    Opis:
    Rozdział XI Kodeksu wykroczeń z dnia 20 maja 1971 roku [8], noszący tytuł „Wykroczenia przeciwko bezpieczeństwu i porządkowi w komunikacji”, dotyczy czynów zabronionych, mogących mieć miejsce w ruchu drogowym. Wśród nich można wyróżnić wykroczenia naruszające bezpieczeństwo w komunikacji. W artykule omówiono istotę prawną wykroczenia polegającego na niezastosowaniu się do znaku lub sygnału drogowego (artykuł 92 Kodeksu wykroczeń). Dodatkowo przedstawiono wyniki badań własnych, mających na celu sprawdzenie stosowalności tego przepisu w praktyce.
    Chapter 11 of petty offences’ code from 20 May 1971 [8] entitled “offences against safety and order in road traffic” concerns forbidden acts which may occur in road traffic. Among them the offences violating safety in communication can be distinguished. The article discusses the legal issue of petty offence which is disobedience to a road sign or road signal (article 92 of petty offences’ code) Additionally, the article presents own tests results which were to check the application of this regulation in practice.

    Opis:
    Improving road safety is a prime objective of the European Union’s transport policy. An important element of that policy is the consistent enforcement of sanctions for road traffic offences committed in the Union which considerably jeopardise road safety. In order to improve road safety throughout the Union and to ensure equal treatment of drivers, namely resident and non-resident offenders, enforcement should be facilitated irrespective of the Member State of registration of the vehicle. To this end, a system of cross-border exchange of information should be used for certain identified road-safety-related traffic offences, regardless of their administrative or criminal nature under the law of the Member State concerned, granting the Member State of the offence access to vehicle registration data (VRD) of the Member State of registration. A more efficient cross-border exchange of VRD, which should facilitate the identification of persons suspected of committing a road-safety-related traffic offence, might increase the deterrent effect and induce more cautious behaviour by the driver of a vehicle that is registered in a Member State other than the Member State of the offence, thereby preventing casualties due to road traffic accidents.

    Bei illegalen Autorennen in deutschen Innenstädten kommt es immer wieder zu tödlichen Unfällen. Się werden von den Gerichten i. d. R. als fahrlässige Tötung geahndet. Bis ein Urteil des Berliner Landgerichts mit einer Verurteilung der Raser wegen Mordes Rechtsgeschichte schreibt. Das bedarf der Begründung. Gerichtsurteile sind argumentative Texte. Vor dem Hintergrund der geltenden Grundlagen von Recht, Gerechtigkeit und Rechtsprechung werden in diesem Beitrag zwei gegensätzliche Urteile (in Köln und Berlin) über den vergleichbaren Tatsachverhalt, der einmal als fahrlässige Tötung, einmal als Mord bewertet wird, mit dem linguistischen und argumentationsanalytischen Besteck aus dem Instrumentenkasten der Forensischen Linguistik genauer betrachtet.
    Illegal car racing in German city centres repeatedly lead to fatal accidents. As a rule, they are punished by the courts as involuntary manslaughter. Until a judgement of the Berlin Regional Court makes legal history by convicting the speeders of murder. This requires reasoning. Court judgements are argumentative texts. Against the background of the applicable foundations of law, justice and jurisprudence, this article will take a closer look at two opposing verdicts (in Cologne and Berlin) on the comparable facts of the case, one assessed as negligent homicide, the other as murder, using the linguistic and argumentation-analytical cutlery from the toolbox of forensic linguistics.

    Opis:
    The main aim of EU´s Vision Zero is “no fatalities or serious injures through road accidents should be met by 2030”. With this long-term road safety strategy, the EU wants to purposefully and gradually overcome the failures of previous measures that have failed to result in reducing the number of road accidents victims. The last three years of EU policy on road safety have improved this area only minimally. This paper provides an analysis of the EU road safety strategies and deals mainly with the directive on the cross-border exchange of information. This directive seems to have become an effective tool for the prevention of cross-border traffic offences from a long-term perspective. The main aim of this directive is to take preventive action against road traffic offenders in order to correct their road behavior through sanctions to discourage them from committing more serious offences, including fatal accidents. This article also outlines current crucial findings resulting from the application of this directive, which should be resolved by its planned revision.
