Opis:
General legal position of an individual in terms of education is shaped by the norms of constitutional weight. Among them a special place is taken up by the principle of equal access to education, which is one of the guarantees of the right to education. In the author’s opinion, the above mentioned principle has a close relation to educational diagnostics, especially its normalized part, which is didactic measurement. Therefore, an extralegal element, which is the measurement (of its quality), has a significant influence on the legal position of an individual and determines the possibility to use one of the most fundamental rights. From the pedagogical perspective, the author proposes taking into account the legal environment in which educational diagnostics functions, and which – although roughly – he presents in the article, whereas from the legal perspective he points out to the necessity of taking into account the educational diagnostics’ conditioning in the evaluation process of implementing equal access to education.

The main aim of this paper is to raise reflection on the conditions of respect for the right to education in the unexpected, pandemic time and after. The right to education is presented as the main agent of personal and social well-being, respect for human dignity, and the power of changing the world. The main question that organizes the structure of this paper concerns the conditions of respecting the right to education in Poland during remote education forced by a pandemic. Attention is focused on conditions, such as the place of living, possibilities for parents with different levels of education to support students, and access to broadband Internet. The discussion highlights the role of imagination as a factor of change in education and ways of respect for the right to education.

It is almost a consensus among the Brazilians that, in order to solve the social issues, the education must be improved. Thus, the present study aimed to analyze the Brazilian key-thinkers on education. Rui Barbosa, Fernando de Azevedo, Anísio Teixeira, Cecília Meireles, and Paulo Freire were selected because they worked to develop some aspects of education: politics, educational system, philosophy of education, childhood education and pedagogical methods. These intellectuals fought against powerful societal forces, but they did not give up on transforming the Brazilian education, and, consequently, the Brazilian society. Therefore, they were selected to represent the Brazilian key-thinkers on education.

The article discusses the theoretical assumptions of research, the expression of education in modern society, analyzes scientific theories, and presents the development of educational accessibility in Europe and Lithuania. The relationship between public transformation and access to education is also analyzed, the essence of access to education and the problem of access to education in a transformed society are analyzed. The methodology and methodology of empirical research on the accessibility of education for students of grades II – IV G are presented. Lithuanian and EU documents regulating education reform and accessibility are analyzed, the results of the research on accessibility of education for students of grades II – IV G and their interpretation are presented. The preconditions for the provision of educational and social services that ensure equal access to education for pupils of grades II – IV G are also discussed.

The paper deals with the issues related to the right to education under the Constitution of the Republic of Poland of 1997 and to the actual operation of the education system. The main focus is on the constitutional guarantee of equal access to education. This guarantee should be treated as Kant’s Regulatory Idea which should be pursued by public authority though its full attainment is not possible in social reality. This study attempts to indicate to what extent the state’s obligation to ensure equal access to education is implemented by the institution of the school in Poland.
Artykuł obejmuje rozważania dotyczące problematyki związanej z prawem do nauki na gruncie Konstytucji Rzeczypospolitej Polskiej z 1997 roku oraz w praktyce funkcjonowania systemu oświaty. Szczególną uwagę poświęcono konstytucyjnej gwarancji równego dostępu do wykształcenia. Gwarancję tę należy traktować jako Kantowską ideę regulatywną, do której władza publiczna powinna dążyć, ale której pełne osiągnięcie nie jest możliwe w rzeczywistości społecznej. Celem niniejszego opracowania jest próba wskazania, w jak dużym stopniu instytucja szkoły w Polsce realizuje ciążące na państwie zobowiązanie zapewnienia równego dostępu do wykształcenia.

Aim. The purpose of the study is to research the career of Professor Ioannikii Malynovskyi in higher education, his contribution to its development, the goals of the university education. Methods. In the study several different methods were used in the system and interaction. A dialectical method, which boils down to the fact that all phenomena in society have a beginning and an end. The historical method was used to take into account historical traditions, socio-cultural roots of the state and law. A logical-semantic method was also used to help define the conceptual apparatus used in the study. Formal-legal method was used to analyse and disclose legal concepts. Results. The research showed that Malynovskyi conducted scientific researches in the chosen field and by getting acquainted with the heritage of national and world culture. The professor made considerable efforts in education to democratise higher education, in particular, by admitting women to higher education in Western Siberia. He defined the goals of university teaching: 1) to learn to acquire knowledge, the method of scientific research and, 2) to get acquainted with the current state of science. The scientist was the first to create a chronologically consistent, comprehensive subject course on the history of Rus’ law. Conclusions. Malynovskyi’s contribution to the democratisation of higher education already belongs to history, but his scientifically based recommendations on the goals of university education and means of achieving it are not without relevance today, but especially on the practical side in training future legal practitioners  which are topical for today.

Opis:
Teaching children and youth with disabilities is an integral part of the education system in Poland. In publication is provided selected issues from the many legal instruments pertaining to the principles of the organization of special education pupils with a disability in the aspects of: 1) the strategy deciding on equalization of educational opportunities of disabled people, 2) ensuring conditions for learning by preschool and school chosen by the parents, 3) implementation of special education on the basis of quantitative analysis SIO Ministry of National Education. This is in close connection with the creation of legal arrangements giving the chance to earn an adequate education and equal participation in the life of people with disabilities. Based on the analysis of desk research/quantitative data obtained from of Educational Information System (SIO), showing that in the school year 2013–2014 in all kinds of kindergartens and schools has educated a total of 135 506 pupils with various disabilities. Public primary schools were the most frequently chosen for childrens: with low vision (~43.4%), hearing impaired (~41.4%) with autism/ Asperger’s Syndrome (~39.4%), with movement problems (~39%), the blind (~19.8%), with multiple disabilities (~16%), deaf (~12.5%). While the a total of students (135 506) with a disability education in mainstream secondary schools continued 7 222 (approximately 5,3%) of students. In special secondary schools continued training 13 027 (approximately 10%) of the students. Students with the ruling about the need for special education due to different of disability have the right to education at all levels of education in the school chosen by the parents, but not all graduates in gymnasiums are enrolled high schools.

The article concerns the subject of homeschooling practice conditions in Poland – it focuses on the legal conditions and outlines the socio-economic conditions in which Polish homeschoolers operate. It discusses the specific kind of right which is the right to education, its position in the systematics of the constitution and the connection to the learning duty and school duty. It brings attention to state-citizen relations and the rule of state subsidiarity. It points to legal regulations which allow realization of the school duty outside of school, underlining the controversial and discriminatory regulations which ignore the parents’ priority to decide on their own children’s education and treat children learning in this way unequally to those who attend school. The article is ended by an observation about the state remaining decisive on the form of education of each citizen, despite the constant change of legal regulations, which in relation to the discussed subject characterizes the last three decades.

Various quantile regression approaches are implemented to analyze the characteristics of Italian data on earnings in the tails. A changing coefficients pattern across quantiles shows increasing returns to education along the wage distribution. A quantile decomposition approach shows that higher education grants higher return at all quantiles, thus implying additional, non-linear returns to higher education throughout the entire pattern of the earning distribution. Wage gender gap displays a decreasing pattern across quantiles, and it does not disappear at the higher quantiles. The southern workers penalty decreases across quantiles as well for highly educated workers.

In 2003 Madagascar joined the UNESCO “Education for All” programme. The primary objective of the programme is to improve accessibility to and the quality of the education system. Although there has been progress in achieving universal primary education, this progress has not been accompanied by the necessary safeguards for ensuring quality of education. According to the UNESCO report “Éducation pour tous. Madagascar 2015" only 79% the Malagasy children who started school went on to complete their primary education. The PASEC (Program on the Analysis of Education Systems) report also shows the low quality of education – children repeating school years together with low educational outcomes in Mathematics and French. This poor quality of education is undoubtedly in violation of the rights of children to their individual development. This article attempts to answer the question about the causes of the low quality of education in Madagascar. According to the author it’s important to note that apart from poverty and child labour the low professional qualifications of teachers is also a contributory factor.

There is neither consensus whether the category of linguistic rights shall be distinguished, nor international agreement on the catalogue of such rights. Nevertheless, access to education in mother tongue constitutes a core element of most of the international and national frameworks of minority protection. Academic and legal disputes are particularly absorbing in Europe, where linguistic policies frequently intertwine with politics (e.g. Cyprus, Moldova, Ukraine). Thus, it is essential to pose the question, whether the right to education in mother tongue is always granted the equal scope of protection or is such protection differentiated by any additional criteria. Most of all, it shall be considered whether the analyzed right has an independent character or its protection is associated with perception of other fundamental rights and freedoms. This paper investigates the scope of the protection of this right within the framework of the Council of Europe.

Why does the state have power in the area of education over parents’ wishes? The first reason has already been explained above: these are financial and economic aspects. The second reason is of historical nature. The state has controlled education in general historically. When in the 19th century the idea of public schools was created, the state sponsored such schools. Private schools were in a good condition, since they had their own sponsors or proceeds from pupils’ tuitions. When they lost their self-sustainability, they had to request the state for some support. And, as mentioned above, the state had its interest in controlling the educational system, because it wanted to influence the upbringing process of its citizens and create an ideology, which would help to achieve the government’s goal.

The paper presents the results of the analysis of factors differentiating the level of monthly net incomes in Poland. In the first step of the research, one-way ANOVA was applied in order to verify whether the level of education influences incomes. Subsequently, it was investigated whether such variables as sex, age, the class of residence, region, experience, study major and occupation additionally differentiate the incomes of persons with a higher education. The analysis makes use of the individual data from Social Diagnosis gathered in 2009. All the calculations were performed with the application of IBM SPSS STATISTICS 20 package.

The aim of the article is to identify attitudes towards higher education of graduates of high schools in Białystok and to identify the individual and social factors influencing these attitudes. The decision-making model presented in the article included the personal preferences, peer groups, teachers and parents as a factors determining the value of higher education, the criteria of study selection and the expectations associated with them. The decision-making process associated with the choice of an educational path has a nature of investment decisions that are highly unpredictable because of delaying desired outcomes. That’s why the decision-making process of graduates of high schools have to be highly social in nature.
