The Act of 20 July 2018 on Higher Education and Science is the eighth Polish normative act of statutory rank since 1920 to deal with matters concerning the title of professor, not counting separate acts and their amendments. It is also the first act based on the regulations in force before 1965 to regulate in a single act matters of higher education and science. Despite their new formulation, not all of the solutions implemented by this Act imply a full withdrawal from the regulations adopted in previous years. What is absolutely new in it, however, is the simplification of the procedure and conditions of the proceedings for conferring the title of professor through: (1) a new definition of fields of science (arts) and scientific disciplines (artistic disciplines) based, following the OECD classification, on the two-tier qualification of sciences (with some exceptions); (2) the constitution of the Council for Scientific Excellence, as a new institution, as of 1 January 2021 exclusively endowed with the right to initiate proceedings for the conferment of the title of professor (including refusal) and the subsequent process, ending with a positive or negative decision of that Council. Other solutions of this law have been subject to broader or narrower changes or have been retained in their current wording. Those of such a nature constitute answers to the following questions: (1) On whom may the title of professor be conferred, and in relation to whom, despite meeting the requirements for it, is this unacceptable, for other statutory reasons?; (2) What requirements does the legislator expect from a candidate for this academic title, and to what extent do the expectations placed on them – outstanding scientific (artistic) achievements – go beyond the framework of the previously binding standards in this regard?; (3) What determines the selection of candidates for reviewers in this procedure, and what is the procedure for selecting them?; (4) What are the conditions for a candidate’s legal protection against negative decisions by the Council for Scientific Excellence, taking into account (5) the conditions for the President of the Republic of Poland’s participation in this procedure, which have remained unchanged since 1990?

The interpretation of the law plays a specific role in the whole legal system. In the vast area of constantly changing provisions of administrative law, with all their numerous imperfections, this interpretation takes on particular importance. An interpretative decision may be a simple reflection of a provision’s content, or it may take a slightly different form determined as a result of decoding it in the process of interpretation. The interpreter of the law must be guided by the requirements of the law, and achievements of the general theory of law, it must be based on rational grounds that allow for a reasonable and fair balance of arguments that are important in each case. It is primarily the letter of the law, the place of regulation in the legal system and the functions and purposes assigned to the interpreted provisions that determine the result of the interpretation. In the process of applying the law, this result determines the content of a decision taken. It has a significant influence on the position of the individual bound by such a decision, also in situations where this decision may cause justifiable apprehensions about its fairness. The interpretation of the law ordinarily focuses on resolving doubts against the background of specific cases under consideration. The article presents such a situation. I describe controversies relating to the interpretation of one of the provisions formulating the conditions that must be met by a person applying for the title of professor. In this case, it is a matter of the conditions for achievements obtained by her in training academic staff. The assumption that these conditions had not been cumulatively met affected a decision of the Central Commission for Degrees and Titles to refuse the presentation of the candidate to the President of the Republic of Poland for conferral of this title. But is there always a legal justification for challenging the fulfilment of these conditions? I will try to answer this question in this paper.

The purpose of this paper is both to present issues related to the interpretation of currently in force provisions on awarding degrees of doctor, habilitated doctor and the title of professor in the light of the Higher Education Law, as well as to attempt to reflect on whether a specific model of scientific promotion (career path) can be found in the analysed regulations. The issues seem to be of key importance for the practice of applying the latter, especially if one assumes that the supreme purpose of a particular model of scientific career is to ensure the highest quality of scientific research.

The issues concerning the conferment of the title of Professor regulated by the law on academic degrees and academic titles covered a period of twenty-five years. This is much shorter than subjecting proceedings in this area to the law on higher education for the past forty-five years. It is not without reason that during the seventy years (1920–1990) covered by both parts of the study issues related to the conferring the title of professor were subject to significant changes, in accordance with the changing legal and factual reality of the People’s Republic, the Polish People’s Republic, and the Republic of Poland. The 1965 Act on Academic Degrees and Scientific Titles undoubtedly differed from the legislation in force in the People’s Republic and in the first years of the Polish People’s Republic. Its unquestioned advantage was: (1) a limited number of academic titles of professor, restricted to extraordinary and ordinary professor, (2) identified fields of science in which these titles could be awarded, and (3) a gradual simplification of the procedure for applying for the award of the academic title to a candidate in universities, scientific institutions of the Polish Academy of Sciences and research institutes. Although in this respect, the provisions of the Act of 1965 together with the secondary legislation issued on its basis were subject to amendments, as a rule they were limited to clarifying the legal solutions adopted earlier, or to increasing the requirements imposed on candidates for the title of professor, except for candidates not possessing a degree or a scientific title, subject to a separate legal regime dictated by exceptional cases. The wider scope of changes concerned the procedure for presenting to the Prime Minister by competent ministers and the Scientific Secretariat of the Polish Academy of Sciences (PAN) candidates for the academic title and the requirements related to the obligation put on these bodies to seek the opinion of the General Council for Higher Education, the Central Qualification Commission, or competent Higher Education Councils in the scope of a relevant science.

There may be circumstances where academic degrees or the title of professor are obtained deceitfully, i.e. in breach of copyrights or moral principles in science. Dishonesty in scientific research constitutes gross misconduct because it is executed in order to appropriate ideas, findings, collocations and theses of others, without accurate citation of the source. It also entails infringement of intellectual property rights. Scientific misconduct in ethical and legal aspect is explicit. It disqualifies the offender as a scientist. The unlawful act of obtaining an academic degree (Ph.D.) or the title of professor in such a deceitful manner, irrespective of how much time has passed, shall not make the resumption condition fall under the statute of limitations. Thus, it enables the reopening of procedures to deprive the person who deceitfully obtained an academic degree or title of this degree or title.

The political changes initiated in 1989 affected many sectors of the state’s activity, including higher education and science. In 1990, the Sejm passed two new Laws – on Higher Education, and on Academic Degrees and Title. The former placed greater emphasis than before on the freedom to conduct scientific research. With the second act, it finally abandoned the possibility provided for by the 1965 solutions of granting two different titles of professor, i.e., associate professor and full professor, by introducing one academic title – “professor”. For the purposes of evaluating and establishing the significance of the solutions adopted by the 1990 Law, this article presents the procedure and conditions for awarding the titles of professor provided for in the 1965 Law in the wording in force prior to its repeal in 1990, as well as those introduced set out in the 2003 Law and in force until its amendment in 2011. The replacement of the two titles of professor with a single academic title did not limit the range of proposals for changes introduced at that time. In the article, particular attention is devoted to these. The main trend in research comes down to: (1) how the degree and scope of regulations adopted in 1990 differed from earlier solutions, and (2) whether, in the context of the 2003 Law they were sufficient and served the quality of academic advancements well. It is only by basing research on previous findings in this respect that conclusions could be drawn as to the legal meaning and significance of conferring the title of professor in the years 1990–2011. This approach in achieving the purpose of the discussions was also important foranother reason. It made it possible to emphasize the changes in terms of awarding the title of professor from the solutions in force during the Polish People’s Republic to the norms adopted in the initial years of the political transformation, as well as to the new regulations introduced in the more strongly established Republic of Poland. These were not the same solutions, and the Act of 1990 placed them in thegroup of liberal solutions.

In the commented order, the Supreme Administrative Court held that the matter of conferring the title of professor is an administrative matter. The court assumed that the conferring the title of professor is not a discretionary decision of the President, falling within the scope of his personal prerogative. The decision of the President of the Republic of Poland falls into a category “acts or actions related to public administration regarding rights or obligations under legal regulations” referred to in Art. 3 § 2 point 4 of the Act of August 30, 2002 – the Law on proceedings before administrative courts. The President of the Republic of Poland should be treated as an administrative body in a functional sense, and thereby a lack of action or excessive length of proceedings in this case can be a subject to review by an administrative court.
W glosowanym postanowieniu Naczelny Sąd Administracyjny uznał, że sprawa nadania tytułu naukowego profesora jest sprawą administracyjną. Sąd przyjął, że nadanie tytułu profesora nie jest uznaniową decyzją Prezydenta, wchodzącą w zakres jego osobistych prerogatyw. Decyzja Prezydenta RP zaliczana jest do kategorii „aktów lub czynności z zakresu administracji publicznej dotyczących uprawnień lub obowiązków wynikających z przepisów prawa”, o której mowa w art. 3 § 2 pkt 4 ustawy z 30 sierpnia 2002 r. – Prawo postępowania przed sądami administracyjnymi. Prezydent RP winien być traktowany jak organ administracji w znaczeniu funkcjonalnym, a tym samym bezczynność lub przewlekłe prowadzenie postępowania w tej sprawie może być przedmiotem kontroli sprawowanej przez sąd administracyjny.
