The article reveals that the European Union did not formulate any uniformal model of its relation with Churches and religious associations. Religion is not a hot interest of the EU which declares to be religiously neutral. However, for many years when its structures were under construction there were created mechanisms which determine how to deal with Churches and religious associations. In time those mechanisms found their reflection in treaty law and were sanctioned as relations between institutions of Churches and EU. The article presents basic principles of the relation between Churches and EU, and items of the treaty law of EU which institutionalize that relation.

The article pertains to the matter of jurisdiction and the law applicable to relations between parents and children in Polish-Ukrainian relations. In recent years, in particular since the beginning of Russia’s military aggression against Ukraine, large waves of Ukrainian immigrants have come to Poland. The structure of the migration, with the domination of women and children, oblige Polish courts and other authorities to deal with the issues of parental responsibility, contacts with children, custody and maintenance in the cross-border context. In this situation, the bilateral Agreement between the Republic of Poland and Ukraine on legal assistance and legal relations in civil and criminal matters, signed in Kiev on 24 May 1993, acquires a new significance. It contains both the procedural rules (on jurisdiction, international legal aid, service of documents, as well as the recognition and enforcement of judgments) and confl ict of law provisions in the field of broadly understood civil matters, including relations between parents and children. The author undertakes a critical analysis of the provisions of Polish-Ukrainian Agreement as with respect to filiation (children’s origin), parental responsibility and child maintenance. The anachronism of its solutions and the need for its termination is emphasized.

Nowadays, space management is widely recognized as an important area of global governance. The management of outer space is very complex, therefore activities of states in outer space realm are regulated by Outer Space Treaty. However, due to a number of ambiguities in the provisions of the Outer Space Treaty regarding the military use of space, loopholes for an increase in militarization and weaponization of space have emerged, thus causing serious problems with space security and affecting the sustainable use of space. Such shortcomings in the regulation of the military use of outer space by the Outer Space Treaty, including the lack of definition of certain terms and the establishment of appropriate procedures, allow the parties to freely interpret the relevant terms, and also conduct experiments in space, which contribute to the militarization and weaponization of space. Naturally this issue poses global security threat, because once the militarization or weaponization of outer space has started, it is almost impossible to reverse this process. In addition, the development of anti-satellite weapons and the dual purpose of satellites orbiting the Earth undoubtedly adds to the political and legal challenge of managing outer space. Therefore, this articles claims, that the legal regulation of outer space requires thorough revision in order to effectively address the issue of legal mechanisms in outer space.

Opis:
An important factor in shaping the legal system of an independent democratic state is to define the place of its international obligations in the domestic legal system. International law binds states that are bound by its norms governing their cooperation within the international community. Therefore, it is necessary to refer to the problem of the relation of international law to internal law by analyzing the regulations of the Ukrainian legislation and the international conventions concluded by it. The subject of the analysis are the provisions of the Constitution of Ukraine of 1996 and the Act on International Agreements of 2004 as well as the provisions of the Vienna Convention on the Law of Treaties of 1969, to which the Ukrainian Soviet Socialist Republic acceded in 1986 and to which Ukraine is now a party.
Istotnym czynnikiem kształtowania sytemu prawnego niezależnego państwa demokratycznego jest określenie miejsca jego zobowiązań międzynarodowych w krajowym systemie prawnym. Prawo międzynarodowe wiąże państwa, które są zobowiązane do przestrzegania jego norm regulujących ich współpracę w ramach społeczności międzynarodowej. Należy zatem odnieść się do problemu stosunku prawa międzynarodowego do prawa wewnętrznego, poddając analizie uregulowania ustawodawstwa Ukrainy i zawartych przez nią konwencji międzynarodowych. Przedmiotem analizy są przepisy Konstytucji Ukrainy z 1996 r. i ustawy o umowach międzynarodowych Ukrainy z 2004 r. oraz postanowienia Konwencji wiedeńskiej o prawie traktatów z 1969 r., do której w 1986 r. przystąpiła Ukraińska Socjalistyczna Republika-Radziecka i której stroną jest obecnie Ukraina.

The problem of transformations of the definition “Interpretation in international law” is analyzed in the article. Particularly acute and ambiguous is the question of differentiation of the concepts “interpretation” and “explanation”, which are used n the domestic theory of international law. In Western literature, mostly, the term “interpretation” is used (from the Latin interpretatio). It is determined that two concepts, which Ukrainian lawyers often see as identical or synonymous, the national experts in international law often consider to be rather problematic. From the point of view of the Ukrainian legislation, the concept of “interpretation” is legal, and lawyers use in legal practice and theory such terms as interpretation of the law, interpretation of the legal act, legal interpretation, interpretation of the rules of law, interpretation of the norms of international law. The author notes that this not only does not introduce categorical unambiguity and clarity, but rather complicates the integration of Ukrainian legal science and the science of the theory of international law in the European scientific system.

The publication examines the legal nature of wars, looks into the law of war genesis, reviews its conventions, as well as identifies the aim, objectives, causes together with the consequences of Russia’s military aggression on February 24, 2022; it provides a testimony on the war of aggression against Ukraine and identifies its threats to post-war international law and order. The aim of the article is to determine the background, nature, fundamentals and nature of the war the Russian Federation launched on February 24, 2022 against Ukraine within the context of confrontation with the values of Western democracy. Historical-legal dialectical, comparative-legal and system-structural methods, as well as methods of formal logic (induction and deduction, analysis and synthesis, abstraction and concretization, etc.) were used to study the issues. The application of these research methods entails a cross-sectoral scientific nature. Wars have accompanied the entire history of mankind. Since the 17th century the theoretical foundations of the law of war have been laid, which enshrined in international laws and customs of warfare (Geneva Conventions, Hague Convention, etc.) since the 19th century, thus forming the international humanitarian law. After World War II, violations of the latter by the belligerent party are viewed by the world community no less harshly than the mere war. The paper questions the purpose, reasons, conditions and intermediate consequences of the war of the Russian Federation against Ukraine. Obviously, the military aggression and the Russian invasion on February 24, 2022 marked the beginning of the de facto war, under a specific formal definition by a Russian official as a “special military operation” instead of naming it an attempt to avoid legal responsibility for war crimes committed in Ukraine. The article analyses the aggressive nature of this war on the part of the Russian Federation, demonstrates numerous violations of international law conventions by the Russian armed forces during the military invasion and temporary occupied territories in Ukraine. It emphasizes that the law of war has always been replaced by signing a peace treaty and relevant international agreements, which entails the obligation to severe the political, economic, and legal responsibility of the state violating international humanitarian law. The paper reviews the key institutions and legal tools for bringing the Russian Federation authorities to justice for the war crimes committed in Ukraine. So far, the President of Ukraine, the Supreme Council of Ukraine, and the Cabinet of Ministers of Ukraine have managed to apply legitimate international legal mechanisms, primarily the International Criminal Court and the UN Security Council, to prosecute Russia for violating the international humanitarian law and committing war crimes in Ukraine. At the same time, on the Ukrainian territories currently liberated from the Russian army’s occupation (Bucha, Gostomel, Irpin, etc.), it is already possible to implement a special mechanism of justice, which consists in the collaboration between national and international experts: specialists, investigators, prosecutors, and judges to collect objective and impartial evidence of gross violations of international law and war conventions in Ukraine. It is obvious that for Ukraine today both the victory and just punishment for the committed and continuing committed war crimes on its territory are important. The article presents the concepts proposed in 2006 and in 2014 by the Polish political parties to enhance energy security in Europe (the idea of the European Energy Security Treaty and Energy Union) and determines the role of these proposals for the energy security of the member states of the European Union. Formulated by Polish political parties (Law and Justice, Civic Platform), the concepts for energy cooperation between the EU resulted from the comparable importance of energy in modern international relations. Politicians from both political parties were aware of the dependence of many countries of the European Union on energy supplies from the Russian Federation and the nature of the foreign policy pursued by Russia. Consequently, they indicated the need for close political cooperation, both with the importers and exporters of energy resources. In terms of political science analysis of this issue it is important from both the theoretical and practical point of view, as it relates to the determination of the essence of understanding by policy makers of changes taking place in Europe, as well as the distinction between the measures and actions taken to ensure energy security in the EU. The concepts proposed by the two political party’s resulted from the need to pursue an active foreign and energy policy. Nevertheless, clear assessment of the concept of Law and Justice and Civic Platform is difficult to determine.

Sam plan stanowi oczywiście ogromne wyzwanie logistyczne, ale jednocześnie może rodzić pewne wątpliwości co do jego zgodności z prawem międzynarodowym. Artykuł niniejszy ma na celu odpowiedzenie na pytanie, czy działanie polegające na holowaniu góry lodowej może w istocie stanowić naruszenie przepisów prawa międzynarodowego, w tym szczególnie Układu Antarktycznego oraz prawa morza.
In the ongoing climate crisis, more and more states of the world undertake initiatives thatwould reduce negative impact of dangerous growth of global average temperature, includingdroughts, drowning of coastal cities and water shortage. Recently, an ambitious idea to providehuge supplies of water for the population of the United Arab Emirates was initiated by one ofEmirati businessmen – Mr Abdulla Alsheni, who plans to tow a huge Antarctic iceberg to thecoast of Emirates. The plan itself is a logistic challenge, but at the same time may raise certain concerns on its compliance with international law. Hereby article has as an aim response toa question whether an act of towing an Antarctic iceberg would breach international law provisions, particularly those related to Antarctic Treaty System and law of the seas.

The aim of the article is to present the issue of the freedom of navigation on international rivers in the context of the Oder case brought before the Permanent Court of International Justice in 1929 – a case of utmost importance for the development of the law of international watercourses and contemporary international law applicable to water resources. The author analyses the provisions of the Treaty of Versailles which declared the Oder to be an international river and put it under the jurisdiction of an international commission. The territorial jurisdiction of the International Commission of the River Oder was disputed between Poland and Germany, leading to the aforementioned proceedings before the PCIJ. The author presents the arguments put forward by both parties, the legal context of the case – in particular the provisions of the Treaty of Versailles and of the Barcelona Convention – and analyses the Court’s judgment. An analysis of the judgment is carried out, having recourse to the main concepts of the law of international watercourses.
