After last global financial crisis from a decade ago, financial market have been experiencing significant increase in number of regulations. This was especially visible in the banking sector, in which number of post-crisis new regulations amounted to thousands per year. It was not only challenging for banks, that have been spending increasingly more financial resources on compliance, but also for supervisory entities that have to keep track of compliance for every entity on financial market. Due to the fact that supervisory process relies mostly on manual process, it can be both time consuming and inefficient. This is why, not only banks have been exploring new technologies in compliance with regulations (Reg Tech), but also supervisory authorities have been doing the same with the aim of increasing their efficiency (Sup Tech). The research paper aims to test hypothesis, which is as follows: – Sup Tech is becoming an innovative tool for banking supervision and is expected to have increasingly larger role in banking supervision. For the purpose of the paper, the following methods have been applied: critical analysis of literature and research papers as well as descriptive method and comparative analysis of presented data.

Supervision of the financial markets has become over the last twenty years or so, an increasingly important element of the financial system. It is progressively moving away from passive compliance checks, towards becoming a real and active influence of the financial markets. It is encompassing a growing range both of issues and entities and is undertaking an ever-deeper insight. Financial supervision is also increasingly acquiring regulatory powers through the extensive application of self-produced ‘soft’ regulatory norms as well as accumulation of resources. (proliferating particularly after the recent global financial crisis). The goal of this article is to provide a systematic review of principal challenges currently facing financial supervision. The article is split into three parts. Its first part discusses the theoretical foundations of the supervisory system trying to indicate the sources of its powers, including its societal role. It deserves more attention in view of the unprecedented powers acquired by supervisors over supervised institutions and the financial markets. In the second part we take a close look at the changing supervisory paradigm in its current form. The third part reviews the new challenges facing financial supervision in its search for innovations which adapt to new requirements, and the available opportunities in the development of its new toolkit.

According to the current state of law, a Deputy who is not a member of supervisory boards and programme boards of public broadcasters is not entitled to attend meetings of these bodies, even as an observer. Deputies may, however, in the exercise of their parliamentary mandate, have access to minutes documenting meetings of such bodies. Providing a parliamentarian with such documents is conditional, as it cannot infringe on personal rights of others, as well as on provisions concerning statutorily protected secrets.

Artykuł przedstawia wyniki badań dotyczących opinii zarządzających szpitalami na temat funkcjonowania oraz przydatności rad społecznych i nadzorczych. Wyniki te wskazują, że działalność rad nadzorczych jest przydatna dla organu właścicielskiego i samej placówki. W przypadku rad społecznych – większe korzyści uzyskuje organ właścicielski. Szczególnie wysoko jest oceniany nadzór rad nadzorczych nad kwestiami ekonomiczno-zarządczymi. Nie wskazano na większe problemy funkcjonowania rad. Respondenci podkreślili jednak, że ich członkowie nie zawsze są przygotowani do posiedzeń i nie zawsze mają odpowiednie kwalifikacje. Zarządzający szpitalami zdecydowanie wyżej cenią sobie wkład w zarządzanie szpitalami, jaki wnoszą rady nadzorcze. W porównaniu z nimi rady społeczne zostały ocenione stosunkowo nisko.
The paper presents the results of research on the opinions of hospital managers concerning the operation and usefulness of social supervisory boards and supervisory boards. The results of the research suggest that boards of trustees are useful for hospitals and their owners. Social supervisory boards are more beneficial to the owners. The impact of boards of trustees on economic and management issues is particularly important. The boards themselves operate without significant problems. Respondents stress, however, that board members are not always prepared for meetings and do not always have appropriate qualifications. Hospital managers appreciate the contribution of boards of trustees much more than that of social supervisory boards.

The purpose of this article is to analyse the competences of the supervisory authority provided for in the General Data Protection Regulation (GDPR) as a tool to shape the practice of personal data processing. This article verifies the thesis that the status of the supervisory authority formed in the GDPR, taking into account the authority’s independence, makes it possible to exercise the authority thoroughly, which is the basis for shaping personal data processing practice. Supervisory authorities have a wide range of powers to carry out the duties assigned to them. This is guaranteed by their independence. The exercise of powers resonates with all entities that fall under the jurisdiction of those authorities. The decisions of the authorities become the subject of interest of both the literature and personal data administrators. The powers connected with imposing administrative penalties might play a particular role. Their imposition causes that entities which are in similar circumstances may expect to be subject to the same penalties. In order to avoid this situation, they tend to adapt their practices to the model adopted in the decision. Opinions and recommendations, as well as codes of conduct approved by the supervisory authorities for particular sectors, which are a benchmark for administrators in those sectors, play an important preventive role.

Opis:
The study provides characteristics of basic supervision orientations as well as analyses of infor- mation usefulness depending on the moment presented at time axis in which the supervisory authority can or should intervene. Useful information facilitates verification of current and future operations performed by insurance institutions, detecting possible irregularities and also the assessment of economic and legal capacity for maintaining correct financial relations. Depending on the accepted supervision orientation the nature of useful information is changing and therefore it provides the reflection of actual reality to a different extent and also enables availability in time, not always offering the possibility to take up proper actions. However, information influences cognitive efficiency and facilitates undertaking decisions which sup- port meeting adequate supervisory objectives.

Authors present a development of the temperature control system in the spray booth equipped with the two - state burner. The paper presents results of temperature control for different conditions of the external air temperature. A typical two-state algorithm isn’t enough effective to minimise temperature fluctuation amplitudes inside a spray booth. Minimisation of the number of burner ignitions with acceptable fluctuation amplitudes of the temperature is possible by means of : modification of the measurement loop, modifications of the two-state algorithm. Minimisation of number of burner ignitions will increase durability of the burner and decrease consumption fuel used to start the burner. In the final part of the article selected results of real time experiments were presented and shortly analysed.

Authors present a real time supervisory system for two cooperating spray booths, which are elements of the production line. The supervisory system enables a constant observation of such physical parameters like: temperature, pressure, air flow, concentration of styrene etc. The system also warns workers inside spray booths about dangerous events like a critical level of styrene, too low overpressure, the air flow is not high enough, etc. The paper presents results of the hardware and software development.

The police process huge amounts of personal data without which they would not be able to carry out their basic tasks. The data processed by the police have a very different nature and scope. Data processing in such large quantities and in such a wide range is associated with great responsibility for its safety. Maintaining a high level of security becomes a challenge when, at the same time, it is necessary to take care of the rights of data subjects. The article contains an overview of administrative decisions issued by the Inspector General for Personal Data Protection (currently: the President of the Personal Data Protection Offi ce) relating to police activities. The issues of the implementation of the rights of data subjects are discussed in three areas, i.e.: sharing information from police resources, deleting data from the National Police Information System, and verifi cation of identity documents.

Zmiany w zakresie problematyki ochrony danych osobowych związane z wejściem w życie przepisów RODO oraz ustawy o ochronie danych osobowych spowodowały nałożenie na Prezesa UODO szeregu różnorodnych zadań. Wiele z nich organ ten wykonuje korzystając z podstawowej prawnej formy działania administracji, jaką jest decyzja administracyjna, która w tym przypadku podejmowana jest w jednoinstancyjnym postępowaniu. Na tym tle podjęto kolejno analizę: statusu i zakresu zadań, w tym uprawnień nadzorczych Prezesa UODO oraz ram proceduralnych, w których są one podejmowane – w tym z wykorzystaniem formy decyzji administracyjnej. Za zasadne uznano też zbadanie, czy w konkretnych przypadkach forma decyzji administracyjnej stanowi adekwatny środek realizacji zadań powierzonych przez przepisy RODO Prezesowi UODO. W konkluzji autorki uznały za konieczne rekomendowanie, aby ustawodawca ściśle określił formę prawną, w jakiej powinny być wykonywane zadania Prezesa UODO. Nadto wskazały one, że ustawodawca zdaje się nie dostrzegać, że charakter powierzonych Prezesowi UODO zadań wskazuje, iż forma decyzji administracyjnej nie zawsze wydaje się być nie tylko najlepszą, ale wręcz odpowiednią. Szczególnie, gdy chodzi o działania tego organu związane z koniecznością wydania ostrzeżenia czy udzielenia upomnienia – forma decyzji administracyjnej nie wydaje się być zasadną.
Changes in the field of personal data protection related to the entry into force of the provisions of the GDPR and the Act on the protection of personal data resulted in the imposition of a number of different tasks on the President of the Personal Data Protection Office. Many of them are implemented by this authority using the fundamental legal form of administrative action – i.e. an administrative decision, which in this case is adopted in one-instance proceedings. On this basis, the following analysis was carried out: the status and scope of tasks, including the supervisory powers of the President of the Personal Data Protection Office, and the procedural framework in which they are undertaken – including the form of an administrative decision. It was also considered worth to examine whether, in specific cases, the form of an administrative decision constitutes an adequate means of implementing the tasks entrusted by the provisions of the GDPR to the President of the Personal Data Protection Office. In the conclusion, the authors considered it justified to recommend that the legislator should precisely define the legal form in which the tasks of the President of the Personal Data Protection Office should be performed. Moreover, they indicated that the legislator does not seem to notice that the nature of the tasks entrusted to the President of UODO indicates that the form of an administrative decision does not always seem to be not only the best, but even appropriate. Especially when it comes to the actions of this authority related to the need to issue a warning or issue a reminder – the form of an administrative decision does not seem to be justified.

In generating and transmission nodes to secura for the grid correct process of voltage regulation and reactive power flow control it is needed to aim at application the systems of group regulation on voltage and reactive power. Systems of group regulation by its superior control should overcome all regulation formations whose take a part in the process of U & Q regulation in particular. In the paper requirements for the systems of groupregulation in generating and transmission nodes have been proposed.

The consequences of last crisis on financial market is the promotion of the macroprudential policy as new approach in regulatory policy on the financial sector. The main ideas of goal, tasks and instruments of macroprudential policy were presented in the article. They were confronted with the goal, tasks and instruments of microprudential supervisory policy. This comparison indicates the existence of general goal of macroprudential policy but there are also some problems concerning the detailed tasks of this policy. This result causes the further problem with identification of many instruments which should be belong to the marcoprudential policy only. Lack of detailed tasks of macroprudential policy and similar instruments used by micro- and macroprudential policy may generate some tension in supervisory policy and diminish the safety of financial sector and the trust its clients. We recommend to implement the new supervisory policy on step by step basis, collecting all the time the necessary experience and to take the decision later if the institutional separation of macroprudential policy is really reasonable or it is better to divide the tasks of this policy between microprudential policy and central bank activity.
Jednym z głównych wniosków wyciągniętych z doświadczeń ostatniego kryzysu na rynkach finansowych na świecie był postulat wprowadzenia polityki makroostrożnościowej. W artykule pzedstawiono najważniejsze cele, zaadania i instrumenty tej polityki oraz skonfrontowano je z dotychczasową polityką mikroostrożnościową. Brak szczegółówego określenia zadań polityki makroostrożnościowej i podobieństwo wielu potencjalnych jej instrumentów do narzędzi polityki mikroostrożnościowej może prowadzić do potencjalnych konfliktów w zakresie stosowania obu polityk. Pojawienie się takich konfliktów może prowadzić do obniżenia bezpieczeństwa sektora finansowego i zaufania jego klientów. Dostrzegając te zagrożenia, rekomendujemy stopniowe wdrażanie nowej polityki, gromadzenie niezbędnych doświadczeń w tym zakresie i odsunięcie w czasie decyzji o ewentualnym instytucjonalnym wyodrębnieniu polityki makroostrożnościowej zamiast jej podziału między kompetencje polityki mikroostrożnościowej i zadania banku centralnego.

Purpose: The purpose of this paper is a discussion and in-depth analysis of the legal and organizational circumstances associated with the activities of Supervisory Boards in housing cooperatives. Methodology: A critical analysis of the existing legislation, own analytical analysis of the source documents, supplemented by conclusions and observations formulated on the basis of a case study, for the preparation of which information has been used obtained from primary sources in the form of documents of the analyzed housing cooperative and information obtained through participant observation. Findings: What has a decisive impact on the mechanisms of corporate governance in housing cooperatives are the direct behaviors of Supervisory Board members, as well as the lack of awareness and involvement of the residents, who do not want to actively participate in the life of the cooperative. A diagnosis is presented of the most important factors that infl uence the actual operations of the analyzed Supervisory Board. While the current legal regulations make it possible to ensure effective and proper control as well as adequate supervision over the activities of cooperatives. Originality: The paper enriches the theory of management sciences in terms of a wider perception of the term corporate governance in relation to other organizations than companies. The presented methodological approach that is the basis for a comprehensive and thorough inspection of the activities of the Management Board can be used in other cooperatives as well. In the literature on the subject no similar analysis, supported by the results of own analytical research, had been found.

Przeprowadzono analizę wrażliwości, optymalnej struktury powiązań układu nadrzędnego, w obecności zakłóceń. Przedstawiono analizę wrażliwości parametrów systemu w otoczeniu optymalnego punktu pracy. Porównano wyniki takiej analizy dla kilku wybranych wariantów struktur technologicznych. Analizy przeprowadzono metodami symulacyjnymi. Zastosowano opis analityczny modeli statycznych układów technologicznych wzbogacania węgla oraz technikę metamodelowania do opracowania modelu całkowitego układu sterowania nadrzędnego grupy zakładów przeróbki węgla.
The problems of application of a sensitivity analysis for a supervisory control of a group of coal preparation plants have been discussed in the paper. The sensitivity analysis of an optimal structure of links within a superior system in presence of disturbances has been made. The sensitivity analysis of the parameters of the system around an optimal working point has been presented. The results of such analysis have been compared for some chosen versions of technological structures. The analyses have been conducted by simulation methods. An analytic description of the static models of the technological systems of coal preparation as well as a metamodeling technique have been applied to development of a total model of the supervisory control of a group of coal preparation plants.
