Celem artykułu jest przedstawienie zagadnienia podstawy przetwarzania danych w celach marketingowych przez przedsiębiorców telekomunikacyjnych. Główny problem dotyczy stosunku przepisów sektorowych, jakimi są przepisy prawa telekomunikacyjnego do przepisów ogólnych wynikających z ustawy o ochronie danych osobowych. Zagadnienie to wymaga analizy kolizji norm, do której dochodzi pomiędzy tymi ustawami, w szczególności ustalenia treści normy kolizyjnej zawartej w art. 5 ustawy o ochronie danych osobowych, stanowiącym podstawę wyznaczania relacji przepisów ogólnych i sektorowych w tym zakresie.
The purpose of this article is to present the issue of processing data for marketing purposes by telecommunication companies. The main issue raised in the article is the relation of sectoral rules contained in Telecommunications Law to general provisions under the Personal Data Protection Act. The issue requires analysis of a conflict occurring between these laws. In particular it is necessary to determine the normative content of Article 5 of Personal Data Protection Act, which is of basic importance for determining the relationship between general and sectoral provisions in this regard. - Źródło:
