Artykuł został poświęcony codzienności w stanie wojennym w Trójmieście. Jego celem jest próba ukazania dnia powszedniego w okresie nietypowym dla całych dziejów PRL.
In the morning of 13 December 1981 Poles were informed of the martial law declared on Poland by Gen. Wojciech Jaruzelski. The move was accompanied by mass arrests of Solidarity leaders and political dissidents; and militia and army troops in tanks and armoured military vehicles appeared on the streets of every major city. The restrictions imposed on the country included, among others, curfew between 10 pm and 6 am; telephone lines were disconnected, and mail was subject to censorship. Streets were patrolled by soldiers, classes in schools and at universities were suspended, travel between towns required permission, and many other restrictions on civil liberties were imposed. Only two national-wide papers were issued, which in the Tri-City region were merged into one „tri-daily” published by the party comrades selected by the Voivodeship Committee of the party. All public administration, state services, mines, power plants and most of the key companies were placed under military management. All this, combined with an economic and political crisis of the state, had a dramatic impact on the everyday life of people, who rebelled against martial law by organising strikes and street demonstrations. The article describes the everyday struggle of people in the harsh reality during the first months after the introduction of martial law in Poland on the example of Gdańsk, Gdynia and Sopot, which together make up the “Tri-City” (Trójmiasto) conurbation.

This article is entirely devoted to the issue of discharge from ser-vice in the Police under Article 41(1)(1) of the Police Act. Exemption on this legal basis requires that a medical committee must issue a medical certifi cate to the police offi cer, which states that he/she is totally incapable of serving in the Police. This must be a fi nal decision. Issuing a fi nal ruling requires the superior in charge of personal matters to discharge the police offi cer from offi cial duties in the Police, before he/she is dismissed from service. During the period of dismissal from offi cial duties, the police offi cer retains the right to full salary despite not performing service duties.

Increasingly, the use of different means of investigation is enabling the authorities to clarify the facts and to arrest the perpetrator of the crime more quickly and effectively, within the different means of investigation available to police authorities, one of which and the most common in all countries is the police informer, being a person of particular importance during the police investigation, as he or she provides confidential and essential information in order to learn important facts about the crime and its perpetrators. The problem with this research tool is that it is not uniform in its treatment, in different countries, the informant is treated differently, and as a result of this, the product or the investigation that is offered to the judges, as a result of these confidences, is different. Likewise, when working with police informants, it is very important to take into account a series of precautions so as not to violate any human rights, as well as not to being manipulated by the informer. As an example of the above, this article studies the treatment of police informants in different countries, considering the legislation of each one, sentences and documents that establish the guidelines for the use of police informants.

The aim of the study is not only an attempt to define the concept of “apoliticality of the police” and its meaning, but above all, to draw attention to the increasingly emerging problem of interference by the participants of the political scene in the work of the Polish Police. For the purposes of this study, the notions of “political neutrality” and “apoliticality” are equivalent and synonymous. The main problem is the search for an answer to the question of whether the Polish Police nowadays are adequately protected against the influence of political pressure? The text uses theoretical research methods, including literature analysis and statistical data analysis. It was assumed that the apolitical nature of the police means the lack of involvement of police officers in political activities and the scrupulous and impartial performance of official duties, regardless of what is happening on the Polish political scene. The results of the conducted analyses allow the conclusion that the apolitical nature of the Polish Police is a mystification because it is insufficiently protected against the influence of politics, which as a consequence leads to a reduction in its effectiveness and social trust.

The Police are a uniformed formation intended to ensure security and public order. The formation plays an auxiliary role in relation to the society. The Police carries out assigned tasks of preventive, criminal and investigative nature. The purpose of this study is to assess the utilitarian effectiveness of the preventive anti-crime measures of the Polish Police forces. In order to achieve this goal, the authors used the method of examining relevant documents, statistics and literature. The main source of information were statistical data made publically available by the Polish Police and communications from surveys carried out by the Public Opinion Research Centre (CBOS). The period under examination included the years 2014-2017.

A body check is a measure that is usually carried out in the event of a reasonable suspicion of a crime, i.e. when there are grounds to institute criminal proceedings. Moreover, the Police Act has never determined the limits of Police interference with the constitutional rights and freedoms of an individual, nor did it identify any adequate measures to protect the checked persons. These limits were determined by the provisions of the Regulation,1 according to which the Police could not uncover the parts of body covered with clothes. The Constitutional Tribunal recognised these provisions as inconsistent with the Con- stitution of the Republic of Poland and ordered that the definition of a body check, deter- mining the limits of Police interference with the rights and freedoms of an individual and authorising the person subject to a body check to appeal to the court against the decision of the Police, be included in the Police Act. The amendment to the Police Act and other acts, which implemented the judgment of the Constitutional Tribunal, authorised the person subject to a body check to have the ac- tions of the Police verified by an independent court, but at the same time, it expanded the scope of Police interference with the rights and freedoms of an individual. The legislator of the Police Act and other acts did not remove the one prerequisite that simultaneously trig- gered a body check and the search of a person, but instead added other prerequisites that broadened the scope of Police measures in this respect. The limits of Police interference with the rights and freedoms of an individual were also expanded to include a check of the oral cavity, nose, ears and hair of the person subject to a body check and, in special cases, also their private body parts, which the Police officer may check visually or manually. The purpose of this paper is to show that the provisions of the amended Police Act and other acts, to a large extent, failed to meet the provisions of the Judgment of the Constitu- tional Tribunal of 14 December 2017. Its extensive, non-transparent provisions broadened the authority of the Police to arbitrarily determine the limits of interference with the rights and freedoms of an individual, thereby eradicating them. The analysis of the amended Act and its implementing acts, as well as the statement of reasons for the draft Act, confirm the thesis that the amended provisions transformed a body check into an extrajudicial search

Undoubtedly, serving as a police officer is associated with a high level of occupational stress. The stressfulness of this profession, which keeps increasing every year, results from several reasons, of which the most important ones include frequent participation in difficult and sometimes dramatic situations, endangering one’s own life and the lives of others, making quick decisions, bearing the burden of a potentially unjustified use of weapons, and exposure to trauma and other traumatic experiences of other people. The high level of stress related to the profession of a police officer is also associated with other factors, such as low wages, shifts, or paperwork. This paper looks at the notion and consequences of burnout among police officers on the example of the Krakow Constabulary. The study rests on a detailed survey of 110 officers based on the application of the ANOVA method of analysis of variance.

The present article is focused on general characteristics of the police as armed enforcements and uniformed services. The police are one of the major authorities responsible for ensuring the safety of citizens and public order. This article aim is to depict a structure of a particular disposable group, the specificity of its work, and the tasks it performs. The police consisting of qualified people, properly verified at a recruitment stage, may have much public confidence now. The selection of candidates for service must take place at various stages since the service that officers perform is difficult, requires a lot of dedication, a high degree of discipline and most of all it requires a high sense of responsibility.

The police formations in various countries of the European Union are required to ensure the adoption of institutional patterns to increase the efficiency of detection and improvement of the management system. The subject of the conducted analysis described in this article are the adopted solutions, new forms of supervision of police formations in Ireland and in Poland and their assessment. The article details the provisions of the act adopted in 2015 and entitled Garda Siochana (Policing Authority and Miscellaneous Provisions) Act 2015, in terms of functioning of the collegial supervisory authority named Policing Authority. Knowing the need to confront the Irish solutions with the Polish ones, the provisions of the draft law of 8 March 2017 were also examined amending the Act on certain rights of employees of the office that supports the Ministry of Interior and Administration as well as officers and employees of offices supervised by the minister as well as certain other laws under which is to be established Internal Supervision Office of the Ministry of Interior and Administration. The author describes the creation and functions of Policing Authority and the Internal Supervision Office at the Ministry of Interior and Administration, the powers of the members and the specificity of action of the listed institutions. The article not only attempts to organize a synthetic knowledge of Policing Authority and the Internal Supervision Office of the Ministry of Interior and Administration, but also focuses attention on a comparison of tasks, relations between the authorities and the minister and the method of financing and control of their current activities. Author focuses mainly on identifying the similarities and differences in the legal solutions determining the existence of both institutions.

The ruling under review deals with an issue that has long been present in doctrine and jurisprudence. The commented judgement is yet another statement of the Supreme Court concerning the jurisdiction of the court in cases relating to civil claims of reinstated officers. However, the analysed judgement is signifi cant because it determines not only the jurisdiction of common courts (which has already been confi rmed in previous case law) but also determines the character of the benefit granted under Article 42 paragraph 5 of the Police Act. The interpretation of this provision adopted by the Supreme Court opens the way for reinstated officers to seek compensation from the State Treasury over the limit specified in this provision,

The article attempts to confront the individual’s constitutional right to informational autonomy and the powers of the Police in the framework of which the service may collect and process personal data. Bearing in mind the paramount role of the Constitution of the Republic of Poland and its special importance for the sphere of rights and freedoms, the key regulations devoted to the right to privacy and the possibility of limiting informational autonomy were referred to. Treating the constitutional content as fundamental in the relationship between the individual and the state authorities, they were referred to the powers of the Police based on which the service may legally interfere in the information sphere of the individual. It was also stressed that the multiplicity of powers and the expansion of their catalog make it necessary to pay more attention to applying the proportionality mechanism.
W artykule podejmuje się próbę skonfrontowania konstytucyjnego prawa jednostki do autonomii informacyjnej oraz uprawnień Policji w ramach których służba ta może gromadzić i przetwarzać dane osobowe. Pamiętając o nadrzędnej roli Konstytucji RP i jej szczególnym znaczeniu dla sfery praw i wolności, przywołano kluczowe regulacje poświęcone prawu do prywatności oraz możliwości ograniczenia autonomii informacyjnej. Traktując treści konstytucyjne jako fundamentalne w relacji jednostki z organami państwa, odniesiono je do uprawnień Policji na podstawie których, służba ta może legalnie ingerować w sferę informacyjną jednostki. Podkreślono również, iż wielość uprawnień oraz poszerzanie ich katalogu sprawia, że coraz więcej uwagi należy poświęcić zastosowaniu mechanizmu proporcjonalności.

One of the state entities which have the task of preventing and combating terrorism is the Police, while the Police Academy in Szczytno is their intellectual base. It is not only an organisational unit of the Police, but also a higher education institution with legal personality. This status entitles it to teach at different levels of civilian higher education, as well as conduct in-service training for police officers. Education in the area of terrorist threats and counteracting them is aimed, on the one hand, at making the students aware of the scale of such threats and their accurate identification, as well as the ways of responding to them by the state and its institutions, and, on the other hand, at learning specific reflexes that will allow anyone who finds themselves in an area threatened by a terrorist attack to quickly assess the resulting threat and to react immediately. The goals set in this way are reflected in the employment structure of the academy, which includes specialist organisational units, and among the scientific and teaching staff are experts, including practitioners, who in the past carried out the tasks of the state at different levels of the system for counteracting terrorist threats. They systematically participate in scientific undertakings, including research projects, scientific conferences and publication work, participate in the work of expert teams, both national and international, and cooperate extensively with external entities. The result of their multidimensional activities is shaping and deepening social awareness of terrorist threats and desired attitudes towards them, as well as appropriate preparation of police officers, but also other services, to safely perform tasks related to the elimination of terrorist threats.
