This article examines Chinese-Philippine cooperation within the framework of the Belt and Road Initiative (BRI). This is an intriguing issue because, in 2016, many people predicted that China would exclude the Philippines from the BRI framework due to their dispute over the Scarborough Shoal. Former Philippine President Benigno Aquino III had criticized China’s South China Sea maritime expansion, but Duterte changed the country’s foreign policy in 2016. He followed China’s advice and moved forward, resolving differences between the two countries and developing a healthy bilateral relationship. This article found that the BRI framework is critical in this shift in diplomatic relations. China and the Philippines’ interdependence, as well as the shift in identity from an enemy to a partner, have both contributed to the improvement of China-Philippines relations.

Opis:
Air pollution emissions from road vehicles majorly contribute to particulate pollution. This poses significant threats to the environment and human health. Road dust contains various potentially toxic elements, which, when exposed to humans, can lead to severe illnesses such as asthma, cardiovascular diseases, and cancer. This study assessed adult health risks through accidental ingestion, inhalation, and dermal contact associated with heavy metals (Cr, Cu, Ni, Pb, and Zn) in road dust (with a fraction size < 0.1 mm). The analysis covers areas between sound-absorbing screens (S), in open spaces without screens (F), and at highway/express exits (E) with different surfaces: asphalt (A) and concrete (C). Results indicate the highest health risk levels are associated with Zn in road dust in S and E areas, indicating its potential negative impact on human health. When comparing results for all metals, road dust collected from A surfaces might pose a greater health risk than C surfaces. The carcinogenic risk for Cr and Ni found in road dust collected from A and C surfaces at points S, F, and E is medium. The most significant carcinogenic risk (medium-high) is associated with Cr in road dust from A surfaces in the F area, whereas the lowest risk (low-medium) for both A and C surfaces is linked to Ni exposure in the S point. The contributions of Cr and Ni highlight the need to reduce emissions of these elements in areas surrounding heavily trafficked roads.

Opis:
The underground mining of minerals with a longwall system requires the construction of two parallel galleries (bottom road, top road). As the longwall progresses, they are eliminated (mining from the boundaries). Reconstruction of this area, i.e., the wall-road crossing, is usually carried out manually. Other methods can be used to reduce the physical effort of handling the wall. One way is to use supports dedicated to these locations and an example of such a solution is the HENNLICH-20/43-CH support. The article discusses the advantages of using mechanized power support as an alternative to development with individual props. The technical parameters of the selected type of mechanized power support are presented.
Eksploatacja podziemna minerałów systemem ścianowym wymaga wykonania dwóch równoległych wyrobisk korytarzowych (chodnik podścianowy i nadścianowy). W miarę postępu ściany następuje ich likwidacja (eksploatacja od granic). Przebudowę tego miejsca, czyli skrzyżowania chodnik-ściana, dokonuje się najczęściej ręcznie. Możliwe jest zastosowanie innych sposobów pozwalających zmniejszyć wysiłek fizyczny obsługi ściany. Jednym z rozwiązań jest wykorzystanie obudów przeznaczonych do tych miejsc. Przykładem takiego rozwiązania jest obudowa HENNLICH-20/43-CH. W artykule omówiono zalety zastosowania zmechanizowanej obudowy skrzyżowań stanowiącej alternatywę zabudowy z użyciem stojaków indywidualnych. Przedstawiono parametry techniczne wybranego typu obudowy zmechanizowanej.

The hippie subculture has created a large number of its own values, signs, symbols, ideas and folklore elements. The hippie movement in Russia, called sistiema, was a manifestation of mainstream‑rejecting activities comparable to the Western countercultural movements of the 1960s. With the dissolution of the Soviet Union, the subculture significantly modified itself, but the developed traditions, practices and behaviours are still present among certain youth groups. A contemporary take on the hippie culture was presented by Irina Bogatyreva in her debut novel AutoSTOP (2005). This article attempts to analyse its text from the perspective of a continuation of the hippie culture. It also focuses on the contemporary aspects of putting into practice a “hippie utopia”, considered as an alternative to the culture of consumption.

Autorka podejmuje w artykule analizę praktycznych skutków tendencji do rozszerzania katalogu celów publicznych w polskim porządku prawnym. Porusza w szczególności kwestię konsekwencji wprowadzania modyfikacji procedury wywłaszczeniowej określonej w ustawie o gospodarce nieruchomościami, w tzw. specustawie drogowej i rozporządzeniu w sprawie wyceny nieruchomości i sporządzania operatu szacunkowego. Na podstawie problemów z aplikacją zasady korzyści w wycenie nieruchomości przeznaczonych pod inwestycje drogowe wyjaśnia konieczność nakreślenia jasnej hierarchii w regulacjach dotyczących procedury wywłaszczeniowej. Celem artykułu jest określenie wybranych elementów efektywnego ekonomicznie i optymalnego pod względem prawnym modelu wywłaszczenia nieruchomości, który będzie równoważył interesy prywatnych właścicieli i rozwijającego się rynku inwestycji publicznych w kontekście odszkodowawczej odpowiedzialności państwa z tytułu legalnej ingerencji w prawo własności. Aktualność tematyki wynika z intensyfikacji prac związanych z lokalizowaniem infrastruktury technicznej, takiej jak drogi, linie kolejowe, lotniska czy porty komunikacyjne, i związanych z tym problemów legislacyjnych. Poruszone zagadnienia mają kluczowe znaczenie w kontekście wysokości przyznawanych odszkodowań za nieruchomości przejęte pod inwestycje celu publicznego, a co za tym idzie — określania relacji pomiędzy interesem publicznym a prywatnym.
The article analyzes the practical effects of the tendency to expand the catalog of public goals in the Polish legal order. In particular, it deals with the issue of the consequences of introducing modifications to the expropriation procedure specified in the Real Estate Management Act, in the so-called special road act and the regulation on the valuation of real estate and the preparation of an appraisal report. On the basis of the so-called "the principle of benefit", the research explains the need to outline a clear hierarchy in the regulations concerning the expropriation procedure. The aim of the article is to identify selected elements of an economically effective and legally optimal model of real estate expropriation, which will balance the interests of private owners and the developing public investment market in the context of the state's liability for compensation for legal interference with property rights. The importance of the topic results from the intensification of works related to the localization of technical infrastructure such as roads, railways, airports or communication ports and related legislative problems. The issues raised are of key importance in the context of the amount of compensation awarded for real estate taken over for public purpose investments, and thus — determining the relationship between the public and private interests.

Realizowana w Polsce sieć autostrad i dróg ekspresowych ma w rozwiązaniach szczegółowych pewne wady, szczególnie w obszarach węzłowych największych aglomeracji. Dla częściowego usunięcia tych wad artykuł zawiera propozycję realizacji w latach trzydziestych nowej dwujezdniowej drogi północ–południe z Olsztyna do Opola. Za budową tej trasy wymieniono pięć szczegółowo opisanych argumentów. Ponadto artykuł zawiera koncepcję przebiegu nowej trasy północ–południe na odcinku od Ostródy do Ostrowa Wielkopolskiego.
The article is an original proposal for the expansion of the national roads from Olsztyn to Opole via Brodnica, Toruń, Inowrocław, Konin, Kalisz, Ostrów Wielkopolski, Kluczbork. The network of motorways and expressways implemented in Poland has, in specific solutions, some disadvantages, especially in the nodal areas of the largest agglomerations. In order to partially remedy these defects, the article contains a proposal: to build a new dual carriageway in the mid-2030s north-south road from Olsztyn to Opole. The justification for the construction of this route is based on five detailed arguments. In addition, the article contains a cartoon concept for the route of the new route from Ostróda to Ostrów Wielkopolski.

The first section of this paper presents in general terms the main ideas of literary Darwinism represented by Joseph Carroll, Jonathan Gottschall and other scholars concerning theory (literature as an adaptation) and interpretative practice. It also reviews the key arguments of this literary school's critics focusing on the papers of Jonathan Kramnick and William Deresiewicz. The second section is an attempt at applying Darwinian methodology to the interpretation of The Road by Cormac McCarthy taking into account its reception, style, the behavioural systems (survival, parenting, and cognitive activity), the literary context and the author's point of view.

This article discusses three films that helped landmark American cinema in the 1970s. Although differing in inception and reception, all three belong loosely to the genre of the road movie and are linked by protagonists whose stances of rebellion and alienation were characteristic of the counterculture of the 1970s and by the broader theme of existential self-definition that still influences moviemaking today. A critical and commercial failure on its release in 1970, Michelangelo Antonioni’s Zabriskie Point has been revalorized as an ambitious attempt to represent the political and cultural conflicts that seemed to be fracturing American society at the time. In contrast, Richard Sarafian’s Vanishing Point soon overcame the disadvantage of studio disinterest and established itself as a cult favorite. Arguably the definitive anti-hero of 1970s cinema, the amphetamine-fueled renegade driver played by Barry Newman achieves iconic stature through an act of defiant self-destruction that still leaves viewers of the film stunned. Finally, Clint Eastwood’s The Gauntlet, in which the actor-director breaks with his ‘Dirty Harry’ persona to depict a burned-out cop who redeems a ruined career, and enables himself a new start, not by making his own law but by enforcing the law on the books, and against all odds. In all three films, the still unspoiled landscape of the American Southwest, crisscrossed by its skein of highways, provides the tableau for escapist fantasies that may in fact be real, for high-speed chases and automotive acrobatics that defy the laws of physics, and for vignettes of an ‘outsider’ way of life that was already beginning to perish.

The article aims to show the next points of contact between public law and private law by presenting the civil and administrative legal effects of the decision on the permit for the implementation of a road investment (including its amendment and repeal), referred to in the Act of April 10, 2003, on special rules for the preparation of and implementation of investments in the field of public roads. The reason for the author to analyze the topic was the fact that the author has noticed the increasingly stronger interpenetration of the areas of public law and private law and problems encountered in legal practice. The article is a synthesis of the civil and administrative legal consequences – sometimes unintentional – of issuing and changing the decision on the permit for the implementation of a road investment, which have their source in the unilateral, imperative action of a competent public administration body. It is also another voice in the discussion on the advisability of the classic division into the two oldest branches of law.

Opis:
Increase in motorization and densification of populations in cities have led to the use of more resources both for the construction of different objects and for the service and operation of automotive vehicles. As a result, volumes of freight transportation, which are related to the construction and servicing of these objects, increase. New scientifically applied tasks that are related to the safety of freight transportation have emerged. Special attention is being paid to those that are related to dangerous tasks. It is obvious that traffic safety and the quality of the transportation process significantly depend on the behaviors and actions of the driver. The driver, as it is known, is the main chain of the “driver - automobile - road - environment” (DARE) system. With improvements in the technical and operational parameters of vehicles and road characteristics, the study of the functional state (FS) of the driver and the reliability of his skills become more important every time. The specific importance of this becomes clear when drivers operate vehicles that transport dangerous goods. Therefore, research on the interaction of chains of the DARE system (using improved existing and developed methods by the authors) is carried out in this paper, taking into account the indicators of drivers’ FS in different situations (stress index, which consists in evaluation of the heart and brain operations). The results obtained provide an opportunity to predict their behavior in different road situations and, as a consequence, to determine possible risks during the transportation of dangerous goods. The authors improved the methodology of determining the levels of possible risks of accidents and assessment of their consequences, taking into account the peculiarities of transportation routes, traffic conditions, and psychophysiological indicators of the driver`s body during the transportation of dangerous goods within settlements and on the roads between them.

Opis:
W niniejszym opracowaniu podjęto próbę szczegółowego, statystycznego opisu przestępczości prowadzenia pojazdów mechanicznych w stanie nietrzeźwości lub pod wpływem środka odurzającego przy wykorzystaniu dostępnych danych o liczbie przestępstw i skazań z art. 178a §1 k.k. oraz liczbie wypadków drogowych i kontroli trzeźwości kierujących. Liczba przestępstw z rozpatrywanego artykułu istotnie spadła od roku 2005 do 2016, podobnie zresztą jak ogólna liczba przestępstw w Polsce. Co oczywiste, mniejsza liczba wykrywanych rokrocznie przestępstw z analizowanego artykułu prowadzi do analogicznych spadków liczby osób osądzanych i skazywanych za to przestępstwo. Ale co ciekawe rośnie liczba warunkowych umorzeń postępowań sądowych z tego artykułu. Zmienia się także struktura orzekanych kar – istotnie spadł udział kary pozbawienia wolności z warunkowych zawieszeniem jej wykonania, a wzrósł udział grzywien i ograniczenia wolności. Wyniki szczegółowych analiz wymiarów poszczególnych orzekanych kar sugerują nieznaczne złagodzenie polityki karania za to przestępstwo. Wzrosła jednak istotnie liczba orzekanych środków karnych przypadających na jednego skazanego, w tym głównie świadczenia pieniężnego. Udział wypadków drogowych spowodowanych przez nietrzeźwych kierujących w ogólnej liczbie wypadków jest stosunkowo niski (ok. 6%) i systematycznie spadał w analizowanym okresie. Fakt ten, łącznie z systematycznie spadającą liczbą przestępstw prowadzenia pojazdu mechanicznego pod wpływem alkoholu lub środka odurzającego (przy ponad dwudziestoczterokrotnym wzroście liczby przeprowadzanych przez policję kontroli trzeźwości kierowców w tym samym czasie), wskazuje na korzystną i bardzo istotną zmianę społeczną w zakresie jazdy samochodem pod wpływem alkoholu. The number of such crimes significantly decreased from 2005 to 2016, as well as the overall number of crimes in Poland. Obviously, the smaller number of crimes detected leads to analogous decreases in the number of people judged and sentenced for this crime. But what's interesting is change in structure of sentenced penalties – the share of the penalty of imprisonment decreased significantly, and the share of fines and community service increased. The number of penal measures imposed per one convict, mainly including cash benefits, increased significantly. The share of road accidents caused by intoxicated drivers in the total number of accidents is relatively low (about 6%) and systematically decreased in the analyzed period. This fact, together with the systematically decreasing number of analyzed crimes and increasing number of police nchecks of drivers' sobriety at the same time, indicates a favorable change in social attitudes towards driving under the influence of alcohol.
