The subject of this article is the right to petitions specified in Article 17 of the Basic Law of the Federal Republic of Germany. This provision regulates the individual’s right to address requests and complaints to public authorities. This publication contains an analysis of this institution with regard to entities that are entitled to exercise this right, as well as entities obliged to consider submitted petitions. The author begins the analysis of the indicated institution be reviewing the evolution of the historical right to petition, which has evolved from the institution of supplication known in ancient Rome. He indicates changes in the subjective scope of the right to petitions, focusing on the achievements of German constitu- tionalism in the 19th century. Next, the current regulation that guarantees the right to petition in Germany in its normative environment is presented. The public authorities that are the addressees of the petition have been analysed, and the scope of duties associated with receiving a complaint or request indicated. Furthermore the author describes particular types of entities that are guaranteed the right to submit petitions under the Basic Law of the Federal Republic of Germany. In this respect, various kinds of restrictions of this right, depending on the type of the petitioner, are identified. The last part of the work contains the characteristics of various forms of petitions due to the type of author and the addressee. Various functions which currently are fulfilled by the institution of petitions were subjected to analysis. In this context, a distinction was made between individual petitions and collective petitions, tak- ing into account their subject matter and the aims intended by the petitioner. The author also shows the future possibility of a development of the discussed institution, describing the public petition to the Bundestag, which has an electronic form.

In recent years we have interviewed members of the audience after musical performances and asked them to evaluate the acoustics of the concert halls. A group of "music lovers" (with a high level of musical training and experience) and "acousticians" (with a wide knowledge of the physical characteristics of sound transmission) also attended each performance and answered the same questions as the general public. This group thereby served as a control group when evaluating surveys of the general public. In this paper, the results obtained when analyzing these control group surveys are presented. This analysis shows that a common vocabulary exists between music lovers and acousticians when rating a hall, although the grouping of the questions for each factor depends on the training of the respondents.

Ustalenie strony podmiotowej danego przestępstwa, czyli stosunku wolicjonalno-intelektualnego sprawcy do zarzucanego mu czynu, jest nad wyraz istotne dla rozstrzygnięcia sprawy choćby dlatego, że wpływa na wymiar kary. O ile w przypadku osoby poczytalnej co do zasady ustalenie strony podmiotowej nie stanowi trudności, o tyle w przypadku sprawcy niepoczytalnego jego zaburzenia psychiczne utrudniają wspomniane ustalenie. Zaburzenia te powodują, że cierpiące na nie osoby niekiedy w inny sposób odczuwają wolę popełnienia czynu bądź jej brak, a także w inny sposób aniżeli osoby poczytalne przewidują lub nie przewidują możliwości popełnienia czynu zabronionego. W związku z tym kwestia ustalenia strony podmiotowej czynu zabronionego w przypadku popełnienia tego czynu przez sprawcę niepoczytalnego jest przedmiotem sporu w doktrynie. Autor swoje rozważania zacznie od omówienia, czym jest strona podmiotowa, a także czym jest niepoczytalność w rozumieniu kodeksu karnego z 1997 roku. Przedstawi także przykładowe poglądy doktryny co do omawianego problemu, niekiedy będące sobie przeciwstawne. Przytoczy również wybrane orzeczenia związane z omawianą materią. Następnie przedstawi własne stanowisko, odnosząc się przy tym do poglądów przedstawicieli doktryny.
Attributing the subjective features of the crime, in other words volitional and intellectual attuite at criminal act committed by perpetrator, is extremally important for settle the matter, if only because it have an influence at the punishment. In case of sane person in principle attributing subjective features is not difficult. But in case of insane perpetrator, perpetrator’s mental disorder impedes this attributing. This disorder cause that insane person sometimes in another way feels the desire to committing of criminal act or not. Insane persons also in another way than sane persons predicts or not possibility of committing the criminal act. Therefore issue of attributing subjective features of the criminal law in case of committing criminal act by insane perpetrator is issue in a dispute in Polish doctrine of criminal law. The author will start his consideration at elaborate what is subjective feature and insanity in sense of Criminal Code from 1997. Author will presents also examples of the Polish doctrine of criminal law views as to this problem, which are sometimes extremely different. The author also will quote some judgments as to this problem. At next the author will elaborate his opinion in the issue of attributing subjective features.

The aim of this paper was to explore both direct and indirect associations between subjective and relative economic well-being, materialism and SWB of young adults of the post-transformation generation. In particular, the moderating role of materialism on the relationship between subjective and relative assessment and SWB was explored. The study was conducted on a group of 207 evening/weekend students, from public and private Warsaw colleges and universities. Correlational design was used and hierarchical regression analysis and moderation analysis using Hayes Model macro # 1 were done. The study’s results indicate that young people’s well-being is positively associated with their material situation assessment (subjective and relative) and negatively with materialism. The study’s results also show that a high level of materialism weakens or eliminates the relationship between subjective and relative assessment of one’s material situation and SWB.

The aim of this paper is to define the correlation between social evaluation and personal well-being.  Methods. The study involved the citizens of Chernihiv (average age – 31.5 years old): 91 people in total, 37 men and 54 women. The following methods were used: the scale of satisfaction with life scale by Diener, as adapted by Leontiev and Osin (2008); questionnaire of parameters of subjective social well-being by Danylchenko (2015); subjective life satisfaction scale by Lybyna (2008), questionnaire on the peculiarities of evaluation by other people by Danylchenko (2019). Results and conclusion. In Ukrainian society, the most important reference groups are parents and a spouse, while friends and colleagues play a comparatively smaller role. All these groups are more likely to give positive and neutral social evaluations. However, negative evaluations are more likely to come from colleagues and friends, and positive – from family. There are differences in indicators of subjective well-being, social acceptance (as a measure of social well-being) and competence between people who are assessed predominantly positively and predominantly negatively. Subjective well-being is reduced reproaches from reference groups. Praise contributes to the enhancement of subjective social well-being Comparison with other people and the existence of a role model reduces psychological well-being. The filter for the perception of positive and negative evaluations from the social environment is a person’s self-acceptance.

Mass Observation was founded in 1937 to collect subjective, qualitative data on everyday life in Britain, and has continued to record the ordinary and the everyday ever since. Mass Observation’s purpose has always been to make the data it collects available to a range of disciplines to apply their own methodological approaches upon, resulting in data that can be reused within different projects and disciplines. This paper will use Mass Observation as a case study to illustrate how a sociological shift in attitude towards subjective data has played out in the use of a dataset traditionally viewed as a historical archive.  I will review how the data itself is used to define and design methods of analysis, examining the epistemological implications of this approach to research design and the new dimension to the researcher-data subject relationship that is introduced. I will conclude by suggesting that research using Mass Observation exemplifies the methodological opportunities and insights that can be gained by adopting a broader, multi-disciplinary research approach to reusing data.

Aim: The aim of this paper is to define the correlation between experiencing personal well-being and manifestations of spirituality of an individual.  Methods: The study involved the citizens of Chernihiv (average age – 33.2 years old): 96 people in total, 40 men and 56 women. The following methods were used: a) to measure the components of personal well-being – Satisfaction with Life scale by E. Diener, Psychological well-being scale by С. Riff, Questionnaire of parameters of subjective social well-being by T. Danylchenko; b) to measure the spiritual component – EPU Plus (Egoism - Personal Uniqueness) by L. Z. Levit, Methodology of measuring social interaction (mentality aspect) by G. L. Voronin. Results: The source of experiencing personal well-being is positive health (physical abilities, absence of physical limitations). Factors that decrease personal well-being are low level of tolerance and the pursuit of pleasure. Personal well-being is ensured by belief about collaboration and experiencing positive health as a state of readiness for activity. Psychological well-being has a negative correlation with basic egoism (the pursuit of pleasure) and a positive one with social egoism (ability to comply one’s needs with the group interests, following social rules and norms). Subjective social well-being relates to the highest egoism (unique self-realization, realization of existing potential in an acceptable way). The orientation towards achieving personal or public goals determines the peculiarities of experiencing well-being in the eudaemonic and hedonistic dimensions.

Quality of life (QoL) is strongly influenced by an individual’s health. The lack of population studies measuring the QoL of people with physical disabilities (PD) and people who are deaf and hard of hearing (D/HH) encouraged us to consider conducting this research. The aim of this study was to compare the satisfaction with quality of life indicators (QoLI) and domains (QoLD) between people with PD and people who are D/HH. This study included 315 individuals with disabilities, concretely with PD and hearing impairments. Participants were divided into two groups based on participation in physical activities: active (people with PD, n=73; people who are D/HH, n=52) and inactive (people with PD, n=77; people who are D/HH, n=113). The second part of Subjective Quality of Life Analysis (S.QUA.L.A.) between active and inactive members with disabilities was used. The Pearson chi-square test was used to determine the differences in satisfaction with 23 QoLI and 5 QoLD (general health, physical health and level of independence, psychological health and spirituality, social relationships and environment) between the two groups (active and inactive) within each population with disabilities. We found significant differences between active and inactive people with PD only in 3 from 23 QoLI and only in one from 5 QoLD. On the other hand active people who are D/HH presented significant higher satisfaction with 11 QoLI and with 4 QoLD as well as significant higher level of overall QoL (p<.05) comparing inactive individuals with the same disability. This evaluation of the satisfaction with QoLI and QoLD by S.QUA.L.A. shows that it is a suitable tool to asses QoL in the population with different kinds of disabilities. The results of our study confirmed that regular participation in sport increases QoL, especially in people who are D/HH.

In the late adulthood, people tend to feel younger than it is indicated by their real age. It has been shown that subjective age (psychological variable) is a better predictor of psychosocial functioning than an actual age (objective variable). The aim of this study was to address the question of whether a subjective sense of age is more important than chronological age in experiencing oneself in a bodily dimension in people in old age. A group of 194 seniors (including 111 women and 83 men) aged from 57 to 90 years has been examined using Beata Mirucka’s Battery of Tests To Examine Representation of Body Self. The results revealed that the majority of respondents felt on average 12 years younger compared to their chronological age. At the same time, the subjective age, as opposed to chronological age, proved to be a good predictor of the positive experience of the body self at the old age; experiencing oneself as a younger person remained closely related to the positive body image, body schema and body feeling.

The aim of this article is to answer the question whether taxpayers are entitled to any subjective rights that are overtly, unambiguously and legibly laid down in tax law. The author presents the title issue by analysing a broad base of judicature by Poland’s CT, the EUCJ and Poland’s administrative courts, also discussing the relevant literature concerning subjective rights as coded in the provisions of the Polish Constitution and tax law. Taxpayers’ subjective rights may constitute an effective protection measure not only vis-a-vis the administrative discretion of tax authorities, but also in the event of their abuse of administrative power in relations with entities obliged to pay levies.

Research interest in topics such as happiness, the quality of life, and the experience of well-being has dramatically increased in the past four decades. Global measures of Subjective Well-Being (SWB) have long held a prominent position in this burgeoning body of research (Diener, 1984; Pavot, 2008). Despite their widespread acceptance and use, the validity and utility of global measures of SWB have been challenged at several levels of analysis. These critiques have ranged from the conceptual basis of SWB (e.g. Ryan & Deci 2001; Ryff, 1989; Ryff & Singer, 2008) to very specifi c concerns about the context of the assessment situation and the cognitive processes involved in formulating a response to such measures (Pavot & Diener, 1993a; Schimmack & Oishi, 2005; Schwarz, & Strack, 1999). The purpose of this paper is to review and address some of the more prominent critiques of global measures of SWB, and to discuss methodological procedures and strategies for minimizing threats to the validity and increasing the utility of global measures of SWB.

Curiosity is a personality trait that is inversely related to depression and positively related to subjective wellbeing. However, the relationship between curiosity and these two outcomes is still unclear which hampers our general understanding of well-being. Based on research within positive psychology that showed character strengths such as curiosity can indirectly decrease depression, we hypothesized that the inverse relationship between curiosity and depression would be mediated by subjective well-being. Two hundred and fifty seven participants, between 18 and 64 years old (M = 24.50, SD = 8.33) completed a web-based survey comprising: The Curiosity and Exploration Inventory - II, Center for Epidemiological Studies - Depression and the Steen Happiness Index. We found that well-being mediated the relationship between curiosity and depression. The results indicate that curious individuals tend to report higher levels of subjective well-being which, in turn, is associated with lower levels of depression. Our findings contribute to the understanding of positive results obtained from clinical samples that underwent positive psychotherapy of depression.

This study aimed to investigate the subjective health complaints (SHC) in the teaching profession of Hong Kong. On the basis of the SHC inventory, a questionnaire was prepared for data collection through a mail survey. A total of 1 710 usable questionnaires were returned by the primary or secondary school teachers. The results showed that 99.5% (n = 1 702) of respondents suffered at least one type of the 39 single health problems on the total SHC scale during the preceding 30 days. The 10 most frequently reported health complaints among the teachers were tiredness, eyestrain, anxiety, sleep problems, voice disorder, shoulder pain, neck pain, headache, cold/flu, and lower-back pain. With the exception of the category of pseudoneurological complaints, primary school teachers showed a statistically higher prevalence in reporting problems in 6 of 7 subscales. The 5 most severe complaints were tiredness, eyestrain, sleep problems, shoulder pain, and voice disorder.

The present study examined the mediating role of ego depletion sensitivity between temperaments and subjective vitality. The sample of the present research consisted of 210 undergraduate students of the University of Sargodha. Temperament, ego depletion sensitivity, and subjective vitality were operationalized through Approach-Avoidance Temperament Questionnaire (Elliot & Thrash, 2010), Depletion Sensitivity Scale (Salmon et al., 2014), and Subjective Vitality Scale (Ryan & Frederick, 1997), respectively. Correlation analysis depicted that ego depletion sensitivity was positively correlated with avoidance temperament and negatively correlated with subjective vitality. Furthermore, ego depletion sensitivity mediated between avoidance temperament and subjective vitality. Implications of the study along with its limitations and suggestions were discussed.
