain EU Member States such as Poland. For the purpose of determining discriminatory aspects, the author analysed the domestic rules differentiating couples living in a marriage and couples not possessing the right to marry. Due to lack of case-law on tax and inheritance discrimination resulting from sexual orientation, relevant case-law of the Court of Justice of the European Union have been recalled, revealing possible violations of fundamental freedoms, including free movement of persons.

This article argues that the arrests and expulsion of large numbers of Roma carried out by the French government in 2010 violated the European Union’s human rights principles because non-French Roma were targeted collectively for removal. In response to the expulsions, the European Commission initiated infringement proceedings against France for procedural violations of European Union Directive 2004/38 (the Free Movement Directive). However such racially discriminatory state action should be challenged more properly as a substantive violation of Directive 2000/43 (the Racial Equality Directive). Because the European Union does not have its own separate body of human rights law that is binding within Member States, using the Racial Equality Directive to offer protection to vulnerable minorities by challenging discriminatory state practices may be an alternative method of achieving human rights objectives within Member States. Moreover, since the Racial Equality Directive lacks interpretation, a situation of race-based expulsion of EU migrants would be an opportunity to clarify and develop the scope and meaning of the Directive.

The paper analyses the exportation and importation of works of art between Poland and the European Union prior to Poland’s entry into the bloc on May 1, 2004. The author presents a dynamic analysis of artwork exports and imports data according to Poland’s Central Statistical Office (GUS) in 1992-2004. She identifies the main artwork export and import markets in Europe and estimates the share of the private sector in artwork trade. The analysis yields several conclusions. The value of artwork exports and imports between Poland and the EU-15 was characterized by major changes. EU countries accounted for a high percentage of Poland’s artwork trade in 1992-2004. This applies to both exports and imports. In the analyzed period, the value of Polish artwork exports was higher than the value of imports. Moreover, the analysis revealed that the movement of artwork between Poland and the EU was strongly concentrated in the case of several countries, with a clear marginalization of the remaining member states. France, Germany, Britain and Italy had the greatest share in Poland’s artwork trade. The share of the private sector in artwork trade was considerable, exceeding 75 percent in exports and 58 percent in imports.

Free movement of workers is one of the most important fundamental right, which results from the membership in the European Union. This right includes in particular : the right to apply for the offers of employment in the other EU states; the right of free movement for the purposes of seeking work; the right of residence; the right to stay in the other EU state after the termination of labour contract. According to European Union law, mention rights belongs not just to employees, who are the citizens of the European Union, but in limited range also to their family members. The exemptions to the right of free movement are rather limited. The aim of the presented contribution is to describe the essence of the right of free movement of workers in the European Union mainly in the light of the relevant judicial decisions of the Court of Justice of the European Union.

The right of family members of Union citizens to live with them in the host Member State has always been considered essential for an effective freedom of movement of citizens. However, the provisions of Directive 2004/38/EC contain a different description of the scope of rights of family members of Union citizens taking advantage of the freedom of movement of persons as to the possibility of accompanying or joining EU citizens taking advantage of the freedom of movement of persons, depending on whether they belong to the circle of ‘closer’ or ‘distant’ family members. This issue acquires particular significance in the context of family members who are not citizens of any Member State of the Union. For individuals belonging to the circle of ‘closer’ family members, the EU legislator grants the subjective right to accompany or join a Union citizen exercising the right of the freedom of movement of persons. In the latter case, the legislator only obliges the host Member States to facilitate entry and residence for such individuals in accordance with their national legislation. The glossed judgment, by determining the status of individuals under legal guardianship within the framework of the Algerian kafala system as a ‘distant’ family member of a Union citizen, clearly touches upon a significant issue in the context of the Union’s freedom of movement of persons.

Today Moldova is not on the top of international political agenda, but it is important both for the West and Russia in the context of their geopolitical competition. At the same time it is a competition of two integrative projects, which propose two different models of development – the European Union and the Eurasian Economic Union. For a long time it seemed that parliamentary “Alliance for European Integration” will be able to make Moldova a successful example of Europeanization, but finally it discredited European idea and Moldovan people after massive social protests elected pro-Russian Igor Dodon president of the country. Now it seems that he will eventually integrate Moldova to the Eurasian Economic Union, but to do this he has to solve the problem of parliament, which is controlled by his political opponents. Referendum is supposed to become a solution. Finally, potential additional advantage of I. Dodon is that the challenge of Transnistria can also be overcome in connection to the Eurasian integration of Moldova, because Chisinau with the help of Kremlin will get unified state and Tiraspol – formal affiliation with Russia it dreams of. The story is not over yet, but Vladimir Putin’s chances to win are good as never

The legislation of Ukraine on agricultural lands turnover is one of the most conservative in the world, prohibiting alienation of most types of agricultural lands. This prohibition is likely to be lifted soon, but there are intense debates whether foreigners should be allowed to purchase agricultural lands. By virtue of Article 145 of the Association Agreement between Ukraine and the European Communities Ukraine has a duty to implement the principle of free capital movement, in particular by abolishing restrictions on acquisition of land by foreign citizens and companies (Articles 22, 81, 82 of the Land Code of Ukraine). In case Ukraine fails to introduce the necessary amendments, the provisions of Article 145 of the Association Agreement should be applied directly. The formal unconditional obligation of our country to remove the said obstacles to free capital movement serves its best interests. Today, turnover of agricultural lands in Ukraine should be very dynamic, and it should be governed by general rules applicable to immovable property.

On 23 June 2016 the United Kingdom voted in a referendum to leave the European Union. On 17 January 2017, the UK Prime Minister, Theresa May, stated that what she is seeking is “Not partial membership of the European Union, associate membership of the European Union, or anything that leaves us half-in, half-out. We do not seek to adopt a model already enjoyed by other countries. We do not seek to hold on to bits of membership as we leave. No, the United Kingdom is leaving the European Union” (Reuters, 16 January 2017). It is by no means clear what “leaving” the EU will mean for the UK, the EU and the millions of European citizens who have exercised their right to free movement enshrined in the Treaty of Rome “with the legitimate expectation that their EU citizenship rights were irrevocable.” (UK Citizens in Europe, “Towards an Alternative White Paper on the European Union (Notififi cation of Withdrawal) Bill”, February, 2017). This article considers the implications of the UK’s decision to leave the EU for mobile EU citizens’ social security and healthcare rights in the UK and UK nationals’ corresponding rights in the EU. It examines the rights at stake and possible arrangements to coordinate social security following Brexit. The article concludes that the most effective arrangement would look conspicuously similar to the current coordinating Regulations 883/04 and 987/09. However, in the event of a ‘Hard’ Brexit new institutional arrangements would have to be found to administer, review, revise, interpret, and provide consistency and legal certainty across at least 30 countries.
Na skutek decyzji podjętej przez społeczeństwo brytyjskie w referendum 23 lipca 2016 r. Wielka Brytania opuści Unię Europejską. Brytyjska premier Theresa May zapowiedziała, że decyzja ta oznacza nie tyle szukanie modelu już istniejącego, co zupełnie nowy sposób współpracy z Unią Europejską. W artykule rozważa się różne możliwości takiej współpracy oraz rożne rozwiązania w zakresie zabezpieczenia społecznego w świetle zapowiadanych zmian w swobodzie przepływu osób. Wypracowany przez UE model koordynacji zabezpieczenia społecznego należy do najbardziej złożonych – ale jednocześnie skutecznych – rozwiązań prawnych w nowożytnej historii. „Brexit” może więc oznaczać niezwykle trudny proces poszukiwania rozwiązań w tym obszarze, zakładając, że dotychczasowe mechanizmy zostaną odrzucone w ramach scenariusza tzw. twardego wyjścia Zjednoczonego Królestwa z Unii Europejskiej (ang. hard Brexit).
