    Dane przestrzenne zbierane przez użytkowników Internetu (VGI) niebędących profesjonalistami w tym zakresie z roku na rok zyskują coraz więcej zastosowań. Główną przyczyną tego zjawiska jest ich darmowy charakter oraz bardzo wysoka aktualność, a także wręcz nieograniczona szczegółowość tematyczna. Cech tych nie można przypisać profesjonalnym danym przestrzennym wchodzącym w skład Krajowej Infrastruktury Informacji Przestrzennej. W artykule podjęto próbę odpowiedzi na pytanie – czy można wykorzystać dane VGI pochodzące z największego projektu tego rodzaju OpenStreetMap do realizacji wybranych zadań jednostek samorządu terytorialnego? Analizie poddano zadania wyszczególnione w ustawie z 8 marca 1990 r. o samorządzie gminnym w odniesieniu do zadań gmin, ustawie z 5 czerwca 1998 r. o samorządzie powiatowym w odniesieniu do zadań powiatów oraz ustawie z 5 czerwca 1998 r. o samorządzie województwa w odniesieniu do zadań województw. Następnie dokonano przeglądu kompetencji wyszczególnionych w ustawach samorządowych, a także ustawach je uszczegóławiających i do każdej z nich przypisano informację o tym czy do jego wykonania potrzebne są dane przestrzenne. Następnie przedstawiono możliwości wykorzystania danych OpenStreetMap w realizacji przykładowych zadań jednostek samorządu terytorialnego.
    Voluntereed geographic information (VGI) gains more and more applications every year. The main reason for this phenomenon is their free nature and very high timeliness, as well as unlimited thematic details. These features can not be attributed to professional spatial data included in the Spatial Information Infrastructure. The paper attempts to answer the question – can you use VGI data from OpenStreetMap, the largest project of this kind, to implement selected tasks of local government units? The tasks specified in the Act of 8 March 1990 on municipal local governments, Act of 5 June 1998 on district (powiat) government and the Act of 5 June 1998 on provincial (voivodship) government were analyzed. Next, the competences listed in local government laws, as well as the laws detailing them, were reviewed and information on whether spatial data was required for their implementation was assigned to each of them. Then, the possibilities of using OpenStreetMap data in the implementation of exemplary tasks of local government units were presented.

    This article looks at the issues related to financing of the Polish central government’s tasks which by law are delegated to local government units. It first discusses some legal issues connected with responsibility for delegated tasks, as well as problems with underfinancing of these tasks. Next, it provides an overview of the scope of delegated tasks, and looks at financial analyses of special-purpose grants for delegated tasks, which depend on the type of the local government units and their location. The article concludes with the discussion of possible solutions to the problems raised.

    The discussion in the article takes into account two aspects: the specific nature of contracts as legal forms of action of local government bodies, and the special rela- tionship of two branches of law, i.e. administrative law and public economic law. Both directions of this discussion entail a civil law aspect with a extended theory on contracts and the freedom of contract. The study assumes that the element linking the above threads is the principle of the social market economy as one of the foundations of the system of the Republic of Poland, which does not exclude state economic activity, subject to Article 1, Article 2 and Article 5 of the Constitution of the Republic of Poland. This field includes the regulations of the Law on Municipal Management, whose addressees are local government bodies. For the implementation of the tasks assigned to local government in the field of economy, local government bodies enter into contracts; this is one of the legal forms that allows them to take into account the complexity of administration-economy relations (relationships), and therefore third parties: entrepreneurs, contractors, competitors and consumers. An area of study related to the issues stated in the title and which is significant for both theoretical and practical reasons is the regulation of Article 3 of the Law on Municipal Management. This provision provides a specific legal basis for concluding contracts “for the purpose of entrusting the performance of tasks” in the field of municipal management. The article points to the issue of the legal determination of contractual entrustment of such tasks, taking into account the constitutional principle of binding the administration to the law (Article 7 of the Constitution of the Republic of Poland) and the civil law principle of freedom of contract (Article 353¹ of the Civil Code). The scope of freedom enjoyed by local government units in the use of the form of contract in the doctrine is also considered as an element  of “organizational independence” of these units, and whose theoretical expression is the constitutional principle of subsidiarity. The article emphasizes the lack of a general and common statutory basis in the Polish legal order that would regulate the transfer of public tasks, as well as the lack of a statutory regulation providing a template(s) for the contract, which is most often referred to in the doctrine as a public-legal contract.

    Celem artykułu jest prezentacja zasad finansowania zadań oświatowych przez jednostki samorządu terytorialnego i analiza udziału w procesie finansowania zadań oświatowych, środków przekazywanych z budżetu państwa w postaci części oświatowej subwencji ogólnej. Celem tekstu jest także zbadanie stopnia pokrycia wydatków oświatowych w jednostkach samorządu terytorialnego przez pozyskane przez te jednostki transfery z budżetu państwa. Realizacja przedstawionych założeń obejmuje część teoretyczną i empiryczną. W części teoretycznej przedstawiono oświatę jako dobro publiczne oraz zasady finansowania zadań oświatowych w aktualnym stanie prawnym ze szczególnym uwzględnieniem części oświatowej subwencji ogólnej. Część empiryczna zawiera analizę udziału dochodów z tytułu części oświatowej subwencji ogólnej w poszczególnych jednostkach samorządu terytorialnego. Pokazano także lukę pomiędzy wydatkami jednostek samorządowych na zadania oświatowe a dochodami pozyskanymi na ten cel z budżetu państwa.
    The purpose of this article is to present the principles of financing educational tasks by local government units and to analyze the share in the process of financing educational tasks of funds transferred from the state budget in the form of the educational part of the general subsidy. The aim of the article is also to examine the degree of coverage of educational expenditure in local government units by transfers from the state budget obtained by these units. The implementation of the presented assumptions includes the theoretical and empirical part. The theoretical part presents education as a public good and the principles of financing educational tasks in the current legal status, with particular emphasis on the educational part of the general subsidy. The empirical part includes an analysis of the share of income from the education part of the general subsidy in individual local government units. This part also shows the gap between the expenditure of local government units on educational tasks and the revenues obtained for this purpose from the state budget.

    Dla właściwej i efektywnej współpracy pomiędzy społeczeństwem a organami publicznymi konieczne jest spełnienie dwóch podstawowych warunków. Mowa o należycie skonstruowanej podstawie prawnej oraz chęci wzajemnego współdziałania. Istota obu przesłanek została przedstawiona na przykładzie wniosku o realizację zadania publicznego oraz inicjatywy lokalnej. Analiza ma na celu ukazanie ich charakteru prawnego oraz zasygnalizowanie dylematów prawnych wynikających z obecnego kształtu ustanawiających je przepisów. Szczególna uwaga została skupiona na wniosku o realizację zadania publicznego, który mimo wielu wątpliwości prawnych, do tego czasu nie doczekał się szerszego omówienia. Ponadto przedstawione zostały wyniki badań własnych dotyczących praktycznego stosowania wniosku o realizację zadania publicznego oraz inicjatywy lokalnej w wybranych jednostkach samorządu terytorialnego województwa śląskiego.
    For appropriate and effective cooperation between territorial self-government units and non-government organizations it is necessary to achieve two basic conditions. It is about proper legal basis and responsiveness. Significance of these conditions is presented by the example of two institutions regulated in the Act of April 24th, 2003 on public benefit activity and volunteering- application for realization of public tasks and local initiative. This article shows the legal nature of these institutions and the legal issues connected with actual normative frameworks. Particular attention is paid to the application for realization of public tasks. Despite many legal ambiguities, this application did not receive wider doctrine studies so far. Furthermore, the article presents results of own research on the practical usage of the following applications in the chosen territorial self-government units in Silesian voivoidship.

    Problematyka organizacji oraz finansowania systemów ochrony zdrowia stanowi jeden z istotnych aspektów funkcjonowania współczesnych państw. Poświęca się jej wiele uwagi, co znajduje swoje odzwierciedlenie również w systemach prawnych, które w coraz szerszym zakresie odnoszą się do poszczególnych aspektów ochrony zdrowia. Istotnym elementem definiującym system ochrony zdrowia danego państwa jest przyjęty model jego organizacji oraz finansowania. Determinuje on oczywiście w znacznej mierze kształt przyjmowanych w państwie rozwiązań organizacyjnych oraz zasad finansowania świadczeń opieki zdrowotnej. Pozostaje jednocześnie w związku z realizacją prawa do ochrony zdrowia, a w tym zakresie z zapewnieniem dostępu do świadczeń opieki zdrowotnej finansowanych ze środków publicznych. W niniejszym opracowaniu analizie poddano strukturę źródeł finansowania systemów ochrony zdrowia – ze szczególnym uwzględnieniem środków publicznych przeznaczonych na ten cel przez jednostki samorządu terytorialnego.
    The management and financing of health care is one of the most important aspects of the operations of modern states. Te authorities of modern states pay a considerable amount of attention to the management of health care, and this is also reflected in their legal systems, which are focusing more and more on specific aspects of health care. An important aspect of a given state’s system of health care is the model it adopts to manage and finance its health care facilities. Naturally enough, this largely determines the kind of management solutions the given state uses and the principles it decides on to finance its health service. At the same time, this is connected with the implementation of the individual’s right to health care, and hence with the state’s duty to provide its citizens with access to health care services financed from public funds. This study analyzes the structure of sources used to finance health care systems – with particular attention to public funds allocated for this purpose by local government units.
