Within the set of principles of agricultural law there can be distinguished those that are directly or indirectly empowered in the Constitution of the Republic of Poland. The outcome of analyzing them according to this criterion may serve as contribution to better systematize these principles and to determine the extent of their consistency with the socio–economic model of the system. It also appears that the results of in–depth research of this issue could become useful in the determination of the constitutional norm for controlling legal solutions applicable to the existing provisions of agricultural law. As a result of the analysis conducted, it can be assessed that the principles of agricultural law proposed by P. Czechowski and A. Lichorowicz have multifaceted empowerment in the provisions of the Constitution, which allows to better understand and more fully define them. The only principle of a constitutional status, regarding the family farm as the basis of the agricultural system, for its greater usefulness, requires a wider application on the basis of ordinary laws. It seems that it is the requirement of the times to take a new, slightly more comprehensive, look at the principles of agricultural law and to cogitate on establishing new ones, particularly in the light of the experience of almost a decade of the Polish membership in the European Union and more than fifteen years of the Constitution of 1997.

It has been more than thirty years since, in the pages of “Państwo i Prawo” (State and Law), together with Professor Andrzej Stelmachowski, who is not with us anymore, we formulated the principles of agricultural law for the young, developing discipline of Juridical Science, i.e. for the agricultural law. Dynamic development of the agricultural law in the previous political formation (also continued in the free–market economy) required the formulation of specific guiding principles of this discipline of Juridical Science. The passage of time, the political transformation that took place in Poland after 1989 as well as Poland’s membership in the European Union require verification of the formulated principles of agricultural law. Existing agricultural law as well as the legislation of the European Union and national legislation allow the formulation of new principles of agricultural law and ranking them according to the importance of legal regulation. They include: 1. The principle of intervention impact on agriculture and rural areas by the European Union and nation states in accordance with the objective of the EU Common Agricultural Policy. 2. The principle of productivity including the stimulation of technical and agricultural as well as biological progress by the state. 3. The principle of protection of the productivity of land within the frameworks of the protection of natural resources in conjunction with development of spatial rural areas. 4. The principle of protection of the farm as a farmer’s workshop and of the protection of other forms of land management.

Celem artykułu jest nakreślenie problematyki prawnej obrotu nieruchomościami rolnymi w Unii Europejskiej. Obrót ten w pełni podlega podstawowym zasadom traktatowym. Szczególne znaczenie w odniesieniu do transgranicznych operacji związanych z obrotem nieruchomościami rolnymi w Unii Europejskiej ma swoboda przepływu kapitału, uregulowana w art. 63 Traktatu o funkcjonowaniu Unii Europejskiej. Przepisy prawne obowiązujące w państwach członkowskich UE powinny zatem zapewniać możliwość korzystania z tej swobody przez obywateli innych państw członkowskich. Swoboda przepływu kapitału nie ma jednak charakteru absolutnego. W świetle ugruntowanego orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej możliwe jest wprowadzenie na poziomie krajowym regulacji ograniczających tę swobodę pod warunkiem, że będą one służyły realizacji celów interesu ogólnego oraz będą odpowiadać zasadom proporcjonalności i niedyskryminacji.
L’articolo si propone di delineare la problematica giuridica concernente la compravendita di fondi agricoli all’interno nell’Unione europea, in quanto essa risulta pienamente soggetta ai principi di base stabiliti dai trattati. Di particolare importanza per le operazioni transfrontaliere legate alla compravendita in esame si rivela la libera circolazione dei capitali, disciplinata dall’art. 63 del trattato sul funzionamento dell’Unione europea. Le disposizioni di legge in vigore negli Stati membri dell’UE dovrebbero pertanto garantire ai cittadini di altri Stati membri la possibilità di esercitare questa libertà. Tuttavia, la libera circolazione dei capitali non è assoluta. Alla luce della consolidata giurisprudenza della Corte di Giustizia dell’UnioneEuropea, è del tutto possibile introdurre regolazioni che limitino la suddetta libertà a livello nazionale, a condizione che servano a perseguire gli obiettivi di interesse generale e rispettino i principi di proporzionalità e non discriminazione.
The aim of the article is to outline the legal issues of trading in agricultural property in the European Union, which is entirely subject to basic treaty rules. The free movement of capital, regulated in Article 63 of the Treaty on the Functioning of the European Union, is of particular importance in relation to cross-border operations connected with trading in agricultural property. Therefore the legislation in force and applicable in EU Member States should ensure that citizens of other Member States have the possibility of exercising this freedom. However, the free movement of capital is not absolute. In the light of the established case-law of the Court of Justice of the European Union, regulations limiting free movement of capital may be introduced at national level, provided that they pursue general interest objectives and comply with the principles of proportionality and non-discrimination.
