In the last decade on Polish roads has been recorded every year, at least 70,000 driving under the influence. Such statistics put Poland ahead of EU countries with the highest number of intoxicated drivers. There is also no doubt that the risk of road accidents is increasing along with the number of drivers with are drunk. Although there are numerous publications addressing issues of offences relating to driving under the influence, this publication containing the analysis of court cases with this range. This work also presents consideration for actually meted sanctions and measures against people who committed offences relating to driving under the influence. Article consist an introduction, codex regulation of art. 178a § 1 and 4 of the Polish Criminal Code, statistical considerations and conclusion.

Opis:
Think tanks of the United States as a functional prototype of modern analytical centers are explored in the article. The main factors that determined the formation of think tanks in the United States in the early years of the twentieth century were distinguished, in particular: 1) the economic boom in the United States at the beginning of the 20th century; 2) course of administration of T. Roosevelt; 3) cartelization and trasification of the national economy. The process of formation of the official institutionalized elements of the system of expert-ideological influence in the 19101920 years was analyzed. The types of non-state structures of expert support of foreign policy processes of this period are distinguished, such as: 1) non-governmental think tanks, whose activities are directed on ideological substantiation, expert evaluation and advocacy support of foreign policy; 2) councils and associations created to coordinate with the assistance of scientists economic and political interests of business and the state. The influence of the first think tanks of the USA on the public decisions making process is considered. The influence of the Industrial Revolution, private philanthropy and the Great Depression on the formation and development of American think tanks is analyzed. The influence of the Rockefeller Foundation and the Carnegie Foundation on the process of the formation of think tanks in the United States is considered. The influence of the Second World War and the Cold War on the formation of expert-analytical organizations in the USA was determined. The peculiarities of the development of think tanks of the USA in the 40’s - 50’s of the twentieth century, which were caused by a new wave of expansion into the European market of American corporations and banks, were considered. The ideological and organizational changes in the work of think tanks of the USA in the 1960s were explored. The main political events that have created the context for the distribution of disproportionately large numbers of conservative think tanks in the 1970s are analyzed, in particular: 1) political mobilization of business and corporations; 2) political conversion and aggressive propaganda by the neo-conservative intelligentsia; 3) the political mobilization of evangelical and fundamentalist Christians; 4) the prevalence of neoclassical economic theory at universities and among key politicians. The reasons that prevented the creation of non-conservative think tanks in the 1960s-early 1970s are researched, namely: 1) the adoption by Congress of a tax reform law which has tightened restrictions on the political activity of private foundations that historically are major sponsors of think tanks; 2) reducing the resources of the Ford Foundation and reducing its interest in funding analytical centers; 3) a decline in the cost of research and development of the Ministry of Defense, historically another important source of funding for think tanks in the United States. The causes of the emergence and spread of ideologically oriented think tanks (lawyer type) in the USA in the 70s and 80s of the 20th century, which openly demonstrated commitment to a certain policy, party or ideology, carried out aggressive propaganda and sought to make influence the discussion of issues current policy are analized. The current condition of think tanks in the USA is considered. It is established that the process of developing strategic ideas by think tanks of the United States is closely linked with the applied orientation towards obtaining specific socio-economic and political results. American think tanks are directly influenced primarily by public interests and have a close connection with the interests of large American business. They are quite different from similar organizations in other countries, with the active participation of many of them in the political process and widely funded from various sources. American think tanks are directly and indirectly ready to participate in shaping public policy, and politicians, in their turn, are appealing to them for advice.

Our perception of reality is subjective. Each person perceives reality in a different way, experiencing only a fraction of it. And yet we believe, or rather we want to believe, that there is an objective reality. Today one needs an extensive knowledge so as not to get lost in the hotchpotch of information provided by the modern media, and to find the information essential for us. Subconsciously, we are looking for an authority to provide us with an interpretation of reality, explanation, personal opinions and even instructions on how to understand it. Mass media have taken up this role in the modern, technologically developed society. The belief in the omniscient media drives people to perceive the media-generated images and news as more real than their own life experiences. Not without a reason the media consciously resort to manipulation. There is a conviction that one can rule over people by gaining power over their imagination. An average receiver of the 21st century media is a perfect target for the modern television, Internet, video games, etc; overworked, tired and stressed, s/he will trust the media and the information they provide. And again we come back to the question of whether it is the media that create the world, or is it the world that shapes the mass media? Whatever the answer, we arrive at further questions: the question of responsibility in the communication process, responsibility for spreading honest and reliable information, and responsibility for creating social relationships.

Opis:
The author of the article sheds light on the most important aspects of the approach to the study of the biblical texts based on tradition, that is the history of the influence of the text – Wirkungsgeschichte. In the first part he shows the philosophical foundations (H-G. Gadamer) and the historical-theological origin of the method that is one more response to the shortcomings of historical-critical studies. In the next point various definitions and formulations of Wirkungsgeschichte are discussed that can be encountered in academic publications, especially written by German exegetes. The article is concluded with a critical evaluation of the approach from the point of view of Catholic hermeneutics and the theological-dogmatic principles formulated in the documents of the Catholic Church (cf. Dei Verbum 12).

Opis:
The article analyses the influence of a particular name on the individual's life and the development of his script. It contains the examples taken from psychotherapeutic practice and the results of the study conducted on a group of students, which reveal that most of them believe that their name have been chosen purposefully (56,4%). Thus, it can be assumed that when parents chose names for their children, they have a concrete intention in mind, which may include the performance of certain tasks, the pressure to adopt certain roles or the expectations of certain behaviours. All this leads to the development of a particular life script.

Dla wschodnich Słowian charakterystyczne są personifikacje chorób, czego wyrazem jest nazywanie ich imionami własnymi. Przykładem takiego morfizmu może być ukazywanie ospy jako starej kobiety z błyszczącymi oczami i jednym mocnym, zdrowym zębem. Szczegółowym tematem artykułu jest natomiast charakterystyka ludowego sposobu przedstawiania febry (ludowa nazwa zimnica, trzęsawica), którą autor sprowadził do zestawienia ośmiu podstawowych cech kategorialnych, takich jak: wygląd zewnętrzny, przymioty, stosunek człowieka do choroby i odnoszenie choroby do człowieka, jej działania na człowieka, przyczyny (pochodzenie) choroby, czas i miejsce jej przebywania w człowieku. W tym zestawie kategorią najbardziej rozbudowaną są działania febry, która może człowieka dusić, gnieść, gryźć, podpiekać ogniem, łamać kości, ciągnąć, dręczyć itp.
One of the characteristic features of East-Slavonic cultures are personifications of diseases, referred to by proper names. An example of such anthropomorphism is an image of smallpox as an old woman with sparkling eyes and one firm, healthy tooth. The article offers a characterization of folk representations of fever (the folk names being zimnica lit. ‘the cold disease’, trzęsawica lit. ‘the shaking disease’). The characterization is a complex of eight basic categorial features: appearance, attributes, the relationship of people to the disease and vice versa, the influence of the disease on a person, the casues and origin of the disease, its duration and location in the human organism. The richest category is that of the influence of fever on people: it can strangle, squash, bite, burn, break someone’s bones, pull or torment someone, etc.

The following article examines a variety of elements concerning the influence of the English language on the vocabulary and spelling of the IRC chats in Polish and Russian. After a short presentation of the IRC service itself and the conversations made through it, a number of examples of the jargon, the youth slang, the play with spelling, and the transcription of the Cyrillic alphabet, which appear in the medium, are presented. Most of the examples serve to illustrate the influence of the English upon the Polish and the Russian languages of the IRC users. Additionally, the examples prove the author’s assumption that IRC is a medium which stimulates linguistic creativity

This paper is concerned with the methodological, practical and analytical dimension of creative writing training. Lectures and seminars for first year students „Literary masterpieces of XX–XXI Century”, have been dedicated to the education of close reading skills, which is an introduction to the skills of creative writing, understood as re-writing, or re-formulation of canonical literary texts. Creative writing students have been instructed how to find their own voice on the margins of famous texts. This approach for creative writing education is presented by Nicholas Delbanco, author of The Sincerest Form. Writing Fiction by Imitation. Close reading and creative re-writing of canonical literary works is a significant exercise of stylization, pastiche, narrative modes, point-of-view technique, focalization and world and character building processes. Exercises like these are not only creative writing training but also a workout of critical thinking, based on influential paradigms like post-colonialism, feminism, cultural studies, due to the subversive potential of re-written literature. This is an interesting challenge for both sides of the education process: for students and for academic teachers. This paper is a review of analytical procedures, practical exercises, questions and issues which were given to students during a course on „Literary masterpieces of XX–XXI Century” (dedicated to Lord Jim by J. Conrad, The Death in Venice by T. Mann; The Stranger by A. Camus) and an opportunity to present students’ short stories and exam task fragments.

Opis:
To forecast the optimum route passage of a vessel in the real weather conditions using the so-called velocity characteristics of the ship. These are developed in the way, as to have a very simple form, which can not guarantee high precision in calculating the speed of the vessel. The paper presents a mathematical model of the external forces operating in the vessel and the algorithm to solve this model for calculating the instantaneous speed of the vessel in the selected weather conditions. Made of a computer program, after appropriate research and testing, can be used to optimize the transport route of the ship.

Artykuł porusza tematykę prezentowanych w literaturze przedmiotu definicji wiedzy. Ze względu na różne ujęcia przez badaczy tego pojęcia trudno jest znaleźć i opracować jedną płaszczyznę jej rozumienia. W celu uporządkowania wielości stanowisk niektórzy uczeni podjęli próbę systematyzacji terminu wiedza. W artykule zostały przedstawione typologie opracowane przez: B. Mikułę, J. Beliczyńskiego, Cz. Mesjasza, A. Stabryłę, I. Tuomi, M. Alavi, D. E. Leider. Konsekwencją niejednolitego rozumienia pojęcia wiedzy są różne perspektywy zarządzania wiedzą. Zbadanie tych perspektyw pozwala na zdiagnozowanie rozumienia i stosowania terminu wiedza w praktyce. Celem artykułu jest zaprezentowanie teoretycznych ujęć pojęcia wiedzy oraz wyników badań na temat perspektywy pojmowania wiedzy w kontekście wpływu na zarządzanie wiedzą.
The purpose of this article is to present the theoretical approaches to the concept of the knowledge and results of research which were focused on understanding the knowledge in the context of the knowledge management. The article refers to the definitions of knowledge which are presented in the literature. Due to the different approach to this term it is difficult to find and develop a platform of understanding it. To organize a plurality of positions some scientists have attempted to systematize the term of the knowledge. The article presents typologies developed by B. Mikula, J. Beliczyński, Cz. Mesjasz, A. Stabryła, I. Tuomi, M. Alavi, D. E. Leider. The consequence of various understanding of the term of knowledge are different perspectives of the knowledge management. Examination of these perspectives allows to understand and use the term of the knowledge in practice.

Opis:
The article presents the case of multiple reflection ofa blast wave from a rigid obstacle. The pressure impulse was generated in the Euler domain according to Taylor-Sedov theory. Additionally, there the results of numerical and analytical investigations on the behaviour of the reflected pressure impulse from the flat stiff obstacle were discussed. The analytical considerations are pursuant to the accessible literature. This case is identical with the explosion under a flat bottom of the tank-type vehicle or BWP. All the considered obstacles which are influence by the pressure impulse are similar to the construction of the vehicles used by Polish Army. As it was mentioned above, the numerical investigations were supported by analytical modelsfrom the scientific literature. In the previous papers, the authors conducted the numerical and experimental investigations on the flat blast wave. Those papers concentrated on the selection of the Euler domain parameters and parameters describing an explosive charge for numerical analyses. Additionally, the parameters of the boundary elements of the Euler domain were selected in order to unable the uncontrolled influence of gases. The innovation presented in the paper is the description of the issue of the numerical problem of multiple pressure impulse reflection from a rigid obstacle. The presented papers aim at increasing the safety of the military vehicles crews during the stabilisation missions in Iraq and Afghanistan.

Opis:
The article is devoted to the study of the content of conditionality as a legal phenomenon in the evolution and convergence of modern concepts of legal responsibility, clarification of further guidelines for improving the content of legal responsibility through justice and effectiveness as the main attributes of the principles of legal responsibility concepts of legal responsibility in the system of general theoretical jurisprudence. The formation of the rule of law necessitates the study of the problems of determining the institution of legal responsibility, its features and principles, as this legal category demonstrates the level of legal culture of society and the general state of its legal consciousness. The issue of legal responsibility occupies one of the key places in domestic jurisprudence. However, despite a long period of comprehensive study of legal liability, many aspects of its legal nature remain controversial. Thus, justice and effectiveness as core, fundamental, main principles and principles of legal responsibility remain insufficiently equipped in terms of doctrinal support, which in a consolidated and generalized form, along with other pressing issues of the legal system create gaps, conflicts and shortcomings, thereby reducing quality and productivity of law enforcement. It is stated that the conditionality of legal responsibility serves as a leading indicator, a core indicator of the effectiveness of any legal regulation, the effectiveness of mechanisms for the functioning of the state as a manager of legal tools. Legal prescriptions on the issue of responsibility do not exist in isolation: their construction is based on the synergistic coexistence of basic principles of the institute of legal responsibility and critical issues of society, as the latter secretly determines the vectors of responsibility, its content, application, and specialization. coercion of the state. It is summarized that the retrospective of the development of both global and domestic doctrinal baggage demonstrates the diverse content of the understanding of legal responsibility, and this trend is consistently traced in a variety of temporal and territorial conditions.
Статтю присвячено дослідженню змісту зумовлености як правового феномену в умовах еволюції й конвергенції сучасних концепцій юридичної відповідальности, з’ясуванню подальших орієнтирів для удосконалення змісту юридичної відповідальности за рахунок справедливости та дієвости як магістральних атрибутів принципів юридичної відповідальности, встановленню доктринального значення зумовлености в синергетичній взаємодії із сучасними концепціями юридичної відповідальности в системі загальнотеоретичної юриспруденції. Формування правової держави викликає необхідність вивчати проблеми визначення інституту юридичної відповідальности, її ознаки та принципи, оскільки саме ця правова категорія демонструє рівень правової культури суспільства та загальний стан його правосвідомости. Проблематика юридичної відповідальности посідає одне з найважливіших місць у вітчизняному правознавстві. Незважаючи на тривалий період комплексного вивчення юридичної відповідальности, й досі дискусійною залишається значна кількість аспектів її правової природи. При цьому справедливість та дієвість як стрижневі, основоположні, магістральні принципи і засади юридичної відповідальности залишаються недостатньо оснащеними з погляду доктринального забезпечення, що в консолідовано узагальнювальному вигляді, поряд з іншими злободенними проблемами правової системи, створюють прогалини, колізії й недоліки, тим самим зменшуючи якість і продуктивність правозастосування. Констатовано, що зумовленість юридичної відповідальности слугує провідним показником, стрижневим індикатором ефективности будь-якого нормативно-правового регулювання, дієвости механізмів функціонування держави як розпорядника юридичного інструментарію. Юридичні приписи щодо питання відповідальности не існують ізольовано – їхня конструкція базується на синергетичному суміжному існуванні базових принципів інституту юридичної відповідальности та критичних питань життя суспільства, оскільки останнє визначає негласно вектори становлення відповідальности, її зміст, потребу застосування, а також спеціалізацію дії і специфіку іманентного розвитку апарату примусу держави. Резюмовано, що ретроспектива поступу світового й вітчизняного доктринального багажу демонструє різновекторний зміст розуміння юридичної відповідальности, причому цю тенденцію стабільно прослідковуємо в найрізноманітніших темпоральних і територіальних умовах. Зважаючи на окреслений факт, констатуємо, що досі немає єдиного тлумачення поняття юридичної відповідальности, оскільки низка авторів ототожнює її із самостійним універсальним соціально-правовим інструментом регулювання, інші інтерпретують цю категорію як особливу видозміну, неординарний вияв правових відносин, де основним юридичним змістом слугує примус, що, зрештою, спрямований на реальне забезпечення прав та інтересів взаємопов’язаних сторін. Доведено, що в сучасних наукових колах переважають такі концепції розуміння юридичної відповідальности: санкційна концепція, дуалістична (дихотомічна, двохаспектна) концепція юридичної відповідальности, управлінська концепція, функціональна концепція, концепція перманентного спрощення інституту юридичної відповідальности.
