The rule of law of the state is beginning to be of particular and increasing importance in the current political situation. This requires a revision of views on the standards and expectations that one can have towards the law-abiding state and its apparatus. The scope of the issue thus determined requires reference to the constitutional concept of a democratic state governed by the rule of law and its role in determining imperatives in the activities of the state and its organs. It also raises the need to address the issue – is it sufficient for the existence of the rule of law in a state to only respect the supreme legal force of constitutional norms?

One of the manifestations of the systemic crisis in Poland is progressive centralization in the management of local affairs. The causes of the phenomenon under analysis can be justifiably traced to three factors that are complementary to each other. First, in a constitutional model of the local government which assumes that the legislator has a decisive influence on the scope of tasks entrusted to local government units as well as on the degree of independence of their execution. A consequence of a crisis around the agencies of the third estate is also the weakening of the efficiency of judicial measures of protection of that independence. Secondly, a considerable influence upon the phenomenon under analysis is exerted by the strategy for fighting the pandemic adopted by the public authorities based upon the construction of a ‘hybrid’ state of emergency where the dominant role is played by the central public authorities. Thirdly, further politicization of the local government has become a particular feature of its operation in the times of the pandemic.

Although the rule of law is a normative notion, it requires a multidimensional approach. It speaks to important issues of law and politics, and its respect is essential for both legal and social security. It can be observed within the European Union (EU) where the issue of respect for the rule of law by its Member States has gained particular importance. The main goal of our study is to contribute to the academic discourse concerning the EU rule of law. The analysis particularly considers the approaches adopted by the EU institutions to the definition of this concept. Consequently, the first part of the article concentrates on difficulties in defining the rule of law. The second part presents the evolution of the Court of Justice approach toward this concept. The next part contains the analysis of the attitudes presented by other EU institutions in their documents. In the conclusions, it is underlined that although the approaches of the EU institutions towards the rule of have evolved, and they have tried to define it and indicate its main components, certain issues require clarification, e.g., the relations of the rule of law with other values.

The Catholic church is an important actor on the political scene in Poland and its influence is visible- directly and indirectly. The article describes the issue and explains how the Catholic Church in Poland as an institution, as well as its clergy leaders,  refers to political conflict which was visible after the introduction the reform of the judiciary system in 2017. The main aim of the article is the reconstruction of the Catholic church’s clergy position on the reform of the judiciary in 2017. The article consists of four parts. The first on is focused on the theoretical consideration what the conflict is. The  second one suggests different interpretations of this conflict in Poland in 2017. The third part includes the official statements and speeches the clergy leaders of Polish Catholic church which refer to the reform of the judiciary in Poland. Moreover, this part also includes the position of the Apostolic See to this conflict. The last part are shown the voices of the journalists who considered the Catholic church attitude towards the conflict and the reform of the judiciary in Poland. The author, on the based on the collected materials about the issue, answers the essential questions: 1/ How does the Catholic church’s leaders define the political conflict in Poland? 2/ What was the Catholic church role in this conflict and how it was seen by the clergy? 3/ What was the Polish clergy attitude to the reform and the conflict? Moreover, were it an unambiguous position or appeared the voices of clergy who were against the official statements of the Catholic’s leaders? 4/ How reacted the public opinion, some journalists and politicians to the Catholic clergy official statement? 5/ What kind of consequences are, or can be in the future, of this particular Catholic church’s attitude to the reform of the judiciary in Poland 2017?

looking at two rarely associated concepts, civic unity and the rule of law. It attempts to bring a novel approach to the study of democratization in a divided society such as Ukraine, building on a selection of the existing literature on the subject and focusing on the civic dimension of the process. It follows the approach of those political scientists who have challenged the “no precondition’ line in democratization research by looking precisely at context specific conditions that may sustain democracy. It is argued that the common sense of citizenship and belonging to a political community, supported by legal and institutional mechanisms and conscious effort of political elites, would contribute to the development of civil society and perhaps even democratic consolidation in the long run. Thus the civic and institutional dimensions of democratization should not be separated, especially in case of some post-communist societies such as Ukraine. The relationship between these two dimensions, however, is problematic at least from a methodological point of view and requires careful examination.

The article presents multifaceted considerations and results of analyses concerning the necessity to perceive the phenomenon of corruption through the prism of a gross violation of constitutional values, the principles of the rule of law and social justice. The main focus is on discussing civic rights that are effectively eradicated by corruption, at the same time emphasizing a holistic and systemic approach to understanding and interpreting specific processes and decisions confirmed in practice. At the beginning, it is explained why a broad research perspective should be adopted to understand the essence of corruption. An important argument supporting the correctness of the adopted approach are statements contained in the Government Program for Counteracting Corruption 2018–2020. Next, the most important constitutional values and civil rights are indicated, which are not respected and remain only in the declarative sphere as a result of corrupt practices. In order to prove the illusory nature and facade of certain provisions of the Polish Constitution, important statements contained in the judgments of the Constitutional Tribunal are quoted, and then these interpretations are analyzed in relation to real situations occurring in everyday reality. These problem issues are presented from the perspective of the constitutional principle of equality before the law, social justice and non discrimination. It is also noted in this regard that corruption activities are precisely the main factor leading to the division of citizens into two separate categories according to the way they are treated. Finally, it is mentioned that in the European Union ever greater emphasis is currently being placed on compliance with the rule of law. This problem is closely related to the need to understand the negative consequences of corruption as an element that undermines trust in the state, constitutional order and the rule of law.

The purpose of this article is twofold: on the one hand, to relate the fiscal and financial model to the Social and Democratic Rule of Law, on the other one, to transfer Spanish experiences that may be of interest to Poland, as both countries began their democratic experience and integration into the European Union a few decades ago. From a multidisciplinary perspective, the contributions that law could make to the field of political economy can be of capital importance for the consolidation of our democratic systems, public order, and social peace, analyzing the role of religious confessions. Methodology. To achieve this purpose, the analytical-comparative-interdisciplinary method was chosen as it was considered the most appropriate one in view of the close connections between economics, law, progress and social peace. The result of the research. The work shows that democracies, although they are the most effective models for achieving the highest standards of progress, and even though in the Polish and Spanish cases, they have the advantage of having served to bring dictatorial periods to an end, there is a need for effective control mechanisms. Democracies absolutely cannot degenerate into corrupt and ineffective systems under the control of large political and partisan oligarchies. The independence of the judiciary is, in this sense, an essential and inalienable element in guaranteeing the correct functioning of other state institutions. It is necessary to insist on the importance of the legal norm as an instrument of political control and its impact on macroeconomics, and the consolidation of democratic regimes, even more in the context initiated with the respective integration processes in the European Union. On the other hand, the aim is to show how beneficial tax treatment for religious denominations has a powerful effect on the achievement of the common good and social peace. In addition, it is about relating importance that has the budgetary balance and mechanisms for controlling public expenditure for the maintenance of progress and social justice in a sustainable model.

Zasada Rule of Law należy do zasadniczych wartości ustrojowych, ujętych w art. 2 Traktatu o Unii Europejskiej. Została ona rozwinięta w orzecznictwie Trybunału Sprawiedliwości UE i skonkretyzowana w Rozporządzeniu Parlamentu Europejskiego i Rady UE z 16 grudnia 2020 r. Rozporządzenie wzmacnia kompetencje Komisji Europejskiej i jej autonomiczną funkcję jako strażniczki przestrzegania zasady Rule of Law przez państwa członkowskie. Przedmiotem niniejszego opracowania jest przedstawienie genezy państwa prawa w prawie pierwotnym UE oraz egzegeza Rozporządzenia w sprawie ogólnego systemu warunkowości ze zwróceniem uwagi na ustrojową konkretyzację zasady państwa prawa, normatywne ujęcie oraz ograniczenia systemowe związane z jego stosowaniem. Jako hipotezę badawczą przyjęto, że rozwój i konkretyzacja zasady państwa prawnego w prawie pierwotnym oraz jego normatywny wyraz w prawie pochodnym stanowią ważny krok w umocnieniu ustrojowych podstaw funkcjonowania UE połączony z możliwością wymuszenia przez KE przestrzegania zasady państwa prawa/praworządności przez państwa członkowskie.
The principle of the Rule of Law is one of the fundamental systemic values included in Art. 2 of the Treaty on European Union. It was developed in the jurisprudence of the EU Court of Justice and specified in detail in the Regulation of the European Parliament and the EU Council of 16 December 2020. The regulation strengthens the competences of the European Commission and its autonomous function as the guardian of compliance by the Member States with the Rule of Law. This study analyses of the genesis of the Rule of Law in primary EU law together with the exegesis of the Regulation on the general regime of conditionality, paying attention to the systemic realization of the Rule of Law, the normative approach related to it and systemic limitations to its application. It was assumed, as a research hypothesis, that the development and realization of the Rule of Law in primary law, as well as its normative expression in secondary law, constitute an important step in strengthening the systemic foundations of the EU’s functioning combined with the possibility of enforcing compliance by the European Commission with the Rule of Law by the Member States.

The paper analyses the principle of decent legislation and its significance for Polish administrative law. The principle in question derives from the concept of a democratic state under the rule of law. The significant role of administrative law in shaping the status of individuals (citizens) in the state as well as the influence of this branch of law on particular areas of social life are indicated. Due to the special characteristics of this branch of law, the principle of correct legislation should be absolutely taken into account in the legislative process that involves drafting of administrative legal acts. The case law of the Polish Constitutional Tribunal has distinguished certain elements or aspects of the principle of good legislation, including the following: non-retroactivity, protection of acquired rights, pacta sunt servanda, respect for pending interests or appropriate vacatio legis. The vast majority of them should be taken into account when working on administrative regulations. The paper also refers to the current crisis of administrative law discussed in the domestic literature from a practical point of view, by presenting two errors made by the legislator when amending administrative procedural laws. The conclusion of the study includes i.a. a proposal for a fuller involvement of experts, legal scholars and commentators, professional attorneys or administrative court judges in the process of drafting administrative laws.

The importance of ethical boundaries in the exercise of the right of defence has been written about for a long time. The defendants’ use of the entitlement granted to them by the legislator (Article 6 of the Code of Criminal Procedure) should harmonise with respecting the culture of criminal proceedings. Meanwhile, as practice has demonstrated, the culture of ongoing proceedings often remains outside the required standards of the process. The use of so-called “evasive defence”, assessment of participants to the proceedings through the prism of stereotypes, demonstrating offensive behaviour towards representatives of procedural bodies, or a superficial analysis of the evidence collected reinforce the negative perception of the course of proceedings, thus promoting inappropriate procedural patterns. Furthermore, these situations form the basis for the emergence of judicial mistakes, which usually leave a lasting mark on the further fate of the plaintiff in court. In accordance with theoretical assumptions, effectiveness in the exercise of rights of defence (Article 6 of the CCP) should correlate not only with the fundamental objectives of criminal proceedings (Article 2 of the CCP) but also with well-established assumptions that comply with the standards of diligence as broadly understood, along with the fulfilment of the procedural guarantees of the parties to the proceedings. This paper focuses on crucial issues related to the ethical boundaries of the exercise of the rights of defence. The issues discussed herein are supported by conclusions drawn from the analysis of the outcomes of case studies.
