    Opis:
    Public procurement reform currently being implemented in the EU is supposed to facilitate its use as an instrument of the Europe 2020 strategy and the goals of sustainable development. It involves redefining the function of public procurement, hitherto associated with increasing the spending efficiency of contracting authorities, due to competition on the open European market. The demands to strengthen the so-called social dimension of European Integration enjoy broad public support. However, there is no simple optimizing formula for simultaneously promoting competition on the open public procurement market and achieving sustainable development. Based on previous experience, the practical range of possible simultaneous implementation of these goals seems to be limited. At the same time one may notice an imbalance of international trade generated by an open public procurement market, which aggravates the realization of socio-economic convergence goals.
    Wdrażana obecnie w UE reforma zamówień publicznych ma m.in. umożliwić ich wykorzystanie ich jako instrumentu realizacji strategii Europa 2020 i osiągania celów zrównoważonego rozwoju. Oznacza to redefinicję funkcji zamówień publicznych, związanej dotychczas ze zwiększaniem efektywności wydatków instytucji zamawiających dzięki konkurencji na otwartym rynku europejskim. Postulaty wzmocnienia tzw. społecznego wymiaru integracji europejskiej mają szerokie poparcie społeczne. Nie istnieje jednak prosta formuła optymalizacyjna jednoczesnego wspierania konkurencji na otwartym rynku zamówień publicznych i osiągania celów zrównoważonego rozwoju. Na podstawie dotychczasowych doświadczeń praktycznych zakres możliwego jednoczesnego osiągnięcia tych celów wydaje się ograniczony. Jednocześnie dostrzegana jest nierównowaga w międzynarodowej wymianie handlowej generowanej przez otwarty rynek zamówień publicznych, co pogarsza sytuację w zakresie konwergencji społeczno-ekonomicznej.

    The article presents the results of a study on the quality of conical picks for the purposes of tender procedures in accordance with the public procurement law in Poland. The pick studies presented here are one of the few that in practice allow the selection of an offer based on objectively determined numerical indicators defining the quality of the product and not only on the basis of price. Thanks to this, the contracting party can decide the relevance of price and quality in their evaluation of a pick. The geometrical and material parameters required in a tender, if not met, are the basis for rejecting a given offer of picks. The numerical parameter influencing the final evaluation of the offer is the picks' rate of wear. Conical picks are tools for mining minerals, rocks, asphalt or concrete. They are used in many industries, especially in mining, construction and road engineering. In difficult working conditions, the durability of knives is limited to as little as several hours. Several dozen picks work on a cutting unit at the same time, and taking into account the price of a knife which oscillates around several dozen euros, significant operating costs are incurred. Therefore, the selection of tools with an optimum price-quality ratio is crucial. The article presents the results of studies on geometric parameters, material parameters and the rate of wear of 48 sets of picks conducted for a tender consisting of 14 tasks. The tender was conducted for 6 underground mines of a coal company. Five producers submitted their offers for selected tasks in the tender.

    W artykule przedstawiono wyniki badań jakości handlowych noży styczno-obrotowych na potrzeby realizacji procedur przetargowych zgodnie z prawem zamówień publicznych w Polsce. Przedstawione badania noży są jednymi z nielicznych, które w praktyce pozwalają na wybór oferty na podstawie obiektywnie wyznaczonych liczbowych wskaźników określających jakość produktu a nie jedynie na podstawie ceny. Dzięki temu zamawiający może decydować jaki udział w ocenie oferty stanowić ma cena a jaki jakość. Wymagane w przetargu parametry geometryczne oraz materiałowe, w przypadku braku spełnienia są podstawą do odrzucenia danej oferty noży. Parametrem liczbowym wpływającym na ocenę końcową oferty jest szybkość zużycia noży. Przedstawiono wyniki badań parametrów geometrycznych, materiałowych oraz szybkości zużycia 48 kompletów noży, przeprowadzone dla przetargu składającego się z 14 zadań. Przetarg przeprowadzono dla 6 kopalni podziemnych jednej ze spółek węglowych. Do wybranych zadań w przetargu swoją ofertę zgłosiło 5 producentów.

    Podmioty wykonujące usługi na rzecz KZK GOP mają różną formę własności. Zdecydowaną większość zadań przewozowych realizują przedsiębiorstwa będące własnością komunalną. Spośród reszty linii większość zlecana jest pojedynczo, z kilkoma wyjątkami. Tak naprawdę tylko w tej niewielkiej grupie linii można dostrzec zjawisko konkurencji między potencjalnymi wykonawcami i tylko tu widoczne są pozytywne skutki konkurencji. Mechanizm konkurencji, jakie ma zastosowanie w przypadku dobrze skonstruowanych postępowań o udzielenie zamówienia publicznego przyczynia się do bardziej racjonalnego wydatkowania środków publicznych, czyli do obniżenia (lub zahamowania wzrostu) cen za usługi. W artykule zostały opisane szczegółowo wymagania stawiane oferentom w różnych postępowaniach. Artykuł stanowi drugą, z trzech części.
    The entities which provide services for KZK GOP are in a different position in terms of ownership. Most of those entities, which provide those services, are the enterprises which are municipal and owned by a given town or city. Among the rest of the bus lines, most of them perform their tasks individually, with a few exceptions. Only in a small group of bus lines can one observe the competition among potential task executors and only in those cases the positive aspects of such competition can be observed. The competition mechanism should exist in case of well-constructed procedures in reference to public order and it then influences more rational spending of public funds, that is to lowering (or to a stop of the increase) of prices for services. The article presents all the detailed requirements which are presented to the bidders in various types of proceedings. This article is the second out of three parts.

    W artykule przedstawiono problematykę związaną ze zużyciem noży styczno-obrotowych oraz metodykę oceny jakości noży styczno-obrotowych stosowanych do zbrojenia organów urabiających różnych maszyn roboczych. Omówiono autorską metodę oceny jakości noży styczno-obrotowych polegającą na badaniach parametrów geometrycznych, materiałowych oraz szybkości zużycia noży. Metodyka wykorzystuje wskaźniki parametryczne w celu dostosowania badań do określonych warunków, maszyn oraz wymagań użytkownika. Wyniki badań zebrane w postaci kart pomiarowych pozwalają na wybór najlepszego noża oraz określenie wpływu wybranych jego parametrów na szybkość zużycia.
    This paper presents a methodology for the quality assessment of tangential-rotary picks used to equip cutting heads of different types of machinery. An original method for assessing the quality of tangential-rotary picks based on examination of geometrical and material parameters, including the pick wear rate, has been discussed in detail. The presented methodology makes use of parametric factors to adjust testing to particular conditions and machinery as well as to the user requirements. The test results compiled in the form of measurement cards allow to select the optimal pick and determine the influence of selected parameters on wear rate.

    Celem artykułu jest zwrócenie uwagi na uwarunkowania prawne wyboru najkorzystniejszej oferty i problemy praktyczne występujące na kanwie stosowania poszczególnych przepisów ustawy z dnia 29 stycznia 2004 r. Prawo zamówień publicznych i innych ustaw. Zamawiający wybiera ofertę najkorzystniejszą na podstawie kryteriów oceny ofert określonych w specyfikacji istotnych warunków zamówienia. Najkorzystniejszą ofertą jest oferta, która przedstawia najkorzystniejszy bilans ceny i innych kryteriów odnoszących się do przedmiotu zamówienia publicznego albo oferta z najniższą ceną. W tym kontekście szczególnego znaczenia nabiera wskazanie przez zamawiającego kryteriów oceny ofert i sposobu operowania poszczególnymi kryteriami. Nowelizacja ustawy Prawo zamówień publicznych z dnia 29 sierpnia 2014 r. ukierunkowana została między innymi na rzecz wyboru ofert gwarantujących najlepszą relację jakości do ceny na podstawie pozacenowych kryteriów oceny ofert, w tym kryteriów środowiskowych, jakości, wartości technicznej. Tego rodzaju modyfikacje determinują również konieczność wzmocnienia kwalifikacji pracowników zamawiającego, w szczególności komisji przetargowej, w zakresie umiejętności właściwego sprecyzowania kryteriów pozacenowych. Praktyka stosowania nowych rozwiązań pozwoli wkrótce odpowiedzieć na pytanie, czy założenia ustawodawcy, które towarzyszyły nowelizacji przepisów ustawy Prawo zamówień publicznych, przyniosły oczekiwane rezultaty.
    The objective of this article is to draw attention to legal conditions related to choosing the most advantageous tender and practical problems occurring on the basis of applying individual provisions of the Public Procurement Act of 29 January 2004 and other acts. Contracting authority chooses the most advantageous tender on the basis of criteria for evaluation of tenders determined in the specification of essential terms of the contract. The most advantageous tender is such a tender that presents the most advantageous balance of price and other criteria related to the subject-matter of the contract or a tender with the lowest price. In this context the indication of criteria for evaluation of tenders and the method of operating individual criteria by contracting authority grows in importance. Amendment of the Public Procurement Act of 29 August 2014 concentrated on, inter alia, the choice of tenders that guarantee the best relation of value for money on the basis of non-price criteria for evaluation of tenders, including environmental, quality and technical value criteria. Such alternations also determine the need to enhance qualifications of contracting authority’s employees, especially qualifications of tender committee, in respect of the ability to properly specify non-price criteria. The practice of applying new solutions shall soon answer the question, whether the assumptions of legislator that accompanied the amendment of provisions of the Public Procurement Act have produced expected results.

    Opis:
    The article presents the essence and importance of internal audit as well as the incentives to use it in forest companies. The research utilizes the database of enterprises, which submitted their offers in the process of the best bid selection during the procedures of public procurement in the field of forestry (forest management, forest protection including fire prevention, timber harvest and loggong, soil preparation, nursery works and seed collection) for years 2012−2016 in Regional Directorate of the State Forest in Gdańsk (N Poland). The database consisted of 103 firms that participated in 75 tender procedures in 15 forest districts. Basing on the analysis of tenders for forest services, an activity of forest companies was assessed, with the emphasis on companies fulfilling the requirements of the Reliable Forest Enterprise certification. Furthermore, the tenders criteria were evaluated taking into account their number, type and weight. In the analyzed procedures following criteria were used: price, execution of works only by employed staff (logging and extraction, tree cutters and machinery operators as well as supervisors), fulfilling the requirements of Reliable Forest Enterprise certificate, supervisor with forestry education, experience of the company (value of completed services), and ownership of specialized equipment (multi−task machinery, horses). Certain weights were attributed to all of the above mentioned criteria. The analysis of companies activity showed, that the noticeable decrease in number of offers for tenders in 2016 is a reaction to a new tender criterion – Reliable Forest Enterprise certificate, with the assumed weight of 20%. Another relatively new criterion was the condition, that all persons used to carry out the forest works had to be contractually employed by the company. Both these criteria decreased the weight of price criterion by average 30% comparing to previous years. The presence of these new criteria increased the number of non−price criteria by average of 1 comparing to previous years, and contributed to the unification of non−price criteria used in Regional Directorate of the State Forest in Gdańsk.
