Opis:
Notification to committee members about a committee sitting (date and agenda) should take place at least three days before the sitting, unless the meeting was convened as a result of decisions taken at the sitting of the Sejm. The discussed rule allows each member of the committee to plan a calendar of activities taking into account all individual responsibilities. The author emphasizes that with Article 152 para. 5 of the Standing Orders of the Sejm causes a few interpretation concerns, what indicates a need of its amendment.

Opis:
The term “tax act” is used in the Standing Orders of the Sejm in the substantive sense and refers to a public levy having the features of a tax, i.e. a pecuniary, compulsory, non-returnable and nonequivalent payment imposed by law and constituting budgetary revenue of the State Treasury or local government units of general purpose. The author points out that it is irrelevant for the qualification of a bill as a “tax bill” what name the bill uses to denote a public levy, if it bears the features of a tax. The title of a tax bill also refers to the bill that repeals or modifies the scope of a tax obligation or its elements. The author concludes that any tax act amendment bill meets the characteristics of the term “tax act”, and the scope of the term “tax act” does not include public tributes other than taxes.

In accordance with Article 193 of the Standing Orders of the Sejm, the answer to an interpellation is to be given in writing. The term in question is, in the parliamentary practice, understood explicitly. It considers it as a “paper form” of a document, which is also supported by established practice of the Sejm in this respect.. Even if the Standing Orders do not contain a legal definition of the term “in writing”, the classification allowing – in the analyzed case – for the use of an electronic version would be of a “projective” nature and differ from the current understanding of the rules of the Sejm. The proposal for a relevant amendment of the Standing Orders of the Sejm, explicitly guaranteeing accessibility of an electronic document, is justifiable.

The author is of the opinion that the loss of the mandate by a Deputy, who has supported the motion to convene a sitting of the committee in accordance with Article 152 para. 2 of the Standing Orders of the Sejm, does not affect the effectiveness of the motion, even if it will result in the number of members supporting the motion (putting their signatures thereupon) being less than 1/3 of the committee membership. An obligation to establish the date and time of the sitting of the committee arises at the time of submission of the properly formulated motion, and should be satisfied immediately. It cannot be accepted that the tardiness in the implementation of the obligation, which arose at the time of submission of the motion, could have an impact on its binding efficiency.

The purpose of the opinion is to examine the possibility of referring the recommendation for election or appointment by the Sejm of individual persons to particular State offices specified in Articles 26, 27–29 of the Standing Orders of the Sejm, or dismissal therefrom, to more than one Sejm committee for their opinion thereto. In the author’s view, a flexible interpretation of Article 30 (5) is possible, as it is implied by the wording of that article which does not state that the recommendation is to be referred to “one” committee, so it does not preclude referring it to a greater number of committees.

The opinion provides an assessment of the legal acceptability of limiting the form of submission of interpellation and Deputies’ questions to the format an electronic document. The analysis of Article 193 (2) of the Standing Orders of the Sejm currently precludes such a possibility, as both interpellations and Deputies’ Questions must meet the formal requirements that include, inter alia, the need to be in writing. The Standing Orders of the Sejm do not contain a legal definition of the phrase “in writing”. From literal interpretation it follows that it is a paper document, signed in person by its author. The inability to accept that the meaning of the written form can also include the form of electronic document is proved by an absolute requirement to append two copies to an answer to a Deputies’ question. The imposition of an obligation for interpellations and Deputies’ question to be submitted in the form of an electronic document therefore requires amendment of Article 193 (1) and (2) of the Standing Orders of the Sejm.

The requirement to perform a particular act “in writing”, as provided for in the Standing Orders of the Sejm, should be understood as an obligation to fix on paper the content of a particular act, using in this purpose graphic symbols, as required by the so-called written language, and such a paper document should be signed in person. The requirement to perform a particular act “in writing” cannot be satisfied by making it in an electronic form. Electronic form is a form of making certain acts (separate and autonomous from a written one) which the Standing Orders of the Sejm provides for only in special situations. A written response to a Deputy’s interpellation must therefore be filed in paper, hand-signed by the person giving response to the interpellation.

The subject of the amendment was modification of the content of the protocol. The essence of the amendment is to include in the protocol an information on the remark sent to the Marshal of the Sejm by the Deputy Chief of the Chancellery of the Sejm regarding the resumption of voting. The author analyzes the normative model derived from the Standing Orders of the Sejm and confronts the theoretical assumptions with parliamentary practice accompanying the procedure for election of the Marshal of the Sejm, based on its similarity to the procedure for recall of the Marshal of the Sejm. He argues that the general principles set out in Chapter 2, “Debates of the Sejm” in Section III of the Standing Orders of the Sejm, should apply to this matter in question. The said provisions do not provide for specific powers that would give the Deputies subject to the motion for the recall of the Marshal of the Sejm the right to speak in the debate in accordance with the rules different from those defining the procedure for taking floor by other speakers. It should be assumed that in the debate on a motion to recall the Marshal of the Sejm the questions in the debate can be responded by their intended addressees, i.e. a person subject to the motion or the designated candidate. There is no specific basis in the Standing Orders that would allow giving a speech by the Deputy subject to the motion when no question has been addressed to him/her during the debate.

The author notes the existence of a legal loophole in the Standing Orders of the Sejm with regard to the issue of consent for broadcasting committee sittings in the Sejm Information System. The systemic inconsistency between the Standing Orders of the Sejm, the Committee’s Rules of Procedure and the rules set forth in the resolution of the Presidium of the Sejm, on the basis of which broadcasts of committee proceedings are included in the Sejm Information System, makes it fundamentally difficult to resolve the doubts in this regard. By way of interpretation per analogiam, the author assumes that since the chairperson of a committee decides on the presence of media representatives at a committee meeting, it is also up to this body to decide on the broadcasting in the Sejm Information System.

The author provides an analysis of the provisions of Article 10a, para. 4 of the Standing Orders of the Sejm in the context of the time period within which it should consider a motion to recall the Marshal of the Sejm. She points out that the opportunity to recall the Marshal of the Sejm is complicated as compared to the election procedure,. The character of the time limit for consideration of the motion to recall the Marshal of the Sejm is not indicative, but mandatory. In the opinion of the author, the principle of discontinunity in relation to “petition proceedings” does not apply to acts carried out as part of the work of the Committee on Petitions. This should also apply to those activities of the Commission that follow the choice of how to handle the petition, e.g. to prepare projects or desiderates as part of dealing with a given petition. Petitions that were considered in the previous term of office should be reconsidered, while the Commission in the current term is not bound by the arrangements made in the previous term of the Sejm. It is not permissible to renew the legislative initiative in the event of the draft submitted by the Committee on Petitions of the previous term was discontinued at the end of the term.

The opinion was drawn up in the context of the work of Sejm committees on the Concept for Town and Country Planning 2030 (Paper No. 169). The author finds the occurrence of procedural inconsistency in the conduct of the committee’s procedures and the ineffectiveness of the election of a Deputy‑Rapporteur. She claims that the formal requirements provided in Article 43 (2) of the Standing Orders for the adoption by the committee of a report on a bill (draft resolution) should also be applied to other committee resolutions relating to reports, information or other documents supposed to be discussed by the Sejm, as well as committee desiderata and opinions. The lack of support from the majority of Deputies participating in the vote does not necessarily mean support for the motion to the contrary. Therefore, in the author’s view, the committees have not finished their work on the above‑mentioned draft resolution.

Provision of information about the activities of the Chamber through the Information System of the Sejm is the primary making accessible public information by the Sejm. The express legal basis is given in Article. 202a of the Standing Orders of the Sejm. This provision is, however, brief – and does not specify what information about the operation of the Sejm will be made available through the System and who is responsible for the published materials and their selection. Shaping the mechanism for making accessible public information by the Chancellery of the Sejm, the Sejm assumed that the website only part of the information specified in the Constitution and the Act as public information, will be published. The scope of the information available is determined by the Chancellery of the Sejm. The Standing Orders of the Sejm, however, do not contain any provision forming the basis for recording the sittings of Sejm committees and sub-committees, which would also provide the basis for placing the recordings in the Information System of the Sejm.

Opis:
As determined by analysis, a committee sitting convened under Article 152. para. 2 at the request of a defined group of Deputies should concern matters falling within the scope of activities of a Sejm committee. In contrast, a supervisory measure established in Article 167 consists in inspecting and examining by committees of the activities of the entities specifically mentioned in that provision (enterprises, firms or government institutions; basic criterion for the designation of controlled entities is a form of property – the property of the Treasury). Moreover, there are no legal obstacles for the committee (or the committee’s presidium) convened in accordance with Article 152 para. 2 to decide on the visit of the committee members, to inspect the entity meeting the requirements specified in Article 167. The author stresses, however, that such a visit, or examination of activities, should take into account the aim expressed in Article 167, which is the assessment of the mode of action of specific entities managing the property belonging to the State Treasury.

Opis:
The specificity of the proceedings in relation to petitions precludes the admissibility of discontinuance of the proceedings regarding consideration of a petition on the basis of appropriate application of Article 105 § 1 of the Code of Administrative Procedure. In case of withdrawal of a petition submitted to the Sejm, the body responsible for its consideration, i.e. the Petitions Committee, should make a decision about the way of proceeding with the petition. Withdrawal of the petition does not prevent its consideration. Given the open catalogue of the ways in which petitions can be proceeded, the Committee should be allowed to adopt a resolution to refuse consideration of the petition because of the applicant’s willingness to withdraw the petition

Opis:
Article 184 para. 1 of the Standing Orders of the Sejm obligates the Marshal of the Sejm to give the floor regardless of the orders of the day for the sitting or in respect of the debate to claim rectification. Only the Deputies to the Sejm are entitled to make rectifications. Rectifications can only refer to “statements that has been misunderstood or imprecisely quoted,” and notice of intention to use the remedy of rectification under this procedure is a direct response to the statement of another Deputy or any other participant in the sitting of the Sejm. For assessing the admissibility of rectification request it does not matter whether the author of the rectified statements directly mentioned the specific individuals whose statements he/she quotes giving their names. Presented rectification is not subject to debate or vote. A rectification should take the form of indicative sentence. In a situation where the Deputy’s statement does not satisfy the requirements relating to rectification, the Marshal of the Sejm has the right, and even the obligation, to reproach the Deputy, and to discontinue his/her speech.

Opis:
The opinion deals with the exercise of parliamentary oversight functions by Sejm committees. It provides an analysis of whether the representatives of State administration might be held responsible for failure to discharge their duties resulting from Article 157 of the Standing Orders of the Sejm. In the author’s view, Sejm committees have at their disposal the means to enforce only political responsibility. Moreover, as concerns suspension of work on a bill in the event of breach of the obligations specified in Article 157 by the representatives of public administration, the author believes that the legitimacy of such action cannot be assessed in abstracto. The author does not rule out that, depending on circumstances and seriousness of the infringements, suspension of work on a bill may be justified.

The subject of the opinion is the admissibility of consideration by a committee of motions to carry out a control in connection with the lack of general principles of carrying it out set out in the Standing Orders of the Sejm. Motions to carry out the control submitted to the National Defence Committee stay within the scope of the subject matter of activities of the committee. The author claims that one of the motions rises some concerns of a legal nature. The subject of the request was defined in a problem way, whereas committee’s control relates to enforcement and executing statutes and Sejm resolutions, what leads to a conclusion that the scope of the control should be related to a given act or resolution.

In the author’s opinion, the following provisions (sections) of a bill project referred to committee should not become subjects of voting by the committee, but the committee should vote only on motions aimed at their modification (substantive and editorial amendments and motions for deletion of a provision). A different manner of work of the committee may lead to the deletion of a given provision, if the provision is not approved in voting, even in case of the lack of motion to delete it. The Sejm should decide upon legislative motions and legislative postulates included in the committee’s report on the bill, prepared in the form of a consolidated text.

The report, submitted by the Council for the Polish Language, entitled “Language of political information”, contains an analysis of the problem that is narrow in scope. In the light of the current parliamentary practice, the narrow scope of the Council’s reports is typical and this has not been questioned in the course of parliamentary work. The decision of the Culture and Media Committee, resulting in a refusal to consider the document in question, is an expression of negation of the decision of the Marshal of the Sejm to recognize this document as a report. Formally, the committee proceedings on the report had not been completed. The Committee should return to examining this document and complete its work, formulating an appropriate opinion.

An obligation, provided for in the Standing Orders of the Sejm, of a sponsor’s of the bill to present to present outline drafts of principal executive orders is one of the core procedural regulations shaping the content of an explanatory statement of a bill. If the sponsor does not plan to issue any executive orders on the bases on the bill, it has to be indicated in the explanatory statement of the bill, as an information about legal consequences of the bill. Suspension of the membership in Deputies’ (parliamentary) club is not the same as loss of membership, hence it does not cause changes in the composition of a club. Due to the fact that the Standing Orders of the Sejm do not include any provisions concerning the status of a Deputy, whose membership in the club has been suspended, effects of such suspension should be perceived solely in the sphere of club’s internal matters. The suspended Deputy, until a information about a loss of his/her club membership is submitted to the Marshal of the Sejm, shall be treated by Sejm authorities as a member of the club.

Penalty payments imposed on a Deputy for not participating in or interfering with the proceedings of the Sejm are cumulative, but are limited by the amount of funds, to which the Deputy is entitled to collect for the holding of a mandate. Thus, the imposition of a penalty after exceeding this limit cannot have other repressive effects. The assessment of the legitimacy of imposing penalties remains the responsibility of the Presidium of the Sejm. According to the Standing Orders of the Sejm, the subsequent penalty should be collected from the part of the salary remaining after the execution of the first penalty, in the event of the need to apply both provisions.

The article provides an analysis of the procedure for adoption by the Legislative Committee of a resolution containing an opinion referred to in Article 34 paragraph 8 of the Standing Orders of the Sejm. It deals, in particular, with taking a decision whether a quorum is present and an assessment of the consequences of the meaning of the phrase “in the presence of at least half of the number of members of the Committee” for the validity of resolutions adopted by the Committee. The author claims that the said requirement determines the Committee’s capability of making legally binding decisions under Article 34 paragraph 8 of the Standing Orders of the Sejm (the procedure for adoption of a resolution finding a bill inadmissible under Polish law). The notion of “presence” contains all members of the Committee staying at the place where its meeting is held, irrespective of whether they participate in the vote or not. The requirement of presence of at least half of the number of members of the Committee should be referred to the total number of its members elected by the Sejm as it stands at the moment of election.

The opinion concerns the decision of the Marshal of the Sejm to expel a Deputy from a sitting, taken pursuant to Article. 175 para. 5 of the Standing Orders of the Sejm. In the author’s view, such decision is not final, as the Presidium of the Sejm may quash it, having considered an appeal submitted by the Deputy and – on the other hand – is immediately applicable, because the expelled Deputy is obliged to leave the Chamber and abstain from participating in further deliberations until his/her appeal is considered (or until the end of the session of the Sejm, if the Deputy has not submitted an appeal). Therefore, the expelled member does not have the right to participate in voting. Preventing the Deputy expelled from the sitting from “entering the Chamber with the purpose of voting” is necessary in order to respect Article 176 para. 6 of the Standing Orders of the Sejm.

Opis:
The analysis of the current state of law indicates that the committees of the Sejm and the Senate competent in European affairs could be equipped by the legislator with instruments to allow them to participate in political discourse with the EU institutions and the committees of other national parliaments. The implementation of this objective requires amending the statute and the rules of procedure of both Houses of Parliament. However, the legislature‘s failure to act cannot stand in the way of the Parliament‘s exercise of powers relating to the integration process. It is necessary to redefine the interpretative assumptions regarding the relevance of the Constitution in determining the position of the Parliament in the legal order determined not only by national legal provisions but also by the EU law.

A shareholder’s right of access to information concerning a company, in accordance with the Commercial Companies Code, is a form of exercising ownership supervision. The entity exercising the rights attached to the State Treasury shares is obliged to take advantage of this right in order to protect the interests of the State Treasury. Opis:
The author emphasizes the formal equality of the Deputies founded on the provisions of the Constitution. He points out the impossibility of extending the time for speech of non-aligned Deputies over six minutes for the entire sitting of the Sejm. The term “speech” should not be understood as any of the instances of taking floor by a Deputy, but only those in which they present their views on the issue considered at the meeting of the Sejm. Referring to the rules of procedure of the Sejm, he claims that posing questions by non-aligned Deputies during the third reading shall depend the consent of the Marshal of the Sejm. The author points out that the principles of, and procedures for, providing information to the Sejm by the President of the Institute of National Remembrance (IPN) are specified in the provisions of the Act on the IPN and in the general rules for the acquisition by the Parliament and its bodies of information from representatives of the competent authorities and State institutions contained in the Act on the Exercise of the Mandate of a Deputy or Senator, and in the Standing Orders of the Sejm. “Heads of other State offices and institutions” are in fact obliged to submit reports and render information, and to participate in committee sittings where matters relating to the scope of their activity are considered. The exception limiting the scope of this duty of the President of the IPN concerns information contained in the so-called classified collection in the archives of IPN, composed of the documents for which the head of the Internal Security Agency and the head of the Intelligence Agency or the Minister of National Defence, respectively, declared that – for a specific period – they cannot be made available to any person apart from the representatives appointed by them, if it is necessary for the state security.

The opinion deals with the interpretation of the provision which states that the Marshal (Speaker) of the Sejm may request the committee to express its attitude to the conclusions and remarks made by the legal services of the Chancellery of the Sejm, which have not been taken into consideration, and whether – in this context – it is possible to change the report adopted by the committee. The author argues that the provisions of the Standing Orders of the Sejm provide no grounds for claim that expressing by the committee of its attitude to the conclusions and remarks could take place by way of modification of the report already adopted by the committee. In this situation, it seems that it could only be admissible that the Deputy Rapporteur takes position at the sitting of the Sejm considering the bill or draft resolution in the second reading.

It does not seem possible to formulate an exhaustive list of instances in which it would be permitted to make access to a complete records of the meeting of the Special Services Committee, marked as classified. Typical examples where such access is allowed include actions by the public prosecutor’s office taken within the framework of criminal proceedings and by special services for the detection of crime or actions related to the conduct of inspection under the Act on the Protection of Classified Information. The Marshal of the Sejm is a body competent for making decisions on the provision of classified documents providing the record of the Committee meeting. The head of one of the special services, who at the invitation of the Committee participated in the committee meeting, has the right to be acquainted with the text “working” or preliminary version of the minutes of the meeting. This, however, does not preclude that the activities of services (subordinate to him) provided for in the Act will require reading of the final text of the minutes marked as classified.

The opinion analyses the possibility of removal from office of the Marshal (Speaker) and Vice-Marshals (Deputy Speakers) of the Sejm. In the author’s view, the provision contained in the amendment to the Standing Orders (2008) making possible such a remove is not compatible with Article 110 (1) of the Constitution, which does not relate to appointment of a Marshal or Vice-marshals, but rather deals with the “election” of a Marshal (which would imply his/her irremovability during the term of parliament). He also points to the controversies relating to the possibility of an appropriate application of the provision on resignation from the function of Marshal when the Vice-Marshal has been removed from office. Such an interpretation seems to be abuse of law, since an appropriate application of the provisions in similar situations cannot be assumed, but should rather be expressly formulated in a legal provision. From an analysis of Article 10a (5) of the Standing Orders of the Sejm it follows that the future regulation should be made more specific, particularly by the inclusion of the case of death and the conditions of resignation of the Vice-Marshal.

Opis:
On 26 March 2020, by a resolution adopted on 26 March 2020, the Standing Orders of the Sejm of the Republic of Poland were amended to allow the sessions to be conducted using electronic means of remote communication. These amendments raise serious reservations as to their constitutionality. This is due to the fact that the Constitution of 1997 stipulates that the Sejm and Senate shall meet at sessions, while the meeting, being a concept that has been defined, is defined as the assembly of MPs in one place in order to consider the matter under discussion. In addition, as parliamentary practice has demonstrated, the changes introduced have generated a number of problems related to Deputies’ attendance at such remote sessions, participation in debates and casting votes. As a consequence, this may lead to weakening of the legitimacy of the work of the Chamber and a reduction in the capacity to exercise the mandate.
Sejm uchwałą podjętą dnia 26 marca 2020 r. wprowadził do regulaminu Sejmu zmiany umożliwiające prowadzenie obrad z wykorzystaniem środków elektronicznych umożliwiających komunikowanie się na odległość. Wprowadzone zmiany budzą poważne zastrzeżenia co do ich konstytucyjności. Wynika to z faktu, że Konstytucja z 1997 r. stanowi, że Sejm i Senat obradują na posiedzeniach, zaś posiedzenie, będąc pojęciem zastanym, definiowane jest jako zebranie się posłów w jednym miejscu celem rozpatrzenia sprawy będącej przedmiotem obrad. Ponadto wprowadzone zmiany, jak pokazuje praktyka parlamentarna, generują szereg problemów związanych z uczestniczeniem posłów w takich zdalnych posiedzeniach, udziałem w dyskusji i głosowaniach. W konsekwencji może to prowadzić do osłabienia legitymizacji prac izby i ograniczenia możliwości wykonywania mandatu.

The concept of “non-performance of Deputies duties” covers all kinds of acts that violate legal norms determining the manner of exercising the parliamentary mandate. At the same time, this concept does not include acts leading to non-performance of such Deputies’ duties, the violation of which is threatened by a legal sanction set out in other legal provisions. It is not possible to indicate a full catalog of duties, whose breach casuses a liability under Article 22 of the Standing Orders. “Non-performance of Deputies’ duties” covers, among others, cases of violation of duties related to the participation in the composition of another state authority, related to the function of representing the Sejm in proceedings before other authorities and in interparliamentary relations.

The provisions of the Standing Orders of the Sejm concerning the reduction of Deputy’s salary or parliamentary per diem allowance (as a form of financial penalty) do not require any changes, as there is no need to adjust Polish law to the jurisprudence of the European Court of Human Rights contained in the cases referred to in this opinion. The views expressed by the ECHR in these judgments may however affect the interpretation and application of the provisions of the Standing Orders of the Sejm concerning, in particular, the terms “a Deputy making it impossible for the Sejm to work” and “making it impossible to carry out the debate”. The author claims that the introduction into the Standing Orders of a requirement to give reasons for decisions on the reduction of salary or per diem allowance in order to avoid the allegation of “excessive severity of the penalty,” would also allow both to demonstrate that the principle of equality before the law and principle of proportionality are observed.

Examining the possible adoption by the Presidium of the Sejm of an interpretative resolution regarding limiting the number of interpellations and Deputy’s questions on the same “matter”, the author of the opinion concludes that any restrictions in this regard should be formulated with caution. The rights of Deputies to submit interpellations cannot be only illusory. He also notes that the Standing Orders of the Sejm have already introduced a mechanism for control by the Presidium of the Sejm over interpellations and Deputy’s questions. In order to counter the practice of submitting excessive number of interpellations of similar content to the same body, the author examines the possibility of combining by the Presidium of the Sejm similar interpellations into one interpellation.

The power of the presidium of the committee to determine the agenda of a committee sitting is limited only in two cases – a minority request to convene a sitting and an initiative of the Presidium of the Sejm. The chairperson of the committee establishes the agenda of the committee meeting only in the case in which he executes the minority’s request. No provision of the Standing Orders of the Sejm l allows the chairman of the committee to set the agenda for a committee meeting without the involvement the presidium of the committee. Producing minutes documenting a sitting of the presidium is not required, nor there are any procedural requirements regarding the rules for convening these sittings.

The opinion concerns a draft resolution to amend the Standing Orders of the Sejm of the Republic of Poland. The principal purpose of the amendment was to abolish the requirement to seek an opinion of the minister competent for Republic of Poland’s membership in the European Union when considering matters concerning the conformity of provisions of the considered bills to the legislation of the European Union. Sponsors of the resolution justify the amendment on legal grounds, such as the need for implementation of the principle of separation of powers, and on extra‑legal grounds, such as the need for modernisation and restoration of functionality of the provision of opinions on legislative proposals. The author of the opinion challenges the arguments of the sponsors of the draft resolution, pointing out its lack of appropriate justification and possible inconsistency with the provisions of both the Constitution and the Act on the Branches of Government Administration.

The article deals with the question whether, in the context of the power of appropriate Sejm committees to consider individual parts of draft budgets, as referred to in Article 106 paragraph 2 of the Standing Orders of the Sejm, it is admissible to submit a motion for and to adopt a resolution on holding a public hearing (Article 70a of the Standing Orders of the Sejm). Based on the analysis of the provisions of the Standing Orders of the Sejm, the author draws a conclusion that Sejm committees do not have such a power. According to the Standing Orders of the Sejm, in the course of work on a draft budget, an exclusive right to adopt resolution on holding a public hearing belongs to the Public Finances Committee.

Opis:
The purpose of this opinion is to explain the legal basis of a “red card” procedure and the legal basis for the cooperation between the national parliaments of EU Member States, including the Sejm of the Republic of Poland, in relation to this procedure. The “red card” procedure involves scrutiny of the compatibility of EU draft legislative acts with the principle of subsidiarity and is operatively associated with the treatybased mechanism for submission by national parliaments of reasoned opinions on the non-compliance of draft legislation with the principle of subsidiarity. The possible concerted action of national parliaments on the “red card” procedure will have the same scope as that applied for “yellow card” and “orange card” procedures. According to the authors, decisions to be taken under “red card” procedure are not inconsistent with the Treaties, do not interfere with the procedures of “yellow card” and “orange card” and would not require changes to the Standing Orders of the Sejm. The legal basis (in both EU law and national law) for cooperation between national parliaments will be the same as the legal basis for their cooperation in the process of submitting reasoned opinions on the non- compliance of EU draft legislative acts with the principle of subsidiarity.

Opis:
The opinion points out that a key role in the preparation of preliminary motions to hold persons accountable before the Tribunal of State is played by the Constitutional Accountability Committee acting in corpore. The Commission has an exclusive power to take substantive decisions concerning the conduct of proceedings relating, e.g., to an assessment of the validity of the submitted motions as to evidence. The tasks of presidium and chairperson of the Committee are, in principle, limited to organizational and technical issues, such as planning a timetable of committee meetings and proposing the agenda of the debate (presidium) and representing the Committee in external events, as well as hearing witnesses and experts (chairperson). The performance of the presidium or chairperson is reviewed by the Committee. In the event of a negative assessment of the work of these authorities, the Committee has the power to make appropriate changes in membership of the presidium, including changing its chairperson.

In the author’s view, the existing provisions of the Standing Orders of the Sejm do not contain loopholes that might reduce the effectiveness of actions taken by the Sejm in the exercise of the oversight of the Public Prosecutor General. There is no need to amend the Standing Orders of the Sejm to “align” this act to the provisions of the Law on the Public Prosecutor’s Office. The scope of oversight exercised by the Sejm over the Public Prosecutor General in the current constitutional framework system is based on the assumption Public Prosecutor General may use all oversight instruments which serve the exercise of control over the activities of the organizational system subordinate to the Council of Ministers. The author proposes to consider the simplification of the rules allowing the committee meeting to be held in camera when its subject concerns information subject to legal protection.

Problematyka funkcjonowania Sejmu w czasie pandemii wirusa SARS-CoV-2 stanowi zagadnienie, które ze zrozumiałych względów cieszy się obecnie znacznym zainteresowaniem doktryny. Celem artykułu była dogmatyczna analiza tych przepisów konstytucyjnych, które rzutują na zakres możliwości modyfikacji sposobu organizacji posiedzeń Sejmu w okresie pandemii, co pozwoliło na sformułowanie wniosków dotyczących konstytucyjności tzw. hybrydowego modelu posiedzeń izby wprowadzonego wskutek przyjęcia zmian regulaminowych 26 marca 2020 roku. Doceniając praktyczną użyteczność przyjętego wówczas modelu organizacji posiedzeń w sposób hybrydowy, tj. z możliwością zdalnego udziału posłów, trzeba stwierdzić, że rozwiązania te wywołują zastrzeżenia konstytucyjne. Zarazem należy podkreślić, że stanowisko doktryny odnośnie do tej kwestii nie jest jednolite. Osobny wątek rozważań poświęcony został możliwościom reorganizacji posiedzeń Sejmu na podstawie ogólnych, obowiązujących od lat przepisów regulaminowych, tj. w hipotetycznej sytuacji, gdyby w marcu 2020 roku nie dokonano jakichkolwiek zmian normatywnych dotyczących tej kwestii.
The problem of functioning of the Sejm in time of the SARS-CoV-2 pandemic is currently a matter being, due to obvious reasons, often discussed by Polish legal doctrine. The purpose of the paper was to carry out a dogmatic analysis of constitutional rules with determine the allowed scope of modification or organising plenary sittings of the Sejm, what allowed to draw conclusions regarding the constitutionality of the so-called hybrid model of sittings introduced as a result of the adoption of the amendments of the Standing Orders on 26th March 2020. While a practical value of the model of hybrid plenary sittings, i.e. with a possibility of a remote participation of Deputies, cannot be questioned, the legal solutions in question raise doubts as to their conformity to the Constitution. Still it should be mentioned that there various doctrinal standpoints regarding this matter. A separate part of the paper was focused on the possibilities of reorganising plenary sittings of the Sejm on the basis of general, having been in force for many years, rules of the Standing Orders, i.e. in a hypothetical situation, if no normative changes regarding this issue had been in March 2020.

Opis:
The discussed Article specifies the acceptable subject matter of points of order. The assumption that they may concern matters being the subject of orders of the day and the course of sittings means that the subject matter of the point of order cannot become a matter to be considered in the future, i.e. during any of subsequent sittings. In the author’s opinion, it is in principle unacceptable to submit pro futuro points of order. Article 184 para. 2 of the Standing Orders of the Sejm refers only to the subject of the point of order and not to the motives of the motion submitted by the applicant. This means that, on justifying the point of order, a Deputy may rely on external circumstances, i.e. not related to a group of matters considered by the Sejm during a given sitting.

The author is critical on the application of Article 51 (2) of the Standing Orders of the Sejm in proceedings in relation to draft law codes and bills to amend draft law codes. He emphasizes that, despite the lack of a provision which would prevent beginning the second reading of the above‑mentioned drafts immediately after the conclusion of the first reading without referral to the committee, extended work on draft law codes and on bills to amend them are useful for the reflection on this legislation which is, in principle, extensive and complex. The author concludes that Article 51 (2) of the Rules of Parliament is contrary to the reason of the law of the proceedings carried out in accordance with a law‑code.

Parliamentary custom has been present in modern parliament since its inception. The functioning of the British or German parliament shows that customs can co-create or supplement parliamentary procedure. In the Polish parliament, customs also regulate a number of proceedings. The subject of this article is the custom found in the practice of the lower house of the Polish parliament – the Sejm. Examples of customs that have been transformed into norms of the Sejm’s rules of procedure despite their long practice are indicated and discussed. However, the analysis of these examples does not give a clear answer to the question of the reasons for turning custom into law. It shows the inconsistency and discretionary nature of the changes. It is also in vain to find purposefulness and consistency in the creation of norms on the basis of custom.
Zwyczaj parlamentarny jest obecny w nowożytnym parlamencie od początków jego powstania. Funkcjonowanie parlamentu brytyjskiego czy niemieckiego pokazuje, że zwyczaje mogą współtworzyć czy też uzupełniać procedurę parlamentarną. W polskim parlamencie zwyczaje również regulują szereg postępowań. Przedmiotem artykułu jest zwyczaj występujący w praktyce działania izby niższej polskiego parlamentu – Sejmu. Wskazane i omówione zostały przykłady zwyczajów, które mimo wieloletniej praktyki ich stosowania zostały przekształcone w normy regulaminu Sejmu. Analiza tych przykładów nie daje jednak jednoznacznej odpowiedzi na pytanie o przyczyny zmiany zwyczaju w prawo. Pokazuje brak konsekwencji i uznaniowość zmian. Próżno również doszukiwać się celowości i spójności w kreowaniu norm na podstawie zwyczaju.

The author of the opinion supports a dominant position among Polish constitutional lawyers, according to which rejection of bill during the first reading is constitutionally acceptable. He shows that the possibility of rejection of bills during the first reading is an institution firmly rooted in the Polish parliamentary tradition. Removing it would cause extension of the work on bills, because of a likely “ritualization” of three readings. The author claims that such situation would lead to a weakening of the role and importance of the institution of readings of bills.

Epidemia wirusa SARS–CoV-2 spowodowała realne zagrożenie dla możliwości realizowania przez Sejm jego konstytucyjnych funkcji. Zarówno to zagrożenie, jak i potrzeba zapewnienia bezpieczeństwa posłom i pracownikom Kancelarii Sejmu skłoniły ustawodawcę do przyjęcia stosowych rozwiązań prawnych dotyczących organizacji prac Sejmu i jego organów. Nowelizacja Regulaminu Sejmu uchwalona 26 marca 2020 roku stworzyła możliwość przeprowadzania posiedzeń Sejmu, Prezydium Sejmu, Konwentu Seniorów, komisji oraz podkomisji z wykorzystaniem środków komunikacji elektronicznej. Prowadzenie obrad w takiej formie zostało uzależnione od wprowadzenia nie tylko stanu epidemii, lecz także jednego ze stanów nadzwyczajnych. Na podstawie analizy prawnodogmatycznej aktów prawnych oraz analizy dokumentów z etapów procesu uchwałodawczego i stosowania nowych rozwiązań prawnych zostały zaprezentowane podstawy prawne, cele nowych instytucji oraz wybrane problemy pojawiające się w praktyce parlamentarnej. Analiza praktyki umożliwiła ocenę efektywności nowych instytucji.
The SARS-CoV-2 pandemic introduced a genuine threat to the possibility of the Sejm conducting its constitutional functions. The pandemic and the necessity of ensuring the safety of the members of the Sejm and employees of the chancellery of the Sejm compelled lawmakers to adopt appropriate legal arrangements in relation to the organisational aspects of the work of the Sejm and its official bodies. The amendment of the Standing Orders of the Sejm passed on March 26th 2020 introduced the possibility of the Sejm’s parliamentary sessions, the Presidium of the Sejm, Council of Seniors, Committees and Subcommittees to take place remotely utilising electronic means of communication. Parliamentary proceedings became conditional not only on the introduction of a state of pandemic, but also one of the states of emergency. The wording of the amendment detailed the new institutions and the legal bases of new procedural solutions (the Standing Orders of the Sejm, Orders of the Marshal of the Sejm) and recognised the practical problems associated with this mode of procedure.

The author assesses the possibility of withdrawing motion to pass a vote of no confidence in the Council of Ministers, finding it. unacceptable, notwithstanding that this matter has not been literally regulated in law. Although this problem was not analyzed in the constitutional literature, an analysis of the current provisions of the Standing Orders of the supports the above conclusion.
