    Opis:
    In the registration process as well as classification and putting into service of mopeds, motorcycles and quadricycles, very important is a proper use of precise technical nomenclature and definitions. This nomenclature and definitions would be used during the whole vehicle's lifetime (e.g. taxation, insurance, driving licensing, trial verdicts etc.). Engine capacity and power, maximum design speed, number of wheels, masses of vehicle is just an example of the terms, which always play an extremely significant role. There are numerous disputes on how to describe some of the crucial vehicle design features and general purpose. Those disputes are more and more frequently an essential aspect of administrative hearings and trials. Especially for L-category vehicles, many difficult regulations have been recently introduced. This situation may cause well grounded confusion. During the periodical technical inspection, it is not uncommon that vehicle owner urges the technical staff to classify his motorcycle as a moped. As the European authorities have already taken notice of the issues in question, EU law has been introduced, in order to prevent such irregularities. Paper presents views of the Harley - Davidson V-ROD VRSCAW motorcycle the TGB R50X moped, the Suzuki Ozark 250 quadricycle and the Honda TRX450R quadricycle.
    Niniejsze opracowanie stanowi uzupełnienie tematu „problemy klasyfikacyjne w procesie rejestracji i dopuszczania do ruchu motorowerów, motocykli i czterokołowców" i ma na celu opisanie stosowanego w przepisach nazewnictwa przedmiotowych pojazdów i innych cech technicznych mających istotne znaczenie prawne. Precyzja stosowania pojęć podczas postępowań prawnych i administracyjnych jest istotnym zagadnieniem klasyfikacji pojazdów. Spory dotyczące wskazania istotnych cech pojazdów które opisywałyby jednoznacznie konstrukcyjne przeznaczenie pojazdu należą w ostatnich latach do jednych z częściej spotykanych aspektów postępowań prawnych przed sądami i urzędami administracyjnymi. Prawidłowa klasyfikacja pojazdów ma istotne znaczenie dla wielu systemów prawnych w tym podatkowych, w zakresie praw jazdy, zasad ruchu drogowego, itd. niestety często jest nie odpowiednio stosowana lub doceniana.

This nomenclature and definitions would be used during the whole vehicle's lifetime (e.g. taxation, insurance, driving licensing, trial verdicts etc.). Such parameters as: engine capacity and power, maximum design speed (constructional), number of wheels, masses of vehicle, are just an example of the terms which always play an extremely significant role in proper classifying the vehicles in not only proper classifying the vehicles not only at the point of registration, but also driving licensing. There are numerous disputes on how to describe some of the crucial vehicle design features and general purpose. Those disputes are more and more frequently an essential aspect of administrative hearings and trials. Especially for L-category vehicles, many difficult regulations have been recently introduced. This situation may cause well grounded confusion. During the periodical technical inspection, it is not uncommon that vehicle owner urges the technical staff to classify his motorcycle as a moped. This is the real problem and it appears not only in our country. As the European authorities have already taken notice of the issues in question, European Union law has been introduced, in order to prevent such irregularities. There is no doubt that it essentially and really affects the safety in the road traffic.
    W procesie rejestracji, klasyfikacji i dopuszczania do ruchu motorowerów, motocykli i czterokołowców ważne jest odpowiednie stosowanie użytego w przepisach nazewnictwa przedmiotowych pojazdów i innych cech technicznych mających istotne znaczenie prawne. Precyzja stosowania pojęć podczas postępowań prawnych i administracyjnych jest istotnym zagadnieniem klasyfikacji pojazdów. Odpowiednia terminologia oraz definicje wykorzystywane są w trakcie całego okresu użytkowania pojazdów (m.in.: dla celów podatkowych, ubezpieczeniowych, w zakresie praw jazdy oraz zasad ruchu drogowego, itd.). Parametry takie jak: pojemność silnika, moc silnika, prędkość maksymalna (konstrukcyjna), liczba kół, masy własne i dopuszczalne mają w świetle przepisów kluczowe znaczenie dla prawidłowego sklasyfikowania pojazdów nie tylko z punktu widzenia rejestracji, ale również praw jazdy. Spory dotyczące wskazania istotnych cech pojazdów które opisywałyby jednoznacznie konstrukcyjne przeznaczenie pojazdu należą w ostatnich latach do jednych z częściej spotykanych aspektów postępowań prawnych przed sądami i urzędami administracyjnymi. Szczególnie w przypadku pojazdów kategorii L w ostatnich latach powstały różnego rodzaju rozwiązania prawne, które, niekiedy zapomniane, mogą wywołać „zamieszanie" podczas badań lub rejestracji przedmiotowych pojazdów. Podczas badań technicznych w stacjach kontroli pojazdów bardzo często dochodzi do próby wymuszenia przez właścicieli pojazdów sklasyfikowania motocykli jako motorowerów. Jest to problem nie tylko naszego kraju, dlatego wprowadzono przepisy unijne mające zapobiegać tego rodzaju nieprawidłowościom. Ne ulega wątpliwości, że ma to istotny i realny wpływ na bezpieczeństwo w ruchu drogowym.

    Opis:
    The road safety is affected by several factors quality of infrastructure, behaviour of drivers, including their proper training and also safe cars. For the safety of vehicles in the approving process a number of regulations (regulatory acts) apply, regulating the technical requirements in the active and passive vehicle safety, but also in the environment. In the area of technical requirements for vehicles and their parts significant changes occur constantly, mainly due the progressive technological developments. A large number of regulatory acts are often changed due to the tightening. These regulatory acts relates directly to manufacturers, because their manufactured vehicles have to meet these requirements. That these regulatory instruments are evolving in the right direction proved the fact that due to better road safety the number of fatal accidents in the last two decades shrunk, although the volume of traffic has tripled. A significant progress has been achieved only through the improved vehicle safety and only in a small measure thanks to the improvement and upgrading of the infrastructure.
