Opis:
The legal regime of the Turkish Straits is considered in the article. The Montreux Convention Re- garding the Regime of the Straits signed in 1936 established the sovereignty of the Republic of Tur- key over the Straits and a set of rules for navigation through them. This notwithstanding, there is a number of legal uncertainties left unsettled. The uncertainties could hinder free access to the Black and Azov Sea while a lot of frozen armed conflicts and disputed territoriesgather round the Seas. The Straits are of great importance for the Caspian Sea countries and regions since they have access to them through the Volga, Don and Volga-Don Canal. For the last two decades Turkey has introduced many new rules for navigation there because of the abovementioned uncertainties that has essentially modified the legal regime of the Straits. The Tur- kish interpretationsof and additions to the Montreux Convention in the form of new legal acts, re- gulationsand instructions are evidently aimed at the accretion of Turkish national power over the Straits. This trend could raise problems for freedom of navigation as a key principle for international law of the sea. In addition, the Turkish authorities promote the project of ‘Canal Istanbul’as a sea route alternative to the Bosporus.Obviously, the restrictions of the Montreux Convention would not be applicable for a new canal. The second canal alternative to the Dardanelles could completely ruin the conventional legal regime. The rules of U.N. Convention on the Law of the Sea would not be also applicable since Turkey is not a member of the Convention. If the new canals are built, the strictest common law of the sea must be applied for navigation through them. The Montreux Convention has to be modified, taking into account the interests of all regional and extra-regional stakeholders.

Opis:
The aim of the study is to analyze the impact of exemption from pilotage for 75m and 90m long vessels entering Szczecin on navigation safety on the waterway Świnoujście-Szczecin. Available sources concerning the influence of maritime pilotage on the safety of navigation have been analysed. Such data have been collected and made available only for the Danish Straits, the Great Barrier Reef Area of Australia, the Bosporus Straits and the Tokyo Bay. The study also included an analysis of economic effectiveness of pilotage exemption in this area.

Apportionment of authority among states in the space is one of the fundamental function of public international law and aim of that serves state borders institution. State borders are define as a line or surface separating state territories in land, martime and airspace. Opis:
Shared mental models, measured as similar perceptions and understandings of the components of a work task or an operative environment, is a key characteristic for high performing teams. Identifying and addressing differences in mental models may help enhance teamwork, and can serve as a frame for the improvement of human-centered information and communication systems. This paper has been written as part of the SESAME Straits project, a testbed within the e-Navigation framework. It examines similarities and differences in mental models between Deck Officers working aboard ships and Vessel Traffic Service Officers working ashore. Data was compared the participants´ perception of 12 challenging traffic situations in the Straits of Malacca and Singapore. A total of 189 respondents participated by means of an electronic survey. Findings show that Deck and Vessel Traffic Officers do have a large degree of shared mental models, but that there also are significant differences. In particular, there are large ship-shore differences in perceptions of the impact on local ship traffic on safety and efficiency. The second and third situation of large difference was delayed or reduced availability of port services, and challenging weather conditions. Implications are that future development of ship-shore collaborative systems should specifically explore and address the issue of local ship traffic, and to find ways to integrate information about availability and timing of port services and of difficult weather situations.

The paper discusses a scheme for a landing operation in the Kaiser Wilhelm Canal area (German Kaiser-Wilhelm-Kanal, from 1948 the Nord-Ostsee-Kanal, the Kiel Canal in international terminology), whose aim was to capture and destroy the Germanbuilt transportation route that connected the Baltic Sea with the North Sea. The canal bore a strategic importance after the outbreak of World War I, as the German navy had to operate both in the North Sea against its main adversary, the British fleet, and to ensure Germany’s strategic control in the Baltic. The scheme, which has received little attention in literature to date, was developed after the outbreak of World War I, in the autumn of 1914, by Captain 2nd Rank (Commander) Alexander Bubnov, an officer in the Staff of the Commander-in-Chief of the Imperial Russian Army, Grand Duke Nicholas Nikolaevich. The article proposes an analysis of the assumptions of Bubnov’s scheme, the question of who it was inspired by, and discusses the reasons why the scheme was not implemented, also in the context of the cooperation between the Allies (Russia and Great Britain) at the beginning of the war.

The Black Sea and the Black Sea Straits during World War II and immediately after its end had a huge impact on the formation of Turkish-Soviet relations. Already at the beginning of the war, Moscow tried to force Ankara to revise the Montreux Treaty. Soviet pressure depended on the war situation and resurfaced as the Allies began winning the war. In 1945, Turkey, fearing a lack of support in the event of a conflict with the Soviet Union, was ready to make concessions, and in the following year Moscow began to boldly demand a revision of the Montreux Treaty in its notes in such a way that the straits would be decided by the Black Sea states, and the security guards Turkey and the Soviet Union were to become the Bosphorus and the Dardanelles. Ankara could only have been saved by Western support during this period - and in the longer context by the outbreak of the Cold War.
Morze Czarne oraz cieśniny czarnomorskie podczas II wojny światowej i zaraz po jej zakończeniu miały istotny wpływ na kształtowanie się relacji turecko-sowieckich. Już na początku wojny Moskwa starała się wymusić na Ankarze rewizję traktatu z Montreux. Naciski sowieckie uzależnione były od sytuacji wojennej, powróciły, gdy Alianci zaczęli zyskiwać przewagę w konflikcie. W 1945 roku Turcja, obawiając się braku poparcia w przypadku konfliktu ze Związkiem Radzieckim, gotowa była na ustępstwa, w następnym roku Moskwa coraz śmielej zaczęła w swoich notach domagać się rewizji traktatu z Montreux w taki sposób, aby o Cieśninach decydowały państwa czarnomorskie, a na straży bezpieczeństwa Bosforu i Dardanele stały Turcja i Związek Radziecki. Ankarę mogło w tym okresie uratować tylko wsparcie zachodnie – a w dłuższym kontekście wybuch zimnej wojny.
