Opis:
This article focuses on the solidarity of EU member states with the so-called “front” country, Greece, which found itself during the migration crisis in 2015 and in the following years on the most burdened East-Mediterranean route, i.e. the route by sea from Turkey to Greece and onwards to various European Union countries. Refugees from Syria but also from Iraq and Afghanistan continue to arrive along this route. The destinations for boats carrying immigrants and refugees via Turkey to Greece are the islands in the Aegean Sea including the island of Lesbos whereon the infamous Moria camp still plays a special role. The island which hosts Moria is the subject of European solidarity research with Greece. The structure of this article consists of three parts. The first discusses the principle of solidarity which, like any community, lies at the heart of the European Union. Part Two deals with the migration crisis and its challenges regarding the solidarity of EU Member States from Greece. The third part focuses on the humanitarian consequences of the lack of solidarity between EU member states and Greece. The source material is scientific publications on the EU, information from EU portals and press agencies and their recordings of developments in Greece related to the influx of immigrants along the Eastern Mediterranean route along with the author’s own observations of the Moria camp during a visit at the end of November 2019. This article also partly refers to the new humanitarian challenges arising in the context of the situation of immigrants on their way to Europe during the Coronavirus pandemic (COVID-19).

Providing specific criminal protection for migrant minors requires the balance of two legal aspects related to the specific weaknesses of the children; on the one hand, the condition of the minor is characterized by the inadequate experience and specific risks of victimization; on the other hand, the migrant status is related to the lack of social and family references, economic need and diversity of culture. The protection the two mentioned legal aspects requires the enforcement of both different rules to be combined; the application of existing regulations, with the evaluation of the crime’s circumstances, as well as the definition of new criminal figures, who identify some peculiar forms of possible aggression or endangerment, are both useful solutions for the very problematic balance of the two goods. In order to provide effective protection for migrant minors, it is essential to fully implement the principle of “last resort”. Criminal protection, in fact, should only intervene in support and completion of priority preventive administrative safeguards; the administrative protection has to intervene before the commission of serious crimes, which risk compromising, even irremediably, the personality of the vulnerable minor. Otherwise, the administrative action would provide only indirect protection, with no effects on weak persons; an efficient intervention aims to preserve the fragility of the migrant child taking into account the objective risks, often very serious, due to the simultaneous of the two conditions (minor age and migration status). Criminal protection alone would not prevent the maturing of trauma, harassment, exploitation, material and educational deprivation. The law of 7 April 2017, n. 47 «Provisions regarding the protection measures for unaccompanied foreign minors» is significant in this regard.

In recent years, in particular after 2015, tenths of thousands of unaccompanied children have arrived in Europe, mostly in Greece and Italy, escaping from war, conflicts and other hardships they were faced with in their countries of origin. A considerable number of them are very young (under 14 years) and extremely vulnerable. The challenge for Europe, in line with the obligations deriving from UNCRC, is to offer them a safe, appropriate environment to live and to carefully examine and protect all their rights, including their protection from violence and exploitation and access to education, health and social participation. In this direction and following EU action plans and decisions, European states are expected to further share responsibilities, collaborate and take all appropriate measures to fully protect the rights of these children.

Through a qualitative research carried out in South-East Italy with twelve Unaccompanied and Separated Children (UASC) this paper attempts to explore their relation with the Internet and digital media. Findings reveal that digital tools facilitate communication and socialization and allow UASC to maintain relationships with social networks in their countries of origin as well as expand their networks in the country of residence within the migrant community. Digital media enhance access to information and leisure activities. Even if UASC recognize some risks of being online similar to those European adolescents face, it emerges that overall the Internet and digital media contribute to their wellbeing. They have the power to boost resilience vis-à-vis the challenges UASC face in their lives: being alone, in a new country, often institutionalized and without the support of a trustworthy adult figure.

W artykule przedstawiono wyniki badania jakościowego dotyczącego sytuacji w Polsce dzieci cudzoziemskich bez opieki w kontekście systemu ochrony dzieci. Na badanie składała się analiza danych zastanych, wywiady z ekspertami oraz z opiekunami dzieci cudzoziemskich przebywających w pieczy zastępczej. Przedstawiono także statystyki dotyczące dzieci cudzoziemskich przebywających w Polsce w pieczy zastępczej. Omówiono takie zagadnienia, jak problem reprezentacji prawnej i ustanawiania opieki prawnej nad dziećmi cudzoziemskimi, obowiązujące procedury i pomoc instytucjonalna, a także kwestie integracji kulturowej młodych cudzoziemców, ich relacji z rodziną i funkcjonowanie w systemie szkolnym. Na koniec sformułowano rekomendacje dla poprawy sytuacji dzieci cudzoziemskich bez opieki w Polsce.
The article presents the results of qualitative research on the situation of unaccompanied minors in the context of the child protection system in Poland. The study consists of desk research, interviews with experts and interviews with carers of foreign children living in foster care. The article also presents the statistics on foreign children residing in Poland in foster care. It touches the issues such as the problem of legal representation and the establishment of legal guardianship of foreign children, applicable procedures and institutional support as well as the issues of cultural integration of young foreigners, their relationships with family and their functioning in the school system. At the end recommendations for improvment of the situation of unaccompanied children in Poland are proposed.

Unaccompanied child migration, propelled by war, political strife and instability is an increasingly serious global problem. Refugee youth contends with numerous challenges as they adjust to living in a new country. Although their capacity for resilience is being given the deserved recognition, studies where their views are taken into account greatly outweigh in number those where the voices of young refugees directly narrate how they bounce forward in the face of an uncertain future (Walsh 2002). Resilience scholars are challenged to move beyond a narrow understanding of youth refugee resilience by conducting research on their life situations exploring their own perspectives. This article describes some of the insights gained from a phenomenological study— whose methods are particularly effective at capturing and illuminating the experiences and perceptions of individuals from their own perspectives— undertaken with unaccompanied minors living in Germany. The narrative approach used to explicate their narratives highlights seven major coping strategies: (1) Treasuring personal identity, (2) Maintaining cultural identity, (3) Networks of support and social negotiations, (4) Nurturing the need to belong, (5) Embracing a positive outlook, (6) Perceived self-efficacy and personal characteristics, (7) Adopting a growth mindset & self-enhancement expectations. The empirical data of this research show that URMs are active agents in choosing meaningful pathways to resilience and purposefully navigate through the numerous challenges in their lives.

Artykuł przedstawia rolę kuratora małoletniego bez opieki ubiegającego się o ochronę międzynarodową oraz identyfikuje praktyczne problemy z tym związane. Celem badania jest analiza adekwatności istniejących przepisów w stosunku do ich praktycznego zastosowania z uwzględnieniem prawa polskiego. Wyniki badania stanowią podstawę do stwierdzenia, że konieczne jest efektywne wdrożenie istniejących przepisów i międzynarodowych standardów na poziomie krajowym poprzez m.in. wprowadzenie kuratora zawodowego z jasno określonymi kwalifikacjami oraz odpowiednimi mechanizmami kontroli podejmowanych przez niego działań. Liczba małoletnich bez opieki wzrosła ostatnimi laty. W postępowaniu o udzielenie ochrony międzynarodowej z udziałem małoletniego bez opieki powinny obowiązywać szczególne zasady. Opieka nad małoletnimi bez opieki w kontekście międzynarodowych procedur ochronnych jest trudna do zdefiniowania, a zakres obowiązków kuratora różni się w zależności od kraju przyjmującego.
The article presents the role of the curator of an unaccompanied minor seeking international protection and identifies practical problems related to this. The purpose of the undertaken research is to analyse the adequacy of existing regulations in relation to their practical application, including Polish law. The results of the research form the basis for stating that it is necessary to effectively implement existing regulations and international standards at the national level, by, inter alia, introducing a professional curator with a clearly defined scope of qualifications and appropriate mechanisms to control the actions taken by him. The number of these unaccompanied minors has increased over last years. Moreover, special rules should apply to the procedure of international protection within minors applicants. Guardianship of unaccompanied minors, in the context of international protection procedures, is difficult to define and the scope of curator’s duties varies from one host country to another.
