    Artykuł jest próbą prześledzenia zasad wnoszenia i zwracania zabezpieczenia wadialnego w formie niepieniężnej. Z założenia uwzględniać ma zmiany, jakie zaszły w procedurze realizacji zamówień publicznych, a dokładnie dotyczyć wprowadzenia pełnej elektronizacji do zamówień publicznych. Nowe zasady związane z elektronizacją nie zakładały wprowadzenia korekt do innych przepisów ustawowych i okołoustawowych, dotyczących wnoszenie oraz zwracania wadium w postaci niepieniężnej. W świetle obowiązujących przepisów jest to poważny problem, mogący prowadzić do nieprawidłowości procedury udzielania zamówienia publicznego.
    The article is an attempt to trace the rules for entering and returning security in a non-monetary form. The assumption is to take into account the changes that have taken place in the public procurement procedure, it is exactly about introducing full electronization into public procurement. The new rules related to electronization did not provide for any corrections to other statutory and legal regulations regarding the lodging and return of the bid bond in non-monetary form. In the light of applicable regulations, this is a serious problem that may lead to irregularities in the public procurement procedure.

    Jednym z podstawowych warunków, prawidłowego funkcjonowania przedsiębiorstw, jest istnienie systemu obsług: gwarancyjnych i pogwarancyjnych klientów w zakresie dostarczanych wyrobów. Uzyskane dane z funkcjonowania tego systemu, mogą być źródłem doskonalenia systemu zarządzania jakością wyrobu, w tym przypadku okien PCV. Niniejszy artykuł przedstawia dane pozyskane z tego systemu a dotyczące przyczyn i skutków niezgodności tego wyrobu.
    One of the basic conditions for the proper functioning of enterprises is the existence of the warranty and post-warranty service system for the customers in the field of the delivered products. The data obtained from the functioning of this system may be a source of improvement of the product quality management system, in this case PCV windows. This paper presents the data obtained from this system, regarding the causes and effects of the nonconformities of this product.

    This article investigates the case of four Lithuanian-Ruthenian dukes vouching for Duke Żedywid before the Polish King Władysław II Jagiełło. The original Ruthenian document does not include a date nor does it contain any information about the circumstances in which the surety (poręczenie) was issued. There have been attempts to solve this riddle in the historical literature, with reference to information about Żedywid contained in primary sources, biographies and genealogies of the vouching dukes, and the political history of the Grand Duchy of Lithuania in the late fourteenth century. However, the majority of conclusions that have been drawn so far are based on misreadings of the text of the surety. The identification of the scribe who prepared the document has made it possible to determine its chronological framework, and information about the vouching dukes and King Władysław’s itinerary indicates that it was written between August 1392 and October 1393, most likely in Kraków. An attempt to put the surety into a broader political context requires us to take into account its possible connection with the actions undertaken by Vytautas aimed at extending and strengthening his power in the Grand Duchy of Lithuania after the Ostrów Agreement of 1392. This connection, however, remains only in the sphere of hypothesis. The exceptionally short diplomatic form of the document and lack of detailed information about these events and Żedywid himself in contemporary sources indicate that Żedywid’s actions did not pose any serious threat to Jagiełło.

    Opis:
    This article is devoted to a guarantor’s risk related to the management of public procurements. Special attention is given to guarantee in this process and the risks associated with its sale. The aim of the article was to show the changes in terms of the guarantor’s exposure to risk in connection with the amendment to the Public Procurement Law. The article consists of three main parts: the introductory, which presents the types of warranty occurring in the procedure for awarding a public contract, the detailed one on the specific provisions of the law analysed, and the third one which describes the changes in the risk of the guarantor in the new legal reality.
    Niniejszy artykuł poświęcony został tematyce ryzyka gwaranta związanego z postępowaniem o udzielenie zamówienia publicznego. Szczególną uwagę zwraca się w nim na rolę gwarancji we wspomnianym procesie oraz na zagrożenia związane z ich sprzedażą. Celem artykułu było ukazanie zmian w kwestii ekspozycji na ryzyko gwaranta w związku z nowelizacją Prawa zamówień publicznych. Artykuł składa się zasadniczo z trzech części, tj.: wstępnej, w której przedstawiono rodzaje gwarancji występujące w postępowaniu o udzielenie zamówienia publicznego; drugiej ‒ dotyczącej szczegółów projektu ustawy oraz trzeciej ‒ opisującej zmiany ryzyka gwaranta w nowej rzeczywistości prawnej.

    This paper highlights the issues arising from an obligation such as surety. Under the provisions of the Polish Civil Code, the legal position of a guarantor is closely related to non-legal factors. The ambiguity and uncertainty of the status of a guarantor are even greater due to the variability in time of the normative construction of a surety. Therefore, in addition to the measures available in law, a certain counterweight, such as the general public values, is necessary to address this state of affairs. The most widely understood trust, being the necessary condition for the proper development of a modern democratic state of law, may undoubtedly play that role.
