    The paper evaluates the crime rate in Poland in spatial and temporal terms. The methods of spatial statistics were employed to identify the clusters of areas with above-average intensity of the selected categories of crimes. Poviats were divided into four groups according to their location in the quadrants of Moran scatter plot. The spatial lag model was used to identify certain spatial relationships between general crime rate and the selected factors recognised in the literature as factors that affect crime. The initial set of potential independent variables was selected arbitrarily. Then Ward's method was used to reduce the number of correlated variables. The following factors were found to significantly explain spatial variation of crime rate in the poviats of Poland: the intensity of crime in the surrounding areas, urbanisation, percentage of single-person households, divorce’s coefficient, gross migration per 1000 population and provided accommodation per 1000 population. The analysis also involved the structure and dynamics of crimes recorded in Poland. It was pointed out that the changes in law, the development of information technology and the increase the level of education significantly affected the number and structure of the crimes recorded in police statistics.

    W artykule analizowano przestrzenne zróżnicowanie, strukturę i dynamikę przestępczości stwierdzonej w Polsce. Stwierdzono utrzymywanie się przestrzennego zróżnicowania natężenia przestępstw stwierdzonych na poziomie województw. Do identyfikacji grup województw podobnych pod względem struktury przestępczości stwierdzonej i dynamiki natężenia przestępstw wykorzystano hierarchiczne metody grupowania danych. W przypadku identyfikacji grup obszarów podobnych pod względem struktury przestępczości stwierdzonej zaproponowano zdefiniowanie odległości (tutaj niepodobieństwa obszarów) z wykorzystaniem wskaźnika podobieństwa struktur.
    The aim of this article was to analyze crime rate in Poland in spatial and temporal terms. There was analysed spatial variation, structure and dynamic of crime rate in Poland. To identify similar areas in terms of structure and dynamic of crime rate there were used hierarchical clustering methods. There was proposed dissimilarity measure between areas based on structure’s similarity coefficient in the case of identify voivodeships characterized by similar structure of recorded crime.

    W artykule przedstawiono przestrzenne zróżnicowanie zagrożenia przestępczością w Polce. Do identyfikacji grup obszarów podobnych pod względem natężenia wybranych kategorii przestępstw wykorzystana została metoda Warda. Zobrazowano, jak zmieniała się struktura i dynamika przestępczości stwierdzonej w Polsce. Zwrócono uwagę na problemy związane z pomiarem zjawiska przestępczości oraz niektóre z czynników mogących wpływać na zmiany struktury i dynamiki przestępczości.
    The aim of the article is to analyze spatial variation, structure and dynamic of crime rate in Poland. There was presented changes in the structure and dynamic of crime rate in Poland. To identify groups of poviats similar in terms of the intensity of selected categories of crimes there was used Ward’s method. Special attention was paid to the problems associated with the measurement of crime.

    Opis:
    The article presents considerations on the victim understood as the passive subject of the crime. According to this conception by the passive subject of a crime is private or legal person or institution is meant whose legal interests were directly violated or threatened by the crime. Therefore the author indicates the place of the victim in the structure of crime as its subjective element. The article also contains the distinctions between the concept of the passive subject of the crime and the concepts of: victim within its meaning in victimology, injured person and subject matter of the executory act. The author shows also at the values and benefits, not only theoretical but also and perhaps even primarily practical, related to the introduction of the concept of the passive subject of the crime to the Polish criminal law.

    Opis:
    Aggressive behaviour of hooligans is not a new phenomenon, but has its roots in ancient times. From that era it developed and evolved, with particular dynamics at the turn of the 1950s/60s of the last century. In Poland this phenomenon and the violence appeared later, in the 1970s. Authors also presented classification of the fans by presenting the attributes and characteristics of particular groups. These often brutal and violent behavior have also been analised in this article –authors have presented the most spectacular tragedies caused by aggression of hooligans. It was showed that modern groups of football hooligans in Poland often have criminal nature, and are an important part of organised (often international) crime, connected with smuggling and drug trafficking.

    W artykule prezentujemy analizę zbiorowości cudzoziemców podejrzanych o popełnienie przestępstwa w Polsce w latach 2013–2016, na podstawie policyjnej statystyki przestępczości. Analizujemy obywatelstwo podejrzanych cudzoziemców, płeć, strukturę ich przestępczości, miejsce popełnienia przestępstwa w podziale na województwa. Odwołujemy się do analizy zbioru danych w policyjnych statystykach przestępczości za lata 2004–2012. Podejrzani cudzoziemcy w Polsce, w latach 2013–2016 to 1% zbiorowości podejrzanych ogółem.
    The article presents an analysis of the foreigners population suspected of commited crimes in Poland in 2013–2016 years, on the basic of police crime statistics. We analyze the citizenship and sex of suspected foreigners, structure the crime they committed but also place where the crime was commited (divided into voivodships). We refer to the analysis in the set of crime police statistics forthe 2004–2012 years. Suspected foreigners in Poland, in 2013–2016 years, was 1% of the total population of suspects.

    Opis:
    W opracowaniu przedstawiono aktualny stan analiz dogmatycznych w odniesieniu do zagadnienia tzw. subiektywnych komponentów: czynu, bezprawności oraz okoliczności wyłączających bezprawność. W pierwszej kolejności przedstawiono rekonstrukcyjne uwagi dotyczące obecnego stanu badań nad problematyką komponentów subiektywnych w strukturze czynu, bezprawności oraz okoliczności wyłączających bezprawność. Na bazie zarysowanej dychotomii prezentowanych w polskiej teorii prawa karnego ujęć – obiektywnego oraz subiektywnego – zarysowano część płaszczyzn, na których dokonywać należy analizy oraz weryfikacji koncepcji odnoszących się do funkcji i znaczenia komponentów subiektywnych w ramach karnoprawnych ujęć: czynu, bezprawności oraz okoliczności wyłączających bezprawność. Odwołując się do płaszczyzny teoretycznej, normatywnej, dogmatycznej oraz strukturalnej, przedstawiono wady i zalety konkurencyjnych koncepcji. W podsumowaniu zamieszczono propozycję zobiektywizowanego ujęcia świadomości, jako jednej z właściwości opisywanego w ustawie zachowania, stanowiącego możliwy kierunek rozwiązania paradoksów łączących się immanentnie z prezentowanymi dotychczas w polskim piśmiennictwie konkurencyjnymi ujęciami analizowanego zagadnienia.
    The paper presents the current state of dogmatic analysis in relation to the issue of the so-called subjective components: act, unlawfulness and circumstances excluding unlawfulness. First of all reconstructive remarks concerning the current state of research on the subject matter of subjective components in the structure of the act, unlawfulness and circumstances excluding unlawfulness were presented. On the basis of the outlined dichotomy of the conceptual and objective perspectives presented in the Polish criminal law theory, some areas have been outlined for analysis and verification of concepts relating to the function and meaning of subjective components within the framework of criminal legal actions, unlawfulness and circumstances excluding unlawfulness. Referring to the theoretical, normative, dogmatic and structural levels, the advantages and disadvantages of competing concepts are presented. The summary contains an offer of objectivized recognition of consciousness as one of the properties described in the Behavior Act, constituting a possible direction of solving the paradoxes immanently combining with the previously presented in the Polish literature competing perspectives of the analyzed issue.
